For industrialists and workers in the sector, as well as for producers and producing areas, a period of major upheaval is beginning with the reform of the common organisation of the market in sugar. Companies will close down whilst others will take up different activities. Thousands of workers will have to change their occupation or find another job altogether. Whole regions will have to convert.

The European Union’s financial instruments can make a decisive contribution during this period, helping all the players in the sector to face up to the coming changes, lessening the economic and social impact of the reform and favouring new developments. The Structural Funds, and especially the European Social Fund, will thus be called upon to facilitate the economic regeneration of the regions concerned and strengthen the adaptation capacities of workers in the sector.

This guide is therefore a precious tool. With it, the European social partners in the sugar industry who have produced the guide together are pursuing their essential role of anticipating and accompanying the changes affecting the sector.

The European Commission will continue to support the approach of partnership, anticipation and mobilisation developed in this way, in accordance with the guidelines in the Communication on "Restructuring and employment" which it adopted in 2005, and ensure a reinforced follow-up of the sector incorporating the social aspects. In effect, the actions undertaken are fully in keeping with the strategy of anticipating and accompanying restructuring which the European Union is pursuing within the context of growing globalisation1.

FOREWORD[return to Table of Contents]

Using the European structural funds is a particularly complex business. It means learning a specific vocabulary and entering a European logic that is often very different from the national logic. However, when it comes to using the funds, the local, regional and national authorities play an essential role. So we should adopt a dual approach in order to:

- understand the basic European mechanisms;- implement them at regional and local level.

This guide is aimed at providing precise selective information concerning:

- the European level;- the decentralised national level, through a number of addresses and contacts.

The key to success for sugar factories will consist in “staging” their case at the different levels: European, national, regional and local. In effect, the problems connected with restructuring or company closures in the sector are not “spontaneously” taken into account. But the restructuring of the sugar sector creates a new situation providing opportunities -whenever possible – for employers (as companies) and employees (as individuals) to receive European subsidies with a view to confronting the crisis more effectively.

Financing is always in the form of “cofinancing” and therefore requires national, public or private intervention.

Furthermore, aid for “training” or “resettlement”, for example, generally forms part of a larger whole. That is why knowledge of local/regional priorities is essential.

Moreover, in 2005 we are going through a transitional period. In effect:

the current general rules (perspectives for 2000-2006) will apply until the end of 2006 but the funds can be used until 2008.

The new programming for 2007-2013 was adopted by the European Council of December 2005. The European Parliament has still to confirm its agreement. This new programming will be especially important for a number of regions which will no longer be fully subsidised within the framework of Objective 1 (regional average less than 75% of the Community average).

Straddling two budgetary periods, we are thus faced with numerous uncertainties. This Guide provides the latest information available on access to the structural funds. For a summary table of the differences between 2000-2006 and 2007-2013, click here.

It is essentially aimed at helping the different local players (companies and individuals) to understand the essential rules without getting lost in the mass of Community information. Once they have this information, it will be up to them, if they judge adequate, to plead their case successfully at national level and have it recognised as a priority issue in local development.

It is important to know from the beginning that these measures require real energy, the effort of compiling a relevant dossier and the will to convince and to succeed. Communications with the local authorities must start as early as possible because the implementation of projects takes time. But there can be no doubt that at the end of it all lies considerable potential financing, particularly for the new member countries of the European Union. This Guide provides the information; the action is in your hands!

Before anything else, rather than reading this practical guide in a linear manner, we recommend you to use the interactive links, which will allow you to select the information that is of direct interest to you, according to:

- your geographical location (First approach)- your industrial project (Second approach)- the type of European aid that you could obtain.

However – if you are not familiar with the structural funds and so as not to get lost in the maze of information available on the Net – it seems wiser to read first of all the summary in this guide (“To find out more”).

You can also display a document map providing a permanent view of the Guide’s table of contents (on the toolbar, select view – document map).

The European Union allocates part of its budget to financing actions aimed at strengthening the economic and social cohesion of the Union’s territory. This financing is effected firstly through the “structural funds” and, additionally, through “Community initiatives”. Within the context of the reform of the sugar regime, it is possible to envisage the financing of various kinds of actions, such as industrial conversion, training for workers, structural adjustment, etc. However, the measures to be taken are not always easy.

Above all, it is necessary to check:

whether the region in which the sugar factory is located corresponds to a “priority” region for the European Union (see Part III.A.2)

compatibility between the industrial measures envisaged (e.g., conversion, worker training, diversification of activities, early retirements, etc.) and the type of aid provided by Europe (political priorities)

whether this project falls within the scope of the regional programmes and forms part of local priorities. This calls for verification of the texts (see Community Support Framework and SPD) and contacts with the national and regional players with whom it should be determined, if appropriate, how to include this new project among the current priorities, by modifying some of these priorities if necessary.

