PUBLIC UTILITIES COMMISSION OF THE STATE OF CALIFORNIA WATER DIVISION

SUBJECT: Senate Bill (SB) 120 Compliance Filing

In compliance with Senate Bill (SB) 120, Southern California Edison Company (SCE) hereby submits for filing the following changes to its tariff schedules. The revised tariff sheets are listed on Attachment A and are attached hereto.

PURPOSE

This advice filing establishes a Tenant Rights letter, Form 14-815W and a 15 Day Notice of Service Termination, Form CSD 470W for Santa Catalina Island (Catalina) water customers. These forms will be used to notify tenants of SCE’s residential customers and submetered tenants of SCE’s master-metered customers of any potential disconnection activity, and to offer the tenant an option to establish service with SCE in his/her name.

BACKGROUND

SB 120, which was signed into law on October, 11, 2009, amends Section 777 and 777.1 of the California Public Utilities Code effective July 1, 2010. SB 120’s objective is to inform tenants who are not SCE’s customer of record, of an eminent utility shutoff when a landlord fails to pay his/her utility bills.

SB 120 establishes that when there is a landlord1 -tenant2 relationship and a utility furnishes individually-metered or master-metered residential service to such tenant where the landlord is the utility’s customer of record, the utility shall make every good

faith effort to inform the tenant(s), in writing, when the account is in arrears, and that service will be terminated at least 10 days (15 days for master-meter tenants) prior to termination. The written notice, which will be either mailed to the residential tenant, or for master-metered customers posted on the door of each residential tenant or in accessible common areas and entry ways, shall further inform these residential tenants that they have the right to become the customer of record without being required to pay any amount which may be due on the delinquent account. The notices are to be written in English, Spanish, Chinese, Tagalog, Vietnamese, and Korean, as specified in Section 1632 of the California Civil Code.

PROPOSED TARIFF CHANGES

In order to comply with the requirements of SB 120 as discussed above, SCE proposes the following tariff modifications:

• SCE establishes a notification letter entitled “Tenant Rights Letter” ( Form 14-815W). This letter is published in six languages, as required by Section 1632 of the California Civil Code, and will be mailed to affected tenants of detached single-family dwellings and multi-unit residential structures. This letter will advise the tenants of their ability to become a customer of SCE and have service billed to their names without including any past due charges associated with the Landlord’s SCE account.

• This filing establishes a form entitled “15 Day Notice of Termination” (Form CSD 470W). This form will also be published in the six languages, as required by Section 1632 of the California Civil Code, and will be posted on the doors of affected residential tenants of mobilehome parks, or in the common areas of the mobilehome parks and multi-family accomodations.

TIER DESIGNATION

Pursuant to General Order (GO) 96-B, Water Industry Rule 7.3.1(3), this advice letter is submitted with a Tier 1 designation.

EFFECTIVE DATE

This advice filing will become effective on July 1, 2010, pursuant to SB 120 and Public Utilities Code Sections 777 and 777.1.

TERMINATION

Your electric, gas and/or water service is provided through a single Southern California Edison

electric, gas and/or water meter serving all tenants. Existing billings (under the landlord’s name)

for service at this address are past due and unpaid. To prevent termination of service, or

reestablish service in the event service has been terminated, you have the right to become a

customer of the utility without being required to pay the amount due on the delinquent account.

The tenants, or their representative, requesting electric, gas and/or water service must meetthe terms and conditions of service and requirements of Edison’s tariffs and any applicable law. Toarrange for the master metered service to be continued or turned back on:

a. Tenants may form a legal association which shall apply for service through anauthorized member, or

b. One or more tenants may accept personal responsibility for the payment of electric,gas and/or water service.

SCE has no alternative but to terminate service in accordance with Rules on file with theCalifornia Public Utilities Commission unless the past due bills are paid, or one of the abovearrangements to pay for future services is made on or before the disconnection date listed below.
