NEW BUSINESS 7. a) Presentation - Lawn Bowling Dave Mathie from the Juan de Fuca Lawn Bowling Club was on hand to present a cheque to WSPR as a token of their commitment to keep the legacy of the Commonwealth Games Facility alive by assisting with the upkeep of the bowling greens. Mr. Mathie noted that in 2009 they will be hosting the Canadian National Lawn Bowling ; Championships at JdF and we hope to show the rest of Canada that we have the beat greens In Canada. We will need the help and support of WSPR with this huge undertalcilig. and wish to meet with your Administrator at a later date to discuss this important event.. Mr. Mathie thanked Karen Frost for all her help with the Clubhouse and any issues that have arisen during the year and he also thanked the Greenskeepers for their hard work in maintaining the bowling greens. The Manager, Human Resources presented the staffing report dated November 12, 2008 forthe period of October 1 - November 12, 2008.

b) Administrator 's ReportThe Administrator presented the staffing report dated November 13, 2008 and noted that asthe cold and wet weather descends again we find ourselves struggling with"aging-einfrastructure and related issues such as leaking roofs , buckling arena floor and-rats ! All themore reason we are counting on support for the updating and retrofitting of the JdF Centre inthe upcoming budget.

On a more positive note, staff have been doing a wonderful job&l^h the United Way kick off.The goal this year is to reach $4,700 with staff donations and payroll deductions, and we arewell on our way to this goal.

tOther events included:-On November 26t", West Shore Parks and Recreatipn Will be recognized by the CanadianCancer Society for its participation in a pilot project, to help employees quit smoking in the"Quit to Win" program. .

-In October, staff also enjoyed an evening ofr"Night Golf" organized by the WellnessCommittee.

-Administration had a meeting with oui insurance broker from Aon Reed Stenhouse this monthin order to clarify the numerous polijesrthat we hold.

-Some time has been spent gveFrthe,pest few weeks working with Langford Parks staff toassess the viability of develbpingja bid for a BC Summer Games proposal for the years 2012or 2014. At this time, there dbesmot seem to be an Interest from those other municipalities.

-Langford Parks had the Grand'Opening of their new artificial turf field and West Shore Parksand Recreation loaned them some bleachers until theirs arrive In the near future.

-The completion of tK6,,2009 Budget and presentation to the Finance Committee was a timeconsuming proje toitmonth. All staff are to be commended for their extremely cooperativeand helpful It tti to the new budget system and their support to Administration.

-Praise is a sd4tTe to our Food and Beverage department staff who have had to assumeresponsj: ility, f& the department during the absence of the Coordinator and AssistantCoordin tor:'

-Thee gjea hyrFoods Initiative continues to be an exciting new project that will soon transformthe'd&'concession into a healthier environment with a new atmosphere . We have had

. wonderful support from the community for this change and hope to highlight our project asthe way of the future".

-An exciting event for Bear Mountain Arena this month was the hosting of the InternationalCongress and Convention Centre Association which highlighted Victoria as a conventiondestination to delegates from around the world . The Bear was transformed into a gorgeouswinter wonderland and we received many compliments on the helpfulness of maintenancestaff in the transformation.

-Centennial Centre was the site of a lovely "Chili Chow Down" hosted by the CommunityDevelopment section to introduce staff to the newly spruced up Centre. A wonderful mural by

local artist, Kyle Peppier has been completed In the preschool area, and fresh paint, furnitureand accessories make it an extremely welcoming space for additional community programs.

-The bathroom renovations are underway upstairs (beside the lounge). Linda thanks the Mtce.Crew for their outstanding work and noted that the new washrooms will be the trademarkstandard for the West Shore.

-As a closing comment, I would like to thank the out going members of the West Shore Parksand Recreation Society Board for their dedication to the recreational needs of this comra)unity,and their personal support of staff and administration. Your contributions make this a'L,eryspecial place to work, and we are all grateful for your volunteer time.

1. CALL TO ORDER - CHIEF ADMINISTRATIVE OFFICER

Mr. Kelly Daniels, Chief Administrative Officer, called the meeting to order at 1:32 p.m. andwelcomed Directors, both new and returning. It was noted that the first regular meeting of theBoard in 2009 will be on January 14'".

2. OATHS OF OFFICE AND ALLEGIANCE

Oaths of Office and Allegiance were taken by Directors.

3. ELECTION OF CHAIR OF THE BOARD (pursuant to Section 792 of the LocalGovernment Act)

Mr. Daniels called for nominations for the position of Chair of the Capital Regional DistrictBoard for 2009. He noted that only one nominator is required and no seconder is necessary.

Director Causton nominated Director Brice.

Director Brice accepted.

Director Hill nominated Director Young.

Director Young accepted.

Mr. Daniels called for nominations a second and third time and hearing none declarednominations closed. Both nominees spoke to their nominations. Ballots were distributed,collected and counted by Ms. Thiel and Ms. Norton.

Following the counting of ballots, Mr. Daniels declared Director Young Chair of the Board for2009.

