ANNUAL NOTICE

PROTECT YOUR CHILD FROM LEAD POISONING AND WINDOW FALLS

New York City law requires that tenants living in buildings with 3 or more apartments complete this form and return it to their landlord before February 15, each year. If you do not return this form, your landlord is required to visit your apartment to determine if children live in your apartment.

Peeling Lead Paint

By law, your landlord is required to inspect your apartment for peeling paint and other lead paint hazards at least once a year if a child under 6 years of age (5 years or younger) lives with you.

You must notify your landlord in writing if a child under 6 comes to live with you during the year.

If a child under 6 lives with you, your landlord must inspect your apartment and provide you with the results of these paint inspections.

Your landlord must use safe work practices to repair all peeling

paint and other lead paint hazards.

Always report peeling paint to your landlord. Call 311 if your landlord does not respond.

Window Guards

By law, your landlord is required to install window guards in all your windows if a child under 11 years of age (10 years or younger) lives with you, OR if you request them (even if no children live with you).

It is against the law for you to interfere with installation, or remove window guards where they are required. Air conditioners in windows must be permanently installed.

Window guards must be installed so there is no space greater than 4½ inches above or below the guard, on the side of the guard, or between the bars.

ONLY windows that open to fire escapes, and one window in

each first floor apartment when there is a fire escape on the outside of the building, are legally exempt from this requirement.

These requirements apply to buildings with 3 or more apartments built before 1960. They also apply to buildings built between 1960 and 1978 if the landlord knows that lead paint is present.

These requirements apply to all buildings with 3 or more apartments, regardless of when they were built.

II. Throughout the nearly three decades of its existence, Baybridge has been

Resident Services

Maintenance Department Our Maintenance Dept. is responsible for the physical upkeep of all common areas. This includes hallway maintenance (including vacuuming and light bulb replacement) snow removal as well the placement of trash receptacles curbside for sanitation pickup and their replacement in the cubicles afterward.

Please Note: Maintenance employees are strictly forbidden from doing private jobs for residents during their regular working hours.

Private Sanitation Our community is serviced by a private carting company. Pickups are Monday, Wednesday and Friday. Recycling is addressed later on in the Handbook. Parking along the side of Jordan Court during garbage pickup is not allowed. A ticket will be issued for non-compliance with this provision.

Cable Television Baybridge is serviced by Time Warner Cable (TWC) (718-358-0900). Any resident wishing this service should call TWC directly. Condo II has signed up with TWC for bulk billing. This enables residents to get a discount for Basic Service. Make sure you mention this to TWC. In addition, TWC offers Road Runner high speed Internet service. Anyone interested in subscribing to either Dish Network or Direct TV should send their request to the Board of Managers for consideration.

Smoke, Carbon Monoxide & Basement Flood Alarm Systems All Condo II buildings have been provided with these systems.

Rover Patrol A roving patrol is provided from 2:00 pm to 6:00 am 5 days a week and 24 hours on Saturday and Sunday.

Gate House The security company operates the gate house at the front entrance. This facility is staffed by 1 attendant 24 hours a day. For the convenience of residents, the front gate exit arm is left in the open position from 6:00 am to 9:00 am during the weekday morning rush hour.

Resident Gate Cards & Remotes Gate cards (one per vehicle) are issued to all Condo 2 residents. Remote control devices are available to residents for $50 (price subject to change) each and the surrender of a gate card. Remote control devices are guaranteed for only 1 year from the date of purchase. Please see “Resident Responsibilities for additional information regarding resident responsibilities.

Announced Visitor Program Each visitor is announced before entry unless other arrangements are made. Visitors receive a pass upon entry which must be displayed inside the front windshield and returned to Security in order to exit the complex. See the “Resident Responsibilities” section for more information.

Vehicle ID Stickers Upon presentation of a car registration, the Management Office will issue to a resident an ID Sticker to denote residency at Baybridge. If you buy/lease another vehicle you must come to the Mgmt Office with the car registration to get a new sticker. For any extended time (3 Days+) with a rental car, you must obtain an Extended Visitor Pass for the duration from the Management Office.

Resident Responsibilities

Landscaping Please take pride in your community. Do not permit your children to play between shrubs or pick flowers. The landscaping is delicate and cannot withstand trampling, abuse by dog owners or other heavy use. Residents are allowed to place flowers and plants on their patios or balconies if done appropriately and in good taste.

