If I knew then what I know nowCan you believe we are entering the second half of 2015 already? Like any midyear business plan review, our Association is continuing to provide professional services to our membership. I’m encouraged by our achievements and see more positives in the second half of 2015.

For a recap, our 2015 Strategic Plan was approved by NAR and continues VPAR’s mission to provide members with the education and resources that will enable them to conduct business ethically, successfully and professionally.

This is also the first year of implementing NAR’s long anticipated Core Standards model and increasing our community involvement. Collectively, we’ve logged close to one thousand hours of volunteerism and promoted our We are the R campaign through community events. Most notably was participating in the Newport News One City Marathon as participants and water station volunteers.

Our membership currently stands at one thousand and eleven members and is indicative of a strengthening market for the peninsula region. As we continue this growth, our lunch and learn series and night courts have been well attended and resourceful this year.Special thanks to Susan Gaston, VPAR Government Affairs Director for coordinating

not one, but two General Membership Breakfasts that featured the police chiefs of Hampton and Newport News and the forum comprised of the Mayors and Supervisors of our Peninsula localities.

Our Association welcomed NEW affiliates ranging from property management to attorneys, thanks to member involvement and interaction with their firms.

Finally, a contingent of VPAR leadership attended the NAR Legislative Conference and Trade Show in Washington ,DC. If you’ve never been, think of Richmond Day on the Hill on steroids. Great networking and learning experience with fellow REALTORS from across the US.

HOARDING TENANTS & UNIT OWNERS MUST BE PROVIDED REASONABLE ACCOMMODATIONS

Compulsive hoarders present very serious problems for landlords, property managers, and homeowners associations. Hoarding often results in countless adverse and potentially life threatening circumstances for both the hoarder and their neighbors. One might assume, justifiably, that evicting or otherwise ridding themselves of a hoarding tenant or unit owner would be a relatively simple endeavor. After all, in those extreme instances which seem to require such action, the foul conditions of a hoarder’s living quarters often constitute not only a breach of the lease or homeowner agreement but also violate numerous federal, state, and local laws, building codes, and regulations meant to address health and cleanliness concerns.

Despite the existence of thoroughly legitimate health and safety concerns, it is incumbent on landlords, property managers, and homeowners associations to approach a hoarding tenant or unit owner with extreme caution.

Compulsive hoarding qualifies as a disability under the Fair Housing Act (FHA). As a

result, landlords, property managers, and homeowners associations have a duty to provide reasonable accommodations prior to pursuing traditional legal remedies. Courts have not been particularly instructive on reasonable accommodations for compulsive hoarders however, opinions have suggested that providing an owner or tenant with the opportunity to clean up shop within a reasonable amount of time will meet the burden. Another acceptable accommodation might include providing additional storage for a hoarder to store his items. In most cases, the hoarder will be unable to comply with an accommodation because doing so would require actions directly in conflict with their disability.

Other reasonable accommodations may exist and it is wise to consider all requests made by a hoarding tenant or unit owner prior to seeking legal remedies. It is also important to remember that not all requests are reasonable. A requested accommodation is unreasonable if it imposes an undue financial or administrative burden on the landlord, property manager, or homeowners association. While it is often in everyone’s best economic interest to seek a mutual resolution, there is no duty to comply with a request for an unreasonable accommodation.

Determining whether a reasonable accommodation has been offered, whether the accommodation has been complied with, or whether an accommodation requested is unreasonable are all difficult tasks requiring analysis of the law and application of that law to the precise circumstances. Failure to handle these matters appropriately may result in severe consequences under both state and federal laws. Some tactics to consider in preparing to evict

MARK YOUR CALENDARS for June 19th through June 23rd for the Dutch Dialogues! Dutch Dialogues, an integrated approach for sea level rise, redevelopment, flood risk mitigation and water management, is coming to both the Southside and to the Peninsula! The Dialogues will kick off on June 19th with a conversation about the process and setting the stage for the weekend long event. The public is invited to observe the opening meeting on Friday, June 19th, from 9am-Noon and the Wrap-Up and Recommendations on Tuesday, June 23rd, 9am-Noon. Both events will be held in Norfolk’s new Slover Memorial Library, 235 East Plume Street, Rm 605, Norfolk, VA 23510.

