SPECIAL INSTRUCTION TO THE TENDERER.

1. Tenders shall have to be down loaded in two parts. (1) Technical and Commercial bid. (2) Price Bid. The two bids shall be submitted in two separate envelopes to be sealed in the one envelope supplied by the Company. The price bid of only those Tenderers will be opened who are considered technically Acceptable.

2. The tenders will have to be down loaded two copies of blank Tender on payment of

Tender fees (non refundable) as per Tender Notice. However, additional copies of Tender Specification can also be had on payment as per the Tender Specification.

3. The tenderers shall have to return the Tender duly filled in two separate envelope

kept in a printed cover given by the Company without any additions/ alterations & duly signed page by page.

The Tenderers are forbidden from furnishing their own printed/ typed commercial and other terms and conditions.

4. All commercial terms and conditions except rates shall be indicated in the technical &

commercial bid only. 5. The Tenderers shall specifically note that the Tenders are invited on percentage basis

only. 6. The Tenderers shall specifically note that the quantities mentioned in the Tender are

likely to vary as per the actual requirement. As such, the successful tenderer shall have to execute the work at the same order rates for the changed quantities, if any, without any extra compensation whatsoever.

7. The Tenderers shall have to submit 10 copies of bidding schedule forming a part of

prince bid as called for in the Tender Specifications for distribution at the time of opening to other participant Tenderer’s.

8. The tenderers will ensure submission of the Tenders duly filled in before the due date

and time. 9. The price bid of those tenderers shall only be opened at the time and date to be

informed by S.E.(TR), Jamnagar which are found technically acceptable and satisfying the requisite qualification & parameters.

-: SPECIAL CONDICATION FOR TENERER:-TAKING DELIVARY AND INSURANCE:-

SECTION – A

INSTRUCTIONS TO THE BIDDERS (A) INSTRUCTIONS TO THE BIDDERS

(A1) SCOPE OF WORK :

Major works covered in this work are Civil works for foundation and electrical works for replacement of 132 KV Breaker at 220 KV Jamnagar S/S under Jamnagar TR division under Jamnagar TR Circle. as per specifications and terms mentioned here under. 1. The site of proposed work is situated at Jamnagar. As per site condition, selected bidder has to carry

out work of foundation work after dismantling the existing structures of CC/RCC/Masonry etc. The works shall be carried out as per tenders specifications & detailed work order.

(2) Any activity not specifically mentioned in the tender but necessary in the opinion of engineer in charge of work must be carried out for successful completion of the job, on getting approval of competent authority of GETCO.

(3) Before taking up construction activity; the agency has to cut the trees which obstruct the working, of any diameter, bushes, vegetations, i.e. roots, plant, shrubs, grass etc including stacking and crediting to GETCO as directed with no extra cost.

(4) Site visit: The bidder is advised to visit the site and examine the site condition. Where in the work is proposed to be carried out and to get himself fully acquainted at his own responsibility for all information that may be necessary for quoting the tender bid and entering in to contract. All cost and liabilities arising out of the site visit shall be at bidder account.

(A2) Earnest money Deposit:

1. Bidders are requested to pay an earnest money deposit (1 % of estimated cost) by demand draft only on any Nationalized Bank at Jamnagar for the amount as specified in the tender notice. Payment of EMD in form of Cheque or any other form shall not be accepted.

2. The EMD shall be submitted along with submission of Technical bid only. In no case it shall be submitted with sealed cover of Price Bid.

3. Tenders not accompanied by EMD shall be rejected. 4. If during the tender validity period, i.e. 180 days, the tenderer withdraws his tender, the EMD shall be

forfeited and the tenderer may be disqualified from tendering for further works of GETCO. 5. The EMD will be returned promptly to the unsuccessful tenderer. The EMD will be returned to the

successful tenderer after he furnishes the Security Deposit for performance and duly enters in to the contract. If he fails to furnish the SD or to execute the contract for the work offered to him, his EMD shall be forfeited and the tenderer may be disqualified from tendering for further works for GETCO.

(A3) COMPLETION PERIOD: The time limit for the completion of the above work will be 01(One) Calendar months from the commencement of the work, which will be reckoned on the 10th day of issuance of L.O.I.

(A4) SECURITY DEPOSIT:As per prevailing rules of the Corporation, 5% of the contract value shall be paid as ‘Security Deposit’. Out of this, 50 % of S. D. shall be paid at Transmission Circle Office Jamnagar within 10 days from receipt of letter of intent either a) In form of FDR in favor of "Gujarat Energy Transmission Corporation Ltd. " of any Nationalized Bank

OR b) In form of Bank Guarantee of any Nationalized Bank as per the approved format of the Corporation.

The balance 50 % Security Deposit shall be recovered from first two R.A. Bills in equal installments. Alternatively 100 % S. D. in form of FDR or B. G. may be submitted on receipt of LOI. The security deposit will be refunded only after the completion of 1 year guarantee period of work completed or finalization of final bill whichever is later.If Security Deposit is not paid within 10 days of issue of LOI, EMD paid will be forfeited and Corporation will not deal with party for the period of two years.

1 Tenders must be submitted in the enclosed schedule of work & quantities. Those received in any other form will not be accepted. They should be accompanied by a covering letter in which the bidder should give all information as called for in the specifications & any other point which he would like to be considered along with the tender.

2 The Schedule-B shall be filled up with the quoted % above or below & shall be submitted in sealed envelope superscripted– PRICE BID for Civil works for foundation and electrical works for replacement of 132 KV Breaker at 220 KV Jamnagar S/S under Jamnagar TR division under Jamnagar TR Circle.The Quoted % above or below shall be written both in words, & figures & the units in words. If any discrepancy occurs between words & figures, then words shall prevail. The tender documents shall be written legibly & free from erasure, overwriting or conversions of figures, crossing out, initializing, dating & rewriting, shall be avoided. In case of any deviation in figure and words the rates quoted in words will prevail. The bidder must sign and affix seal of their company in all the documents of tender including Schedule-B.

3 The bidders shall note that no deviations from the technical specifications or commercial conditions with this bid are acceptable & it will be presumed that the bidder agrees entirely with the specifications & general terms &conditions of the contract.

4 The Corporation reserves the right to accept any tender irrespective of whether it is lowest or not or to reject all the tenders without assigning any reasons there of. Tenders departing from the technical Specification or the method of bidding in a radical manner may also be rejected.

5 On acceptance of the tender the name(s) of the accredited representative(s) of the tenderer who would be responsible for taking instructions from the Engineers of the Corporation shall be communicated to the Superintending Engineer (Trans.), Gujarat Energy Transmission Corporation, Transmission Circle office, Jamnagar.

6 All royalties, sales tax, toll tax, local tax, development charges, Works Contract taxes, VAT & any other taxes etc. in respect of this contract shall be payable by the contractor & Gujarat Energy Transmission Corporation will not entertain any claims whatsoever in this aspect. Any statutory variation in future towards the above mentioned taxes and imposing any new tax that shall also be payable by the contractor & Gujarat Energy Transmission Corporation shall not entertain any claim of whatsoever nature, during or after the completion of this tendered work. Proof of such payments made by the Contractor to the appropriate departments shall be produced to Gujarat Energy Transmission Corporation failing which appropriate amount shall be withheld on getting information / instruction from the concerned departments.

6A. Service tax shall be reimbursed on production of proof of such payments made by the contractor to the appropriate department.

7. The successful contractor will have to sign an agreement as per the Gujarat Energy Transmission Corporation rules on stamped paper & the necessary stamp duty charges shall be borne by the contractor.