Furthermore, the aid provided at national or European level must comply with the regulation on State aid. This regulation is going to change shortly. Please also see the Communication from the Commission entitled “Community Guidelines on state aid for rescuing and restructuring firms in difficulty” (OJ C 244/2 of 1st October 2004).

To begin with, we propose an initial approach in three stages based on your sugar factory. The aid that you could receive depends first of all in fact on the location of your factory in relation to the different areas and objectives.

A second approach can be taken through your industrial project: closure, partial collective redundancies, conversion, restructuring/diversification on a local labour market.

A – FIRST APPROACH ACCORDING TO THE LOCATION OF THE SUGAR FACTORY

STAGE 1

Are you in an Objective 1 or Objective 2 area of the European Union?

To find out:- consult the table of sugar factories in Europe,- click on the region corresponding to your industry, which will take you to the regional policy site

of the European Commission, on the page corresponding to your region.

STAGE 2

If you are in an Objective 1 area: - consult the type of aid that you can obtain.

If you are in an Objective 2 area: - consult the type of aid that you can obtain.

If you are not in either Objective 1 or Objective 2:- consult the actions financed within the framework of Objective 3.

Worth knowing: - The Objective 1 regions are not covered by Objectives 2 and 3. This is the case with the 10 new member countries

(except for certain areas around the capital). - Objective 3 covers all the territory apart from Objective 1 regions, but includes Objective 2 regions.

SO: if you are in Objective 1: ignore Objectives 2 and 3 (except for Community initiatives). if you are in Objective 2: look at your regional Objective 2 plans and the Objective 3 SPDs (which can be consulted

in the “Practical Information” part of this Guide). You are neither Objective 1 nor 2: look at the Objective 3 SPDs (idem).

WHAT IS YOUR INDUSTRIAL SCENARIO?

Another way of using this Guide is to start with your industrial project. In effect, different possibilities exist according to whether you decide on closure, partial collective redundancies, the development of a local labour market or conversion. What are your scenarios?

==> Company closureThis involves aid for closures as provided for by the new sugar regulation and the additional use of the structural funds. It is possible for a link to be established directly at European level between the level of aid for the closure and additional access to the structural funds (in course of analysis).

==> Staff cuts / RetrainingIn this case, the European Social Fund (ESF) seems to be the main fund.For conversion, ERDF can also be relevant in certain conditions (but investments must be maintained for 5 years; it is therefore necessary to verify compatibility with the project).

==> Diversification / Local employment market Apart from ESF, the theme of rural development and Leader+ seem particularly appropriate.

==> Industrial conversion (e.g. production of bioethanol)The environmental aspects of the different programmes, such as the cohesion fund, can be an advantage. To find out more about the European bioethanol strategy, click here.For conversion, ERDF can also be relevant in certain conditions (but investments must be maintained for 5 years; it is therefore necessary to verify compatibility with the project).

ADDITIONAL CRITERIA: DURATION OF THE PROJECT AND PRIORITIES

in the case of total or partial closure, quick access to the present structural funds is necessary. It is a good idea to act within the 2000-2006 budgetary framework.

in the case of diversification or conversion, it seems more rational to include your action in the next programming (2007-2013).

It is also necessary to check the priorities to which you have access over the two periods (2000-2006 and 2007-2013). In some Member States (e.g. Spain), it will be wiser to find funds over the first period.

A - THE EUROPEAN STRUCTURAL FUNDS:WHAT ARE THEY ABOUT?

INTRODUCTION

The European structural funds are financial instruments developed by the European Commission to strengthen the economic and social cohesion of the territory of the European Union. The purpose of these instruments is to cofinance (with the Member States) various kinds of actions in the economic and social field: conversion, employment, training, structural adjustments, etc. Intervention by the Funds – on which a ceiling is placed (see below) – is mainly in the form of non-repayable aid or "direct aid" and, to a lesser degree, repayable aid, interest-rate subsidies, guarantees, capital holdings and risk capital holdings.

1. THE THREE MAIN STRUCTURAL FUNDS:

■ REGION - EUROPEAN REGIONAL DEVELOPMENT FUND (ERDF ):

Aid for regions that are lagging behind in development, going through economic conversion and in structural difficulties.

