New Delhi, dated the 12th August 1947

No. D.-6719-B/47.— Under the terms of the Government of India, FinanceDepartment, Notifications Nos F. 3(2)-F/33, and F 3(8)-F/34, dated the 25thApril 1933 and 31st May 1934 respectively, the Government of India have theright to redeem the whole of the 3 1/2% Loan 1947-50 or any part of it, at par onor after the 15th November 1947, on giving three calender months' notice inthe Gazette of India. The Government of India notify accordingly that thewhole of the 3 1/2% Loan 1947-50 will be repaid at par on the 15th November 1947with all interest due upto date. Interest will not accrue on the loan from andafter the 15th November 1947.

INDIAN INDEPENDENCE (PARTITION COUNCILS) ORDER, 1947.

In exercise of the powers conferred by section 9 of the Indian Independence•t, 1917, arid of all other powers enabling him m that behalf, the Govemor-jnerai is pleased to make the following Order:—

1. (1) This Order may be cited ns the Indian Independence (Partition Councils)dei1, 1947.

(2) It shall come into force at once.

2. The Interpretation Act, 1889, shall apply for the interpretation of thisler as it applies for the interpretation of an Aet ot Parliament.

II. Ah from the fifteenth day of August, 1947, there shall be set up in the.nner hereinafter provided 4 bodies to be known respectively as—

(i) tho Partition Council for India and Pakistan,(iij tho Bengal Separation Council,(lii) the Punjab Partition Committee, and(iv) the Assam Separation Council.

4 (1) The Partition Council for Jndia and Pakistan shall consist of—(a) two representatives ot India who shall be Minister*) of the Government

of India, and(b) two representatives of Pakistan, one of whom shall be a Minister ol

the Government of Pakistan and the other shall be cither anothersuch Minister or the High Commissioner for Pakistan in India.

(2) Tho meetings of the Partition Council shall be held alternately under theliniionship of one of the said representatives of Fndia or one of the saidr^sentatives of Pakistan.

(•1) Tho IIigh Commissioner for Pakutun in India shall be entitled to attendan observer nny of <he meetings of tin Partition Council nt which Pakistan isresented by two Ministers.

5. (1) The Bengal Separation Council shrill consist of two representatives ofi\ Bengal and two representatives of Wubl Bengal.

(2) The Punjab Partition Committee shall consist of two representatives ofst Punjab and two representatives of East Punjab.(ri) The Assam Soparatic i Council shall consist of two repreRentatives of Enstigal and two represenfat res of Assam.(4) The said repreaentati :!8 shall be such persons as may bo nominated by the/ernor of the Province c< cerned, and different persons may be nominated forerent meetings of the Co cil or Cmmnitiet', us the case may be.(j The meetings- of each the borlk-i im-iHionpd in Arliele 5 shall be held —

For the purposes of this Article a series of meetings held in one place fromday to day ahull be deemed Lo be a single meeting.

7 It shall be tho duty of each of the bodies mentioned in Article 3—(a) to consider till questions relating to such of the matters mentioned in

Article 4 oi the Arbitral Tribunal Order, 1047, as are the concern oithat body, and attempt to reach un agreed decision on all BUCIquestions;

(b) in the event ot thoir failure to reach an agreed decision on any sue'question as aforesaid, to make a reference in accordance with tinprovisions of ihe said Order to the Arbitral Tribunal set up by thsuOrder; and

(c) to consider any other question of common concern to the Dominions oIndia arid Pakistan or, as the case may be, to the respective Prcvinces, arising in connection with the transition to the provisionof the Tndian Independence Act, 1947.

THE ARBITRAL TRIBUNAL ORDER, 1917

In exercise of the powers eonfeiied h section 0 of the In'diun IndependenceAct, 1947, and of all other powers enabling h'm in that behalf the Goyernor-Gonernl is pleased to make the following Order —

1 (1) This Order niay be piled as the Arbitral Tribunal Order, 1947(2) I t shall come into force at once.

('2) Whore a question huf, been referred to the Ttibunal under this Article—

6. Tn respect of any reference made to the Tribunal under Aitiolc 1,—(a) if the two members of (ht.1 Tribunal are iiyreed as to the terms uf thf

award to be made, the Chairman shall make (,he award in those terms; arid

(b) in the event of d :sagreement between tho two members with regardto any mat ter ar sing out of the inference, the Chairman shall decide suoVmatter and make the award accordingly.

Provided that the body making the reference may, at any time, before theaward is made, withdraw the reference by notice in writing to the Tribunal,

7. (1) Every award made in accordance with the provisions of Article 6shall bo b nding on the two Dominions and all Provinces and other partsthereof, and on all persons directly or indirectly concerned in or affected bythe award.

(2) Every such award shall be communicated forthwith by the Chairmanto the body by which the reference was made, the Governments of the twoDominions, and the Governments of the Piovinces concerned, if any.