8. The bidder shall visit the site and carefully study the work to be carried. The Corporation will not pay any extra or rate for any reason in case the contractor claims, after acceptance of contract, to have misjudged the site condition.

9. The percentage quoted shall include cost towards of all materials, & machinery including equipments, fixtures, labor, constructional equipments, fuel, scaffolding, staging, ramps, walkways, approach and haul road, temporary works, etc. bearing permanent or temporary nature necessary for the completion of the work in all respects, except for those items specifically mentioned to be furnished by the Corporation. The contractor must also arrange for the transport of materials & include all such costs in the rates quoted by him for finished work.

10. During the execution of the work if it is found that the work is not progressing as per the Scheduled Progress Program, approved by the Corporation & planned by the Contractor, due to the reasons attributable to the Contractor; suitable action shall be taken as per relevant clauses mentioned in General Conditions of Contract..

11. The contract or any part thereof shall not be subject to change without the written permission of the Superintending Engineer (Trans.), Gujarat Energy Transmission Corporation, Transmission Circle office, Jamnagar or his authorized representatives.

12. Tender shall remain open for acceptance for a period of 180 days from the date of Technical bid opening & during this period no bidder shall be allowed to withdraw his tender. Any such withdrawals, during the said period will entail forfeiture of the earnest money deposited with the tender. The GETCO will take further action as deemed fit like not to deal with bidder in GETCO works.

13. Further information required, if any, can be had from the office of the Superintending Engineer (Trans),Gujarat Energy Transmission Corporation, Transmission Circle Office, Jamnagar. But it must be clearly understood that the tenders must be received complete in every respects by the due date & time.

14. The notice inviting tender, general instructions to the contractors & all documents of this tender shall form part of the contract.

15. The works under this contract shall be completed in all respects within stipulated period from the date of commencement order issued by field office. However, interim mile stones to be jointly fixed after issue of LOI.

16. Bidders must quote firm price only, till completion of work under contract, & this is to be confirmed by bidder while submitting his offer. No escalation towards labor and material / fuel shall be paid in this execution of contract.

17. Contractor shall pay minimum wages to his laborers as per the Minimum Wages Act, 1948 & rules there under as applicable from time to time in pursuant to the State Government notification. The concerned contractor shall submit the details of the payment with due certificate of LWO/IRO of the Corporation

18. Once the offer submitted will not be returned back for any reason thereof in any case. 19. Each tender shall contain the name, residence & place of business of person or persons making the tender &

shall be signed by the tenderer with his usual signature with seal of the company. 20. Tender by partnerships shall furnish the full names of all partners. It shall be signed with the partnership name

by one of the members of the partnership or by an authorized representative followed by the name &designation of the person signing.

21. An attested copy of the constitution of the firm with the name of partners shall be furnished. Whenever, whether in submission of the tender or later in other matters, the signatures are made by one person on behalf of Directors or a firm or a corporation, an attested copy of the resolution of the partners or of law shall be supplied by the tenderer authorizing Witnesses & sureties shall be persons of status & probity, &their names, occupation & address shall be stated below their signatures. All signatures shall be dated.

22. Tenders by corporation shall be signed with the legal name of the corporation followed by the name of the state of incorporation & by the signature & designation of the president, secretary or other person authorized to bind it in the matter with rubber seal of the company.

23. The GETCO reserves the right to delete any item of Schedule-B for which contractor shall not have any right to claim on this account.

24. The Bidders shall study the Conditions of site & shall resort to dewatering, where necessary, by appropriate methods & maintain reasonably dry areas to work at and no extra claim will be entertain on this account.

25. The Contractor shall prepare all required roads to execute various items of this Contract & arrange all transport of materials & all such costs shall be taken care of while quoting the rates .

No extra payments shall be admissible towards such costs. On completion, this shall be cleared if asked by GETCO at no extra cost.

26. Gujarat Energy Transmission Corporation shall not entertain idle charges for any site conditions or any circumstances.

27. The Contractor shall take all requisite & necessary care to observe that no damage is occurred to the Existing structures, if any. For any damage to the Existing Structures of Gujarat Energy Transmission Corporation the Contractor shall be held responsible.

28. The submission of any bid connected with these document and specification shall constitute on agreement that bidder shall have no cause of action or claim against the GETCO for rejection of his bid. The owner shall always be at liberty to reject or accept split any bid or bids at his sole discretion and any action will not be called into question and the bidder shall have no claim in that regards against the owner.

29. Recoveries: (I) In case of any damage to equipment/machinery or structure/building of GETCO or any public property due to

negligence’s of contractor or any other reasons attributed to contractor the decision of E.I.C. regarding the amount of recovery shall be final and binding.

(II) If the contractor fails to execute the proportionate work as per direction of E.I.C. within the time frame given for completion of part / whole of the work GETCO shall get the work done through any other contractor and the cost of execution of such work along with 15% overhead charges shall be recovered from contractor.

30. Notwithstanding anything contained to the contrary in the specification or tenders in subsequent exchange of correspondence, the conditions of contract shall be binding on the contractor and any change or variations expressed or implied, however made in the said conditions shall not be valid or operative unless expressly sanctioned by the Corporation. The contractor shall be deemed to have fully informed himself and to have special knowledge of the provisions of the conditions of contract herein contained.

31 Submissions of tender by a contractor implies that he has read the instructions and condition of contract herein contained and has made himself aware of the scopes and specifications of the work to be done.

32 These rules and directions shall form part of the contract. 33 Drawings: Drawings required for the works are available with the Transmission Circle Office, Jamnagar.

They are indicative and for tender purpose only. Bidders shall have to execute the work as per construction drawings issued from time to time by GETCO.34 Electricity Connection: The electric power, at site, will be made available at one mutually agreed points, free of cost at all above substations by Superintending Engineer (TR), Jamnagar. Further distribution will have to be carried out by the contractor as per requirements at their own cost.

35 Water Supply Connection: The contractor has to make his own arrangement of water for construction activity at his own cost. However, if possible, on completion of Corporation bore well / open well only, the water supply line from GETCO will be given at one mutually agreed point as per the contractor’s request. Further distribution will have to be carried out by the contractor as per their requirements at their cost. Water shall be supplied on chargeable basis and recovery for water charges will be affected at two percent of the cost of items as executed in which the water is supplied by Corporation, is used, as certified by the EIC.

36 Tenders received after time: The tenders received after time and date specified in the tender notice, will not be accepted. Once the offer submitted by the contractor before due date of submission, the contractor will not be allowed to submit revised / additional / modified / other even before due date. However, if the issue and receipt of tender is extended by the Corporation due to any reason, the contractor may submit the revised offer before due date of submission, if he wish to submit.

37 The work shall be completed within the period stipulated in the contract. However it may be noted that drawings shall be released progressively & site clearance arranged accordingly to the progress of work at site. Therefore the contractor has to organize & coordinate the works to suit these. In the event of any delay due to the above or due to any other reason not attributable to the contractor, reasonable extension in the completing the work may be given at the discretion & as decided by the Corporation but no compensation or idle charges will be paid to the contractor under any circumstances.

38 The price bid/proposals will be opened in the presence of the bidder’s representatives who choose to attend at the date and time and venue to be notified by the GETCO, after conclusion of the Technical Evaluation and Post Qualification process.

39 GETCO will not issue any material required for the work. All the materials – tools & tackles, labor etc. will have to be arranged by the contractor.

1.1 The contractor has keep tower materials & line materials in safe custody and transport to the respective sites

and will be reasonable for any damages to or loss of all materials at any stage during transportation or erection or taking over of the line by GETCO.

