JUSTIFIABLE.There have been, nt different

times, in the past, outcriss againstthe Executive for transferring roo-nei- 's

from one appropriation to an-

other, and for overdrawing amountsappropriated. Undoubtedly therehas been goodgiound for complaint,although perhaps the uproar createdhas bcon sometimes greater than themischief done.

All respecters of tho law willagree that it is the duty of the Min-isters to obey the Appropriation Actto the letter, if possible, and tokeep all expenditures within its pro-visions; but it must be admittedthat if circumstances arise whichimperatively require a larger ex-

penditure than the Legislature hasprovided for, and if a strict adher-ence to the Appropriation Act isdistinctly detrimental to the publicservice, the Executive is justified inexceeding the appropriation, draw-ing for that purpose from any sur-plus that may be in the treasury, orif the treasury is without a surplus,securing a temporary loan. Notonly is the Government justified indoing so, but that is its plain dutyin such cases, the proper after-cours- e

being to apply to the Legis-lature for its sanction, at its nextmeeting, by the passage of an in-

demnity bill. An intelligent Legis-lature can scarcely be so perverseas to withhold its approval of un-

authorised expenditures that areclearly shown to have been reallynecessary.

It would appear that our Govern-ment finds in certain cases that theamounts appropriated are instifll-cien- t,

and that by confining itself tothe Appropriation Act the publicservice will suffer. In one casethere is no appropriation at all.

Two of tho Associate Justices oftho Supreme Court, Judge Bickertonand Judge Dole, have, wo under-stand, received no salaries since thecommencement of the year, becausetheic is no appropriation for thatpurpose. liiose gentlemen canprobably afford to wait,and for any-

thing we know to the contrary areperfectly willing to do so, but theirsalaries should have been paid whendue, appropriation or no appropria-tion, and the Executive, in ouropinion, would have been wellwithin its discretionary powers inpaying them.

In the matter of offering areward for the capture or discoveryof an atrocious murderer, the Attor-

ney-General has abstained fromdoing so, because the appropria-tion under the head from whichmoney for such purposes is drawn,has been exhausted. "We surelythink the discovery and capture of amurderer of sufficient public con-

cern to warrant the overdrawing ofthe appropriation if necessary forthat end. No one can tell who nextmay fall a victim to the same as-

sassin as long as he is at liberty.Now another matter comes up.

It is said, and we believe truty, thatthe tugboat Eleu has about exhaust-ed the appropriation for her runningexpenses, and that if the appropria-tion be not overdrawn the tug can-

not continuo operations much longer.Everybody knows that the tuc; is anabsolute necessity, and must bekept going; and therefore it is aproper thing for the Government tokeep her going, even if it does takemoro money than the Legislaturehas allowed.

Lot not our readers run awaywith the impression that wo advo-cate excessive expenditures, or favora systematic departure from theAppropriation Act, but simply this,and nothing more that when an ex-

penditure in excess of tho appropri-ation is urgently needed in tho in-

terest of the public good, the Gov-

ernment does its duty in taking uponitself the responsibility of incurringthe additional liability, and that thethreo instances cited arc of this par-

ticular nature. Exception may bo

taken to the first, on the ground thattho judges continuo to perform theirduties, notwithstanding the delay ingetting their stipends; but thesame argument docs not apply totho other two.

J l"CABINET AHD PRIVY COUNCIL.

A brief news item appealed inthis paper a couple of days ago, tothe effect that talk was in circula-

tion of tho Government having suf-

fered defeat in a lCBoltttion intro-

duced by it to the Privy Council that day ; and such tens the talk."Defeat," perhaps, was hardly theproper word to use. It would bemore correct to sa that the PrivyCouncil declined to assume the res-

ponsibility of appropriating thomoney asked, simply because theCouncil did not consider it a casewithin its province.

This is how we understand thematter: The nppiopiiation for thorunning expenses of the tugboat isrun out, and money will be requiredto keep her at work until the Legis-

lature meets and makes new appro-

priations. Under these circum-

stances the Ministry asked thoPrivy Council to sanction the neces-

sary expenditure, under Article 15

of the Constitution, which providesfor the drawing of money from thePublic Treasury without the consentof the Legislature, between sessions,in the emergencies of war, invasion,rebellion, pestilence, or other pub-

lic disaster, with tho concurrence ofall the Cabinet, and of a majority ofthe whole Privy Council. The PrivyCouncil not thinking that any ofthese emergencies arc involved inthe tugboat question, and believingthat it is purely a matter for theexercise of Ministerial discretion,preferred to leave the responsibilitywith the Cabinet.

We may add, that, in our opinion,the Privy Council did the correctthing, although the reference of thematter to it by the Government mayindicate a commendable dispositionon the part of the latter not to ex-

ceed its authority. As stated else-

where, this is clearly a case in whichthe Executive should shoulder theresponsibility of providing ways andmeans until the Legislature meets.

"We would still further add thatthe impression which prevails in

certain quarters that the earnings ofthe tug should be suflicient to payher expenses, is entirely aside fromthe question. These earnings arcpaid into the Treasury as "Govern-ment Realizations," and can bedrawn out in the regular way only.No matter how great the earnings,they are not directly available.

AVhite menmade their bids, one I notice bidnearly as low as Ahi & Co, only 30cents difference. Let me ask, Whathave the Chinese ever done that thepreference is given them by a Gov-

ernment that by so doing is stand-ing in its own light? Does the Legis-lature desire to drive the white manto the wall, and let tho cooliethrive?

Let them remember that whenHonolulu needed aid all her youthwere ready to sacrifice their lives, ifneed be, and that the majorit' wcicthe sons of merchants here. Is re-

form going backwards? Would itnot be wise to consider who lias thegreater right to supply the Govern-ment with stores? Who is responsi-ble? Will it be requisite to frame anow constitution? or, have not thefounders or the writers of the d

new one courage or manlinessenough to live up to their ownpledges, to benefit and help thosewho are their fellow men?
