SCOPE

This schedule of rules and regulations i s a par t of a l l contracts fo r e l ec t r i c service received f r o m South Kentucky Rural Electr ic Cooperative Corporation , hereinafter referred t o as the "Cooperative" and applies t o a l l service received whether the service received i s based upon a contract , agreement, signed application o r otherwise. t o make an exception ,to ra tes or rules and regulations as are on f i l e a t the Cooperative's off ice . by the Board of Directors and approved by the Public Service Commission.

These Rules and Regulations may be revised, amended , supplemented, or otherwise changed from time to time by the Board of Directors. Such changes, upon approval by the Public Service Commission, shall have the same force as the present rules and regulations. The members shall be informed of any changes as soon as possibll t h r o u g h the Cooperative's monthly newsletter.

CONSUMER'S RESPONSIBILITY FOR COOPERATIVE 'S PROPERTY

A1 1 meters, service connections, and other equipment furnished by the Cooperative shall be, and remain, the property of the Cooperative. The member shall exercise proper care t o protect the pr0pert.y o f the Cooperative on i t s premises and i n the event of loss or damage t o the Cooperative's property arising from neglect of member t o care for same, the cost of necessar.y repairs or replacement shall be paid by the members.

MAINTENANCE OR CONTINUITY OF SERVICE

The Cooperative shall make a l l reasonable e f for t s t o preven service and when such interruptions occur shall endeavor to w i t h the shortest possible delay, b u t i f such supply shall or become defective t h r o u g h act of God, or the public enemy' s t r ikes , labor troubles, or by action of the elements, or i

RELOCATION OF LINES BY REQUEST OF MEMBERS

The Cooperative's established l ines will not be relocated unless the expense for moving and relocating i s p a i d by the member, except i n instances where i t would be t o the advantage of the Cooperative t o make such relocation.

SERVICES PERFORMED FOR MEMBERS

The Cooperative's personnel i s prohibited from making repairs or performing services to the member's equipment or property except in cases of emergency or t o protect the public or member's person or property. services are performed, the member shall be charged for the actual cost of labor and material for such service.

Each prospective member desiring e l ec t r i c service will be required t o s i g n the Cooperative's form "Application for Membership and for Electric Service" be,fore service i s supplied by the Cooperative and provide the Cooperative with necessary easements o r right-of-way permits.

MEMBERSHIP FEE

The membership fee in the Cooperative shall be $25.00 (Tw The membership fee will be refunded i f a l l b i l l s are paid unpaid b i l l s of the member a t the time service i s discont automatically terminate the membership.

RIGHT OF ACCESS

The Cooperative's identified employees shall have access t o member's premises a t a l l reasonable times for ,the purpose of reading meter, tes t ing, repairing removing or exchanging any and a l l equipment belonging to the Cooperative.

MEMBER'S D1,SCONTINUANCE OF SERVICE

Any member desiring service discontinued or changed from one lacation t o another shall give the Cooperative three (3 ) days notice in person o r i n writing providing such notice does n o t v iolate contracutal obligations.

CONNECT AND RECONNECT CHARGES

The Cooperative will make no charge for connecting service t o tne new member's i n s t a l l a t ion of service provided the connection is made during regular working hours.

The Cooperative may make a service charge of $15.00 (Fifteen DoYlars) for reconnecting the service of any member whose service has been csznnected one o r more times within the preceding twelve months. The service charge s h a l l be an additional $50.00 (F i f ty Dollars) i f made a f t e r regular hours. Any service charge will be due and payable a t the time of connectian or upon notice o f said charge.

RESALE OF POWER BY MEMBERS

All purchased e lec t r ic service used on the premises of the member shall be supplied exclusively by the Cooperative, and the member shall not d i rec t ly or indirect ly s e l l , sublet , or otherwise dispose of the electr ic service or any par t thereof.

SPECIAL CHARGES

The Cooperative will make a charge of $15.00 (Fifteen Dollars) fo r each t r ip made d u r i n g regular working hours or $50.00 (F i f ty Dollars) fo r each t r i p made a f t e r or before regular working hours-any service t r i p requested by a member t o restore e l ec t r i c service when it, i s determined tha t the service interruption was caused by a defect i n the member's w i r i n g or equipment and i s n o t the f a u l t of the Cooperative.