The Contractor has to open site store nearby the route of the line and ensure for safe custody of all the stored materials at his own cost. The Contractor shall have total responsibility for the entire materials stored loose, semi assembled and/or erected by him at site in his custody. The Contractor shall make suitable security arrangements at his own cost to ensure the protection of all materials, equipments and works from theft, fire pilferage and any other damages and loss, it shall be the responsibility of the contractor to arrange for security till the works are finally taken over by the Corporation. STORAGE-CUM-INSURANCE:- The contractor shall make suitable storage-cum-erection insurance cover at his cost to the extent of 60% cost of line material, which are required to complete the line. Contractor shall have to take comprehensive insurance policy against any loss, damage, theft, pilferage, fire etc for the complete period of storage, erection and commissioning up to the time of taking over of the transmission line by the Board. The contractor shall deal directly and pursue the claim with the insurance company and shall be responsible in regard to maintenance of all insurance coverage as well as for settlement of claim. The proof of insurance policy taken by the successful contractor shall be furnished to Engineer-in-Charge, in absence of the above insurance policy. R.A.Bill payment will be with held. In the event of any damage, theft, loss, pilferage, fire etc, Contractor will be responsible to lodge, pursue and settle all the claims with the insurance company for all items, materials and the corporation shall be kept informed about it. Contractor shall replace the lost/damaged materials/items promptly irrespective of the settlement of the claims by underwriter and ensure that the work progress is as per agreed schedule. The loss, if any, such replacement will have to be borne by the contractor and Board will not entertain any claim/representation in this regard. However it will be contractor’s responsibility to insure the entire project till the line is taken over by the Board. 2.0 PENATLY FOR DELAY: 2.1 The tenderer should note that the completion time allowed for carrying out the work should be strictly observed. Any delay that may take place in supply and erection beyond contractual cut off date stated as per stipulated delivery period shall be subject to the penalty at the rate of ½ % of the contract value per week on delayed work ( supply and erection work) with a ceiling of 10% of the total contract value.

** GENERAL CONDITION:

Civil works for foundation and electrical works for replacement of 132 KV Breaker at 220 KV Jamnagar S/S under Jamnagar TR division under Jamnagar TR Circle

The erection work should be carried out according to the specification and as per instructions and programmed laid out by the Superintending Engineer-in-charge of the work.

1. The tenders shall remain open for acceptance at least for a period of Six Months, from the date of opening of tenders.

2. The Gujarat Energy Transmission Corporation Limited does not bind itself to accept the lowest or any tender. The Superintending Engineer (TR.), JAMNAGAR. reserves the right to reject any or all tender without signing any reasons whatsoever.

3. The contractor should employee as Supervisor with sufficient qualification and experience who could supervise the execution of work thought. He should always be present on the site.

4. The erection work should be commenced immediately from the date of receipt of instructions from office and should be completed within thereafter.

5. As regard damage the materials, equipment and worker of the contractor, he himself will be responsible. If there is any compensation to be paid in respect of “WORKMAN” compensation act of any other statutory provisions, the same will have to be paid by the contractor direct. If he thinks fit he may take necessary insurance cover, at his cost.

6. Security deposit: - The contractor will have to pay the Security Deposit at 5% of the order value on placing the order 2.5% will have to paid in cash or demand draft in favor of ‘GUJARAT ENERGY TRANSMISSION CORPORATION LTD’ within 7 days from the date of the issue of LOI, and the remaining 2.5% will be recovered from the first two R.A. Bills and higher percentage of security deposit may be fixed at the direction of The Superintending Engineer.

7. The tender includes all minor accessories and items of work which are not have been specifically mentioned in the specification schedule etc. but are essential for completion of work. The contractor will not be eligible for any extra payment in respect of such minor accessories and items of work.

8. The time allowed for completion the work is 30 days from the date of the commencement of the work, failing which the penalty ½% per week or part thereof on delayed portion of work and / or supply value subject to ceiling of 10% of the total contract value will be imposed.

9. Guarantee: - It is the responsibility of the contractor to handover the complete work free of all defects. If within a period of one year from the date of handing over the work it is noticed that any defects occurs due to bad workmanship. It is the duty of the contractor to rectify / replace the same at his own cost. If within seven days from the date of receipt of such notice. The contractor do not take up the work, same will be carried out at his risk and cost.

10.Tenderer should be qualified only who have submitted all the required documents as mentioned in tender notice.

11.Service tax will be paid as per prevailing norms on production of service tax registration. And against production of payment proof.

12.No higher rate of revised rate will be applicable for the work, if work is held up/ closed

due to whatever so reasons. 13.Incase of any dispute/ doubt, the decision of Superintending Engineer (TR), GETCO,

JAMNAGAR shall be unchallengeable, final and binding to the contractor.

14.10% retention money will be deducted from each R.A. Bills. 15.The GETCO will supply Bentonite Chemical Compound, steel section required for earth

mesh/ structure, G.I./ MS Strip required for completion of earthing work. The wooden charcoal, salt, black cotton soil, G.I. Pipe, C.I Pipe, nuts and bolts and lugs etc required for completion of earthing work shall be arranged by the contractor.

16.Cutting, bending, welding, brazing, wherever necessary is to be done by the contractor. 17.Erection of panel board is includes shifting in control room – bolting with side panel –

leveling of panel with proper grouting as per instruction of Engineer-in-charge. 18.The tendered should furnished details of past experience of such jobs of similar nature

completed by him satisfactorily within the time limit in GETCO without this certificate offer shall be rejected out rightly.

19.The quantum of the work as mention in estimate/ schedule –‘B’ is tentative and it can

be very differ as per site condition. The payment shall be made only on actual work executed or order quantity, which ever is less.

20.The tenderer will be abide by and fulfill all the terms and provisions of the “Tender &

Contract” for works as applicable and incase of any default there to the GETCO shall for fit the S.D. or any other action as may be decided by Superintending Engineer (TR), GETCO, JAMNAGAR.

21.The time limit for the work may be reduced and contractor should make all his efforts to

complete the work within stipulated time limit as may be given by the Engineer in charge depending upon emergency of work, GETCO reserves the right to reduce the time limit without giving any notice.

22.The contractor has to remain in close day contact with D.E. 220 KV S/S Jamnagar

Engineer in charge of work who will issue detailed instruction for the commencement of the work.

23.Contractor will abide by and fulfill all the terms and conditions and general terms and

condition of the contract for works available in the office. 24.All other general terms and conditions as prevailing in the GETCO shall be applicable to

the contract. 25.The cost of damages, if any will be recovered from the Contractor’s bill. The assessment

of which will be done by filed Engineer at his sole discretion and his decision shall be binding to the contractor and shall be considered as final and unchallengeable.

26.The contractor will have to give indemnity bond to GETCO against any possible claim of

compensation for damage to contractor’s equipments or staff or any of third party during the execution of work.

27.The contractor will have to complete entire job as per directive and instruction of

Engineer in charge. If he fails to do so entire work will be carried out at contractor’s risk and cost.

28.The contractor must engage sufficient knowledgeable persons round the clock,

exclusively for oil filter machine provided by GETCO for oil filtration work. No loss of oil should occur and in case if occurs, it’s cost will be recovered from contractor’s bill. The contractor has to apply sufficient nos. of cycles for oil filtration works as decided by the Engineer in charge.

29.The tender shall be issued to only the experience and contractor who has completed such job of similar nature and magnitude satisfactorily in time. However, issuance of blank tender, will does not qualifies the tenderer to offer the bid.