Chair Young assumed the Chair.

Chair Young called for nominations for the position of Vice Chair of the Board for 2009.

Director Derman nominated Director Hill.

Director Blackwell declined.

Chair Young called for nominations a third time and hearing none declared nominationsclosed.

The Chair declared Director Hill Vice Chair of the Board for 2009 by acclamation.

5. SCHEDULE OF REGULAR BOARD MEETINGS

MOVED by Director Brownoff, SECONDED by Director Hill,that the regular Board meetings for 2009 be scheduled on the secondWednesday of each month.

During discussion Director Causton asked if consideration could be given to going back to twoBoard meetings each month , on the second and fourth Wednesdays.

The Chair agreed to be guided by the Board and to ask staff to provide comment on probablelength of meetings and business that is facing the Board.

MOVED by Director Causton, SECONDED by Director Ranns,that the motion be amended to the effect that the Board accept the initialschedule up to the end of January , 2009 , with the proviso that the issue of thenumber of meetings per month will be on the agenda for the January 1emeeting.

MOVED by Director Blackwell, SECONDED by Director Brice,that the draft progress report on the Core Area and West Shore wastewatertreatment project be approved and forwarded to the Minister of Environment.

During debate, the following points were made:• the report does not address a blank sheet approach with respect to the best

architecture or fundamental design, but makes the assumption that the existing systemarchitecture is the best way to go; comparative studies have not been done;

• not enough study has been done on alternatives and there should be informationincluded on integrated management resource and status of reports regardingMcLaughlin vs. Macaulay;

Mr. Kalynchuk commented that substantial Information will be provided to the Core AreaLiquid Waste Management Committee over the next several months , including reports onIntegrated resource management , the tanker farm site, and investigation of the systemconfiguration . He noted that there will be a briefing for the Core LWM Committee at aworkshop on Dec . 17th from 9 - Noon . Draft peer review questions will be provided to theCommittee prior to a January meeting and feedback is welcome on those questions. Mr.Kalynchuk emphasized that the progress report to the Minister is Intended to provide thestatus on what has been done and decisions made to date and is due by December 31°1.

The Chair Indicated that committee members may want to put forward questions for thepeer review process which address matters of concern.

"and that a letter of transmittal be attached to this report that clearly sets out thenewness of some members and our interests that may materially alter some ofthe components and the foundations of this report."

That Council

1. Direct staff to prepare a bylaw to amend the zoning of the subject property at 3458 HappyValley Road from AG1 (Agriculture 1) to R2A (One and Two Family Residential A), RS3(Residential Small Lot 3) and RM3A (Apartment A) subject to the following terms andconditions:

a)That the owner agrees to provide as a bonus for increased density on that portion ofthe subject property designated for single-family residential development, the followingcontributions per lot at the time of subdivision:

i) $2,500 toward the General Amenity Reserve Fund;

ii) $2,500 toward the City Park Reserve Fund;

facade oriented towards Happy Valley Road (i.e. front door entranceway.gables , substantial window area , all culminating in an attractive, interestingfacade); and

it) A comprehensive riparian area assessment report by the project biologistconfirming trail location , construction and connection to the Galloping GooseRegional Trail, work relating to the alteration of the creek, and a riparianreplanting scheme;

e) That the applicant provide a Section 219 Covenant, prior to bylaw adoption, thatagrees to the following:

I) That prior to subdivision approval, the owner dedicates ( as amenity land) to theCity of Langford, the 752m2 (8,094ftz) of SPEA along the total length of thesouthern lot line, to establish a public trail and to preserve the green space;

ii) That prior to subdivision approval, the owner dedicates to the City of Langfordthe 10% amenity land dedication as shown on the plans attached;

iii) That prior to subdivision approval, the owner construct a trail to municipalstandards (including fencing on both sides of the trail) in the SPEA along thesouthern property line connecting the future sidewalk on Happy Valley Road toconnect to the Galloping Goose Trail and work is to be done in consultationwith, and to be supervised by, the project biologist at the owner's expense;

iv) That the owner agrees to construct the residential dwellings on Lots 1-6 insubstantial conformance to the plans presented at Public Hearing, to thesatisfaction of the City Planner;

v) That the property owner provide full frontage improvements along Happy ValleyRoad to Subdivision and Servicing Bylaw No. 500 standards, to the satisfactionof the City Engineer prior to subdivision approval;

vi) That the property owner construct cul-de-sac improvements on the adjacentproperty to the north;

vii)That the owner provides a 5 meter wide road dedication along the entire HappyValley Road frontage, to be dedicated to the City of Langford prior tosubdivision approval;

viii) Register a nuisance easement on title to allow for legal noise nuisance fromSouth Vancouver Island Rangers, and general nuisance associated withneighbouring agricultural uses;

ix) That the underside of the floor system of any area used for habitation or storagewill be 0.6 in above flood elevation, as required by Sec. 3.16 of Zoning BylawNo. 300; and

x) Full servicing (sewerldrain/water) to 3450 Happy Valley Road (Lot 10, PID No.026-908-484, VIP82261) in the adjoining development to the north inaccordance with the standards of Subdivision and Servicing Bylaw No. 500, andto the satisfaction of the City Engineer as a condition of subdivision.

