Dear REALTORS®,
Normally this time of year, we’d all be talking about the end of “season.” But, this year has been different for most of us. The usual hustle and bustle of January and February has been pushed back; March was solid and April has been refreshingly busy. When you are really busy with work and client services, don’t forget to make time for yourself, too.
A veteran REALTOR® once gave me great advice. He said to schedule “your” time in your calendar just like an appoint-ment for a client. You wouldn’t cancel an appointment with a client; don’t give up “your” time, either. Put the same value on your time as any other client time.
Speaking of busy, candidates for the office of Florida REAL-TORS® Secretary are currently campaigning. You may re-ceive emails, calls, and/or letters from the candidates: Gia Arvin, Lynnette Hendricks and Veronica Malolos. 2 weeks ago, your RAIRC State Directors met with the candidates at our District 3 conference in Stuart. I can assure you that we have 3 great candidates running for the office. All were well informed with the needs of our REALTORS®.
Additionally, FR Past President, Mike Dooley, gave an amaz-ing speech on the water quality issues facing Florida and the impact it will have on real estate. Unlike everything you’ve heard before about algae and red tide, President Dooley gave us the history on how the Kissimmee River was manip-ulated for faster, more direct flow and how that has forever altered Lake Okeechobee, the Everglades and our waters. As he spoke, I thought about how his speech is exactly what Realtors need to best service their buyers.
1. You need to know the history of the area. 2. You need to know the effects that history has had on the
present market. 3. You need to be able to give sound advice on where the
markets are headed.
Now, that you’ve scheduled some “your” time, use some of that time to go out and learn more about your community’s history. Get involved, and make an impact.

In my time off, I enjoy exploring Florida with my wife, Melania. I also support the communities I serve through various charities. I am most proud of the 17-year involvement in the University of Florida Sport’s Camp for Type 1 Diabetic Young People.

Ethics Case Interpretations related to Article 2
Case #2-14: Time at Which Modification to
Cooperative Compensation is Communicated is a Determining Factor
(Revised Case #9-26 May, 1988. Transferred to Article 2 November, 1994. Cross-reference Case #3-7. Revised May, 2017.)
REALTOR® A listed Seller X’s home and entered the listing into the MLS. The relevant MLS data field indicated the compensation REALTOR® A was offering to the other
Participants if they were successful in finding a buyer for Seller X’s home.
During the next few weeks, REALTOR® A authorized several Participants of the MLS, including REALTOR® C, to show Seller X’s home to potential buyers. Although several
showings were made, no offers to purchase were forthcoming. REALTOR® A and Seller X, in discussing possible means of making the property more salable,
agreed to reduce the listed price. REALTOR® A also agreed to lower his commission. REALTOR® A changed his
compensation offer in the field in the MLS and then called the MLS Participants who had shown Seller X’s property to
advise them that he was modifying his offer of compensation to cooperating brokers. Upon receiving the
call, REALTOR® C responded that he was working with Prospect Z who appeared to be very interested in
purchasing the property and who would probably make an offer to purchase in the next day or two. REALTOR® C
indicated that he would expect to receive the compensation that had been published originally in the MLS and not the reduced amount now being offered to
him, since he had already shown the property to Prospect Z and expected an offer to purchase would be made
shortly. REALTOR® A responded that since Prospect Z had not signed an offer to purchase and no offer had been
submitted the modified offer of compensation would be applicable.
The following day, REALTOR® C wrote an offer to purchase for Prospect Z. The offer was submitted to the Seller by
REALTOR® A and was accepted. At the closing, commissions were dispersed reflecting the modified offer
communicated to REALTOR® C by phone. REALTOR® C refused to accept the check indicating that he felt
REALTOR® A’s actions were in violation of the Code of Ethics. REALTOR® C filed a complaint with the
Association’s Grievance Committee alleging violation of Articles 2 and 3 on the part of REALTOR® A citing Standard
of Practice 3-2 in support of the charge.
During the hearing, REALTOR® C stated that REALTOR® A’s modification of the compensation constituted a
misrepresentation through concealment of pertinent facts since he had not provided REALTOR® C with specific
written notification of the modification prior to the time
REALTOR® C began his efforts to interest the purchaser in the listed property. REALTOR® A defended his actions by
indicating that timely notice of the modification of compensation offered had been provided to REALTOR® C
by telephone prior to REALTOR® C submitting a signed offer to purchase. REALTOR® A also indicated that his modified offer of compensation had been noticed to all
Participants, including REALTOR® C, through the MLS in accordance with Standard of Practice 3-2 prior to the time
that REALTOR® C had submitted the signed offer to purchase. REALTOR® A also commented that had
REALTOR® C submitted the signed offer to purchase prior to REALTOR® A communicating the modified offer, then
REALTOR® A would have willingly paid the amount originally offered.
Based on the evidence presented to it, the Hearing Panel concluded that REALTOR® A had acted in accordance with the obligation expressed in Standard of Practice 3-2 based on changing the offer of cooperative compensation in the
MLS alone, even without the courtesy phone calls, and there had been no concealment of a pertinent fact relating
to the transaction, and consequently was not in violation of Articles 2 or 3.