30.Tender offer without payment of EMD required certificate, documents, bar chart list of

tools, tackles, equipments etc. required for execution of job will be out rightly rejected without assigning any reason thereof and decision of Superintending Engineer (TR), Jamnagar will be final and unchallengeable.

31.The Contractor will be governed by The GETCO’s general conditions of works contract.

The Booklet will be available in the concerned office in any working days. In the event of placing order, the contractor will have to sign this booklet along with other document and agreement. All the usual terms and conditions of the GETCO, through the same might have not been mentioned in this specification or contractor booklet will applicable to this contract, and the decision of the Superintending Engineer/ Superintending Engineer shall be binding on the contractor.

32.After completion of the work, all the surplus materials issued by the GETCO shall be

returned by you to the respective center of the GETCO as per instruction of Engineer in charge at your cost.

33.Specification in any items mentioned in tender are subject to change without any prior

notice and binding to the contractor. 34.GETCO shall deduct the Income-Tax and other taxes as per prevailing rules from each

and every bills. 35.If the work is required to be carried out during fix outage then the contractor has to

deploy adequate man power, material, tools etc. well in advance and has to complete the entire work during this specific outage period only, failing to which GETCO shall be at liberally to deduct the amount of revenue loss due to prolong outage.

36.If required by GETCO you shall have to provide free to and fro traveling facility to our

Junior Engineer or Technical staff for the work. 37.The tender include all minor accessories and items of work which may not have been

specifically mentioned in the specification/ Schedule etc but are essential for completion of work. The contractor will not be eligible for any extra payment in respect of such minor accessories and item of work.

38.The contractor shall not refuse to execute the work order at any time and it will be his

sole responsibility to execute and complete this work as per the instruction of Engineer in charge.

39.For shortages of any materials issued by the GETCO for the work, recovery shall be

made from you, on the basis of prices of the materials (prevailing on the date of settlement of materials account) plus 15% supervision charges.

40.The contractor has to carry out all the works in accordance with revised and latest

provision under I.E. Rules Act made there under and as per instruction of Engineer in charge.

41.Registered class ‘A’ contractors with the GETCO and having furnished Rs. 5 lacs bank

guarantee towards lump sum permanent deposit are exempted from to renew / extend the validity of registration and bank guarantee well in time before expiry dates.

42.The S.S.I. Industries will be exempted from the payment of Security Deposit provided a

competency certificate is issued by the Regional Circle Officer of the National Small

Scale Industries Corporation to the effect that the firm is capable of executing the order.

43.No subcontractor, Power of Attorney shall be allowed. 44.All the materials issued by GETCO shall be transported to the work site on same day

and to be preserved in safe custody failing to which GETCO shall initiate Police actions. Similarly as per instruction of Engineer in charge, you have to credit the material at GETCO store without any loss of time failing to which GETCO shall initiate Police action.

45.No part rate or reduced rate shall be allowed in final bill. 46.Contractor has to co-ordinate E.I.C. for planning of outage and work schedule thereof,

so as to complete all the planned work in outage. Contractor has to deploy adequate manpower accordingly.

47.The undersign reserve rights to reject any or all the tenders without assigning any

reasons thereof. Issuance of blank tender does not automatically qualifies the tenderers for award.

48.No tools, tackles, manpower, crane facilities etc will be provided by the GETCO. 49.The contractor has to follow all labor laws, safety rules and regulations. The GETCO

does not take any responsibility in case of accident or injury to the workers. The safety/ security of men, materials and equipments shall be sole responsibility of the contractor.

50.The compliances of all Central/ State Govt. rules, safety and insurance rules etc. and

that of local body, is a must condition for the agency. 51.The contractor has to submit the list of tools, tackles, equipments with him along with

his tender offer. The tender without this list and other required documents (as mentioned above herein the tender) should be rejected out rightly.

52.The contractor has to deploy minimum 8 to 10 skill labors/ fitters at site daily failing to

which GETCO shall deduct 1,000/- per day from the bill. 53.The bidder shall specifically note that GETCO will not pay any extra amount towards any

type of claim except for the description indicated in Schedule – ‘B’. The party has to carry out all other/ additional required activities/ works as directed by Engineer in charge which is not mentioned in Schedule but required to be completed as per site condition and for this work no extra payment shall be made by GETCO.

54.It will be bidder’s sole responsibility for erection off complete line/ equipment in all

respect as per the provision of I.E. Rules and procedures and as per the instruction of Engineer in charge.

55. In addition to the general of the TRANSMISSION particular, attention shall be paid to

the final finish and every effort shall be made to have the entire work contented with standard of workmanship by the contractor.

56. Experience certificate of same work should be enclosed with the tender.

57. GENERAL:-(a) Electricity Rules:- All the works shall be carried out in accordance with latest

rules Under Electricity Act. (b) Testing:- Complete installation shall be put to the necessary test as required and (c) Should be approved by Government Electricity Inspector.

(d) The interpretation of specifications doubts etc.:- In case of any doubts about What is mentioned in specification or schedule or elsewhere, the tenderer should get All doubts cleared from the Department in writing and in advance of filling in the Tender. In case of difference of opinion about interpretation of specification etc the decision of Superintending Engineer will be final and shall be binding to the contractor.

(e) Accounts of Materials issued:- The contractor shall have to maintain accurate day to day and item wise account of use of issued materials which shall be got checked from time to time by the representative of the GETCO. The contractor will be responsible for custody and preserving the issued materials till the work is handover by the contractor after completion.

(f) The contractor has to maintain site register, covering all the daily details of material receipt and utilization, progress of work etc. This register shall be checked and signed by Engineer in charge and Superintending Engineer during the site visit. Any bill without site register shall not be passed.

58.The contractor shall be responsible for breakages, losses and thefts of material during

transit or erection after the materials issued from the stores till the completion of work and is taken over by the GETCO.

59.The erection work should be commenced within seven days from the date of receipt of instruction from the office of the GETCO and should be completed within the time limit there after.

60.The contractor will be responsible for the loss, distribution of deterioration of the materials, stores or articles supplied to him by the GETCO, even if such a loss distribution or deterioration has occurred under any circumstances whatsoever beyond his control as if the materials, stores or articles so supplied were his property.

61.The contractor shall co-operate with the GETCO in recording measurement etc as expeditiously as possible and he shall fulfill all the requirements which are necessary to finalize the accounts on the basis of its records and pay him such amount as if found due to him together with the amount of security deposit. If any remaining payable to him after deduction there from the amount due by him to the GETCO.The GETCO shall not entertain further claim from thereafter.

62.The competent authority can delete any item in schedule of the tender, if he feel that the rate quoted by the contractor for that item is abnormally high when compared to the estimated rates.

63.Delivery of Material:- All material/ equipment required for this work as per schedule shall be delivered at any store centers of TR. Circle, Jamnagar jurisdiction and contractor has to take delivery from these stores at his own cost only.

64.The contractor shall not refuse to execute this work order at any time and it will be his sole responsibility to execute and complete this work as per the instruction of Engineer in charge.

65.You will ensure that completion of erection work i.e. all works connected with substation aving been completed correctly as per Indian Electricity Rules & procedure. Any extra cost nvolved due to incompleteness of work or bad workmanship found out subsequently shall be set right forth with by you at your own cost.

Erection of Equipments.

1. All the equipment to be opened carefully and any damage during opening of equipment cases or during shifting of at erection places will be at Contractor’s cost.

2. Before erection of equipment it should be cleaned properly or if required may be

washed as per instruction Engineer-in-charge.

