housing at affor!able cost" basic ser2ices" an! e3plo#3ent opportunities>

b< Pro2i!e for the rational use an! !e2elop3ent of urban lan! in or!er to

bring about the follo$ing4

?6< E@uitable utili=ation of resi!ential lan!s in urban an! urbani=able areas

$ith particular attention to the nee!s an! re@uire3ents of the

un!erpri2ilege! an! ho3eless citi=ens an! not 3erel# on the basis of 3ar8etforces>

Section A' 0efinition of Ter3s for Purposes of this *ct'

a< 9*ffor!able cost: refers to the 3ost reasonable price of lan! an! shelter

base! on the nee!s an! financial capabilit# of Progra3 beneficiaries an!

appropriate financing sche3es>

b< 9*reas for priorit# !e2elop3ent: refers to those areas !eclare! as such

un!er eDisting statutes an! pertinent eDecuti2e issuances>

c< 9lighte! areas: refers to the areas $here the structures are !ilapi!ate!"

obsolete an! unsanitar#" ten!ing to !epreciate the 2alue of the lan! an!

pre2ent nor3al !e2elop3ent an! use of the area>

!< 9Consultation: refers to the constitutionall# 3an!ate! process $hereb#

the public" on their o$n or through peoples organi=ations is pro2i!e! an

opportunit# to be hear! an! to participate in the !ecision%3a8ing process on

an! other fiDtures that are 3ere superi3positions on the lan!" an! the 2alue

of i3pro2e3ents shall not be less than ?< of the assesse! 2alue of the

propert#>

g< 9&oint 2enture: refers to the co33it3ent or agree3ent of the t$o ?,< or



ha2e pre2iousl# been a$ar!e! ho3elots or housing units b# the Go2ern3ent

but $ho sol!" lease! or transferre! the sa3e to settle illegall# in the sa3e

place or in another urban area" an! non%bona fi!e occupants an! intru!ers

pri2ate sector for the un!erpri2ilege! an! ho3eless citi=ens $hich shallinclu!e sites an! ser2ices !e2elop3ent" long% ter3 financing" liberali=e!

ter3s on interest pa#3ents" an! such other benefits in accor!ance $ith the

pro2isions of this *ct>

CO/ER*GE *N0 EJEMPTIONS



Section B' Co2erage % The progra3 shall co2er all lan!s in urban an!

urbani=able areas" inclu!ing eDisting areas for priorit# !e2elop3ent" =onal

i3pro2e3ent sites" slu3 i3pro2e3ent an! resettle3ents sites" an! in other

areas that 3a# be i!entifie! b# the local go2ern3ent units as suitable for

sociali=e! housing'

Section ' EDe3ptions 7 The follo$ing lan!s shall be eDe3pt fro3 the

co2erage of this *ct4

a< Those inclu!e! in the co2erage of Republic *ct No' KK+" other$ise

8no$n as the co3prehensi2e *grarian Refor3 La$>

b< Those actuall# use! for national !efense an! securit# of the state>

c< Those use!" reser2e! or other$ise set asi!e for go2ern3ent offices"

facilities an! other installations" $hether o$ne! b# the National

Go2ern3ent" its agencies an! instru3entalities" inclu!ing go2ern3ent%

N*TION*L 1R*N 0E/ELOPMENT *N0 HO1SING FR*MEOR

Section K' Fra3e$or8 for Rational 0e2elop3ent' % There shall be a National

1rban 0e2elop3ent an! Housing Fra3e$or8 to be for3ulate! b# the

Housing an! Lan! 1se Regulator# oar! un!er the !irection of the Housing

an! 1rban 0e2elop3ent Coor!inating Council in coor!ination $ith all local

go2ern3ent units an! other concerne! public an! pri2ate sectors $ithin one

?6< #ear fro3 the effecti2it# of this *ct'

The Fra3e$or8 shall refer to the co3prehensi2e plan for urban an!

urbani=able areas ai3e! at achie2ing the ob;ecti2es of the Progra3' In thefor3ulation of the fra3e$or8" a re2ie$ an! rationali=ation of eDisting to$n

an! lan! use plans" housing progra3s" an! all other pro;ects an! acti2ities of

go2ern3ent agencies an! the pri2ate sector $hich 3a# substantiall# affect

urban lan! use patterns" transportation an! public utilities" infrastructure"

en2iron3ent an! population 3o2e3ents shall be un!erta8en $ith the

concurrence of the local go2ern3ent units concerne!'