The Dutch Dialogues are collaborative efforts of Dutch technical experts, the Netherlands Embassy in Washington, D.C., local and state governments and other stakeholders. The first Dutch Dialogues were held in New Orleans, and similar workshops have been held in New York, Bridgeport, St. Louis, Tampa Bay, and Los Angeles. The goal of this effort is to improve the region’s approach to water management through learning about the Dutch perspective on “living with water.”

This five-day workshop will focus on the Peninsula areas of the Newmarket Creek watershed that runs from the Back River in Hampton across the Peninsula through Newport News to the James River. On the Southside, the focus will be the Tidewater Drive district area in Norfolk, including St. Paul’s Quadrant, Harbor Park, South of Brambleton and Chesterfield

City of Hampton

On May 13th, the City Council unanimously approved changes to the sign provisions of the Zoning Ordinance that will allow for building owners in the Hampton Roads Center Parkway development to post the names of current tenants on their exterior in-ground signs. This change benefits VPAR directly and permits the Association’s various tenants to be listed. In doing so, greater exposure is given to these companies and incents them to stay within the development. VPAR expresses its appreciation to the staff, the Economic Development Authority, the Planning Commission and the City Council for their guidance and support!

ALERT: Wire Fraudsters Targeting Real Estate TransactionsBy Jessica Edgerton, NAR associate counsel

In recent months, real estate professionals have reported an upswing in a particularly insidious wire scam. A hacker will break into a licensee’s e-mail account to obtain information about upcoming real estate transactions. After monitoring the

account to determine the likely timing of a close, the hacker will send an e-mail to the buyer, posing either as the title company representative or as the licensee. The fraudulent e-mail will contain new wiring instructions or routing information, and will request that the buyer send transaction-related funds accordingly. Unfortunately, some buyers have fallen for this scheme, and have lost money. A possible red flag to be aware of, and to alert clients to, is any reference to a “SWIFT wire” transaction, a term that indicates an overseas destination for the funds. However, unlike many other e-mail-based “phishing” schemes, this particular manifestation appears to be more sophisticated and less recognizable as fraud. The communications do not contain the typical grammatical or stylistic oddities that are often present in scam e-mails. In addition, because the perpetrator has been monitoring the licensee’s e-mail account, the fraudulent communication may include detailed and accurate information pertaining to the real estate transaction, including existing wire and banking information, file numbers, and key dates, names, and addresses. Finally, the e-mails may come from what appears to be a legitimate

e-mail address, either because the thief has successfully created a sham account containing a legitimate business’s name, or because he or she is sending the e-mail from a truly legitimate—albeit hacked––account. Be aware, also, that this particular scheme is only one of many forms of online fraud being perpetrated against real estate licensees and their clients. In protecting all parties to a real estate transaction from cybercrime, real estate professionals should consider the following guidance:

1. Prevention.The best line of defense against fraudsters is to make sure that all parties involved in a real estate transaction implement security measures before a cyberattack occurs. These measures include the following: Never send wire transfer information via e-mail. For that matter, never send any sensitive information via e-mail, including banking information, routing numbers, PINS, or any other financial information. Inform clients from day one about your email and communication practices, and alert them to the possibility of fraudulent activity. Explain that you will never send, or request that they send, sensitive information via email. Prior to wiring any funds, the wirer should contact the intended recipient via a verified telephone number and confirm that the wiring information is accurate. Do not rely on telephone numbers or website addresses provided within an unverified e-mail, as fraudsters often provide their own contact information and set up convincing fake websites in furtherance of their schemes. If a situation arises in which you have no choice but to send information about a

Since 2011, when Republicans won a majority in the U.S. House, regulatory reform has been a key plank of the legislative agenda. The broad goals have been to increase transparency and accountability in the rulemaking process.

