I talked with Jenna yesterday and she said that this topic came up in preparation for Juan's interview with Al JazeeraAmerica. Although we do not have "talking points" from John Steiger, she said that Phil Lyman's interpretation may come fromtwo somewhat recent IMs that deal with closures (IM-2010-028 Dec.11, 2009; IM-2013-035, Dec.20, 2012). In one or both ofthese IMs a two year limit is put on closures and if we want a longer closure we have to go through a NEPA analysis to extendit.

John's position is that we don't go back and retroactively change other decisions (closures) when we released these IMs, sothe two year limitation does not apply to Recapture.

IurgetheBLMtoprotectthenaturalandculturalresourcesofRecaptureCanyon,includingthenumerousprehistoricsitesthatareeligiblefortheNationalRegisterofHistoricPlaces.TheseirreplaceablearchaeologicalresourceswillbeputatgreatriskofdamageandlossifBLMapprovesSanJuanCounty'sproposedrightofwayfortheillegallyconstructedoffroadvehicle(ORV)trailinthecanyon.

OnMay10,SanJuanCountyCommissionerPhilLymanleddozensofantifederalgovernmentprotestersdrivingoffroadvehicles(ORVs)pastsignsprohibitingORVuseintoRecaptureCanyon.Althoughthereareapproximately4,000milesofdesignatedroutesopentoORVuseonpubliclandsinSanJuanCounty(2,820milesmanagedbytheMonticelloBLMandanother1,000milesmanagedbytheMoabBLM),CommissionerLymansaidhewasleadingtheillegalORVridetoprotestthe"jurisdictionalcreep"ofthefederalgovernmentandthenotionthattheBLM"arbitrarilyshutdownaroadinSanJuanCounty."

Farfromanarbitraryaction,BLM's2007closureofthetrailtomotorizedvehicleswasbasedonevidencethattheillegallyconstructedORVtrailandsubsequentORVusewascausingadverseeffectstothecanyon'sprehistoricculturalresources.Thepotentialfortheseadverseeffectshasnotbeennegated.Thus,BLMmustdenythecounty'srightofwayproposalandcontinuetoenforcetheORVclosure.

Kay Shumway, Phil Lyman's father-in-law showed up at the Brown's Canyon trailhead this morning and took pictures of thevehicles. According to Laird Naylor he started out with a pretty aggressive stance. Mr. Shumway said he understood BLM wasdoing a damage assessment; laird did not respond directly to that. Laird did say that he ahd taken Phil down to show him thesites before the ride and he is showing the same things to this group.

They spent most of the time talking about other projects and as he and Laird talked Mr. Shumway seemed to calm down.