8. (1) The Tribunal shall Lave power—

(a) to make an award conditional or hi the alternative;(b) to correct any clerical mistake or error arising from cttiy accidental

slip or omission;(c) subject to the provisions of this Girder, to determine its own proce-

dure ; and(d) to appoint such ministerial officers us it may find necessary.

(2) The Tribunal shall have all the pouei^. <A a civil court for the purposeof receiving evidence, admmistc't'iu" oaths, I'tiio'X'ing tin - attendance <>f witness-es and compelling the discovery and production of documents, and -shall bedeemed to be a civil court within the meaning of sections 480 and 482 of theCode of Criminal Procedure, 1893

J n exercise of the powers conferred by section 9 of the IndianIndependence Act, 1947, and of all other powers enabling him inthat behalf, the Governor-General is pleased to make the followingOrder :—

1. (1) This Order may be cited as the Indian Independence(Tnoome-tax Proceedings) Order, 1947.

(2) It shall come into force at once.

•2. (1) In this Order,—" appointed day " means the fifteenth day of August,

1947 ;" assessae " means <i person by whom income-tax or excess

profits tax is payable ;" relevant Tax Act '" means the Indian Income-tax Act,

1922, as subsequently amended, or as the case maybe, the Excess Profits Tax Act, 1940, as subsequentlyamonded ;

"' Tax Authority " moans any of the following authorities,namely, the income-tax authorities mentioned insection 5 of the Indian Income-tax Act, 1922, theAppellate Tribunal mentioned in seotion 5A thereof,and the excess profits tax authorities mentioned insection 3 of tho Excess Profits Tax Aot, 1940 ;

"' Tax Officer '" means tin Income-tax Officer or an Exces8

Profits Tax Officer within the meaning of the re-levant Tax Aot.

(2) The Interpretation Aot, 1889, shall apply for the interpre-tation of this Order as it applies for the interpretation of an Act ofParliament.

Where before tho appointed day the jurisdiction of a TaxOfficer under the relevant Tax Act has been altered in connectionwith the setting up of the Dominions of India and Pakistan, orwhere after the appointed day the case of an assessee is transferredfrom one Dominion to the other by agreement between the Cen-tral Boards of Rovenue of the two Dominions, and by reason o fsuch alteration of jurisdiction or transfer the case of an assessee

falls to bo dealt with on or after the appointed day by the TaxAuthorities of India, or as the case may be of Pakistan, all pro-ceedings relating to the case- pending before any Tax Authorityof Pakistan, or as the cape my be of India, shall be transferred to thecorresponding Tax Authority of India, or as the case may be ofPakistan, and shall be disposed of by the last mentioned Tax Autho-rity in accordance with law.

4. Any such transfer shall not render necessary the re-issueof any notice already issued by a Tax Authority, whether beforeor after the appointed day, or the commencement de novo ofany proceeding in the case, and all subsequent proceedings,whether by way of appeal, revision or otherwise, shall bo takenbefore the appropriate Tax Authority of the Dominion to whichthe case has been so transferred.

6. No such transfer shall be calJed in question on the groundthat the Tax Authority to which the proceeding is so transferredhas no jurisdiction to deal with the case.

tho Court, or Tribunal consists of one person only, such person;(c) "Committee" means a Worts Committee constituted under sub-

R. Application.—-An application fur the reference of an industrial dispute ioa Board, Court or Tribunal shall be made in Form A and shall be deliveredpeihontilly or forwarded by regifrtercd post in triplicate to the Secretary lo theCm ernment of India in the Department of Labour. The application shnll beaccompanied by a statement setting forth —

(a) the parties to the dispute;(b) the specific matters to dispute;(c) the total number of workmen employed in the undertaking affected;(d) an estimaic of the number of workmen affected or likely to be affected

by the dispute; and(f) the efforts made by tho parties themselves to adjust the dispute.

4 Attestation of application.—The application and the statement accompany-ing ii, Rhall be signed—

(it) in the case of an employer, by the employer himself, or when theemployer is an incorporated company or other body corporate, bythe agent, manager or other principal officer of the Corporation;

(b) in tho case of workmen, either by tho President and Secretary of aregistered trade union of the workmen, or by five representatives ofthe workmen duly authorised in this behalf at a meoting of theworkmen held for the purpose.

Conciliation proceedings. —Ou receipt of information about an existing orapprehended industrial dispute, or, whore- the dispute relates to a public utilityservice, ou roceipt of a notice of a strike or lock-out given under rule iJ'2 orrule- y3, the conciliation officer shall forth/with arrange to interview both the em-ployer and the workmen concerned with the dispuie at s^ch places and at suchtimed as he may deem fir and shall endmivour to bring about a settlement o£ tin-dispulo in question.

(2) For the purposu of sub-rule (1), u nomination paper shall be held tobe not valid if (a) the oundidnte nominated in ineligible for membership undo)rule 38 or (b) the requirements of rule 41 hove not been complied with.

43. Voting in election.—(1) [f the number of candidates who have beenvalidlv nominated Ls1 equal to the number of aoata, the candidates shall heforthwith declared duly elected.