2. That staff be directed to investigate the viability of a crosswalk at Happy Valley Road andFlatman Avenue,

g) That the applicant provide a tree retention plan prepared by a qualified arborist, prior topublic hearing, showing which trees maybe retained post-development, and the impactof removing trees that cannot be retained post-development;

h) Direct staff to draft a bylaw to amend Zoning Bylaw No. 300 to designate all dwellingunits with accessory detached dwelling units as intensive residential development;

i) That Council consider a variance for the requirement that the applicant provide asidewalk as part of the frontage improvements:

j) That the applicant provide, prior to bylaw adoption, a Section 219 covenant, registered inpriority over all other charges on title, that agrees to the following:

I. That no secondary dwellings in detached accessory buildings are to be built untilthe City has adopted form and character design guidelines for this type ofbuilding;

ii. That the applicant provide a nuisance easement in favour of the SouthVancouver Island Rangers property;

In 2008 the City received subdivision applications to create 297 new lots and gave approval forregistration of 123 new lots.

There has been a significant increase in Subdivision applications in 2008 (over 2007), howeverapprovals have decreased slightly which may be a result of the difficulty in securing trades (ie.Carpenters I plumbers ) during the majority of 2008. For the 4" quarter of 2008, there is a smalldrop in both applications and approvals, likely a result of poor market conditions brought aboutby the economic recession and difficulty in borrowing. In 2008, the north side of the Highwaymoratorium on rezoning remained.

For up-coming years , it is anticipated that as the Spencer Road Interchange progresses, thatthe area north of the highway may be reconsidered for increased density through rezoning, andsubdivision applications will increase ; in South Langford, consultants are working to a new astorm drainage plan (update to the DCC program to accompany in 2009), and work with theMinistry of Highways as it relates to the Sooke Road Corridor, Happy Valley intersection, andWalfred Road are nearing completion. As these processes complete , it will allow severalprojects that have been on-hold to proceed.

Due to widely fluctuating market conditions as a result of the global economy , the City may seea stabilization of subdivision applications for the following reasons:

Possible causes of Increases;1. Large projects may, due to the length of construction required , remain active to take

advantage of lessening trade wages;2. The City may propose Economic incentives to ensure work is continuing;3. Adoption of the South Langford Neighbourhood Plan (and completion of the drainage

study);4. Continued installation of municipal sewers North of the Trans Canada Highway;5. The Spencer Road Interchange project under construction improving access North of

the Highway;6. Ongoing subdivision applications in the Bear Mountain development (now possible due

to the Spencer Road Interchange);7. Skirt Mountain Rezoning;8. Near completion of the Route 14a Corridor study (Sooke Road ), which encompasses

Walfred Road and Happy Valley;

Possible causes of decrease;9. The above will be balanced with the ability to borrow and financial institutions confidence

to lend.10. Consumers ability to buy

It should be noted that the number of lots that were applied for in 2008 exceeded the number oflots registered (created ) in 2008 , so there is a back-log of lots pending.

Areas of Probable Subdivision Activity for 2009

Bear Mountain and potentially Westhills (which experienced a minor slow -down as 2008completed) continue to be the largest area of subdivision activity , however , the adoption of theSouth Langford Neighbourhood Plan and the availability of large parcels of land in the HappyValley region , and the finalization of the Bear Mountain Interchange opening up lands fordevelopment West of Florence Lake and between the TCH and Bear Mountain (Skirt Mountain)will ensure activity is spread around the City.

Installation of municipal sewers in the SetchfieldlTreanor area continues to allow severalmoderate sized subdivisions of lands that were previously used as septic fields.

Other areas of possible activity may be the Walfred Road area and south Happy Valley.

Subject: Community Action on Energy and Emissions Grant Application

A Community Action on Energy and Emissions (CAEE) Grant is available through the FraserBasin Council to fund the development of a Transportation Demand Management Plan.Establishing a Transportation Demand Management Plan, which would be lead by Langford'sGreen Transportation Plan, is a goal embodied in the Langford's Official Community Plan and aCAEE target.

The Community Action on Energy and Emissions (CAEE) Grant is a good opportunity for theCity to get funding for a sustainability initiative that couldn't otherwise be funded within the 2009Budget, and to financially support sustainability activities that are already being pursued by theCity. The CAEE grant application would need Council's endorsement in order to be given anyconsideration by the Fraser Basin Council.

Council may wish to direct staff to complete a CAEE grant application process to takeadvantage of this opportunity, and to direct staff to complete the Green Transportation Plan by2010, which has as its primary goal the encouragement of community-wide energy andemissions reductions.

As part of the application, the City is obliged to select specific CAEE targets for energy andemissions reductions. This summary of CAEE targets is attached.