Pets Renters in Condo II cannot house pets within their units. We ask that all owners of our four legged companions to cooperate with these Pet Policies:

All pets must be curbed in accordance with NYC law and off Baybridge properties.

Dogs must be leashed at all times

Dog dropping must be picked up promptly and disposed of by owner. Please refrain from placing this refuse in your neighbors’ garbage cans.

Destruction to the grassy and shrubbed areas by animal waste will not be tolerated and fines will be imposed.

Do not walk your pet on the grass. Urine destroys grass.

Schedule of fines: First Offense: Warning Letter.; Second Offense: $50; Third Offense: $100.

Deliveries Deliveries will be allowed:

Monday thru Friday: 8:00 am to 8:00 pm Saturday & Sunday: 10:00am to 5:00 pm

Entry is allowed for regular visits by USPS, UPS, Fed Ex, Baybridge private sanitation, Newspaper delivery, Baybridge Pizza, Szechuan Chinese, Fresh Direct and Peapod food deliveries and other public safety and utility vehicles. Flowers will be directed to the clubhouse front desk when residents are not home. The Gate House cannot accept any personal packages or envelopes for any residents.

Outside Contractors The Board of Managers has limited the time that outside contractors may do work in your home to the following:

Weekdays: 8:00 am to 7:00 pm Saturdays: 9:00 am to 6:00 pm Sundays: Only in the case of an emergency

Please Note: Outside Contractors must remove their own debris.

Basements Each unit is assigned one designated section to store their personal belongings. At no time is a unit owner/renter to encroach upon another designated space or the common area space. It is illegal to install any type of non-movable storage closet in the assigned common storage area. You may not change the lock on the basement door. The Maintenance Dept. and the Management Office must have access to the basement at all times. Homeowners of a building will be held liable for damages caused by the inability of the staff to gain access to the basement. Please note: The laundry compartment in the basement is for the use of the 1st floor resident only.

Carpeting Simplex units are multiple dwellings and are subject to New York City rules & regulations. A multiple dwelling unit must have carpeting covering 80% of the apartment, excluding the kitchen. This will eliminate some of the noise and enable your neighbor to live more comfortably.

Common Hallways The common hallways are not storage areas. You cannot store bicycles, carriages, shoes, etc on the basement steps, boiler room, or hallway. If so, they will be removed by our maintenance staff and held in the maintenance room after a warning is issued. You will be charged a storage fee until you pick them up. Plants and paintings may be placed in the hallway with the approval of all residents in that Townhouse, provided that the plants and paintings do not interfere with the duties of our maintenance staff and do not detract from the common good of the other residents in the townhouse.

If the New York City Fire Department makes a surprise inspection and finds your property in violation, you will be fined directly by the Fire Department.

Since Condo 2 notified all residents on this issue, the Condo will not be responsible for any violations. Please note: The ladder leading to the roof hatch must be free and clear.

Common Front Doors No resident is permitted to change the front door lock. The Management Office and the Maintenance Staff must have access at all times. If your lock is defective, please contact the office to have it repaired. Condo II uses security keys which cannot be duplicated. For additional keys contact the Management Office. A fee will be charged. Please note: Both the front and basement doors must be kept closed at all times. Failure to do so is a serious breach of security for your home as well as your neighbors.

Con Edison Meters & Telephone Lines The third floor resident is responsible for providing access to the Con Edison meter reader in order to read the gas meters in the garage. Telephone lines are also in the garage. Therefore any resident that needs access to these lines must contact the third floor resident directly. Please note: For those 3rd floor residents who regularly cannot be home for the meter reader, please plan on filling out the blue & white Con Ed card and report results to Con Ed or provide the key or code to a trusted neighbor on site.

Drains Do not dispose of any cooking oil or oil-based substances down any sinks or plumbing fixtures, as it solidifies in the pipe and could cause a back up and damage. If a drain becomes clogged, do not use Drain-O. Call the Management Office for assistance. Serious blockage may require the homeowner/resident to get a professional service at the homeowner’s expense.

Fluid & Oil Stains Oil and fluid stains from leaking vehicles, cause damage and discoloration to driveways and walk areas. If you notice that your vehicle has a leak, have it repaired immediately. The Maintenance Staff is instructed to check for this condition regularly. The cost of clean-up and/or repair will be borne by the owner of the offending vehicle or owner of the unit of which the offender is a tenant or a guest.