MLS Statistics
Statistics developed by the REALTORS Association of Indian River County through its Multiple Listing Service and in conjunction with Florida REALTORS reflect the following for March 2018/2019. The Residential closed sales of single-family detached homes totaled 293 units for March 2019. This compares to a total of 306 units in March 2018. The median price of single-family detached homes sold by members of the REALTORS Association
of Indian River County MLS for March 2019 was $248,500. This compares to a median price of $225,000 for March 2018. Current active inventory of residential
single-family detached homes total 1,639 for March 2019. This compares to the active inventory of 1,441 for
March 2018.
The Residential closed sales of condominium homes totaled 66 units for March 2019. This compares to a total of 67 units in March 2018. The median price of
condominium homes sold by members of the REALTORS Association of Indian River County MLS for March 2019 was $175,000. This compares to a median
price of $130,000 for March 2018. Current active inventory of condominium homes total 530 for March 2019. This compares to the active inventory of 415 for
March 2018.

Government Affairs Update
The Broker Involvement Program What does it offer?
Voice on Capitol Hill
The program is an opportunity to bring a strong and united REALTOR® voice to members of Congress.
With over 16,000 broker owners and 450,000 agents in the program, the REALTOR® voice will be heard loud
and clear.
Easy-to-Manage Solution
Nothing needs to be downloaded and there is no cost
to the broker. NAR gives the broker-owner or managing broker access to the Broker Portal.
Proven Results
Calls for Action response rates are significantly higher
when agents receive their message from their broker. Nearly 40% of all responses on Calls for Action were
from agents in the Broker Involvement Program.

New FHFA Head, Utility Model Embraced
NAR is applauding the confirmation by the Senate of Mark
Calabria, a former NAR economist, as director of the Federal
Housing Finance Agency. “As he begins his tenure, we urge
Director Calabria to work closely with Congress in the effort
to responsibly reform the GSEs, particularly in search of
policies that protect the 30-year fixed rate mortgage, secure a
government guarantee, and emphasize taxpayer and consumer
protection,” NAR President John Smaby said in a statement.
NAR led a coalition of industry organizations in urging
Calabria’s confirmation.
Also, housing industry leaders are coalescing around a plan
backed by NAR that would transform Fannie Mae and Freddie
Mac, known as government-sponsored enterprises (GSEs),
into regulated utilities designed to promote stability in the
housing market, particularly when the economy encounters
turbulence.
FHA to Flag Risky Loan Applications
The Federal Housing Administration announced that effective
for mortgages with case numbers assigned on or after March
18, lenders may be required to manually underwrite certain
loan applications submitted through the automated
underwriting system. FHA is concerned that the percentage of
FHA loan applicants with a debt-to-income ratio over 50
percent is at its highest level since 2000 even as the average
borrower credit score has decreased to its lowest point since
2008.
Rules Tightening on Energy Loans
Rules are in the works to require borrowers of specialized
home energy efficiency loans to meet the same repayment
standards as regular home mortgage loans, a notice by the
Consumer Financial Protection Bureau says. The agency
published a notice of proposed rulemaking saying it was
preparing rules to meet a statutory requirement that Property
Assessed Clean Energy (PACE) loans meet ability-to-repay
and civil liability requirements that apply to other loans. NAR
supports heightened consumer protection and transparency
standards.
Florida Realtors Continue Legislative Efforts
Florida REALTORS continue efforts seeking support and
approval of their 2019 Legislative Session initiatives:
• Preserve Florida’s natural resources
• Fully fund the Housing Trust Funds
• Curb Assignment of Benefits fraud
• Protect private property rights
• Provide owners remedies for open and expired
permits
• Continue reducing the business rent tax
• Modernize real estate transactions through remote
notaries
• Keep property insurance premiums stable
• Make sure flood insurance maps are accurate

