WHEREAS, rates for garbage pickup for residential users and trailer courts and apartments, and rates for dumpsters and garbage pickup for business/home businesses were estab- lished by Ordinance Numbers 972, 1113, 1129 and 1277 as adopted by the City Council of the City of Columbus, Kansas. WHEREAS, costs for providing services by the Garbage Enterprise fund have increased due to increased fuel and vehicle operations costs, increased labor costs for wages and benefits, increased costs for repairs and maintenance of equipment, and capital costs for vehicles and equipment. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF COLUMBUS, KANSAS: Section 1. That Ordinance Numbers 972, 1113, 1129 and 1277 and City Code 2014 Section 15-523 shall be amended as follows: City Code Section 15-523: (a) Residential users. Garbage pickup services for residen- tial customers, individual trailer court units and individual apartment units shall be Twelve Dollars and 50/100 Cents($12.50) per month, effective January 1, 2020, for pick-up service one time per week. (b) Pick-Up Schedule: All residential, business or home business customers situated outside the designated fire zone shall receive garbage pick-up service one time per week. All residential, business or home business customers situated within the fire zone are shall receive daily pick-up services. The fire zone is defined as the downtown business district in the area between Walnut and Elm Streets on the north and south, and the area between Tennessee and Minnesota Streets on the east and west. (c) Fire zone Rate: Garbage pick-up services for customers situated within the fire zone who do not rent dumpsters shall be Twenty-two Dollars ($22.00) per month, effective January 1, 2020. (d) Trailer Courts and Apartments: Recognized manage- ment of trailer courts or apartments may provide for their tenants' garbage service pursuant to subsection (e) below by securing a dumpster or dumpsters from the City. (e) Dumpster Rates: Any business, organization, apartment complex, trailer court or individual desiring to use a dumpster for the collection of their garbage shall secure a dumpster from the City. Each dumpster shall have a basic monthly charge of Sixty Dollars ($60.00) this includes one dump per week, effective January 1, 2020. A customer renting a dumpster may request additional dumping service at a rate of Five dollars ($5.00) per dump,per dumpster. Customers shall contact City Hall to arrange additional dump- ing services and schedules. (f)Fire Zone Dumpster Rates: Monthly rental and pick-up for daily, weekday pick-up of all dumpsters in the designated Fire Zone shall be Seventy-one Dollars ($71.00) per month per dumpster. QUALIFIED ELECTORS OF THE CITY OF COLUMBUS, KANSAS, THE QUESTION PRESENTED

IN THE PROTEST PETITION CHALLENGING CHARTER ORDINANCE NO. 1436.

WHEREAS, under the power of cities granted by the Kansas Constitution, Article 12, Section 5, the Governing Body may submit to the qualified electors the question of reducing the number of City Council Members from ten (10) to five (5), with staggered three (3) year terms, as proposed by Charter Ordinance No. 1436.WHEREAS, the Governing Body of the City of Columbus, Kansas, has determined that reducing the size of the City Council and establishing three (3) year, staggered terms would serve the best interests of the City.WHEREAS, a qualified number of electors have timely submitted a proper protest petition challenging the Charter Ordinance No. 1436, requiring a special election for voters to decide the question.NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF COLUMBUS, KANSAS,Section 1. A special question election shall be held in the manner prescribed by law on Tuesday, the 6th day of August, 2019, for the purpose of submitting to the qualified electors of the City of Columbus, Kansas, the question of approving Charter Ordinance No 1436.Section 2. If approved by a majority of the electors voting thereon, such Charter Ordinance No. 1436 shall become effective, beginning with the 2020 elections, pursuant to the mandated election laws of the State of Kansas.Section 3.