+ Innovative actions on 3 working themes:• the regional economy based on knowledge and technological innovation,• eEurope-regio: the information society at the service of regional development,• regional identity and rural development

■ EMPLOYMENT – EUROPEAN SOCIAL FUND (ESF )

Intervention within the framework of the European strategy for employment. The ESF grants financial aid to programmes favouring or updating the ‘employability” of citizens: occupational skills, aptitude for social relations, ability to adapt on the labour market.

■ AGRICULTURE - EUROPEAN AGRICULTURAL GUIDANCE AND GUARANTEE FUND (EAGGF ):

The “guidance” section contributes to the development and structural adjustment of rural areas lagging behind in development by improving the efficiency of structures for the production, processing and marketing of agricultural and forestry products.

2. THREE PRIORITY OBJECTIVES FOR THE PERIOD 2000-2006 (2)

■ OBJECTIVE 1

- Promotion of the development and structural adjustment of regions where development is lagging behind, whose average per capita GDP is below 75% of the European Union average (including the French overseas departments, the Azores, Madeira and the Canary Islands, together with areas with a low population density).

- This is the most important Objective: 2/3 of the actions by the structural funds are focused on Objective 1 and almost 20% of the Union’s total population is concerned by the measures taken under this Objective (financing: via ERDF, ESF, EAGGF-guidance, FIFG).

■ OBJECTIVE 2

- Support for the economic and social conversion of areas faced with structural difficulties other than those eligible for Objective 1.

- It essentially concerns areas undergoing economic changes, rural areas in decline, crisis areas depending on fishing and urban areas in difficulties.

- A maximum of 18% of the Union’s population are covered by this Objective ( financing: via ERDF, ESF).- To find out more: Objective 2

- Actions in favour of the development of human resources outside regions eligible for Objective 1 (measures taken on the basis of the new Title on employment in the Treaty of Amsterdam and the European strategy for employment) (financing: via ESF).

Transitional regime (degressive aid system) for regions that are no longer eligible for Objective 1 or 2 between 2000 and 2006.

It concerns: Ostberlin (Germany), Hainaut (Belgium), Cantabria (Spain), Corsica and the administrative districts of Valenciennes, Douai and Avesnes (France), Molise (Italy), Southern and Eastern (Ireland), Flevoland (Netherlands), Lisbon

and Vale de Tejo (Portugal), Northern Ireland and the Highlands and Islands (United Kingdom).

3. ADDITIONALLY: COMMUNITY INITIATIVES

The potentially interesting Community Initiatives for the period 2000-2006 are:

- LEADER+ : aims to promote rural development (financing: via EAGGF -guidance)- INTERREG III : stimulates cross-border, transnational and interregional cooperation ( financing: via

ERDF)

Mention should also be made of the Equal and Urban initiatives, through which it is possible to obtain financing (e.g. industrial wasteland).

NB. However, the Community Initiatives include a number of constraints (transnational project, qualitative added value, innovative nature) and do not receive substantial financing (only 5% of the total for the structural funds). They can be envisaged on an additional basis.

4. FOR INFORMATION: ALLOCATION OF AID FOR THE PERIOD 2000-2006

Period 2000-2006Overall budget for the structural funds

195 billion Euros (excluding the cohesion fund).

Allocation of appropriations for 2000-2006 :

• 69.7% for Objective 1• 11.5% for Objective 2• 12.3% for Objective 3• 0.5% for FIFG outside Objective 1• 5.35% for the Community Initiatives • 0.65% for innovative actions and technical assistance measures.

Performance reserve

4% of the appropriations allocated to each Member State were placed in a reserve until 2003 and then redistributed to the programmes with the best performance by March 31st 2004 at the latest. The Member States submitted their proposals to the Commission on the basis of monitoring indicators that they themselves had introduced. Allocation of appropriations for the period 2007-2013 :

- 81,7 % for the "convergence" objective, of which 24,5 % for the cohesion fund and 5 % for the regions and member states with a progressive phasing out of aid.

- 15,8 % for the “regional competitiveness and employment” objective- 2,4 % for the « European territorial co-operation » objective

5. MAXIMUM AID

Contributions from the Funds are subject to the following ceilings:

■ Regions eligible for Objective 1: - maximum 75% of the total eligible cost and, as a general rule:- at least 50% of eligible public expenditure. - The level of the Community contribution can be as high as 80% for regions situated in a Member State covered by

the Cohesion Fund (Greece, Spain, Ireland and Portugal and the new Member States of the European Union) or even 85% for all the most remote regions and minor islands in the Aegean Sea in Greece.

■ Regions eligible for Objectives 2 and 3: - maximum 50% of the total eligible cost and, as a general rule:- at least 25% of eligible public expenditure.

Depending on eligibility for Objectives and the economic and geographical situation of regions, the regulation places other ceilings on the contribution from the fund in the case of investments in companies or infrastructures likely to generate a substantial net income.

