Harbor Steel Expands Operation

On June 29th, LBX Company broke ground on its new $8.8 million CustomerExperience Center in Lexington. LBX Company is the maker of Link-Belt exca-vators, material handlers, and forestry equipment. The company has beenheadquartered in Lexington since 1998. The new facility on 25 acres on Rem-ington Way in the Citation Business Park will be dedicated to customer expe-rience programs, including dealer training, product demonstrations, andcustomer events. We are proud LBX Company calls Lexington home!

Harbor Steel and Supply Corporation recently broke ground on a50,000 square foot expansion of its current operation in Lexington’sBlue Grass Business Park, which Commerce Lexington Inc. devel-oped over the last 20 years. Harbor Steel is a family-owned, full-ser-vice metals distribution and processing company. They will invest$4,100,000 in new construction and equipment. They will hire morebrake press operators and burner laser operations for the growingoperation. Congratulations to Harbor Steel on its expansion!

Commerce Lexington Inc. recently announced two promotions withinits economic development division. Kimberly Rossetti has been pro-moted to Vice President of Economic Development and has beenwith the team for 13 years. Hannah Crumrine has been promoted toSenior Project Manager of Economic Development and has been withthe team for four years. Congratulations to Kimberly and Hannah onthese well-deserved promotions!

Stat of the Month: Lexington MSA Ranks Among Most Diverse Economies

SOURCE: Emsi Q2 2018 Data Set, Industry Diversity Snapshot.

This year, Lexington ranked 9th out of382 Metropolitan Statistical Areas(MSAs) in industry diversity, according toan Emsi report. Emsi is a labor marketanalysis and economic modeling firm.This report measures distribution of totalemployment for MSA’s amongst 12 majorindustry clusters. They find that Lexing-ton’s employment is more evenly distrib-uted between these 12 industries than thetypical metro area. Lexington’s top fourindustries are capital-intensive manufac-turing, distributive services, higher educa-tion, and healthcare. Each of theseindustries represents between six percentto eight percent of Lexington’s total em-ployment.

What does this mean for Lexington?Cities that rank high in industry diversityare more resilient to economic pressures.Resilient cities are not as greatly impactedby economic recessions, as measured bythe unemployment rate, and tend to re-cover quicker from recessions than undi-versified areas. This ranking is furtherillustrated by Lexington’s 2014 ranking byWalletHub as the #12 Best Post-Reces-sion Recovery.

In the run up to the July 1 effective date for ex-pansion of Kentucky’s sales tax, questions haveabounded about the scope of the tax and its im-plementation. Here are several of the most fre-quently asked questions.

Q: If an individual or business is now requiredto collect and remit sales tax, what do they needto do?A: The individual or business must register fora sales and use tax permit with the Kentucky De-partment of Revenue. The registration processcan be started by going to the following website:https://taxanswers.ky.gov/Sales-and-Excise-Taxes/Pages/Register-for-a-Sales-and-Use-Tax-Account.aspx/

Q: Does an electrician, plumber or HVAC con-tractor have to charge sales tax on installationand repair labor?A: No. Contractors who are making improve-ments or repairs to real property, and improve-ments or repairs to real property are not servicesthat are subject to sales tax. However, contrac-tors will still pay sales and use tax on their pur-chases of materials to complete their contracts.Nothing in the new law changes the current taxtreatment of construction contractor services orlabor.

Q: How are repair services on motor vehiclestreated?A: Manufacturer's/Original/Factory Warranty:The parts used in the repair of a vehicle under amanufacturer's warranty are not taxable eitherupon purchase by the repairer or upon their use.Sales tax does not need to be charged for parts

used to complete work performed under a man-ufacturer's warranty.

A: Extended Warranty: Beginning July 1, 2018,the sale of extended warranties is subject tosales tax. With this change, the parts used in therepair of vehicles (or other tangible personalproperty) under an extended warranty are nottaxable either upon purchase by the repairer orat the time of use. Because sales tax applies atthe time the extended warranty is sold, thedealer may claim a resale exemption for partspurchased and installed to complete repairsunder the extended warranty.

Q: Are maintenance contracts for copiers sub-ject to sales tax?A: Yes. All payments made after July 1, 2018 onmaintenance, service or extended warranty con-tracts covering motor vehicles and tangible per-sonal property, such as copiers, are subject tosales tax.

Q: What constitutes “landscaping services?”A: Landscaping services include, but are not lim-ited to, lawn care and maintenance services;tree trimming, pruning or removal services;landscape design and installation services; land-scape care and maintenance services; and snowplowing and removal services.

Q: Is the building of a pond, patio, retainingwall, stone fence, or installation of an irrigationsystem subject to sales tax?A: No. These items are improvements to real es-tate and not subject to sales tax.

Q: Do individuals who mow lawns part-time inthe summer, including teenagers, have tocharge sales tax?A: Yes.

Q: Do non-profit organizations, colleges, univer-sities and governmental agencies have tocharge sales tax on admissions to fundraisers,sporting events, swimming pools or similarevents or venues?A: Yes.

Q: Does a non-profit organization have to chargesales tax on sponsorships for fundraisers?A: If tickets are provided to the sponsor as part ofthe sponsorship, then sales tax must be chargedon the entire amount of the sponsorship.

Q: Does a non-profit organization have tocharge sales tax on auction items?A: Yes, if the item is tangible personal propertyotherwise subject to sales tax.

Q: Are dues for memberships to professional or-ganizations, community organizations, or tradeassociations subject to sales tax?A: No.

Q: Are dues for memberships to gyms and sim-ilar facilities subject to sales tax?A: Yes.

Q: Are amounts paid for professional trainers orexercise classes subject to sales tax?A: No. A class or session with an instructor isnot subject to sales tax.