Council may wish to adopt the following target within the CAEE grant application process:

> Implement a community-wide Transportation Demand Management Plan by 2010

Subject: Spencer Road Interchange Variance Request to Noise and Truck RouteBylaws

Background

In order to construct the Spencer Road Interchange there is a need to erect the bridge girders(the part of the bridge that will support the bridge deck) spanning both bridge abutments acrossthe Trans Canada Highway . The nature of the installation requires several large cranes andcomplete closure of all lanes of the Trans Canada Highway at the Spencer Road Interchange.

The work is scheduled to take place on two nights as follows:

Thursday, January 29'" starting at 21: 00 and ending at 05:30 Friday, January 300; as well asThursday, February 5" starting at 21:00 and ending at 05:30 Friday, February 6".

The bridge girders will be arriving by BC Ferry and will be transported via pre-approved routessupervised by the bridge contractor (Knappett Projects Inc.). The girders will be stored on theroadside until the erection activities begin on the two scheduled nights.

Commentary

The contractor has scheduled the bridge girder work over two nights in order to minimizedisruption to the traffic flow. The original schedule was proposed to extend over four to fivenights.

The Trans Canada Highway will require closure from the intersection of Spencer Road and theTrans Canada Highway to the eastern-most extent of Goldstream Road (where Goldstreammeets the Trans Canada Highway). Traffic will be re-routed down Spencer Road to Goldstreamand west on Goldstream to meet the Trans Canada Highway. The current barriers across theend of Goldstream Road will be removed and the road will be widened to allow proper trafficflow. Proper traffic flow diagrams including instructions on setting appropriate temporarydiversions on the Trans Canada Highway were prepared by Boulevard Transportation Groupand provided to Knappett Projects Inc, in consultation with the Ministry of Transportation.

Notification of the traffic diversion will be sent to the appropriate local authorities, includingemergency services and the local news groups (Goldstream Gazette and Times Colonist).Electronic signs will be erected on the Trans Canada in both the east and westbound directionswell in advance of these closures to forewarn travelers. Notification will also be posted on theCity of Langford website.

In addition to the road closure and diversion, temporary variances to the Noise Bylaw and theTruck Route Bylaw are required for the two work nights.

Variances to the Noise Bylaw have a precedent and they have been granted in the past. Avariance to the Noise Bylaw was issued for this project in June 2008 to undertake supply andequipment mobilization by prior approval of council. We anticipate that the noises that may begenerated during bridge girder erection will be associated with back-up beepers on equipmentand/or placement of the girders and will primarily be limited to the work area immediatelysurrounding the bridge.

A temporary variance to the Truck Route Bylaw is required in order that larger trucks cancontinue on Goldstream from Spencer Road to make left hand turns at Veterans MemorialParkway to return to the Trans Canada Highway. The current turning radius at Goldstream andSpencer Roads is not sufficient to safely allow larger trucks to turn left up Spencer Road toreturn to the highway. Trucks heading eastbound can make the right hand turn from SpencerRoad onto Goldstream to continue along Goldstream and return to the Trans Canada Highwayso a variance is not required there.

In summary, the temporary bylaw variances for this project are as follows:

Variance to the Noise Bylaw for the two night shifts beginning 21:00 on the night of January29" to 05 : 30 on the morning of January 301" and again from 21:00 on the night of February5"' to 05: 30 the morning of February 6'

Variance to the Truck Route Bylaw to allow larger trucks to access the intersection atGoldstream Road and Veteran's Memorial Parkway for the same time period as the NoiseBylaw

Upon approval of the variance a letter would be given out to the residents of Savory Roadwho are the closest to the work area and who will be directed through a temporary detour atSpencer Road and the Trans Canada Highway as well as the service station at SpencerRoad and the Highway which may have larger fuel delivery trucks arriving on these twonights. Knappet Projects Inc. will undertake the notification per their contract.

Bylaw Enforcement Comment

The Noise Bylaw and Truck Route Bylaw are designed to regulate noise and protect allresidents from having to endure unreasonable and unwelcomed noise or disruption , especiallyat night . The work program has been condensed to two nights to minimize any potential impactsto residents.

In summary, the goal of the project is to minimize the total duration and noise exposure to theresidents.

BACKGROUND

The property located at 2894 Amy Road (an unused portion of the Amy Road right-of-way thatruns north/south between Amy Road and the Trans-Canada Highway [TCH]) has beenidentified as a potential site for a new Langford Tourism Information Center.

The procedure is as follows:PROCEDURE FOR A ROAD CLOSURE:

1. Prepare a bylaw closing the highway to all types of traffic under s.40(1). The bylaw shouldalso cancel the dedication of the land as a highway under s.40(2). =

2. The City then delivers notice of closure to utility companies Council considers will beaffected (s.40(4)) and deal with their objections if any under s.41(4). (Rights of way in favourof the City and B.C. Hydro will be required for access and services.)

3. The City shall give notice of closure and cancellation of dedication under s.94 of the Charterper s.40(3). This means posting it in the public notice posting place designated in the newprocedure bylaw, and publishing in a newspaper once each week for 2 consecutive weeks.

