New Guidelines released to tackle agent underquotingVictor Dominello, Minster responsible for NSW Fair Trading, has announced new guidelines for the Real Estate industry related to underquoting.

Underquoting occurs when an agent falsely understates the selling price of a property in the course of marketing that property. It is an offence under the Act to advertise a selling price which is lower than the price specified in the agency’s agreement with the seller.

“For most people buying a property is the biggest purchase they will make in their lifetime and the NSW Government is working in partnership with the industry to ensure the law regarding price advertising and representations is clear to all real estate agents,” said Minister Dominello.

The guidelines, developed in consultation with the Estate Agents Co-operative are designed to provide agents and consumers with clarity over what constitutes underquoting and how it can be avoided.

They contain guidance on specifying price guides in line with vendors’ expectations and ensuring online listings are maintained and kept updated for the benefit of potential buyers.

Estate Agents Co-operative CEO David Crombie said, “We understand there has been difficulty, especially in the Sydney market, to make accurate estimates on pricing.

“In light of a volatile market agents should review their estimates and any marketing to reflect any change to the price estimate as a result of market or vendor feedback. We welcome the guidelines announced by the minster and feel they will make clear to agents as well as to consumers, the responsibilities when making these estimates,” said Mr Crombie.

Prominent Sydney agency BresicWhitney was charged with underquoting in March, with the case still making its way through the courts. The guidelines say that agents who are guilty of underquoting are liable for a $22,000 penalty if they give a false oral or written estimate to a buyer or seller.

Further to this, Minister Dominello also announced that the Government will be seeking further legal powers in relation to underquoting. “We have also made a commitment to enhance legal protections against underquoting and we will be introducing legislation in the new Parliament,” said Mr Dominello.

The proposed laws will clarify what constitutes underquoting, expand the existing financial penalties to include commissions and fees and place more stringent record-keeping requirements on real estate agents.

Federal inquiry calls for end to stamp dutyLiberal, Labor and Greens parliamentarians have joined forces to call for an end to stamp duty.

The final report of the Senate Economics References Committee’s affordable housing inquiry described stamp duties as a “flawed” revenue source.

“The committee believes stamp duties are an inefficient, productivity-damaging form of taxation which ultimately increase barriers to home ownership,” the report said.

Multiple inquiries have found that stamp duties undermine housing affordability, distort housing choices and reduce the efficiency of land use, according to the report.

It also noted that stamp duties reduce people’s flexibility around their housing options, which in turns reduces labour mobility and hurts economic productivity.

The committee noted that stamp duties

represent a significant source of revenue for the states and thus should be replaced by “more efficient forms of taxation”, such as broader land taxes.

It was acknowledged that such a transition would have a negative impact on asset-rich, income-poor households and retirees.

However, the committee said governments could offset this damage by providing exemptions for owner-occupiers who would be unfairly affected by a broadening of the tax.

“Meaningful reform is difficult, but it is no less important for being so,” the report said.

“The committee believes that if the will exists, it will be possible to phase out stamp duties in a way that is revenue neutral, equitable and has a positive impact on housing affordability.”

Although stamp duties and land taxes are state issues, the federal government needs to lead the process of coordinated reform, according to the report.

“This engagement would be based on a recognition that the implementation of such reforms should ideally take place as part of a broader process of taxation reform, possibly in response to the [forthcoming] tax White Paper.”

The committee consisted of seven Labor MPs, five from the Coalition, two from the Greens and two independents.

Current Vacancy ratesVacancy rate figures for Wollongong are currently standing at 1%. For the same period, the All Residential Real Estate vacancy rate was 0.3%. Once again, the rate is significantly lower than the Wollongong average – more than 3 times better.

How did you get into real estate? I sold my business to the owner of Ray White Banora Point (Qld/NSW Border) and he told me that he would only buy my business if I came and worked for him at his real estate business

How long have you been in real estate? Just over 4 years. I started in February 2011.

First sale? 44 Conway Cres, Blackbutt

Most memorable sale? I have 2. My first million dollar sale being 64 Headland Pde, Barrack Point. Purely because I had a goal to sell a million dollar home that year and that made me reach the goal. The second would be 141 Daintree Dr, Albion Park. It was listed with two agents before I listed it, it was on the market for close to a year. I listed it, took it to auction and sold it within a week after the auction for $935,000 so I was pretty happy with that one too.

What are the current trends in the market? We have seen a significant rise in the sales market of the past 12 months. Increasing in most areas by 10-15% on average. With interest rates at an all-time low, I can only see the market to continue to be strong for the short term until we see an interest rate rise which I think will slow the market down considerably

How do you see the market in the next 5 years? I believe we will see interest rates start to rise in the next year or so with more properties coming onto the market. This is the typical trend in the housing market after a boom like we are experiencing at the moment

What do you find most challenging about real estate? Everyone tagging you as the “Typical real estate agent”. You are automatically flagged as “like all the rest”, then you have to prove you are not like the rest

What changes would you like to see? Mandatory pest and building reports supplied by the vendor. This will avoid the slowing of the process of exchange as the report will be available the day a client inspects a property

What would you be doing if you weren’t in real estate? - I have always had an interest in property developing so probably doing something along those lines

Goals? To build up the business I have just bought into a highly successful multi office business

Interests & hobbies? I love sport. Mainly rugby league and AFL. I also love playing texas hold em poker

Favourite movie? The Shawshank Redemption. Morgan Freeman would have to be one of my all-time favourite actors

What type of music do you listen to? I love Rock. INXS, Metallica, also some old rock like the Beetles, Rolling Stones and ACDC. I actually have a son called Hutchence after Michael Hutchence

Favourite holiday destination? I have been to Bali 14 times however I loved Tonga when I was there a few years ago as it reminded me of Bali 20 years ago

Favourite meal? Nasi Goreng (Indonesian fried rice)