3. Before erection initial testing of equipment whatever is required is to be done with the help of Engineer-in-charge for which no any extra charge will be paid.

4. Arrangement of erection is to be get inspected by Engineer-in-charge before erection

of equipment and its structure. 5. No any extra charges is to be paid if any equipment is required to change its position

as per requirement after erection.

6. Within the sub-station yard no any extra shifting charge will be paid to the Contractor for any equipment.

7. The detailed drawings of equipments can be seen from this office during any working

day and the equipments which are to be erected can also be seen physically at Jamnagar S/S store during any working day and time.

8. The erection work should be carried out according to the specification as per

instructions and programmed laid out by the Engineer in charge. Contractor has to ensure safe shifting and shifting and erection of all accessories/ equipments as per standard norms.

9. The contractor has to arrange for minor fabrication (if required) at free cost & follow

all labor laws I.E. Rules safety rules, Insurance rules, GETCO rules at his risk & cost.

Erection of 66KV G.I. Structure.

1. All the structure to be erected in line level and in plumb as per instruction of Engineer-in-charge.

2. If any structures falls after erection but before grouting then it is responsibilities of Contractor to bet replace damaged members at his cost.

3. After taking delivery of the structures from GETCO stores than contractor is fully responsible for safe custody and theft which will be at Contractor’s cost till completion.

4. During erection due care is to be taken for any damage to any equipment in side the S/S yard and any damage to the equipment is at Contractor’s Cost.

5. Required tools, tackles, ropes, spanners and skilled labors etc. are to be arranged by the Contractor at his cost.

6. All bolt and nuts to be fixed properly and spring washer, flat, washer to be used as per drawing.

7. If any minor fabrication / modification is required during erection to the structure i.e. holes, cutting, which is to be carried out by the Contractor at free of cost.

8. Any loose materials which obstacles during the erection is to be shifted by the contractor for which no extra charges is to be paid.

SCOPE OF WORK

1) RULES AND REGULATIONS:-All works included in this specification shall confirm to the relevant Indian Standard Specification or the British Standard Specification and shall be governed by the I.E. Act Rules & Regulations in force. Due consideration will be given to any special suggestions put forward by the contractor which are calculated to enhance the general utility, efficiency and economy of the installation.

2) COMPLETION OF CONTRACT:-Work of Breaker replacement and its foundation shall be completed in every respect. The contractor shall not be eligible for any extra charges in respect of minor accessories even through they may not have specifically included in the contract document. Earthing of installation wherever required shall also be carried out as per the standard regulations. No extra charges shall be allowed on this account.

3) TOOLS AND TACKLES:-

All the tools & accessories shall be brought by the contractor and department does not bind itself to supply them.

4) MATERILAS AND WORKMANSHIP:-

All the materials shall be of the best quality as specified and so as to suit the tropical climate wit humid atmospheric conditions. All fittings & fixtures should be got approved by the Ex. Engr. before installing the same. The Ex. Engr. Shall have to right to reject any of the materials if the same are found to be defective and/ or inferior quality than those specified.

5) SPECIFICATIONS:-

The fitting will have to be supplied and the work will have to be carried as per specification attached herewith and the same should be got approved by the Superintending Engineer, Jamnagar.

6) ERECTION, STORAGE, INSURANCE:-

The successful contractor shall provide, at his own cost, the insurance cover for the materials, transit, storage, handling & erection. No payment will be made before any damage to the material or to the staff engaged by him in carrying out the work.

7) The offer shall be complete in all respect & shall include all materials, tools

&appliances whether specified or not required for completing of the installation of yard lighting system.

8) TESTING AND COMMISSIONING:-All the work must be satisfactory tested as per IEE Rules and necessary certificate in this respect should be provided by the contractor at the time of testing & commissioning of installation, if any appliance or supplied materials is found defective or failed due to carelessness of the contractor the same should be replaced and fixed by the contractor at his own cost and risks.

9) You have to start the work on date of completion and to complete the work in

stipulated time limit given in the work order. Due to any unwanted forced circumstances you have to get approval for the necessary approval for time limit.

TERMS & CONDITIONS REGARDING INDUSTRIAL LAWS AND OTHER RELATED MATTERS.

(1) Wages to be paid at time of payment etc. by the contractor.

(A) The contractor shall pay minimum prevailing rates per day or as may be specified hereafter or rates fixed under the minimum wages Act. Whichever is higher. The wages or very contract labor employed by him under this contact shall be paid by him before the expiry of 7th day of the month in respective of which the wages are payable ( i.e. wages of a month have to be paid by him in the first week of the next month). The payment shall be disbursed in the presence of management representative during the working hours in factory premises and the contractor shall get the entries certified in the register of wages by the representative of the GETCO. Any default will result in cancellation of contract forthwith or also the contractor shall be paid punishable to the extent of Rs.100/- fine per each day.

(B) The contractor shall give his telephone number and address to the GETCO so that in case of labor troubles etc. the contractor can be contacted. The contractor shall arrange to have his office outside the factory premises and the contractor shall keep himself present through out the working hours.

(2) Labor Laws :-

(A) Person below the age of 18 years shall not be employed for the work. (B) No. female worker shall be employed in the night shift between 7 p.m. to 6 a.m. (C) Contractor shall maintain a valid labor license under the contract labor

(Regulation and Abolition) Act for employing necessary manpower to be required by him. In the absence of such license the contract shall be liable to be terminated without assigning any reason thereof.

(D) The contractor shall at his own expenses comply with all labor laws and keep the GETCO indemnified in respective thereof. Some of the major liabilities under various labor and industrial laws which the contractor shall comply with are as under :-

(i) Payment of contribution by way of employer’s contribution towards provident

fund, family pension scheme, Deposit linked insurance scheme, Administrative charge etc. at the rates make applicable from time to time by Government of Gujarat/Government of India or other statutory authority.

(ii) Payment of deposit in respect of each contract labor at the rate as per admissible with the office of commissioner of Labor as per the contract Labor (Regulation and abolition Act.).

(iii) License fee as prescribed under the contract labor ( Regulation and abolition Act ) and rules framed there under depending upon the number of workmen employed by the contractor.

(iv) Paid leave facility and wages as per the provision of the factories Act at the rate of one day for every 20 days of working.

(v) Identify cards as prescribed under the factories Act with photo at fixe there to the same identification. Liabilities as per industrial Disputes Act any payment to the contractor’s employees arising out of any claim or disputes under the industrial Disputes Act, 1947 or any other labor laws.

(vi) Payment of compensation in case accidental injury. (vii) Maternity leave as per the provisions of the maternity Benefit Act. The above are

some of the major liabilities of the contractor in addition to other liabilities. Prescribed under the various labor laws in force from time to time from statutory

authorities like State Government/ Government of India which the contractor shall have to comply with.

(3) Provident fund & Family pension Scheme :-

The contractor shall submit along with his bill (month wise) a statement regarding deduction against employees provident fund and family pension scheme in respective of each concerned employee, provident fund and family pension scheme at the rate at admissible ( or at the rate made applicable by the Government from time to time ) of the wages. The contractor’s contribution and his workers contribution towards provident fund and family pension scheme shall be deposited by the contractor with regional Provident Fund Commissioner, Ahmedabad.

(4) Deposit Linked Insurance Scheme :- The contractor shall have to deposit ½ % of the wage in respect of employees who is a member of the Provident Fund as the contribution to the deposit. Linked insurance Scheme with Regional Provident Fund Commissioner, Ahmedabad.

(5) Administrative Charges :- Administrative charges for maintaining provident fund A/C shall be deposited by the contractor with Regional Provident Fund Commissioner, Ahmedabad at the rates applicable.