4. Provide opportunity for affected persons to make representations - 5.40(3).5. Obtain ministerial approval under s.41(3) if land is within 800 m of an arterial highway. If

Council is planning to hold the land and not dispose of it, we should also ask the Minister tocancel the right to resume the closed highway under s.35(8) by special order so that the Citygets clear title.

6. Adopt bylaw and deposit in LTO under s.120 of the Land Title Act, along with forms to raisetitle to the closed highway in the City's name.

FINANCIAL IMPLICATIONS

All costs for the closure will be borne by the City.

LEGAL IMPLICATIONS

The road closure bylaw and notification have been reviewed by our solicitors.

OPTIONS

That Council:

1. Instruct staff to proceed with the notification process; OR

Subject: Institution of Economic Stimulus Measures for the Planning Department

COMMENTS

Council may wish to direct staff to provide additional services within the Planning Department,lead key planning initiatives, and enact cost-reducing measures, where appropriate, in order forthis municipality to match the economic stimulus measures being considered by other levels ofgovernment.

Bylaw 209 sets out the Planning Department's Procedures and Fees. Zoning Bylaw No. 300sets out the regulations for density and land use throughout Langford. Council may wish todirect staff to write amending bylaws for both Bylaw 209 and Bylaw 300 in order to ensure thateconomic stimulus measures are fully compliant with the City's bylaws.

Council may wish to direct staff to draft a bylaw to amend Bylaw 209 in order to defer collectionof Public Hearing fees (currently at $2,800) until immediately prior to notification for PublicHearing, rather than collecting these concurrently with the initial application fee. This is a "payas you go" approach . If the application does not go to public hearing , no fees are paid and nopublic funds are expended in advertising or holding the public hearing. This initiative will savethe City the cost of processing a refund if the application does not proceed.

Council may also wish to direct staff to draft an omnibus bylaw to amend Zoning Bylaw No. 300in order to enact the following changes:

a) Elimination of the Happy Valley Corridor Study Reserve Fund and required paymenttowards this fund, with the understanding that any public works that need to occur inrelation to the upgrade to this road should be rolled into the Development Cost Chargesbylaw. Please note this will not affect collection of fees for the Happy Valley / BooksHighway intersection.

b) Crediting original parent parcel, in order to create a parallel process between thecalculation of Development Cost Charges fees and the calculation of amenity feepayments for any subdivision development.

As part of the Spencer Road Interchange project. Savory Road is being re-aligned to provide animproved intersection with the proposed extension of Brock Avenue , adjacent to the TCH. As part of the design process , currentlynearing completion , it was recognized that the 'best' configuration for the Savory Road accessto Brock Avenue was to re-align the existing Savory Road slightly to the east as it nears the newintersection with Brock , to enable improved site lines and geometry at the intersection, whileproviding a more useful development site on the Kramer lands adjacent to Savory Road, andproviding a better location for a four way intersection with the future development lands south ofthe Brock Connector (see Sketch One).

However , in order to provide an improved horizontal and vertical alignment at this intersection,Savory Road needs to be ' raised ' considerably from its current elevation . This will require theconstruction of a new retaining wall, approximately 7 meters (22 feet) high, adjacent to SavoryRoad . While some earth/rock moving has occurred in order to anticipate the new roadelevation , no further work can be done until such time as the retaining wall is designed andtendered . It is likely that further earth/rock moving will occur in this area in conjunction with theconstruction of the wall.

Commentary

Staff is requesting Council's approval to proceed with the design of the retaining wall , which willfacilitate the integration of the wall design into the other related design drawings , includingutilities, which need to be finalized before further construction can begin. There are sufficientfunds within the project budget to undertake this work.

The design of this retaining wall requires the services of a professional structural engineer. OurProject Manager , Tim Stevens, P.Eng. has approached the design engineer who undertook thestructural design for the bridge (Sargent & Associates Ltd. of Victoria) to submit a fee estimatefor our consideration for the retaining wall. The fee estimate for design is enclosed , and totals$49,000 plus GST with further costs of up to $18 ,000 plus GST for construction relatedengineering and inspections.

We recommend a sole source award for this assignment because:

1. The award could be considered an extension to the bridge design assignment whichwas procured competitively.

2. The price received from Sargent & Associates is reasonable considering the cost andcomplexity of the wall.

3. The wall is unique and quite challenging and will require significant coordination withthe City. Sargent & Associates is a local design consultant.

Financial Implications

The City has sufficient funds from the Spencer Rd Interchange Project to undertake the designof the wall.

Options

That Council:

Subject: Design Contract for Spencer Interchange South Ramps

BackgroundThe Spencer Road Interchange project is envisioned to proceed in two phases. The projectwas split into two phases as the traffic studies indicated that two ramps , namely the TCHeastbound off-ramp , and the BMP (Bear Mtn Parkway) to TCH eastbound on-ramp ( loop) werenot required at project opening and potentially for more than 10 years depending on the pace ofdevelopment. For the first (current) phase the TCH eastbound off-ramp function will beprovided by directing traffic along Goldstream to Leigh Road, and the BMP southbound on-rampfunction will be provided through a traffic signal, directing traffic to the eastbound on-ramp. Thecurrent Spencer Interchange project only includes the phase I works, such that the phase IIworks are not currently designed, scheduled, or financed. The estimated cost of the Phase IIworks is in the order of approximately $5 to 6 Million.