6. A SPECIAL CASE: THE COHESION FUND

Supplementing the funds described above, the Cohesion Fund is exclusively for the benefit of the so-called “cohesion” countries, i.e.:

- Greece, Spain and Portugal- Since the enlargement of 2004, the ten new member countries.

It is a question of countries whose per capita Gross National Product (GNP) is below 90% of the Community average and which have introduced a programme aimed at meeting the economic convergence criteria with a view to joining the single currency.

The objective of the Cohesion Fund is to contribute to the development of these countries in the fields of the environment and transport infrastructures. The current priorities are water purification, etc. However, there is nothing to prevent their own energy resources (bioethanol, for example) from being taken into account. For the period 2000-2006, the total resources available for commitment are 18 billion Euros.

Case study: the Rover bankruptcy

In April 2005, the bankruptcy of the car manufacturer Rover, located in the West Midlands in the United Kingdom, resulted in 6,250 employees being made redundant and a further 15,000 jobs threatened (subcontractors). The Commission immediately made known its determination to provide its assistance. This case can be regarded as an example of good practice as far as the swift reaction to a crisis situation is concerned.

The Commission informed the British authorities that it would facilitate and encourage use of the structural funds to remedy the crisis brought about by the Rover bankruptcy. Representatives of the West Midlands authorities and the Commission met in Birmingham and Brussels to examine the support measures that could be envisaged.

Action to help the employees made redundant began almost immediately with the Jobcentre Plus programme, followed by the Learning Skills Councils, which receive support from the European Social Fund (ESF).

The planned contribution from the structural funds (ERDF and ESF) with a view to confronting the crisis generated by the bankruptcy of Rover: 74.5 million Euros, of which 46 million from the ESF and 28.5 million from the ERDF. The resources released to react to the collapse of Rover correspond to adjustments to the existing programmes. The final decisions on the figures will be confirmed by the authorities of these programmes in July 2005.

The breakdown of this aid of 74.5 million Euros is as follows:

- 38.5 million Euros under Objective 2 (of which 10 million from the ESF) allocated to:

* the establishment of a system of wage subsidies for skilled workers, aimed at compensating the employer for loss of productivity during the period for training the employees recruited;

* the creation of an ESF loan fund intended to help employees over 50 who have been made redundant.

- 36 million Euros under Objective 3 (ESF only) allocated to:

* emergency measures to help in the search for jobs: so far, all ESF action has concerned the holding of preliminary talks, the formulation of individual training plans and the introduction of training courses. The training stage is to continue until October 2005.

The refocusing of programmes following the Rover bankruptcy will have repercussions going beyond the crisis itself and will contribute towards diversifying the region’s economic structure, bolstering its competitiveness and responding to the shortages and needs of the labour market in other business sectors such as the building industry.

Before Rover, other car manufacturers (Ford, which owns Jaguar and Land Rover, and Peugeot) had also announced redundancies. This means that in the space of a few months a third of all people directly employed in the British automobile sector have lost their jobs. The regions of the West Midlands and the City of Birmingham are those which have been hardest hit.

B - THE STRUCTURAL FUNDSHOW DO THEY WORK?

Implementation of the Structural Funds is carried out in five stages:

1. programming of aid2. partnership between the parties concerned3. additionality of European aid in relation to national subsidies,4. management, follow-up and evaluation of the use of the Funds5. payments and financial controls.

1. PROGRAMMING

The programming consists in formulating multiannual development programmes. In the first stage, development and conversion plans are presented by the Member States. They are based on national and regional priorities and comprise:

- a precise description of the region’s current situation (disparities, backwardness, development potential);- a description of the most appropriate strategy to attain the set objectives;- indications as to the use and type of financial contribution from the Funds envisaged.

The Member States then present programming documents to the Commission setting out the general guidelines of the European Executive. These programming documents, which it is very important for users of this Guide to examine, are in the form of :

■ Community Support Frameworks set out in Operational Programmes: approved by the Commission in agreement with the Member State concerned, they contain the strategy and action priorities of the funds and of the Member State, their specific objectives, the contribution from the funds and other financial resources (Community Support Frameworks and Operational Programmes in general for Objective 1). ■ Single programming documents (SPDs): consisting of a single document, approved by the Commission and bringing together the elements contained in a Community support framework and in an operational programme (SPDs for Objective 2 and possibly Objective 1 in the case of programming below 1 billion Euros). The Objective 3 SPDs can be consulted country by country in the “Practical Information” part of this Guide.

The nature of the programming documents concerning Objective 3 is left to the regions and Member States.