(6) Paid Leave Facility :- Paid leave facility at the rate of one day for every twenty days worked by the contract labor shall be provided by the contractor to his workers. He shall maintain leave Records/leave cards for individual laborer which shall be duly verified and approved/certified by the authorized officer of the GETCO.

(7) Workmen’s compensation fund & Employer’s Liability Insurance :- The contractor shall cover all his employees under workmen’s compensation fund and under the liability insurance.

(8) The contractor shall employ adequate number of experienced staff at site for dial supervision and for maintenance of various register and records required under the law and contract No. payment for supervision shall be admissible.

(9) Contractor to Identify the GETCO :- The contractor shall indemnify the GETCO and every member officer and employees of the GETCO also, engineering in charge and his staff against all actions, proceeding, claims demands, costs and expenses which may be made against the GETCO or Government for or in respective of formance of his obligation under the contract documents. The GETCO shall not liable for or in respective of or in consequence of any accident or injury to any workman or other person in the employment of the contractor or his sub-contractor and the contractor shall indemnify and keep indemnified the GETCO against all such damage and compensation and against all claims, demands, proceedings costs, charges and expenses whatever in respective thereof in relation thereto.

(10) Workmen’s compensation and employer’s liability insurance :- Insurance shall be affected for the entire contractor’s employee engaged in the performance of this contract. If any of the work is subject the contractor shall require the sub-contractor to provide workmen’s compensation and employer’s liability insurance for the latter’s employees unless such employees are covered under the contractor’s insurance.

(11) The GETCO reserves the right to terminate this rate contract at any time during its tendency without giving notice of termination or any reasons thereof.

(12) The GETCO will be entitled to deduct directly from the bills, to be paid to the contractor any sum or payable by you and which sum/sums the GETCO is required to pay as principal employer on account of your default in respect of all liabilities referred to in above clauses.

(13) The contractor will be required to produced a solvency certificate for an amount as decided by Superintending Engineer and also to produce his Income-Tax clearance certificate.

1. The contractor shall ensure proper safety of all the workmen, materials, equipment & plant & belonging to him or to GETCO or to others, working at the site. The contractor shall also be responsible for provision of all safety notices and safety equipment required both by the relevant legislations and Engineer, as he may deem necessary.

2. All equipment used in TRANSMISSION and erection by contractor shall meet Indian/International Standards and where such standards do not exist, the contractor shall ensure these to be absolutely safe. All equipment shall be strictly operated and maintained by the contractor in accordance with manufacturer’s operation manual and safety instructions and as per guidelines/ rules of GETCO in this regard.

3. Periodical examinations and all tests for all lifting/ hoisting equipment & tackles shall be carried – out in accordance with the relevant provisions of Factories Act 1948, Indian Electricity Act 1910 and associated Laws/Rules in force from time to time. A register of such examinations and tests shall be property maintained by the contractor and will be promptly produces as and when desired by Engineer or by the person authorized.

4. The contractor shall provide suitable safety equipment of prescribed standard to all employees and workmen according to the need.

5. The contractor shall provide safe working conditions to all workmen and employees at the site including safe means of access, railings, stairs, ladders, scaffoldings etc. the scaffoldings shall be erected under the control and supervision of an experienced and competent person. The contractor only shall use good and standard quality of material.

6. The contractor shall not interfere or disturb electric fuses, wiring and other electrical equipment belonging to the owner / other contractors under any circumstances, whatsoever, unless expressly permitted in writing to handle such fuses, wiring or electrical equipment.

7. Before the contractor connects any electrical appliances to any plug or socket belonging to the other contractor or owner, he shall:

1) Satisfy the Engineer that the appliance is in good working condition; 2) Inform the Engineer of the max. current rating & voltage of the appliances; 3) Obtain permission of the Engineer detailing the sockets to which the appliances may

be connected.

8. The Engineer will not grant permission to connect until he is satisfied that; 1) The appliance is in good condition and is fitted with suitable plug 2) The appliance is fitted with a suitable cable having two earth conductors, ones of

which shall be an earthed metal sheath surrounding the cores. 9. No electric cable in use by the contractor/ Owner will be disturbed without prior permission.

No weight of any description will be imposed on any cable and no ladder or similar equipment will rest against or attached to it.

10. No repair work shall be carried out on any live equipment. The equipment must be declared safe by the Engineer and a permit to work shall be issued by the Engineer before any repair work is carried out by the contractor. While working on electric lines/ equipment, whether live or dead, suitable type and sufficiently quantity of tools will have to he provided by the contractor to electricians/ workmen/ officers.

11. In case any accident occurs during the TRANSMISSION/ erection or other associated activities undertaken by the contractor thereby causing any minor or major fatal injury to his employees due to any reason, whatsoever, it shall be the responsibility of the contractor provide medical facility / treatment & to promptly inform the same to the Engineer in prescribed form and to also to all the authorities envisaged under the applicable laws.

12. The Engineer shall have the right at his sole discretion to stop the work, if in his opinion the work is being carried out in such a way that it may cause accidents and endanger the safety of the persons and/or property and/or equipment. In such cases, the contractor shall be informed in writing about the nature of hazards and possible injury/ accident and he shall comply to remove shortcomings promptly. The contractor after stopping the specific work can, if felt necessary, appeal against the order of stoppage of work to the Engineer within 3 days of such stoppage of work and decision of the Engineer in this respect shall be conclusive and binding on the contractor.

13. The contractor shall not be entitled for any damages/ compensation for stoppage of work due to safety reasons and the period of such stoppage of work will not be taken as an extension

of time for completion of work and will not be the ground for waiver of levy of liquidated damages.

14. it is mandatory for the contractor to observe during the execution of the works, requirements of safety rules which would generally include but not limited to following;

1) Each employee shall be provided with initial indoctrination regarding safety by the contractor, so as to enable him to conduct his work in a safe manner.

2) No employee shall be given a new assignment of work unfamiliar to him without proper introduction as to the hazards incident thereto, both himself & his fellow employees.

3) Employee must not leave naked fires unattended, smoking shall not be permitted around fire prone areas and adequate fire fighting equipment shall be provided at crucial location.

4) There shall be a suitable arrangement at every work site for rendering prompt and sufficient first aid to the injured.

5) Requirements of ventilation in underwater working to licensed and experienced divers, use of gumboots for working in slushy or in inundated conditions are essential requirements to be fulfilled.

15. The contractor shall follow and comply with all GETCO safety Rules, relevant provisions of

applicable laws pertaining to the safety of workmen, employees, plant and equipment as may be prescribed from time to time without any demur, protest or contest or reservations. In case of any discrepancy between statutory requirement and GETCO safety rules referred above the latter shall be binding on the contractor unless the statutory provisions are more stringent.

:GENERAL GUIDELINES FOR IMPLEMENTATION:

1. Details of categories of check codes A,B & C including accepting and deviation dispositioning authorities are indicated at annexure-I

2. GETCO specification shall mean GETCO technical specification, approved drawings data sheets and Law provisions applicable for the specific contract.

3. Acceptance criteria and permissible limits shall be as per relevant Indian Standards and / or prevalent code of practice / GETCO specifications.

4. It is clarified that the tests indicated at column 2 of this FQP i.e. Against column “component operation & Description of test “, are only generally required to be conducted. However GETCO reserves the right to carry-out any additional tests at any stage if the situation so warrants.