Heating System NEVER shut down a heating system during the winter months whether or not the unit is occupied. If it is temporarily unoccupied, you should leave the thermostat at 55 degrees. Shutting down the unit will cause the water lines to freeze, resulting in extensive damage. In addition, electricity must also be kept on. If you rent out your unit, please make sure that your tenant, when moving out, does not order Con Edison to discontinue service. All repairs and upkeep on heating units and boilers are the owner’s responsibility.

Air Conditioning Units It is suggested that you install air conditioning covers on the in-wall units for added comfort during the winter months. You cannot change the sleeve of any air conditioning unit. They all must conform to the Baybridge standards.

Hose Bibs Hose bibs will be turned off prior to the winter by our Maintenance Staff in order to prevent freeze-ups. If yours is still on after November 15th, please notify the Management Office to arrange for it to be closed. The bibs are turned on again after April 1st. Triplex residents must contact the office to set up an appointment.

Water Spigots Spigots in the corner unit garages will be turned off and on at the same time as the Hose Bibs. Residents in these units must contact the Management Office to set up an appointment for the maintenance access.

Water Leaks/Stains If you notice any wet spots or leaks to ceilings or in the basement common area, notify the Management Office immediately.

Roofs No one has permission to use the roofs for any purpose. The roof hatch must be closed at all times but must not be locked on orders of the New York City Fire Department. Should you suspect a roof problem, contact the Management Office and request an inspection by the Maintenance Staff.

Recycling and Private Sanitation Our community is serviced by a private carting company. All large throw-away items such as boilers, carpeting (which must be tied), appliance cartons, etc. should be put out the night before a regular pickup day or early morning the day of pickup. Please note: To maintain clean and rodent-free infestation of refuse areas, all owners and tenants must dispose of their refuse in securely tied plastic bags. All residents must individually comply with NY City recycling programs Recycling Schedules are as follows: Mondays –

Regular garbage Paper items (please do not put paper items in plastic bags or mix in with regular garbage) Corrugated cardboard – Must be flattened

Wednesdays – Regular garbage Recyclables (rinsed bottles, plastics, cans) to be placed in the “Recyclable” can in closet. Do not put light bulbs in the recyclables).

Do not use the Recyclable can in the meter closet for regular garbage!

Commercial Business Conducting a business is not permitted. Homes in Baybridge are for residential use only. No storage of commercial goods is permitted in the basements or garages. Please note: We understand that some residents work from their home office which is permitted. What is not permitted are goods & services being exchanged on site or conducting business by having clients coming on site.

Alterations/Modifications No alterations or modifications to the common areas, including painting of the exterior, may be undertaken without the express written approval of the Board of Managers. All requests must be sent to the Management Office. Any interior work done in your unit must be in compliance with all New York City building codes. You must notify the Board of Managers, in writing, of any alterations/modifications done in your home that changes the Certificate of

Occupancy. All contractors must have insurance certificates for the type of work to be performed.

Windows Any repair or replacement of window panes, which include skylights, is the responsibility of the owner. If you replace a window, it must conform to Baybridge standards. If you have any questions in this regard, please contact the Management Office.

Window Guards Under the windows guard law, owners must properly install approved window guards on each window in an apartment occupied by a child 10 years old or younger, with the exception of windows that provide access to fire escapes or windows on the first floor that are a required means of egress from the unit. The Maintenance Staff will install these window guards free of charge; however the cost of the guards is the owner’s responsibility. Please Note: Window Guard forms are mailed to each resident every year between January 1st and January 20th. New York City law requires your completion and submission of this form.

Car and House Alarms Alarms are a necessary part of life. They can, however, become a serious nuisance when set off accidently or through malfunctioning. If you hear an alarm sounding for an unreasonable length of time during the hours of 2:00 pm to 6:00 am, call Security and ask that the Rover Patrol investigate this matter. If you plan to be away on vacation, make arrangements with someone who can deactivate your alarm in your absence. Please note: An emergency number should be on file with the Management Office.

Horn Blowing Unnecessary noise or excessive horn blowing at any time is frowned upon. Please consider and respect your neighbors.

