    Investigation into the bombing incident which occurred at the University of Miami on April 3, 1976.

    SYNOPSIS: ./

    Arrest of MANUEL ORTEGA for the above incident and his subsequent statement which culmin)lted in .the issua.n~ of arrest warrants for GUSTAVO CASTILLOv&nd ORESTES RUIZ. f.//

    DETAILS:

    On Friday, January 28, 1977, this writer and Det. D. Benitez, after consultation with ASA G. Yoss, obtained the issuance of capias 77-727 for the arrest of MANUEL ORTEGA for the charge of conspiracy to commit a felony for his involvement in the above offense. After conversations with Ortega, these officers negotiated an agreement that would include the recommendation by these officers that in exchange for a guilty plea from ORTEGA on the above charge and his testimony against GUSTAVO CASTILLO, ORTEGA be sentenced to concurrent time for the conviction for which he is presently incarcerated.

    At approximately 1:00 p.m. ORTEGA appeared in front of Judge Rivkind and at that time he pleaded guilty and these officers and AUSA J. Sandford recommended that ORTEGA be sentenced to concurrent time in exchange for his guilty plea and with the stipulation that ORTEGA give testimony against GUSTAVO CASTILLO on the University of Miami bombing. The recommendation made by these officers met with the approval of Judge Rivkind and ASA G. Yoss.

    Public Defender Fleming represented ORTEGA during the proceedings.

    Subsequent to the above appearance in Judge Rivkind's chambers and based upon ORTEGA'S statements, two arrest warrants were obtained for GUSTAVO CASTILLO and ORESTES RUIZ for the aforementioned bombing incident.

    Case closed by arrest.

    NARRATIVE:

    On Saturday, 26 March 1977, this detective along with Sgt. P. Janosky

    responded to the Dade County Jail North Dade facility at approximately

    12:00' noon and picked up MANUEL ORTEGA for the purpose of obtaining clothing

    for·the trial on Monday, 28 March 1977. ORTEGA was returned by 4:00 p.m.

    Expenses incurred for the purchases were as follows:

    Cigarettes and clothing: $58.94.

    On Monday, 28 March 1977, at 7:30 a.m. this detective along with Det. E.

    Mederos picked up MANUEL ORTEGA at 7:30 a.m. and transported him to PSD

    Sta. 2, OCB, where he was out of acc,ess to the defendant and his associates

    until he would be needed for court testimony. ORTEGA testified during the

    afternoon of the 28th and was again returned to the Dade CoUnty Jail.

    ORTEGA identified a battery, lantern type, which was purchased by this

    writer and was later used as the bomb mockup during trial.

    Expenses totaled $13.96 for ,3 meals, cigarettes and battery.

    , ' On Tuesday, 29 March 1977" this detective along with Det. Mederos signed

    out ORTEGA from the Dade County Jail and as per instructions of ASA Yoss he

    was taken to court to stand by if needed for trial.

    Expenses: Cigarettes, papers and two meals - $10.00.

    The above expenses were incurred for meal,s and other expenses as listed due

    to the fact that ORTEGA was not able to be fed by routine feeding times

    at the Dade County Jail due to his court testimony and security precautions.

    Case remains closed by arrest.

    This detective had requested fro the State Fire Marshal's Office that the

    names of . QRESTES RUIZ HERNANDEZ, MANUEL ORTEG~nd GA I SCOBED e checked against their office files to determine if they are holders o·f blaster's permit or a user, manufacturer, distributor or dealer in explosive license as set forth in State Statute 552. The attached copies are certificates issued by the State Fire Marshal's Office which are evidence as to the lack of licenses or' permits for the above named persons.

    On 28 March 19·77 the attached papers were received by this writer along with a letter from A. C. Anderson, Deputy State Fire Marshal. The information was supplied to ASA Yoss and used as evidence in the CASTILLO trial •

    Continuing investigation into the University of Miamiv{Ombing which occurred on 3 April 1976 in Dade County, Florida.

    SYNOPSIS:

    Deposition of MANUEL ORTEGA.~ DETAILS:

    On 22 March 1977 this detective was notified by ASA G. Yoss at 1:30 p.m. to have MANUEL ORTEGA at his office for deposition. This detective along with Det. C. Dangler brought ORTEGA to Mr. Yoss's office for his deposition.

    Mr. ORT~A was deposed t 3:00 p.m. by attorneys S, Shere~,~, Wiener. Juan RamireZ'~~ Reporter Jim Harris, and ~ans1ating was Vincente De La Vega of Professional Trans1atorsY Inc.

    During the deposition, several questions were certified and taken before Judge J. N. Durant. In response to the adverse rulings the defense attorneys became upset and left. At that time Mr. Yoss apprised this detective of what had occurred and asked this detective to take Mr. ORTEGA back to jail.

    Expenses: $8.00 for meal and cigarettes for ORTEGA due to his missing routine jail feeding time.

    Case remains pending trial.

    NARRATIVE :

    '/Threats reference MANUEL ORTEGA.

    On Tuesday, 15 March 1977, this detective along with Detective E. Mederos was at the North Dade Detention Center. The following occurred.

    An incoming phone calIon extension 6506 for MANUEL ORTEGA, an inmate, was received by Sgt. P. D'Avanzo, Jail & Corrections Department. Since Mr. ORTEGA has been placed under strict security due to threats against his life (for details see Sgt. Janosky's memo), Sgt. D'Avanzo requested this writer to monitor the call. This detective did so and heard the following.

    A Hispanic male voice stated that he would lik~ to speak to Mr. ORTEGA. When asked in reference to what, he stated that it was personal. Sgt. D'Avanzo stated that ORTEGA'S cell would have' the phone on Wednesday, 16 Marchi that if the caller left a number, ORTEGA would be able to call him back. The yoice stated that he was the cousin of ORTEGA, he had just arrived from New York and that he was s~ing at ORTEGA'S aunt's home. The voice gave the name of ROBERTO ORTEGA when asked by Sgt. D'Avanzo. The conversation only lasted approximately two ~inutes and wSis concluded at 12:56 p.m.

    At a later time during a conversation Mr. ORTEGA was asked for the second time by this writer if he had a cousin by the name of ROBERTO ORTEGA and if he has an aunt in Miami. Mr. ORTEGA stated most emphatically that he 'does not and has never heard of either person.

    It is interesting that just prior to the deposition by Mr. ORTEGA, he gets such a call. During the deposition an effort was made by Mr. Sheves, cocounsel for Mr. CASTILLO, to determine if ORTEGA was now in the U. S. Marshal's Protection Plan or if he had applied or had anyone else apply for him.

    SYNOPSIS:

    Watch purchase (evidence).

    DETAILS:

    On 13 March 1977 this detective purchased a small westclox"i?'~cket watch at the K-Mart located on West 49 Street, Hialeah, at the jewelry counter. The watch was matched by description provided by ORTEGA to the watch purchased. A match was also made by the crown on the watch and the one recovered at the UM bombing.

    Watch descr~ption: Model 40003, bright nickel finished pocket~ ~ - white face with black numbers and black lacquered hands. The second hand was chrome plated or similarly plated in silvery color.

    The watch was purchased for seven dollars and ninety nine cents ($7.99).

    The watch was marked for identification by this writer, sealed

    and placed in the PSD Property Room.