Commentary

Recent announcements from the senior levels of Government , in response to the recenteconomic turndown, indicate that there may be a window of opportunity for the City to exploresenior government cost sharing in this project , such that it may make sense to move this projectforward to construction in 2009.

It is our understanding , based on the information obtained to date from the senior levels ofGovernment , that infrastructure funds may be made available to Municipalities who have 'shelfready ' projects , which can go to construction relatively rapidly , say later in 2009 . Typically, forprojects the size of this one , this means that the detailed design must be complete so theproject can be tendered soon after award of funding . Alternatively , the design-build approachcan be suggested for these larger projects where design is not yet complete , but it still results inthe delay of physical construction as the successful proponent must be selected and thencomplete the design in any event.

For these reasons , staff wish to bring forward , for Council' s consideration , a proposal toundertake the design of the phase II works for the Spencer Interchange Project (the TCHeastbound off-ramp , and the BMP southbound on-ramp) at this time , to enable this project to bepotentially considered as 'shelf ready ' as soon as possible.

While this does not guarantee that the project will receive funding from senior levels ofGovernment, it should increase its chances of being considered for funding. Even if the projectdoes not receive funding in 2009 the design will be competed such that the City could proceedwith the project at any time in the future.

Fee Proposal

Staff has approached a local Engineering Company , Focus Corporation , to request a quote toundertake the design of these two ramps . Their proposal is enclosed herein, and estimates thefees for design of the project at $61,250 plus G.S.T. We approached Focus Corp directly asthey are very familiar with the Spencer Project having worked with our project manager onvarious aspects of the interchange , and are locally based and committed to undertaking thedesign within a 5 week time period . While staff would normally prefer to have asked for anumber of quotes for this work , under the time constraints noted above, we are suggesting thatan exception be given to allowing a sole source proposal.

Financial Implications

The City does not have sufficient funds from the Roads DCC program to undertake the project,or the design at this time. The City does, however, have sufficient funds from the Corix 3%general capital improvement fund that could be directed immediately toward this project , shouldCouncil wish to proceed immediately with the design of these works.

Options

That Council:

1. Award the design of the Spencer Phase II Works project to Focus Corporation, onthe condition that the design be completed within 5 weeks of the notice of award;AND

2. that funding be made available from the Corix 3% capital contribution account to fundthe design work; OR

3. Do not proceed with the design at this time,

Project Understanding

The assignment is to provide detailed design for the southbound off-ramp, and southbound inner loopon-ramp In the southwest quadrant of the Spencer Interchange.

Engineering Services

The Client retains Focus to provide consulting and professional services as described generally in theEngineering Services section and Focus agrees to provide these services to The Client, as follows:

Focus Is familiar with this project , having provided design services for the functional and preliminarydesigns , and currently being involved in a design coordination role for the interchange detailed designunderway. This assignment will consist of the following deliverables and tasks.

• Detailed design and construction drawings for the additional ramp(s), consisting of roadway,signing , pavement marking , and drainage design.

• Coordination with other consultants w.r.t. geotechnical, environmental, landscaping,archeological, traffic, and electrical. (There is no anticipated impact to current utility design.)Focus will lead the design coordination with these other consultants.

• Additions to the interchange contract documents and specifications as required for the rampworks.

Focus will also provide services during the tender and construction phases as required on an hourlybasis.

• The decision to include the inner loop with the construction works will be made by the City at the50% design stage.

• Construction is under way via separate contracts or day labor for the bridge, bulk grading, andsome drainage and utility work. The complete works including base gravels and paving,lighting , signing , signalization , etc. will be delivered via a single finishing contract. Theadditional ramp(s) will be designed and included in the finishing contract. This will simplify theconstruction activities , and limit the effort required in producing additional contract documentsand specifications.

• Focus will revise the current ramp intersection design on the south side of the interchange toaccommodate the additional ramp(s). The current design is an interim intersection which is notsignalized because it consists only of a left-turn off movement from the BM Parkway. With theramp addition this intersection will need to be signalized . If the loop ramp is omitted in theinterim, the intersection will be designed to transition to the ultimate without pole relocations.

• The interchange design assignment currently underway will be complete prior to Focuscommencing the ramp design. CAD and Caice files of the current design will be provided toFocus by the City. The interchange designer will have the opportunity to review and commenton Focus' design of the additional works. The area on the interchange designer's drawingsaround the south ramp intersection will need to be outlined by the interchange designer andnoted as NIC or superseded and refer to the additional design drawings for the ramp(s) andIntersection.

• Sub consultant tasks pertaining to geotechnical , environmental , landscaping , archeological,traffic, and electrical are not included in this proposal and have not been consulted since someare already Involved in the project and could be utilized for this work. Those disciplines willneed to be consulted to finalize the design budget.