Here are several regulatory reform bills that are currently moving through Congress:

SCRUB Act: Summary: Bill would establish a “Retrospective Regulatory Review Commission” designed to reduce the costs of past regulation. The Commission would generate a pool of regulations for agencies to rescind. If an agency chooses to implement a new rule, it must first cut a rule from the Commission’s pool of regulations. Bottom Line: SCRUB would create a Blue Ribbon Commission that would not only review past outdated or duplicative rules, but also ensure that new rules have a plan for future review. Status: reported out of the House Judiciary Committee on a 17-12 vote.

Regulatory Accountability Act (RAA): Summary: Creates category of “high-impact” rule, or a measure that would impose annual costs on the economy of $1 billion or more; requires an advanced notice of proposed rulemaking for a high-impact rule and requires agencies to adopt rules on the basis of the best evidence and the least cost to the economy. Raises the level of judicial scrutiny from “arbitrary and capricious” to “substantial evidence.” Bottom Line: The RAA would fundamentally transform how agencies implement major rules and give the public more time to scrutinize expensive regulations. Status: passed the House by a 250-175 vote and received in the Senate Homeland Security and

Government Affairs Committee.

REINS Act: Summary: The REINS Act requires Congress to approve all major rules before they can take effect. If Congress does not approve of a rule in 70 session or legislative days, it will not take effect. Bottom Line: REINS (Regulations from the Executive in Need of Scrutiny) Act is essentially the inverse of the Congressional Review Act. Instead of resolutions of disapproval once a rule is final, REINS authorizes Congress to approve of every major rule through resolutions of approval. Status: reported out of the House Judiciary Committee on a 15-10 vote.

RAPID Act: Summary: The legislation is designed to ease the process for federally-funded and federally permitted construction projects. It allows lead agencies conducting reviews more power to conclude lengthy inter-agency reviews and requires that lawsuits challenging projects to be filed not less than 180 days from the agency’s decision. Bottom Line: the goal of the legislation is to streamline the federal permitting process for construction and infrastructure projects. Status: reported out of the Judiciary Committee on a 15-11 vote.

ALERT Act. Summary: The ALERT Act would require each federal agency to submit a monthly report to the Office of Information and Regulatory Affairs (OIRA) on pending regulations for the following year. It requires OIRA to publish an annual report on the number of rules and the total costs of all proposed or final rules; and it prohibits a rule from taking effect unless posted on the Internet for at least six months, subject to a few exceptions. Bottom Line: This bill is designed to heighten

transparency of the regulatory state. Status: reported out of the House Judiciary Committee on a 14-9 vote.

Even with evidence of this sort, compliance with state and federal requirements can be difficult to achieve and even more difficult to prove in court. Not only does failure to prove compliance with legal requirements prevent a court from removing the hoarder from the property, such failure also subjects the moving party to monetary and civil penalties. One can avoid these risks and uncertainties by seeking legal advice as soon as a hoarding tenant or unit owner has been discovered.

Clean out your e-mail account on a regular basis. Your e-mails may establish patterns in your business practice over time that hackers can use against you. In addition, a longstanding backlog of e-mails may contain sensitive information from months or years past. You can always save important e-mails in a secure location on your internal system or hard drive. Change your usernames and passwords on a regular basis, and make sure your employees and licensees do the same. Never use usernames or passwords that are easy to guess. Never, ever use the password “password.” Make sure to implement the most up-to-date firewall and anti-virus technologies in your business.2. Damage Control.If you believe your e-mail or any other account has been hacked, you should take the following steps: Immediately change all usernames and passwords associated with any account that you believe may have been compromised or otherwise made vulnerable by the attack.