The Commission negotiates with the Member States on the basis of these documents and effects an indicative allocation of funds for each intervention and for each Member State.

NB: In contacts with the local authorities, it is important to examine these documents carefully to ensure that they include relevant headings, priorities or measures with reference to the industrial project that you intend to present.

2. PARTNERSHIP

In addition to the Member States and the Commission, the partnership approach also involves the regional and local authorities, the economic and social partners and other competent bodies. It brings in the partners at every stage once the development plan is approved.

3. ADDITIONALITY

European aid supplements national aid. It is not intended to replace it. Which means that for each Objective the Member States must keep their public expenditure at least at the same level as in the previous period.

4. MANAGEMENT, FOLLOW-UP AND EVALUATION

The Member States designate a managing authority for each programme which is responsible for supervising the implementation, compliance, management and effectiveness of the programme. In concrete terms, this involves collecting statistical and financial data, preparing annual implementation reports and submitting them to the Commission and organising the mid-term evaluation. In addition, under the responsibility of the Member States, monitoring committees are set up, chaired by a representative of the managing authority. Their responsibility is to ensure the effectiveness and quality of implementation of the structural actions.

The evaluation is carried out in three stages:

- ex ante, which is the responsibility of the competent authorities of the Member States- mid-term, which is the task of the managing authority, - ex post, which is the responsibility of the European Commission, in collaboration with the Member State and the

managing authority.

The evaluation reports are made available to the public.

5. PAYMENTS AND FINANCIAL CONTROLS

- The Member States and the Commission sign a financial contract in which the Commission undertakes to pay annual commitment appropriations on the basis of the programming documents that have been adopted.

- For each programme, every Member State designates a paying authority which acts as the intermediary between the final beneficiaries and the Commission.

Reimbursement of the expenses incurred is on the basis of real costs (and not flat-rate amounts). Funds must therefore be disbursed.

NB: Verification: The control mechanisms are the responsibility of the Member States. The Commission itself ensures the efficiency of the systems introduced, which depend on the managing and paying authorities. 5% of programme expenditure must be verified in detail through, for instance, on-the-spot checks and financial audits.

European rural development policy is aimed particularly at rural areas affected by problems arising from structural changes such as declining employment in the agricultural sector. It is implemented via:

1. support for rural development2. the Leader+ initiative

1. SUPPORT FOR RURAL DEVELOPMENT[return industrial scenarios]

Eligible rural development measures are placed in two groups:

- Accompanying measures under the 1992 reform: early retirement, agro-environmental measures and forestation, and the system concerning less-favoured areas.

- Measures for the modernisation and diversification of farms: farm investment, setting up young farmers, training, support for investments in processing and marketing installations, supplementary aid for forestry activities, promotion and conversion of agriculture.

Two aspects could be relevant within the context of the reform of the sugar regime: “support for investments in processing and marketing installations” and “promotion and conversion of agriculture”.

■ FINANCING

Between 4,300 and 4,370 millions Euros are being granted annually to rural development and accompanying measures during the period 2000-2006 (via the EAGGF -guarantee or guidance).

■ GEOGRAPHICAL COVER AND PROGRAMMING

These rural development programmes are based on plans prepared by the Member States at the most appropriate geographical level for a period of seven years (2000-2006). These contain a description of: the present rural situation, the proposed strategy, the expected impact, the financial planning, the measures envisaged, including agro-environmental measures, the necessary studies and technical measures, the authorities responsible and the provisions allowing effective implementation of the plan.

2. LEADER+ (2000-2006)[return to industrial scenarios]

Leader+:

- encourages implementation of original integrated strategies with a view to sustainable rural development

- places the accent on partnership at local level and encourages the creation of networks of rural territories.

All rural territories are eligible for Leader+, but it should be pointed out straight away that the budget for Community initiatives is only a small percentage of that for the structural funds as a whole. Furthermore, these initiatives operate through national calls for proposals.

The beneficiaries of the Leader+ financial competition are “Local Action Groups” (LAGs) in charge of the development strategy for their territory and responsible for its implementation on the basis of a specific development plan. They establish a local partnership and comprise a number of players from the different socio-economic circles on the territory concerned. In this respect, the economic and social partners and the associations must represent at least 50% of the local partnership.

■ OBJECTIVES

- Making optimum use of the specific resources of a rural territory within the framework of a relevant development strategy adapted to the local context.

- Encouraging the rural players to reflect on the development potential of their territory from a more long-term perspective. The local players implement the original strategy that they themselves have developed. They thus experiment with new ways of:• utilising the natural and cultural heritage,• strengthening the economic environment to create jobs,• improving the community’s organisational capacity.