*RTICLE I/

L*N0 1SE" IN/ENTOR5" *C1ISITION

*N0 0ISPOSITION

Section +' In2entor# of Lan!s'7 ithin one ?6< #ear fro3 the effecti2it# of

this *ct" all cit# an! 3unicipal go2ern3ents shall con!uct an in2entor# of all

lan!s an! i3pro2e3ents thereon $ithin there respecti2e localities' The

in2entor# shall inclu!e the follo$ing4

a< Resi!ential lan!s>

b< Go2ern3ent%o$ne! lan!s" $hether o$ne! b# the National Go2ern3ent or

an# of its sub!i2isions" instru3entalities" or agencies" inclu!ing go2ern3ent%

o$ne! or %controlle! corporations an! their subsi!iaries>



c< 1nregistere! or aban!one! an! i!le lan!s> an!

!< Other lan!s'

In con!ucting the in2entor#" the local go2ern3ent units concerne!" in

coor!ination $ith the Housing an! Lan! 1se Regulator# oar! an! $ith the

assistance of the appropriate go2ern3ent agencies" shall" in!icate the t#pe

of lan! use an! the !egree of lan! utili=ation" an! other !ata or infor3ation

necessar# to carr# out the purposes of this *ct'

For planning purposes" the Housing an! 1rban 0e2elop3ent Coor!inating

Council shall be furnishe! b# each local go2ern3ent unit a cop# of its

in2entor# $hich shall be up!ate! e2er# three ?A< #ears'

Section ' I!entification of Sites for Sociali=e! Housing' % *fter the in2entor#"

the local go2ern3ent units" in coor!ination $ith the National Housing

*uthorit#" the Housing an! Lan! 1se Regulator# oar!" the National Mapping

Resource Infor3ation *uthorit#" an! the Lan! Manage3ent ureau" shall

i!entif# lan!s for sociali=e! housing an! resettle3ent areas for the

i33e!iate an! future nee!s of the un!erpri2ilege! an! ho3eless in the

urban areas" ta8ing into consi!eration the !egree of a2ailabilit# of basic

ser2ices an! facilities" their accessibilit# an! proDi3it# to ;ob sites an! other

econo3ic opportunities" an! the actual nu3ber of registere! beneficiaries'

Go2ern3ent%o$ne! lan!s un!er paragraph ?b< of the prece!ing section

$hich ha2e not been use! for the purpose for $hich the# ha2e been

reser2e! or set asi!e for the past ten ?6< #ears fro3 the effecti2it# of this

*ct an! i!entifie! as suitable for sociali=e! housing" shall i33e!iatel# be

transferre! to the National Housing *uthorit# sub;ect to the appro2al of the

Presi!ent of the Philippines or b# the local go2ern3ent unit concerne!" asthe case 3a# be" for proper !isposition in accor!ance $ith this *ct'

Section -' Priorities in the *c@uisition of Lan!' 7 Lan!s for sociali=e! housing

shall be ac@uire! in the follo$ing or!er4

a< Those o$ne! b# the Go2ern3ent or an# of its sub!i2isions"



instru3entalities" or agencies" inclu!ing go2ern3ent%o$ne! or controlle!

corporations an! their subsi!iaries>

b< *lienable lan!s of the public !o3ain>

c< 1nregistere! or aban!one! an! i!le lan!s>

!< Those $ithin the !eclare! *reas for Priorit# 0e2elop3ent" onal

I3pro2e3ent Progra3 sites" an! Slu3 I3pro2e3ent an! Resettle3ent

Section 6' Mo!es of Lan! *c@uisition' % The 3o!es of ac@uiring lan!s for

purposes of this *ct shall inclu!e" a3ong others" co33unit# 3ortgage" lan!

s$apping" lan! asse3bl# or consoli!ation" lan! ban8ing" !onation to the

Go2ern3ent" ;oint%2enture agree3ent" negotiate! purchase an!