5. SE (TR) of circle shall approve testing laboratory before accepting the test results from the lab. 6. SE (TR) of circle shall approve the sources for cement, coarse aggregate, fine aggregate & water before actual utilization. 7. All the testing & measuring equipments used by the contractor for testing are required to be calibrated. A

Copy of valid calibration report shall be retained by GETCO based on the joint inspection. 8. Classification of foundations shall be approved by GETCO based on the joint inspection report & Soil investigation

reports. 9. Zone-IV fine aggregate shall be used for nominal mix. Reinforced cement concreting work.

Zone-IV fine aggregate shall be avoided for design mix reinforced cement concreting work unless tests have been done to ascertain the suitability of proposed with the prior approval GETCO sit.

10. Bricks should be free from cracks, flaws and modules of free lime. They should have smooth rectangular faces with sharp corners and should be uniform in colour.

11. Cement In case of cement is in the scope of the contractor, the same shall be procured from sources approved by GETCO site and got tested on sample basis for specified acceptance tests as specified in the FQP at a reputed third party lab approved by GETCO site.

The samples of cement for site testing shall be taken within three week of the delivery and all the tests shall be commenced within one week of sampling. If the cement remains in store for a period of more than Six months. All the site tests are required to repeated before usage.

The source and grade of cement shall be as per approved design mix. 12. Reinforcement steel & structural steel used in cable trenches & foundations In case supply of steel is in the scope of the contractor, the same shall be procured from the main producers i.e. SAIL,

TISCO, IISCO or Rashtriya Ispat Nigam or the rerollers approved by main producers. The results of testing of cement and reinforcement steel referred in 12.1 and 13.1 above shall be got approved from

GETCO site before cement and reinforcement steel are put to use. However, in exceptional cases due to exigencies of work, GETCO site may authorize the contractor to use cement and reinforcement steel even before the test results are received. However, in all such cases, if the test results subsequently received are found to be not complying with the specified acceptance criteria, the contractor shall have to dismantle and recast all such foundations cast with such non-conforming materials at his own cost. Confirmation to this effect shall be obtained from the contractor by the project authorities beforehand in all such cases.

13. The contractor shall submit welding procedure specification (WPS) including the type of electrode used for approval of GETCO site before staring the welding work. The welder with proper certificate shall be deployed

14. Approval / acceptance of individual test results by GETCO in the course of execution of contract will neither relieve the contractor from his contractual obligations and responsibilities, nor does it limit the owner’s right under the contract.

15. In case, requirement of special items like super sulphated cement, corrosive resistant reinforcement Steel (CRS) etc. arise due to site conditions, the specific approval of GETCO may be obtained before using the same and all the tests as per relevant standards shall be carried out.

16. All the materials shall be stored by the contractor in a manner affording convenient access for identification and inspection at all the times. Storage of material shall be in accordance with IS: 4032 (latest edition).

(D) TECHNICAL SPECIFICATIONS: (E1) General Conditions :1. The contractors shall at their own expense make all necessary provisions for housing, water supply, and sanitary arrangements for their employees as well as for works and shall pay direct to the authorities concerned, all rates and taxes. 2. The contractor shall make their own arrangements for the necessary approach, road, for transport of their materials and be responsible for the compensation on account of damage to crop etc. & shall till completion of work. 3. All the royalty charges, Octroi and other duties & all taxes will be paid by the contractor and no extra be claimed on this account. 4. Godowns or sheds hired or constructed for storing of controlled materials and more particularly of cement shall be such as would prevent the materials from getting damaged in any way. 5. It will be absolutely incumbent on the contractors to have on the site of work only such of the materials as have been duly passed by the Engineer-in-charge. Materials that have been rejected must on no account be allowed to remain on the site, and in spite written order to do so, any such rejected material is on the site beyond a period of 48 hours notice, the Engineer-in-charge shall have the right to remove it, at the risk and cost of the contractors and even to destroy it. 6. It must be distinctly understood that conditions of contract and of claims in respect of extra work, will not be allowed unless the works to which they relate is clearly without the spirit and meaning of the specifications or unless such works are ordered in writing by the Engineer-in-charge and claimed for in specified manner. 7. On completion of the work, the site shall be cleared by the contractor within the stipulated period, and ground brought to original state and they shall not be entitled for any extra claim on this account. 8. General Specifications of the relevant Indian standard specification shall also apply. 9. Damage to work clause: The works whether fully constructed or not and all materials, machinery plant tools, temporary buildings and other things connected there shall be at the risk and in the sole charge of the contractor, until the works have been delivered, completed to the satisfaction of the Engineer-in – charge and certificate from him to the effect is obtained. Until such delivery, the contractor shall at their own cost, take all the precautions reasonably necessary, to keep all the aforesaid works, materials, machinery, plant tools. Temporary buildings and other things connected with the works, free from any loss or damage and in the event of the same or any part thereof being lost or damaged, shall forthwith within the possible speed, reinstate and made good such loss or damage at contractor’s own cost. 10. Any components or part of the work shall not be given to any sub-contractor without approval of the competent authority of the Corporation. The whole responsibility of the execution of the work, as per the terms and conditions of the contract, will entirely rest of the main contractor. The main contractor shall always keep his responsible representative, preferably a technical hand, on work site with powers to sign M.R.s. and take necessary decision and implement the instructions issued in the interest of efficient execution of the works. 11. The Engineer-in-charge will fix the hours of work, and no work shall be executed beyond that period, during night time or in absence of the Engineer-in-charge of his authorized agent. The box measures shall be filled only in the presence of the engineer-in-charge or his authorized agent. 12. Contractor will be asked to present the sample of materials, and the approved samples will be preserved at the site of work, and no charge in the approved sample will be allowed, without the written permission of the Engineer-in-charge. 13. In any work is not executed according to the specifications, and the directions of the Engineer-in - charge, the same will be rejected, and the contractor has re execute the same without any financial implication to the Corporation. 14. Contractor will have to communicate the name of his authorized agent, who shall be present on the works, and shall be authorized to sign the material requisitions, receive instruction given verbally or on the order book, on behalf of the contractor. 15. The contractor will have to sign the conditions of contract, and execute the agreements, send the list of previous works executed, solvency certificate and pay up the security deposits, falling to that, the tender will be rejected and earnest money deposited will be forfeited. The value of the stamp paper and stamp duty charges shall be borne by the contractor. 16. Tenderer must return the form of tender, with the specifications and the schedule of quantities, and rates and other schedules only signed on each page. Any tender not bearing signature of the tenderer on all the documents accompanying the tender is liable to be rejected.