Cooperation is a central factor in Leader+: among territories of the same Member State, among territories of several Member States and even beyond if appropriate. In addition, an important task to be carried out within networks is enhancing and disseminating the new development models that prove to be relevant.

■ THE THREE SECTIONS OF LEADER+

Section 1 – Territorial rural development strategies, integrated and of a pilot nature via a development plan based on a representative partnership and centred on a theme that is very characteristic of the territory’s identity.

Section 2 – Support for cooperation among rural territories: the financial support concerns both upstream expenditure by way of technical assistance for cooperation and joint action properly speaking. Only rural territories selected for Section 1 of the Initiative are eligible for Section 2, which supports cooperation among rural territories.

Section 3 - networking. The exchange of know-how, experiences and information on achievements in the field of rural development is a priority of Leader +.

■ FINANCIAL PROVISIONS

Budget for 2000-2006: 2,020 million Euros.

Cofinancing can be established for all expenditure linked to participation in the networks, organisation, information, management, follow-up and evaluation of the programme.

With the exception of small-scale projects, investments in infrastructure and production investments for a unit amount above a certain ceiling are not eligible.

The levels of Community contributions to interventions apply. In particular, the contribution from the EAGGF “guidance” section is a maximum of 75 % of the total eligible cost in territories covered by Objective 1 and 50% for those outside this zone.

IV – THE STRUCTURAL FUNDS IN AN ENLARGED EUROPE (PROGRAMMING 2007-2013)

In the coming years, the structural funds are going to be adapted to the new situation created by enlargement of the European Union to 25 Member States. The Union’s action must be concentrated on priority development problems. This adaptation will take account of the political decisions reached regarding the Union’s budget perspectives for the period 2007-2013.

The following are the broad lines of the reform of the structural funds

as presented by the Commission

1. THE COMMISSION’S POLITICAL PRIORITIES AND THEIR POTENTIAL INTEREST FOR THE SUGAR SECTOR

Among the political priorities announced by the European Commission, we should mention the question of economic restructurings, their impact on rural areas and the opening-up of trade, coinciding with the problems of the reform of the sugar regime. It seems important to underline this, particularly in the formulation of national and European strategies for the players in the sugar sector.

Thus, in its Communication of July 5th 2005 entitled “Cohesion policy in support of growth and jobs". Community strategic guidelines 2007-2013” (COM (2005) 299), the Commission underlines that:

- (page 26) “Better anticipation and positive management of economic restructuring, especially as a result of changes linked to the opening-up of trade, are particularly important. Consideration should be given to creating monitoring systems involving the social partners, enterprises and local communities, to scrutinising socio-economic changes at national, regional and local level, and assessing future economic and labour market trends. Support for the programmes aimed at modernisation of labour markets and anticipation of gradual changes throughout the Union in sectors such as agriculture, textiles and automobiles needs to be put in place, alongside active measures to reinforce the economic well-being of regions. There is also a role for specific employment, training and support services for workers in the context of company and sector restructuring, such as rapid response schemes in the case of collective lay-offs.

- (page 30): “Cohesion policy can also play a key role in support of the economic regeneration of rural areas, complementing the actions supported by the new rural development fund (European Agricultural Fund for Rural Development - EAFRD). The synergy between structural, employment and rural development policies needs to be encouraged. In this context, Member States should ensure complementarity and coherence between actions to be financed by the ERDF, Cohesion Fund, ESF, EFF and EAFRD on a given territory and in a given field of activity. The main guiding principles as regards the demarcation line and the coordination mechanisms between actions supported by the different Funds should be defined at the level of national strategic reference framework/national strategy plan. For cohesion policy, action in favour of rural areas should contribute to ensuring a minimum level of access to services of general economic interest with a view to improving conditions in rural areas that is needed in order to attract firms and qualified personnel and to limit out-migration. Connectivity to the main national and European networks is also necessary. In addition, cohesion policy should support the endogenous capacity of rural territories by promoting, for example, product marketing at national and global level, and favouring process and product innovation in existing economic activities.

A few explanations

According to the Commission, the European cohesion budgets for 2007-2013 should be devoted as a priority to three main objectives:

making Europe a more attractive place for investments and employment, improving knowledge and innovation as growth factors, promoting more jobs of better quality.

These approaches involve special attention to territorial cohesion and cooperation. They also entail the contribution by cities to growth and employment, support economic diversification of rural areas and strengthen cross-border, transnational and interregional cooperation.