direct link from the listing records. Realist allows users full
access to valuable data, such as ownership, property
characteristics, assessment, taxes and exemptions, sales
comparable, mortgages, foreclosures, and more. Realist
data information is easily exported for contact management
applications, farming lists and mailing lists. Recently
added to Vacant Land property type “View” and
Commercial Zoning Codes fields to input format.
“Advanced / CMA” – 1:30 - 3:30 PM – Searching,
creating custom hot sheets, using the listing cart
functionality for listing managements into any multiple
clients while navigating the MLS. Using the CMA wizard,
you can customize your reports, branding your contact
information, create your own cover sheet, include map,
adjusting price to comparable. Manage your portal
information and email signature. You can save incomplete
CMA and print or email final reports directly to your
clients.
"Listing Photo/Image Size in MLS"
When inputting photos/images into the MLS for a listing
the size can be 800x600, an increase from the standard
640x480. This allows you to use JPG format 1080 size
photos rather than the substandard offer "high resolution."

“Unlicensed Office Staff /
Personal Assistant Application”
Unlicensed assistants may be assigned a login to access the
MLS. This login will only be available to assist Designed
Broker/Designated Broker approved Agents in their duties.
The fee for the login is $48 per MLS billing. Contact the
Association for the application form in order to activate set
up. All requests must be approved by the Designated
Broker.
“Reporting NON-MLS Property as Sold Comps”
A $30 fee for listing entry by Association staff applies to
and includes Non-MLS property when entered and reported
as sold in the MLS for comparable purposes when there is
no listing agreement. A sold property will be allowed to be
entered when sold by an MLS Participant firm when the
criteria is met and documentation is provided by mailing to
RAIRC MLS Staff for entry into the MLS. Contact MLS for
instructions and form. Reported sold properties must have
compensation to be reported in the MLS.
“CoreLogic Enhances “TRESTLE” management
program for IDX and VOW RETS Feeds”
Notifications to transfer from Matrix RETS to CoreLogic
“Trestle” RETS program on the procedure were emailed
from CoreLogic in February, March and April to all current
IDX and VOW Providers with the cutoff date May 20,
2019. Real Estate brokers will now use “Trestle” to receive
listing data feeds from participating multiple listing
organizations and that clients will soon use Trestle to
manage their existing RAIRC IDX and VOW RETS data
feeds. The program called “Trestle Defender” will be used
for monitoring and reporting to protect multiple listing data
information from scrapers and fraudulent third parties to
keep your data in the right hands. Sharing of the unique

Recently added to the RAIRC MLS Rules and Regulations-
Section 4.4: Use of the Terms MLS and Multiple Listing
Service: No MLS participant, subscriber, or licensee
affiliated with any participant shall, through the name of
their firm, their URLs, their e-mail addresses, their website
addresses, or in any other way represent, suggest, or imply
that the individual or firm is an MLS, or that they operate an
MLS. Participants, subscribers and licensees affiliated with
participant’s shall not represent, suggest, or imply that
consumers or others have direct access to MLS databases, or
that consumers or others are able to search MLS databases
available only to participants and subscribers. This does not
prohibit participants and subscribers from representing that
any information they are authorized under MLS rules to
provide to clients or customers is available on their websites
or otherwise.
