4 . C O N T I N U I T Y OF SERVICE

The Cooperative s h a l l u s e reasonable d i l i gence t o provide a constant and uninterrupted supply of e l e c t r i c power and energy, but i f such supply s h a l l f a i l o r be in te r rupted o r become defec t ive through a c t of God, o r t he publ ic enemy, o r by accident, str ikes, labor t roub le s , or any ac t ion of t h e elements, o r i n a b i l i t y t o secure rights-of-way or o the r permits needed, or f o r any other cause beyond t h e reasonable con t ro l of t he Cooperative, the Cooperative s h a l l not be l i a b l e the re fo r .

5 . RELOCATION OF LINES BY REQUEST OF MEMBERS

The Cooperative's es tab l i shed l i n e s w i l l not be relocated unless t h e expense fo r moving and r e loca t ing i s paid by the member, except i n instances where i t would be t o t h e advantage of Coopera- t i v e t o make such re loca t ion .

. SERVICES PERFORMED FOR MEMBERS

The Cooperative's personnel i s prohibited from making r e p a i r s o r performing services t o t h e members equipment o r property except i n cases of emergency or t o p r o t e c t the public o r member's person or property. When such emergency serv ices a re performed, t he member s h a l l be charged fo r such se rv ice a t the r a t e of time and mater ia l .

B. SERVICE PROCEDURES

7. A P P L I C A T I O N FOR SERVICE

Each prospective member d e s i r i n g e l e c t r i c s e r v i c e w i l l be required t o s i g n the Cooperative's form, "Application f o r Membership and f o r E lec t r i c Service," before serv ice i s supplied by t h e Cooperative - and provide the Cooperative with necessary easemen permits.

RULES AND REGULATIONS

8. METYBERSHIP FEE

1 , The membership fee in the Corporation shall be twenty-five ($25.00) -- dollars. One membership must be held in connection with each member receiving service. The membership fee will be refunded if all bills are paid or applied against any unpaid bills of the member at the time service is discontinued which will automatically terminate the membership. Service covered by each membership shall be metered and billed separately. x -

9. DEPOSITS TO GUARANTEE PAYMENT OF BILLS

Reference: 807 KAR 5:006 Section 7

1. The Cooperative may, at its option, return the deposit to the consumer after 3 years, or sooner if service is terminated prior to 3 years.

2. Adjustments in the amount of the deposit may be made, at the option of the Cooperative, after the first year of service to comply with the 2/12 deposit requirement.

3. Deposits shall be required from all consumers or applicants who do not have a previous, satisfactory credit history established with the Cooperative.

ELECTRICAL REQUIREMENTS AND INSPECTIONS FOR ALL CONSUMERS

1. A l l commercial, i n d u s t r i a l , farm and r e s i d e n t i a l w i r i n g i n s t a l l a - t i o n s must m e e t t h e s t a n d a r d s of t h e N a t i o n a l E lec t r i c Code NFPA 70 and m e e t o t h e r s t a n d a r d s and i n s p e c t i o n s as provided under t h e Kentucky Department of Housing, Bu i ld ings and Cons t ruc t ion and Local Codes as provided i n 815 KAR 10 :020 , KRS 227.80, KRS 198B, 815 KAR 7:010, and 815 KAR 7 : 0 2 0 .

(N) 37. DELINQUENT PENALTY CHARGE

A delinquent penalty charge of five (5%) percent shall be added to the month1.y electric bills if not paid on or before the twelfth (12th) day of each month.

The penalty charge shall be added to all electric bills under rate Schedules 1, 2, 3, 4, 5, 6 and 7.

Each electric bill shall be clearly marked to show the net amount the gross amount and the penalty date.

All the above rates are net, the gross penalty rates being five (5%) percent higher.

SPECIAL RULES FOR SINGLE PHASE:

1. Applicstions for commercial single phase service shall be required to sign a five (5) year contract to pay not less than the minimum bill for five (5) years. Prior written approval must be obtained from the Cooperative before installation of any motor in excess of 10 H.P. single phase.

2.

SPECIAL RULES FOR THREE PHASE SERVICE:

1. The consumer must give satisfactory assurance by means of a written agreement as to the character, amount and duration of the business and complete a five (5) year contract. The consumer will guarantee the computed minimum monthly bill for five (5) years. After this period the minimum monthly charge as specified in rate schedule 2 shall be effective.

3 . The consumer shall be billed monthly for all KWH consumed in addition to the computed minimum bill.

4 . On three phase installations, all motors 10 H.P. and larger must be three phase.