3. THREE NEW OBJECTIVES

Henceforth, the three new objectives of the structural funds will be centred on: - convergence: for the regions and Members States eligible for this new objective, the aim will be to stimulate

growth potential in order to maintain and raise growth levels. This will be done through investments, and the development of collective services and basic infrastructures. The objective is also to increase investments in human capital, to improve access to employment, to reinforce social inclusion and to introduce and implement reforms concerning education and training systems.

- Regional competitiveness and employment: here it is a question of anticipating and promoting economic changes by the following means: by improving the competitiveness and attractiveness of EU regions through investments in the knowledge economy, entrepreneurship, research, university-enterprise cooperation and innovation; access to transport and telecommunication infrastructure, energy, and health; environment and risk prevention; supporting the adaptability of workers and enterprises; reinforcing participation in the labour market; and promoting social inclusion and sustainable communities. This objective concerns in particular industrial regions, areas with a low population density and rural areas.

- European territorial cooperation : this new objective aims to promote greater integration of the Union’s territory in its economic, social and cultural dimensions. In so doing, cohesion policy supports the balanced and sustainable development of the territory of the Union at the level of its macro-regions and reduces the “barrier effects” through cross-border cooperation and the exchange of best practices. These actions are based on shared development strategies of the territories concerned (national, regional, local) and on the networking of the key stakeholders.

It should be noted in particular that the regions in the new Objective 2 will henceforth be determined directly by the national authorities, without any intervention by the Commission.

Furthermore, all the Community initiatives will be grouped together within a single programme, called “Progress“. As for Leader, this will group together all rural development.

For information, the European Commission has launched a public consultation aimed at helping to formulate the strategic guidelines for 2007-2013 for the cohesion policy. Finally, the Commission envisages a reform of the EAGGF, which would become the EAFRD (European Agricultural Fund for Rural Development).

4. REFORM OF THE EAGGF: TOWARDS THE EAFRD

In July 2005, the “Agriculture” Council reached a political agreement on a regulation concerning support for rural development through the European Agricultural Fund for Rural Development during the next programming period (2007-2013).

The new rural development policy takes account of the innovation and restructuring needs of the agriculture and forestry sectors. It promotes protection of the environment and aims to offer rural areas new possibilities by creating more jobs there. It is also simpler, because it plans to incorporate the numerous programmes and financial instruments within the same mechanism.

To be noted that the British compromise on the reform of the sugar regime refers to the EAFRD within the framework of regional diversification and particularly axes 1 and 3 of Regulation 1698/2005 of the 20 September 2005 on support for rural development by the EAFRD (OJ L 277 of the 21 October 2005).

■ MAIN CHARACTERISTICS OF THE NEW RURAL DEVELOPMENT POLICY

- a single financing and programming instrument: the European Agricultural Fund for Rural Development (EAFRD);- a new rural development strategy based on EU priorities;- strengthening of controls and evaluation, better communication of the results and a clearer allocation of responsibilities

between the Member States and the Commission;- a so-called “bottom-up” approach, i.e. starting from the basics and leaving more latitude to the Member States, regions

and local action groups to adjust the programmes in line with local needs.

■ THE FOUR MAJOR OBJECTIVES

Objective 1: Improving the competitiveness of agriculture and forestry

A minimum of 10% of the national appropriation must be devoted to priority objective 1. The rate of Community cofinancing is fixed at a maximum of 50% (75% in the convergence regions).

Objective 2: The environment and rural space

A minimum of 25% of the national appropriation must be devoted to priority objective 2.. The rate of Community cofinancing is fixed at a maximum of 55% (80% in the convergence regions).

Objective 3: Improving the quality of life in rural areas and diversification of the rural economy diversification into non-agricultural activities; support for the creation of microenterprises.

A minimum of 10% of the national appropriation must be devoted to priority objective 3.. The rate of Community cofinancing is fixed at a maximum of 50% (75% in the convergence regions).

Objective 4: the LEADER approach

Every programme must contain a LEADER element for implementation of the development strategies of the local action groups formulated according to the bottom-up approach. A minimum of 5% of the funds intended for national programmes is reserved for LEADER.

VI – LEXICON OF COMMUNITY JARGON [return to Table of contents]

Community Initiatives: specific programmes for the European Union’s structural policy which the Commission proposes on its own initiative to the Member States. These initiatives aim to support actions helping to resolve problems having a particular effect at European level. Main characteristics:- support for the development of transnational and interregional cooperation;- “bottom-up” implementation method;- visibility of Community action in the field. The Community initiatives supplement the Community Support Frameworks and the Single Programming Documents.

Community support frameworks: contain the strategy and action priorities of the Funds and the Member State, their specific objectives, the contribution from the Funds and the other financial resources.