S E R V I C E CHARGES FOR TEMPORARY SERVICE

Consumers requiring temporary service may be required t o pay a l l costs of connecting and disconnecting incidental t o the supplying and removing of service. In addition t o t h i s , a deposit will be required t o cover estimated consumption of e l ec t r i c i ty . Both fees will be pa id i n advance. or slow, an adjustment shall be made t o the member's b i l l by recalculating the monthly b i l l s for t h a t period of time t h a t i t i s known t h a t the meter has been f a s t or slow; however, i f t ha t period of time i s n o t known, then a period equal t o one-half (S) of the time lapsed since the l a s t previous t e s t , b u t in no case shall th i s period exceed twelve (12) months. f a s t and i f time for periodic t e s t has overrun such tha t one-half (%) of the time elapsed since the l a s t previous t e s t exceeds twelve (12) months, then the refund shall be for twelve (12) months, plus those months exceeding the periodic t e s t period. I n the event a member's meter should fa i l t o r eg i s t e r , the member shall be b i l led from the date of such f a i lu re a t the average consumption of the member based on the the three ( 3 ) months period immediately preceding the f a i lu re o r the same bi l l ing period the p a s t year.

DISCONTINUANCE OF SERVICE BY COOPERATIVE

A . The Cooperative may/shall refuse or discontinue t o serve a member under the following conditions:

1. For non-compliance with i t s rules and regulations.

2. When a dangerous condition i s found 'to ex i s t on the member's premises.

3. When a member refuses or neglects t o provide reasonable access t o the premises for the purpose o f i n s t a l l a t ion , operation, meter reading, maintenance or removal of Cooperative property.

4. For non-payment of any indebtedness due the Cooperative.

When t h e Cooperative has discovered evidence t h a t by f raudu len t or i l l e g a l means a member has obtained unauthor ized se rv i ce or has d i v e r t e d the se rv i ce fo r unauthor- i z e d use or has obta ined se rv i ce w i thou t same being p roper l y measured, the se rv i ce t o the customer may be d iscont inued w i t h o u t no t i ce . The Cooperative w i l l n o t r e s t o r e se rv i ce u n t i l t he customer has complied w i t h a l l r u l e s o f t h e Cooperative and regu la t i ons o f t h e Pub l i c Serv ice Commission and the Cooperative has been reimbursed f o r the est imated amount o f t he se rv i ce rendered i n c l u d i n g the i n i t i a l d isconnect ion and the cos t t o the Cooperative i ncu r red by reason o f t he f raudu len t use. D. CONSUMER EOUIPMENT

POINT OF DELIVERY

The p o i n t o f d e l i v e r y i s the p o i n t as designated by t h e Cooperat ive on member's premises where c u r r e n t i s t o be de l i ve red t o b u i l d i n g o r premises namely the meter. A l l w i r i n g and equipment beyond t h i s p o i n t o f d e l i v e r y s h a l l be supp l iec and maintained by the member. The member w i l l , however, n0t i f .y the Cooperative o f any proposed changes i n h i s equipment o r w i r i n g which w i l l m a t e r i a l l y increase or decrease h i s l oad so the Cooperative may check i t s equipment t o make c e r t a i n i t w i l l accommodate the consumer's load requirements.

I 20. INSPECTION

All w i r i n g i n a building must be inspected f o r compliance w i t h a l l applicable Electric Codes by an inspector licensed by the S ta t e Fire Marshall and approved by the Cooperative, before the f i r s t connection f o r service.

For B u i l d i n g s w i t h Service Entrances of 200 Ampere o r Less - the inspection fee shall be $40.00 (Forty Dollars). All buildings shal l receive a rough-in and a f ina l inspection: (Two Trips). For Service Entrances Greater t h a n 200 Ampere - $20.00 (Twentv Dollars) p l u s $2.00 (Two Dollars) per c i r c u i t , (minimum $40.00)

21. BILLING

Should i t become evident t ha t the amount set u p i s substant ia l ly over or under the actual usage, the budget payment may be adjusted accordingly.