• It is anticipated that the drainage design will be straight forward and will outlet into the systemdesigned for the interchange . We will assess the requirement for a detention or treatmentfacility however the design for same, if required, is not included in the fee estimate.

• The design team will consist of Andre Fillion , P.Eng . and Bruce Kenning P . Eng. as engineers forroadway and drainage design respectively, with drawing production and QC led by Ian Douglas.Joe Shook will assist in the production of specifications and quantity review.

• Our client will be the City of Langford.

Fees & Disbursements

The estimate of fees for the engineering services described above is $61,250 plus G.S.T. assummarized on the attached spreadsheet which also includes an outline of the design stages. Theabove noted fees include the costs of disbursements.

The Client may, during the course of the project, without invalidating this agreement, make changes inthe scope of services to be provided by Focus. Additional services as requested will be provided for anadditional fee and the schedule will be changed as is reasonably necessary to allow for the changes inthe scope of services.

There is no proposed start date, however the time required to complete the proposed works will beapproximately five weeks from commencement subject to availability of staff and other consultants. Alonger schedule may be required if there is significant approval time between design stages.

General Provisions

The terms of agreement for the provision of engineering services are set out in this proposal and inTerms of Engagement as appended to this proposal.

If The Client accepts Focus's offer to provide engineering services, then this proposal and the Terms ofEngagement constitute the entire agreement between the parties respecting the project and nounderstandings or agreements , oral or otherwise , exist between parties except as expressly set outherein.

TERMS OF ENGAGEMENT

1. GENERALThe Focus Corporation Ltd. (`FocUsl shall render the Services, as specified in this proposal, to the Client for this Project inaccordance with the following terms of engagement . Each party shall designate a representative who is authorized to act onbehalf of that party and receive notices under this Agreement.

Focus will confirm in writing before proceeding with additional services as required by the client Rates will be either hourly oron a task specific basis.

2. COMPENSATIONFees for Services provided are due and payable upon invoicing. Accounts in excess of 30 days from date of invoice aresurcharged with carrying charge interest at 2 % per month, compounded monthly (26.8% per annum ) on overdue amounts.Obtaining agency approvals is not a prerequisite for payment for Services rendered.

3. TERMINATIONEither party may terminate this engagement without cause upon thirty (30) days ' notice in writing. On termination by eitherparty under this paragraph , the Client shall forthwith pay to Focus all charges for the Services performed . Including allexpenses and other charges incurred by Focus for this Project.

If either party breaches this engagement , the non- defaulting party may terminate this engagement after giving seven (7) days'notice to remedy the breach. On termination by Focus under this paragraph, the Client shall forthwith pay to Focus all chargesfor the Services performed to the date of termination , including all fees and charges for this Project

4. ENVIRONMENTALFocus's field Investigation , laboratory testing and engineering recommendations will not address or evaluate pollution of soil orpollution of groundwater. Focus will cooperate with the Client's environmental consultant.

5. PROFESSIONAL RESPONSIBILITYIn performing the Services , Focus will provide and exercise the standard of care , skill and diligence required by customarily-accepted professional practices and procedures normally provided in the performance of the Services contemplated in thisengagement , at the time when , and in the location which, the Services are performed.

that it will bring no proceedings and take no action in any court of law against any of the Consultant 's employees or principalsIn their personal capacity.

B. These documents may not be used on any other project without the prior written agreement ofFocus.

In the event the Client furnishes Focus with any documents , information , surveys, and reports , Focus shall be entitled to relyon their accuracy and completeness . Any contracts for the provision of such documents , information , surveys, and reportsshall be considered direct contracts with the Client unless explicitly provided otherwise.

9. FIELD SERVICESWhere applicable, field services recommended for the Project are the minimum necessary in the sole discretion of Focus, toobserve whether the work of a contractor retained by the Client is being carried out In general conformity with the intent of theServices. Any reduction from the level of Services recommended will result in Focus providing modified certifications for thework.

10. DISPUTE RESOLUTIONIf requested In writing by either the Client or Focus, the Client and Focus shall attempt to resolve any dispute between themarising out of or in connection with this agreement by entering into structured , non-binding negotiations with the assistance of amediator on a without prejudice basis . The mediator shall be appointed by agreement of the parties . It a dispute cannot besettled within a period of thirty (30) calendar days with the mediator , the dispute shall be referred to and finally resolved byarbitration under the rules of procedure of the British Columbia International Commercial Arbitration centre.

Subject: West Shore Parks & Recreation Society 2009 Budget

COMMENTARY

Attached is the West Shore Parks & Recreation Society's (WSPRS) 2009 Budget package. Theannual budget is adopted by resolution of the WSPRS Board and sent to the membermunicipalities (Langford, Colwood, View Royal, Highlands and Metchosin) for their individualapprovals.. Unanimous consent of all members is required.The 2009 Budget provides for an overall expenditure increase of 5.6% in 2009 and a 3%increase in municipal contributions. The difference is made up from increased operatingrevenues. WSPRS generally targets for a 2.5% increase in municipal contributions.