17. Before submitting his tender, unit rates, which shall be for the finished work complete, including charges involved in testing, maintenance for a period of 12 months, the tenderer shall closely examine the specifications and carefully study the drawings and all documents, which form a part of the contract, to be entered into by the accepted tenderer. 18. The Tenderer must visit the site of works and see for himself the site conditions regarding water, labor conditions rates approach road during all seasons and all other matters affecting the works before submitting the tender. 19. The submission of tender by a contractor implies that, he has read these instructions, the conditions of contract etc. and has made himself aware of the scope and specifications of the work to be done, and of conditions and rates at which stores will be issued to him, and local conditions and other factors bearing on the executions of the work. The Corporation will not therefore, after acceptance contractor’s rate, pay any extra charge for lead or for any other reason. In case the contractor is found later on, to have misjudged the site conditions. 20. The tender document shall be written legibly and free from erasure, over writing or conversions of figures. Correction where unavoidable, shall be made by crossing out, initialing, dating and rewriting. 21. The Corporation or its officers, who accept tender, shall have the right of rejecting all or any of the tenders, and will not be found to accept the lowest offer not to assign any reasons whatever, for the rejection of any tender or all tenders. 22. The tender notice to tenderers shall from a part of the contract. 23. The entire work is to be completed, within the stipulated time limit from the date of issue of letter for commencement of the work by field office. The contractor will not be eligible for any extra for the idle period of works, or waiting period that may be required to suit other consideration, and no claims for compensations on account of such, will be considered. However in case of delay due to circumstances beyond the control of contractors, either in date of commencement or due to, waiting during construction, extension in time may be considered for completion of works, without any penalty to the Corporation. 24. The contractor shall keep full time qualified Civil Engineers at the site, who shall be fully authorized to receive and comply with such instructions, as given by the Superintending engineer. The name of such Engineer with his qualifications and experience shall be intimated by the contractor. The Superintending Engineer shall have the right to demand the removal of any technical personnel, skilled or unskilled workmen, who in his opinion are considered to cause bad workmanship in the execution of works or to cause indiscipline. 25. The department reserves the right to make any change in the design and the plans of the works and the contractor shall be bound to carry out them at the rates tendered. No claim or compensation will be allowed on this account. 26. Bills shall be submitted by the contractor monthly on or before the date fixed by the Superintending Engineer, for all works executed in the previous months. 27. Should this tender be accepted I /We hereby agree to abide by and fulfill all the terms and provisions of the “Tender & contract for works” as applicable, and in default thereof to forfeit and pay to the Corporation the sums of money due. 28. The contractor shall keep instruction book on site, for taking site instruction from time to time. This book shall be made available on site whenever asked for. 29. The contractor shall pay wage to the workers, as per minimum wages act as declared by the Government time to time. 30. The contractor shall follow all labor laws of Govt. 31. Contractor shall arrange for testing of material to be used in the work or finished product, if desired by the Superintending Engineer. The provision shall be made in the unit rate quoted for this. 32. The full value of the “Earnest Money Deposit” paid herewith, shall be forfeited to the Corporation, if the contractor fails to deposit the full amount of specified security deposit, within stipulated time.

(E2) Use of Materials:

I. The contractor shall have to use the best quality of materials in the work, as per the specifications and relevant I.S. codes. In case Corporation desires to carry out any field test/laboratory test for any materials required for the work, the contractor shall arrange for the same at his own cost. Further, for any finished works such as masonry, plastering, cube testing for all important concreting work etc., if any testing is required same shall be arranged by the contractor at his own cost. The contractor shall have to maintain the regular records for such testing and shall submit along with each R.A. bills.

II. No collection of materials shall be made before it is go t approved from the Engineer-in-charge.

III. Materials, if and when rejected by the Engineer-in-charge shall be immediately removed from site of work. IV. All installations pertaining to water supply and fixtures thereof as well as drainage lines and sanitary fittings

shall be deemed to be completed only after giving satisfactory tests by the contractor. V. Approval to the samples of various materials given by the EIC shall not absolve the contractor from the

responsibility of replacing defective material brought on site or materials used in the work found defective at a later date. The contractor shall have no claim to any payment or compensation whatsoever on account of any such material being rejected by E.I.C.

VI. Approval to any of the executed item for the work does not in any way relieve the contractor of his responsibility for the correctness, soundness and strength of the structure as per the drawing and specification.

Special condition for use of cement in work: 1). The rate in Schedule-B is inclusive of cement cost. Contractor has to purchase fresh 43-53 grade cement

confirming to as per IS: 8112 and of approved brand by G. E. T.C.O. 2). Contractor has to construct pucca go-down at site of work so that cement bags can be properly preserved to

avoid damage due to any kind of water. 3). Contractor has to bring sufficient of cement bags and at no time less than 200 (two hundred.) bags to maintain

progress of work .The work should not suffer for want of cement. 4). Cement should give the required strength. 5). To bring sufficient and timely cement at site is full responsibility of contractor Nothing extra will be paid on

account of any reason to maintain progress of work and to complete the work in schedule time. 6). Contractor has to submit material account for consumption of cement used with every bill. In case of not

submitting the same, bill will not be passed. Party has to submit the copy of cement/purchase bill along with each RA Bill/Final Bill.

7). No negative variation will be allowed for consumption in cement then prescribed as per booklet of technical specification of Corporation/mix design and nothing will be paid extra for over consumption.

8). Contractor is fully responsible for safety of cement at site; nothing will be paid extra on account of safety. 9). If Corporation’s authorized representative wants to check cement stock at site, contractor has to allow for the

same at any time. 10). Contractor has to maintain day-to-day cement consumption / balance account at site. 11). As far as possible contractor has to maintain supply of cement of only approved brand and grade throughout

the work. 12). Minimum cement consumption considered for cement concrete having grade of M-15/M-20/M- 25 is 300

Kgs/320-Kgs/340Kgs respectively. Contractor has to use minimum cement as above. Contractor should not use less than the prescribed quality of cement even in the case of mix design recommends lower quantity.

13). Contractor will be allowed to carry out work only after physical verification of cement brought at site. (E3) CEMENT CONSUMPTION SCHEDULE:The proportion of cement with coarse aggregate and the fine aggregate for cement concrete works & with sand in case of cement mortar will be in accordance with the under mentioned schedule showing the consumption of cement in bags. REMARK:- 1) THE SERVICE TAX WILL BE PAID AS PER PREVAILING NORMS ON PRODUCTION OF SERVICE TAX AND AGAINST PRODUCTION OF PAYMENT PROOF.BIDDER HAS TO QUATE THE SERVICE TAX SEPARATELY. NOTE :-

1 All erection work is to be carried out as per the manual of OEM (Original equipment manufacturer), FQP and instruction of E.I.C.

2 All equipment erection charges are inclusive of shifting dragging handling of the respective equipment up to S/S erection site from its S/S site store.

3 Contractor has to ensure safe shifting dragging erection of all equipments to comply with labor laws I.E. rules etc.

4 All erection charges are inclusive of fixing of clamp connectors, all necessary accessories to the respective equipments.

5 All erection work includes erection insurance to be arranged by the contractor at his cost.

6 All the required tools and tackles like compression jointing machine for conductor, earth wire, cutting machine, welding set, drill machine, etc are to be arranged by the contractor at his cost.

7 Electric power supply for project related work like testing, commissioning, fabrication, oil filtration work, battery charging, etc will be arrange by GETCO.

8If filtration of transformer is required in any case the filter machine will be provided by GETCO but transporting and operating arrangement should be done by the contractor on own cost till filtration will continue.

9 All the supply items get to be approved from DE/EE invariably 10 The execution of bore are to be carried out as per soil strata in consultation with E.E. 11 The Classification of hard rock strata should be got approved from E.E. inn variably. 12 No any hard rock shall be given in any item except excavation for earthing pit only.

After issuing the equipment / material for the said work whole the responsibility of security any damage to the same will be of the contractor till the work completion.

Contractor has to make arrangement for site engineer and skill labors for maintaining all activities and records as per FQP. also assisting to staff/Engineer in charge to take IR values, Earth pits values, name plate detail, oil samples etc all activates relative to commissioning of project.

15 Contractor has to make arrangement for skill labors for assisting to commissioning engineer, PLCC staff/engineer, SMS/testing staff/Engineer as an when require as per instruction of Engineer in charge.

After completion of project successful bidder has to submit all the records like battery charging report, control wiring schedule, earth pit lay out, earthing grid layout, power cable lay out, yard light pole and ckt lay out etc in hard and soft copy for handing over the project.

17 Excavation for cable laying, earthing, etc are to be carried out in any type of soil/rock strata.

18 Contractor has to submit the progress bar chart before starting the work.