eDpropriation4 Pro2i!e!" Ho$e2er" That eDpropriation shall be resorte! to

onl# $hen other 3o!es of ac@uisition ha2e been eDhauste!' Pro2i!e!"

further" That $here eDpropriation is resorte! to" parcels of lan! o$ne! b#

s3all propert# o$ners shall be eDe3pte! for purposes of this *ct4 Pro2i!e!"

finall#" That aban!one! propert#" as herein !efine!" shall be re2erte! an!escheate! to the State in a procee!ing analogous to the proce!ure lai! !o$n

in Rule -6 of the Rules of Court'

For the purpose of sociali=e! housing" go2ern3ent%o$ne! an! foreclose!

properties shall be ac@uire! b# the local go2ern3ent units" or b# the

National Housing *uthorit# pri3aril# through negotiate! purchase4 Pro2i!e!"



That @ualifie! beneficiaries $ho are actual occupants of the lan! shall be

gi2en the right of first refusal'

Section 66' EDpropriation of I!le Lan!s' %*ll i!le lan!s in urban an!

urbani=able areas" as !efine! an! i!entifie! in accor!ance $ith this *ct" shall

be eDpropriate! an! shall for3 part of the public !o3ain' These lan!s shall

be !ispose! of or utili=e! b# the Go2ern3ent for such purposes that confor3

$ith their lan! use plans' EDpropriation procee!ings shall be institute! if"

after the lapse of one ?6< #ear follo$ing receipt of notice of ac@uisition" the

o$ner fails to intro!uce i3pro2e3ents as !efine! in Section A ?f< hereof"

eDcept in the case of force 3a;eure an! other fortuitous e2ents' EDe3pte!

fro3 this pro2ision" ho$e2er" are resi!ential lan!s o$ne! b# s3all propert#

o$ners or those the o$nership of $hich is sub;ect of a pen!ing litigation'

Section 6,' 0isposition of Lan!s for Sociali=e! Housing' 7 The National

Housing *uthorit#" $ith respect to lan!s belonging to the National

Go2ern3ent" an! the local go2ern3ent units $ith respect to other lan!s

$ithin their respecti2e localities" shall coor!inate $ith each other to

for3ulate an! 3a8e a2ailable 2arious alternati2e sche3es for that

!isposition of lan!s to the beneficiaries of the Progra3' This sche3es shall

not be li3ite! to those in2ol2ing transfer of o$nership in fee si3ple but shall

inclu!e lease" $ith option to purchase" usufruct or such other 2ariations as

the local go2ern3ent units or the National Housing *uthorit# 3a# !ee3

3ost eDpe!ient in carr#ing out the purposes of this *ct'

Consistent $ith this pro2ision" a sche3e for public rental housing 3a# be

a!opte!'

Section 6A' /aluation of Lan!s Sociali=e! Housing' 7 E@uitable lan! 2aluation

gui!elines for sociali=e! housing shall be set b# the 0epart3ent of Financeon the basis of the 3ar8et 2alue reflecte! in the =onal 2aluation" or in its

absence" on the latest real propert# taD !eclaration'

For sites alrea!# occupie! b# @ualifie! Progra3 beneficiaries" the

0epart3ent of Finance shall factor into the 2aluation the blighte! status of

the lan! as certifie! b# the local go2ern3ent unit or the National Housing



*uthorit#'

Section6B' Li3itations on the 0isposition of Lan!s for Sociali=e! Housing" No

Lan! for sociali=e! housing" inclu!ing i3pro2e3ents or rights thereon" shall

be sol!" alienate!" con2e#e!" encu3bere! or lease! b# an# beneficiar# of

this Progra3 eDcept to @ualifie! Progra3 beneficiaries as !eter3ine! b# the

go2ern3ent agenc# concerne!'