Any consumer being bi l led by budget payment contract agrees t o a l l rules , regulations and pol i c i e s as a1 1 other consumers receiving service from South Kentucky RECC w i t h the exception o f the budget payment being acceptable.

In addition t o making the budget payment monthly, the consumer agrees t o render a meter reading by the due date or i f the account is estimated for three consecutive months, Co-op personnel will read the meter which will r e su l t in an additional $15.00 service charge t o be added t o the b i l l , as s ta ted in Rule #23.

22. TAXES

The Cooperative shall add to the b i l l s of a l l applicable members the Kentucky Sales and Use Tax, any u t i l i t y gross receipts l icense tax for schools or any other t a x or levy tha t may be legal ly imposed on the Cooperative t h a t i s measured or determined by sal es or receipts.

23. METER READING

Each member receiving service will be required t o supply the Cooperative w i t h the reading of each meter on the form as furnished by the Cooperative on the date as designated by the Cooperative. If any member shall f a i l t o read the meter and supply such reading t o the Cooperative Office by the date designated for three ( 3 ) consecutive months, such meter may be read by a representative of the Cooperative and the member shall pay a service charge of $15.00 (Fifteen Dollars) to cover cost of t r i p by such representative. In the event that a n error i n meter reading should be made or member f a i l s t o send i n meter reading card, the member shall pay for t h a t m o n t h e i ther the m i n mum b i l l for the service he receives, o r an amount approximately equal t o his l a s t b i l l . Then the following months' b i l l shall be computed on the regu a r schedule prorated for two months and the amount paid shall be credited.

B I L L I N G ADJUSTMENTS TO STANDARD PERIODS

The f i r s t and f inal bi l l ing of an account for which l e s s t h a n the minimum amount o f KWH are used shall be pro-rated based on KWH and time actually used. 30. UNDERGROUND EXTENSIONS (Residential Subdivision)

The Cooperative will i n s t a l l underground dis t r ibut ion l ines t o a residential subdi vision under the fol 1 owi ng condi t i ons :

1. The subdivision being developed must consist of a t r a c t of l i ne which is divided into ten (10) or more lo t s fo r the construction of new residential buildings or the land on which i s constructed two ( 2 ) or more new multiple occupancy buildings ( r e f e r t o PSC Electric Rules, Appendix A fo r deTinit- ions of terms).

2. Developer or owner of subdivision shall be required t o advance t o the Cooperative a non-refundable payment i n an amount equal t o an "estimated average cost d i f f e ren t i a l " , i f any, between the average or representative cost of underground dis t r ibut ion systems i n res ident ia l subdivisions and o f equivalent overhead dis t r ibut ion systems within the u t i l i t y service areas. If the applicant i s required t o deposit the en t i r e estimated cost of the extensions, the amount in excess of the normal charge fo r under- ground extensions shall be refunded t o the applicant over a ten (10) year period as provided i n Public Service Commission 807 KAR 5:041 Section 11.

3 . The Cooperative will construct underground dis t r ibut ion f a c i l i t i e s in the subdivision adequate t o render single-phase 120/240 vol t service.

Three phase primary mains or feeders required within a subdivision t o supply local dis t r ibut ion or t o serve individual three phase loads may be overhead unless underground i s required by governmental authori t ies or chosen by applicant, i n e i ther of which case the d i f fe ren t ia l cost of underground shall be born by the applicant.

7. The requirements as to wiring specifications of the utility and those o f any regulatory body having jurisdiction must be followed. The Cooperative's Rates, Rules and Reg1.11at ians for furnishing electric service apply in the case of underground service and overhead service alike.

The service from the metering p o i n t i s the consumer's and will be furnished by the consumer. The member will furnish the conduit t o go on the pole along with weatherhead. The Co-op will make connections a t the transformer and furnish a l l metering equipment. The member i s responsible t o co-ordinate the conduit on the pole w i t h the Co-op so as t o allow the Co-op t o ensure t h a t i t i s done safely.

T h i s includes furnishing service wire and c o n d u i t t o the pole.

The Cooperative will open and close the necessary trench and the member shall pay t o the Cooperative the actual cost incurred, or i f the member chooses, he may open and close the trench i n which case there will be no charge made by the Cooperative.