Snow Storms Our Maintenance Department is responsible for snow removal over 2”. They will do their utmost to make sure our roads and sidewalks are passable and ice-free. When more than 4” of snow falls, an outside contractor is called in to assist. Please do not ask the Maintenance Staff to assist in shoveling out or starting your

vehicle during these emergency periods. Please make sure your vehicle is not blocking the sidewalks so that they can be cleaned.

“Snow Emergency” - Effect on Parking Spaces During snowstorms, residents must not park their vehicles in any visitor’s space that is marked “Snow Emergency”. Because of the limited space in the Baybridge complex, these spots are needed to pile the snow that is removed. Vehicles in violation of this rule will be towed away.

Tow Trucks Tow trucks must enter via the Willets Point Blvd. entrance (main gate). Notify Security at the front gate prior to the arrival of the tow truck.

Barbecue Grills Adhering to very strict FDNY regulations, our community prohibits the use of Gas/Propane/Charcoal grills within 10 feet of any part of the building. This is a Zero tolerance policy. Only Electric grills are permitted on the second floor balcony. There are no exceptions to this policy.

Ball Playing The Board wishes to create a community that allows for our residents to play ball or sports only in the designated areas. With limited space available and with a strong concern over safety, we ask that all residents refrain from playing in the common areas of the community. This includes activities such as skate boarding, touch football and street hockey.

Electric Heaters The electric heaters in every hallway are common property. They do not belong to any resident. Their purpose is to warm the hallways, not individual homes. These heaters use a lot of electricity. They are set to a specific temperature. Residents are NOT to change the settings. Please contact the Management Office to have an adjustment made to the thermostat.

Patios and Balconies Even though the patios are to be used solely by the first floor residents and the balconies solely by the second floor residents, residents cannot store any items that would deface the look of the unit. Please note: hanging clothes on a clothes

line or placing tall storage units are prohibited. If the item is higher than the balcony railing then it is not authorized and must be removed.

Insurance It is strongly recommended that residents purchase Condominium property insurance. Condo II carries insurance for structure and the common areas. This insurance does not cover the resident’s units. For example, if you have remodeled and upgraded your apartment, and disaster strikes, the Condo 2 insurance policy will only pay to restore the unit back to its original state (kitchen cabinets, carpeting, appliances, etc.). You are responsible for the value difference. Be sure your insurance policy covers the current or replacement value of your apartment’s contents.

Fireworks Fireworks are strictly prohibited from use on any Baybridge property.

Gate Cards Gate Cards are issued one to a vehicle to all Condo II residents. All gate cards must be surrendered when a resident moves out of Baybridge. If your card is lost or stolen, call the Management Office and they will be deprogrammed from the system. A fee will be charged for a replacement.

Gate Cards and Remote Control Devices All resident vehicles must enter and leave the premises through the use of an electronic gate card or remote control device. Once a card or remote control device raises the front gate arm for a person in front of you, you must wait until it comes down before you insert your card or click the remote control device. Gate cards and remote control devices are to be used only by those residents to whom they have been issued and only with the use of vehicles that have a Condo II ID sticker. All others must use the visitor lane and stop at the front gatehouse for a pass. All gate cards must be surrendered when a resident moves out of Baybridge. If your card is lost or stolen, call the Management Office and the card will be deprogrammed from the system. A fee will be charged for a replacement. Please note the following regarding remote control devices:

The remote belongs to the resident that purchased it and is not refundable

Remotes may be transferred to another owner or a renter; however you must notify the Management Office (failure to do so could result in the remote being deprogrammed from the system)

See the “Resident Services” section above for information regarding the issuance of gate cards and remote control devices. Remote controlled units are available to residents at $50 each and the surrender of a gate cards. Please note:

Remotes belong to the residents and are not refundable.

Remotes are guaranteed for only 1 year from the date of purchase.

Remotes may be transferred to another owner or a renter; however you must notify the Mgmt Office otherwise they will be deprogrammed from the system.

Vehicle ID Stickers All residents must have a Condo 2 ID Sticker placed on the interior left side of the rear window of their vehicle. Call the Management Office for details. For any extended time (i.e., 3 or more days) with a rental car, you must obtain an extended visitor pass for the duration from the Management Office. See the “Resident Services” section above for information regarding the issuance of vehicle ID stickers.

Visitor Program –

When your visitor arrives at Baybridge, he/she must advise the security guard at the front gate of the resident’s name and address. If there are other people with different names living at the address, this information should be on file with the office and given to the Security Guard.