Shoul! the beneficiar# unla$full# sell" transfer" or other$ise !ispose of his

lot or an# right thereon" the transaction shall be null an! 2oi!' He shall also

lose his right to the lan!" forfeit the total a3orti=ation pai! thereon" an!

shall be barre! fro3 the benefits un!er this *ct for a perio! of ten ?6<

#ears fro3 the !ate of 2iolation'

In the e2ent the beneficiar# !ies before full o$nership of the lan! is 2este!

on hi3" transfer to his heirs shall ta8e place onl# upon their assu3ption of

his outstan!ing obligations' In case of failure b# the heirs to assu3e such

obligations" the lan! shall re2ert to the Go2ern3ent for !isposition in

accor!ance $ith this *ct'

*RTICLE /

SOCI*LIE0 HO1SING

Section 6' Polic#' 7 Sociali=e! housing" as !efine! in Section A hereof" shall

be the pri3ar# strateg# in pro2i!ing shelter for the un!erpri2ilege! an!

ho3eless' Ho$e2er" if the tenurial arrange3ent in a particular sociali=e!

housing progra3 is in the nature of leasehol! or usufruct" the sa3e shall be

transitor# an! the beneficiaries 3ust be encourage! to beco3e in!epen!ent

fro3 the Progra3 $ithin a gi2en perio! of ti3e" to be !eter3ine! b# thei3ple3enting agenc# concerne!'

Section 6K' Eligibilit# Criteria for Sociali=e! Housing Progra3 eneficiaries' 7

To @ualif# for the sociali=e! housing progra3" a beneficiar#4

a< Must be a Filipino citi=en>



b< Must be an un!erpri2ilege! an! ho3eless citi=en" as !efine! in Section A

of this *ct>

c< Must not o$n an# real propert# $hether in the urban or rural areas> an!

!< Must not be a professional s@uatter or a 3e3ber of s@uatting s#n!icates'

Section 6+' Registration of Sociali=e! Housing eneficiaries' % The Housing

an! 1rban 0e2elop3ent Coor!inating Council" in coor!ination $ith the local

go2ern3ent units" shall !esign a s#ste3 for the registration of @ualifie!

Progra3 beneficiaries in accor!ance $ith the Fra3e$or8' The local

go2ern3ent units" $ithin one ?6< #ear fro3 the effecti2it# of this *ct" shalli!entif# an! register all beneficiaries $ithin their respecti2e localities'

Section 6' alance! Housing 0e2elop3ent' 7 The Progra3 shall inclu!e a

s#ste3 to be specifie! in the Fra3e$or8 plan $hereb# !e2elopers of

propose! sub!i2ision pro;ects shall be re@uire! to !e2elop an area for

sociali=e! housing e@ui2alent to at least t$ent# percent ?,< of the total

sub!i2ision area or total sub!i2ision pro;ect cost" at the option of the

!e2eloper" $ithin the sa3e cit# or 3unicipalit#" $hene2er feasible" an! in

accor!ance $ith the stan!ar! set b# the Housing an! Lan! 1se Regulator#

oar! an! other eDisting la$s' The balance! housing !e2elop3ent as herein

re@uire! 3a# also be co3plie! $ith b# the !e2elopers concerne! in an# of

the follo$ing 3anner4

a< 0e2elop3ent of ne$ settle3ent>

b< Slu3 upgra!ing or rene$al of areas for priorit# !e2elop3ent either

through =onal i3pro2e3ent progra3s or slu3 i3pro2e3ent an!resettle3ent progra3s>

c< &oint%2enture pro;ects $ith either the local go2ern3ent units or an# of the

housing agencies> or

!< Participation in the co33unit# 3ortgage progra3'



Section 6-' Incenti2es for the National Housing *uthorit#' The National

Housing *uthorit#" being the pri3ar# go2ern3ent agenc# in charge of

pro2i!ing housing for the un!erpri2ilege! an! ho3eless" shall be eDe3pte!

fro3 the pa#3ent of all fees an! charges of an# 8in!" $hether local or

national" such as inco3e an! real taDes' *ll !ocu3ents or contracts eDecute!

b# an! in fa2or of the National Housing *uthorit# shall also be eDe3pt fro3

the pa#3ent of !ocu3entar# sta3p taD an! registration fees" inclu!ing fees

re@uire! for the issuance of transfer certificates of titles'

Section ,' Incenti2es for Pri2ate Sector Participating in Sociali=e! Housing'