EAFRD: see European Agricultural Fund for Rural Development

EAGGF: see European Agricultural Guidance and Guarantee Fund

EQUAL: Community initiative in the service of the European Strategy for employment and the social inclusion programme. Its purpose is to promote a more inclusive working life by combating discrimination and exclusion based on sex, racial or ethnic origin, religion or beliefs, handicaps, age or sexual orientation.

Eligible regions Objective (...): are regions which can apply for Community aid by reason of their economic and social characteristics. This aid is in fact conditional upon certain criteria (e.g. level of GDP, region in industrial decline, etc.). When the region meets these criteria, it is said to be “eligible” for aid under the Objective in question (see also: Total eligible cost).

ERDF: see European Regional Development Fund

ESF: see European Social Fund.

European Agricultural Fund for Rural Development : created on 20 September 2005, this new structural fund contributes towards the promotion of “sustainable rural development” throughout the Community, supplementing the market and income support policies applied under the common agricultural policy, the cohesion policy and the common fisheries policy. Its three main objectives are “improving the competitiveness of agriculture and forestry by means of support for restructuring, development and innovation; improving the environment and the countryside by means of support for land management; improving the quality of life in rural areas and encouraging diversification of economic activity”.

European Agricultural Guidance and Guarantee Fund: the EAGGF is divided into two sections: the “guidance” section and the “guarantee” section. The “guidance” section contributes to the development of the rural sector in general, by granting aid to agriculture in the form of cofinancing (modernisation of agricultural structures, setting up young farmers, agriculture in mountain areas and in less-favoured areas). The “guidance” section also finances programmes to reduce production surpluses, to promote non-agricultural uses of arable land, to improve the processing and marketing of agricultural and forestry products, to promote local products, to conserve the rural heritage, etc. For

its part, the “guidance” EAGGF finances the expenses of agricultural common market organisations: refunds on exports to third countries and interventions aimed at regularising agricultural markets

European Regional Development Fund: contributes to pursuance of the following objectives of European social policy: economic adaptation of regions lagging behind in development, economic conversion of areas affected by industrial decline and economic diversification of regions experiencing structural difficulties.

European Social Fund: set up by the Treaty of Rome “in order to improve the possibilities of employment for workers within the internal market and thus contribute towards raising living standards”. The purposes of this Fund are to “promote employment facilities and geographical and occupational mobility of workers within the Community” and to “facilitate adaptation to industrial changes and the evolution of production systems, particularly through vocational training and retraining”.

FIFG: FIFG forms part of the present Structural Funds of the European Union. It constitutes a framework for Community interventions for structural purposes in the fisheries and aquaculture sector and in the processing and marketing of its products. Its objective is therefore to accompany the restructuring of the fisheries sector.

INTERREG: is a “Community Initiative” with the objective of developing transborder cooperation and helping the European Union’s internal and external frontier zones to overcome the specific problems arising from their relative isolation in the domestic economies and in the Union as a whole.

Managing authority: designated by the Member States and responsible for the implementation, management consistency and efficiency of the programming of the structural funds in the State concerned.

Monitoring committees: chaired by a representative of the managing authority. They are responsible for ensuring the effectiveness and quality of implementation of structural actions in the Member State.

Operational programmes: requests for Community financing presented by the Member State and approved by the Commission. They define a whole series of measures aimed at implementing the priorities established in the Community Support Framework or the Single Programming Document.

Single programming documents: approved by the Commission and grouping together the elements contained in a Community support framework and in an operational programme.

Structural Funds: the European Commission has four financial instruments to strengthen the economic and social cohesion of the Community, called the “Structural Funds”: European Social Fund, European Agricultural Guidance and Guarantee Fund, European Regional Development Fund, and Financial Instrument for Fishery Guidance.

Total eligible cost: the eligibility rules are complicated. It would take too long to detail them here, so we advise the reader to consult these rules. Very concisely, we would say that it must be a question of expenditure actually incurred; co-financing from the structural funds cannot be sought for interest charges, exchange costs and other financial expenses; the purchase of second-hand equipment, vacant lots and other land may be eligible on certain conditions; taxes or charges resulting from co-financing from the structural funds are not eligible unless they have really been borne by the final beneficiary, etc. It will be recalled that Objective 1 can only cover 75% maximum of the total eligible cost and, in general, 50% of eligible public expenditure. Objectives 2 and 3 can only cover 50% maximum of the total eligible cost and, in general, 25% of eligible public expenditure.

URBAN: a Community Initiative aimed at contributing towards the search for solutions to the societal problem of the crisis of numerous urban districts, by supporting actions for economic and social revitalisation, renovation of infrastructures and facilities and improvements to the environment.