Apportionment of the municipal contributions among the members is calculated using a 50%population and 50% assessment formula. The result of that calculation is a 6.27% increase inthe Langford contribution. Given that Langford has grown faster than the other members (bothIn population and assessment), it is reasonable to expect that Langford's tax contributions willincrease at a higher rate than the 3% average increase. On the other hand, Langford will haveproportionately higher new assessment to pay for it. Based on the completed roll for 2009, the6.27% Increase in Langford 's contribution to WSPRS should result in a tax increase tothe typical home owner of 3.08% or $3 .22 for recreation.

The budget package includes a schedule titled 'Additional Capital Requests to Fund 5 YearCapital Plan For Budget Year 2009' which lists some capital items which are over and abovewhat can be funded with a 3% requisition increase. These are broken down as follows:

For any of these projects to be funded by taxation, each $100,000 increase in the requisitionresults in a tax increase of $5.68 to the average home owner. So the cost to that average homefor the Artificial Turf is $21.20 and for the Parking is $15.90.

WSPRS have recommended that funding for all these items except the Artificial Turf andParking should be funded through referendum (debt). Other items in the 5 year capital planwhich are recommended for debt funding include:

In addition to approving the budget (or not), Council may wish to indicate whether it is preparedto conduct a referendum to seek the assent of the electors to borrow up to $5,067,100 for theseprojects. If Council is in favour of conducting a referendum, an indication of timing would beappropriate since some of the projects are scheduled for 2009.

Also attached is correspondence from the Juan de Fuca Senior Citizens' Association in supportof the proposed $120,000 expansion in the base budget plus the 'over 3%' amount of $330,000.This project is shown as referendum funded (for both amounts) in the budget.

That the Administration and Finance Committee recommend that Council:

i) Approve the West Shore Parks and Recreation Society 2009 Budget with a 3%increase in requisition, or

fl) Reject the West Shore Parks and Recreation Society 2009 Budget and refer it backto the Society to address the following:

i) Agree to conduct a referendum in 2009 (or some future year) on a loan authorizationbylaw to fund the projects indicated in the WSPRS budget as referendum funded to amaximum debt of $5,067,100 (or some other amount) subject to the participation ofthe other WSPRS members, or

RE, West Shore Parks and Recreation Society 2009 Budget

Please find attached the West Shore Parks and Recreation Society proposed budget for 2009 for Councilconsideration and approval.

The format and perspective of this years' budget differs from the presentation of WSPR budget over the pastfew years. With a new Administrator and a new Manager of Finance comes a new financial perspective. Thisnew perspective has been implemented in the attached 2009 Budget.

The other thing you may notice is that there are some large percentage variances in a number of areas. Mostof these variances are as a result of the new format, in which program areas have been amalgamated ormoved to a different account . There are also some significant variations based on changes in coordinator andmanagers areas of responsibility.

The new format of the 2009 WSPR Budget is significantly different from previous budget versions and with newcouncils in place across the West Shore, our Administrator, Linda Barnes, and our Manager of Finance.Cameron Reid, would like to be present when the budget comes before council. If requested we would be morethan happy to prepare a presentation to council on specific areas if significant prior notice is given. The goal isto have our budget passed by all Members before the end of February, as paragraph 9 of our Operating,Maintenance, and Management Agreement requires a budget be approved by February 28th,

Capital RequisitionsThe most difficult part of preparing our budget for 2009 was the inclusion of funding for our Five Year CapitalPlan. Operationally we were able to contain our requisition increase to 3% but in order to fund both ourEquipment Replacement Fund and our Five Year Capital plan we need substantially more.

We have prepared the 2009 budget with two levels of additional requisitions, above the 3% operationalrequisition increase. Within the 3% increase we have increased capital spending by 41 % but still have notaddressed the capital spending required to maintain and improve our aged infrastructure. We have highlightedthat infrastructure capital in our Five Year Capital Plan and in a separate schedule called 'Additional CapitalRequests to Fund the 5 Year Capital Plan'. This schedule breaks down the individual projects with thecorresponding requisition Increases for each project.

Admittedly a single year increase to cover the entire request is unlikely; however It does not change our needfor the items on the additional capital list. We respectfully ask that council consider funding more than theoperational increase of 3% on a project by project basis. To facilitate partial funding of our additionalrequirements, we have ranked the importance of the additional items in the hopes that we may move forwardon some items.

4. The 2009 $ 118,900 increase in requisitions is the municipal contribution to an increase in spending of$490,000 or 5.6% over 2008 , mostly to capital projects. That means 75% of the increase in spending iscovered by increased revenue.

5. We have increased spending on capital items by 41 % while keeping our requisitions at a nominalincrease of 3.00% based on higher revenue.

6. We have increased revenue by 14.6% or $663,000 over 2008 based on a 7 . 5% increase in prices, newprograms , higher demand for programs based on 2008 performance , and new revenue streamsIncluding LED sign advertising revenue.