Immediately notify any clients or other parties who may have been exposed during the attack so that they take appropriate action. Remind them not to comply with any requests from an unverified source. Report any fraudulent activity to the Federal Bureau of Investigations via their Internet Crime Complaint Center. Defeated a 500% Increase We helped to defeat a budget amendment that would have increased the deductible that property owners, including

YOUR clients, pay to have their leaking underground oil tanks cleaned up and repaired by 500%. The current $500 deductible was proposed to go up to $2,500.

The petroleum tank increase was a budget amendment.

Prison time: 1 to 6 years We added a felony charge to any criminal who lures or entices a REALTOR® to a property with the intent to do harm.

The added felony will increase a criminal’s sentence by up to 6 years. The 1-6 years are the statutory sentencing guidelines.

Save $150 - $500/hr. on attorneys’ fees We continued to refine legislation that allows property managers to represent your clients in General District court

without needing an attorney. So, how much would your attorney charge per hour? Typically, attorney fees range from $150 - $500/hr.

$12,000 back to consumers Under a new law that VAR drafted, we have made it easier for Virginia consumers who have received a court judgment to

collect damages from the Real Estate Transaction Recovery Fund. The average claim is approximately $12,000. The $12,000 figure is an estimate by the DPOR finance staff on the average claim that comes before the Board.

Wiped out $200/per Sign Fines We worked with a state legislator to prevent a proposal creating daily fines of $200 for any sign in any public right of

way. How often do you use such signs for your listings? 10 days for 1 sign = $2,000 The $200 per sign was the language in the proposed bill VAR was able to stop.

2015 Midyear Legislative Meetings Wrap Up

The National Board of Directors meeting closed out the 2015 REALTORS® Legislative Meetings & Trade Expo in Washington, DC attended by 8,000 REALTORS® and guests. The weeklong meetings included hundreds of visits by REALTORS® to their members of Congress to advocate on behalf of the real estate industry.

Virginia Peninsula was represented well by your leadership team Dewey Hutchins, 2015 President; Andy Cohen 2015 President Elect, Chandra Patterson Treasurer and Federal Political Coordinator, Peggy Todd 2015 Director along with myself and a strong group of leadership from the Virginia Association of REALTORS® and our other local associations.

Our Advocacy outreach focused on REALTOR Housing Finance Issues including the upcoming changes on August 1st with the TILA/RESPA consumer disclosure changes, Support of FHA, and the importance Housing Finance Reform. We spoke of REALTOR Tax Issues to Preserve Existing Housing Tax Incentives, Like Kind Exchanges and Extension of the Tax Relief for Mortgage Debt Forgiveness. REALTOR Business Issues including Patent Reform to control patent trolls, data security and support of the “Data Security and Breach Notification Act” and the Mortgage Choice Act and reduce restrictions imposed by the QM rule. And REALTOR Commercial Issues and

the preservation of Like Kind Exchange tax deferment program and Leasehold Improvement provisions allowing the cost of leasehold improvements to be recovered over 15 years rather than reverting back to a 39 year period.

Your message was loud and clear as legislators and their offices opened their doors to meet and discuss each issue with us! Congratulations to Chandra Patterson our FPC and The Virginia Association for coordinating our efforts here in Virginia with great success.

The Board Meetings were abuzz too with changes to approve programs and initiatives to provide new tools and services for members. This includes an investment to develop a Nationwide Broker Data Entry System. The system will give brokerages a single place to input their listing data for distribution on multiple platforms online, including Realtor.com, local MLSs, and broker websites. It has amazing potential for our members to assist them regain control of their data and where it will go. The data entry system is explained in a video on REALTOR.org. Access that now.

In other actions, the Board adopted the REALTORS® Commitment to Excellence under which NAR members strive for excellence in a number of competencies, including the NAR Code of Ethics, the laws and regulations affecting real estate, and one’s advocacy efforts on behalf of strong real estate markets and healthy communities.
