R.J. Corman Railroad Company/ Memphis Line is requesting the granting of a Public Interest Finding for the KRCI crossing improvement project based on the following factors:

• For the project to advance in a timely manner, the only recourse is to allow the use of Force Account Labor.

• As has been demonstrated on other projects, the R.J. Corman Railroad forces have the capabilities and the pertinentexperience to perform all the aspects of the project on the track that we own, operate and maintain.

• Further, R.J. Corman Railroad has adequate staffing, equipment and access to materials to perform the construction of all theelements of this project.

• Finally, R.J. Corman Railroad has been constructing and maintaining railroad track and systems as well as performing otheraspects of construction activities for thirty years.

It is our belief that it is in the best interest of the public that R.J. Corman Railroad perform the work on this project with the consideration that Kentucky's requirements are met.