The security guard at the front gate will call for your approval. If no one is home, then the visitor will be turned away.

The Visitor must return the visitor’s pass to the security guard at the front gate in order to exit.

Unannounced Visitor Program It is mandatory that all vehicles in Baybridge be identified with an I.D. sticker or a visitor’s pass. There may be visitors on your unannounced list whether

family or friends, to whom you have given a gate card or clicker and may

not be identifiable. Residents must obtain a special visitor’s pass for these cars from the Management Office that contains the unit owner’s identifying information. Any vehicle without a special visitor’s pass that requires one runs the risk of being towed. This will alleviate any discrepancies of unwanted guests who no longer have permission from a Resident to gain entry.

The 5 Day Parking Rule Every evening the roving officer logs in the license plate number of each vehicle parked in a visitor’s space. On the sixth night of consecutive parking, a parking citation is issued. If you have been using the spot for a few days and you leave it, DO NOT return to that spot. The roving officer will have no way of knowing that you were not in the space continuously and you will be ticketed. The Board of Managers has defined a vehicle as any vehicle registered at the same residence. Thus Homeowners are not permitted to “flip-flop” vehicles to monopolize a space.

Someone parked in your space? If someone is parked in your space, call the gatehouse @ 718-352-8191 and ask the roving officer to respond and evict the trespasser. Stopping in Front of Your Home for a Few Minutes? Vehicles parked perpendicular to the driveway are allowed up to 10 minutes for a pick-up or drop-off.

Sales Procedures Before an owner can sell his/her Townhouse, they must receive from the Board of Managers its exercise or non-exercise of its “right of first refusal”. The Board of Managers requires the following:

Copy of the fully executed Contract of Sale.

Completed “sales packet” obtained from the Management Office. o There is a list of refundable and non-refundable fees that are detailed

in the sales packet. Please be sure to read and understand these fees.

If the Board waives its right of first refusal a letter of approval will be sent to the seller. The letter will also state the requirements for the buyer at closing.

Important Notice: Absolutely no move-in or move-outs allowed on weekends or major holidays. Movers must arrive at Baybridge between 8:00 am and 4:00 pm Monday through Friday. No moving trucks will be permitted to enter after 4:00 pm. Movers must leave the property by 8:00 pm. In addition, moving trucks cannot park on the driveways or the brickways. They must park on the street. Violation of this rule will result in the unit owner being fined.

No Open Houses, tag sales or garage sales are permitted.

Rental Procedure Before an owner can rent out a unit they must receive from the Board of Managers its exercise or non-exercise of its “right of first refusal”. The Board of Managers requires the following:

Copy of the fully executed lease. A “No Pet” clause must be in the lease. All leases are to be more than 2 years with a 1 year renewal.

Completed “lease packet” obtained from the Management Office. o There is a list of fees that are detailed in the lease packet. Please be

sure to read and understand these fees

Certified or bank check for all arrears owed for Baybridge Condo 2common charges and HOA charges.

Note: Move in/move out rules also apply to Leasing.

Lease Renewals A rental applicants that is renewing a lease must forward to the Management Office a copy of the renewal agreement along with a check for the renewal fee of $200 (which is subject to change).

Solicitations and Distributions of Flyers No solicitations of any kind are permitted in Baybridge. If you see anyone going door to door, soliciting or distributing flyers, call the front gate (718-352-8191). Note that certain discount flyer packages by local merchants are occasionally brought to the HOA Clubhouse and made available to residents there.

New Carpet Installation If you replace the carpeting in your home, arrange with the installer to bag all of the small scraps and roll and tie the large pieces together in approximate 3foot lengths. Call the Management Office to find out when the carpeting can be put out for pick up.

Repair/Replacement of Sliding Glass/Screen Doors and Broken Windows The repair and replacement are the resident and/or owner’s responsibility. The replacement or new item must match existing Baybridge features and requirements.

Interaction with Security & Maintenance Personnel We strongly urge all of our residents and homeowners to respect the work of our Security and Maintenance Staff. Uncivil behavior toward them is unacceptable. If you have an issue or problem with a member of either staff, report it immediately to the Site Manager who will in turn inform the members of the Board. Do not take matters into your own hands. Let those directly responsible take the appropriate action. The Board of Managers reserves the right after a Hearing to assess a fine to anyone failing to follow the outlined procedure.
