Town of Narragansett, Rhode Island, entitled “Zoning”, proposing amending Section 2.2
(Definitions) and Section 6 (Zone Regulations) to include Mini Warehouse.
SUMMARY: NGP II, LLC has submitted an application to amend the Zoning Ordinance
to amend Section 2.2 – Definitions and Section 6 – Zone Regulations to amend Section
6.3 - Table of Use Code to add a new use code 466 “Mini Warehouse”.
According to the Zoning Ordinance within Section 22 - Notice of Public Hearing
Requirements, the Town Council schedules a Public Hearing.
The Zoning Ordinance requires the Planning Board to review the proposal and forward
a recommendation to the Town Council. The Planning Board shall report to the Town
Council within 45 days after receipt of the proposal, giving its findings and
recommendations as prescribed in Section 21.
Staff recommends a public hearing be scheduled on January 4, 2022 at 8:00 PM.

Assessment Date RECOMMENDATION: That the Town Council approves the contract amendment with Northeast Revaluation Group, LLC to add the processing of building permits for the Tax Assessor, in the amount of $23.00 per parcel, for approximately 100-200 parcels. SUMMARY: On November 18, 2019 the Town Council awarded the bid for the town wide Revaluation Program for the 12/31/2020 assessment date to Northeast Revaluation Group, LLC. We now need to add the processing of the 2021/2022 Building Permits to this contract, under Article 2, Section 5 “Building Permits”. The price of $23 per parcel will include measuring, listing and field review of building permits issued during the 2020/2021 FY. The Tax Assessor shall screen and determine which parcels have been issued building permits for new construction, additions and remodeling, as needed. The inclusion of these permits will be effective as of the 12/31/2021 assessment for the 2022 July billing. SUMMARY: The request to hire one probationary police officer is being made to replace a Police Lieutenant who retired in October 2020. This will allow the police force to return to 41 officers as it is budgeted. Every officer and position is critical for maintaining a high level of service for the community. The new officer is to be hired from the current list of candidates and will start at the next Training Academy in January 2022.

SUMMARY: The bid was for three (3) chemicals used by used by the Wastewater Treatment Facility: Potassium Permanganate, Sodium Bisulfite 38% Solution and Sodium Hypochlorite 12% to 15% Solution. We have awarded bids to Univar Solutions in the past and are satisfied with their products and services. We have not awarded bids to PVS Minibulk Inc. in the past and contacted Municipal wastewater treatment facility operators that have experience with this vendor to inquire as to their performance. Based on our investigations, PVS Minibulk Inc. has provided satisfactory service and delivery for similar chemical supply contracts and we can expect reliable performance from this vendor. The contract period is for one year: November 2, 2021 – November 1, 2022, with a possible contract extension, annually, upon agreement by the vendor and under the same contract terms and conditions. Request for bids was advertised in the Narragansett Times, solicited and posted on the Town of Narragansett and State Purchasing Division websites. Ten (10) vendors were solicited and ten (10) responded. The attached spreadsheet lists the results from the solicitation. SUMMARY: On June 8 2021, we received and opened one proposal for Library Conversion Owner’s Representative Services associated with the conversion of the former Belmont Market Building into a modern and functional public library for the Town. The RFP was issued to three (3) vendors using the State MPA-430 Owner’s Representative Services for RI Architectural/Engineering and/or Public Construction Projects vendor listing and two (2) vendors responded (one as a “no bid”). The attached spreadsheet lists the results from the original solicitation. The proposal scope of work was inconsistent with the RFP, the proposal received is no longer valid (vendors are only required to hold their bid pricing for a 90-day period), and the Town and Library Board desire to seek new proposals and increase competition for the contract. Staff needs to solicit new bids with the refined Scope of Work, accordingly. The revised RFP will be issued using State MPA-430 to additional vendors to increase competition. ATTACHMENTS:

SUMMARY: Prior to 2015, the Town did not have contract or group pricing for propane; we simply paid the market price. In February of 2015, Town Council approved the use of the State of Rhode Island Master Price Agreement (MPA) #166 for the purchase of liquid propane gas through Amerigas at the price of the Selkirk Posting +0.35 per gallon. We had to switch from the company we were using to Amerigas so new tanks and concrete pads were required and installed at multiple locations (standard practice in the industry). In 2018, Town Council approved the contract extension with Amerigas through September 30, 2021 at the cost of Selkirk Posing +0.264 per gallon. Recently, new bids were solicited by the State of RI and awarded to a different vendor, Quality Propane out of CT. However, Amerigas is offering to match the State of RI MPA price of +0.246 per gallon over Selkirk Posting (a decrease from the current contract price). The staff would prefer to remain with Amerigas as a supplier due to the logistics involved in switching out propane tanks and pouring concrete pads and since they matched the State MPA price. Amerigas has been responsive when needed for emergency service as well. Funding is available in various departments’ budgets, in account “50407” for heating fuel. ATTACHMENTS:

Gallagher, Purchasing Manager SUBJECT: Award of Bid – Disaster Recovery Administrative Services RECOMMENDATION: That the Town Council awards the bid for Disaster Recovery Administrative Services to GZA GeoEnvironmental Inc. at their quoted hourly rates. SUMMARY: In the aftermath of a major pandemic/disaster, the Town of Narragansett seeks to protect its interests by securing the services of a qualified disaster recovery consultant to provide technical assistance and support in any potential task associated with Disaster Recovery Administrative Services. The Town recognizes that its facilities and operations are damaged and disrupted by a major disaster and its existing employees and systems need assistance with necessary disaster response and recovery work. In order to ensure a rapid recovery and post disaster redevelopment process, the Town will require the services of qualified, experienced professionals to manage state and federal grant management processes. The Town solicited proposals from qualified professional consulting firms to provide technical assistance and support with post-disaster recovery funding, debris management & monitoring, emergency planning, disaster recovery and hazard mitigation planning, maximize insurance recovery, and maintaining strict compliance and detailed documents to prevent costly project de-obligations. Request for proposals was advertised in the Narragansett Times, solicited and posted on the Town of Narragansett and State Purchasing Division websites. Three (3) vendors were solicited and five (5) responded. The attached spreadsheet lists the results from the solicitation. Each respondent was required to provide information, evidence, and exhibits in their submission to demonstrate their ability to satisfy the project requirements. A committee made up of the Finance Director, Fire Chief, and Town Manager examined and evaluated each submission based upon the firm’s capabilities, staffing, prior history, project understanding, knowledge of and past work experience for the State and local resources, and hourly rates as described in the request for proposals.

The Town utilized a qualification based selection process to evaluate the proposals with the selected firm to be determined based on their experience, qualifications, and understanding of the project as is allowed for professional services under RIGL 45-55. Having completed a review and scoring, we recommend the Town Council award the bid to GZA GeoEnvironmental, Inc. and their partner iPararmetics (GZA), GZA meets all of the criteria for experience and qualifications, submitted the lowest cost fee proposal, and demonstrated within their proposal a thorough understanding of the tasks and activities required to complete the required scope of work. GZA has completed various FEMA Public Assistance Projects for the Town recently, during the height of the COVID-19 pandemic. All staff involved were very satisfied with the work and assistance they provided. Funding is only required if the Town enters into task order agreements. Many of the administrative costs are recoverable through grants. If no grant is available and a department needs assistance, the funding will come from their department budget. ATTACHMENTS:

4. All new vacancies on the Planning or Zoning Boards will require that the Town
Council interview those candidates. Individuals currently serving on these Boards need not be interviewed when applying for reappointment to a successive term on the same Board. However, an attendance record will be included to the agenda item for those individuals wishing consideration for reappointment.
5. The Town Council motion to appoint a candidate to a particular committee,
commission or board, shall have the names of each applicant candidate listed on the summary.
6. A written staff recommendation may be submitted to the council through the
Town Manager. 7. All applications received shall be available for public review to the extent under
law, in the office of the Town Clerk. 8. The mission for each board, commission or committee shall be available in the
office of the Town Clerk and on the town’s website.
II. REQUIREMENT FOR MEMBERSHIP 1. Applications for the various commissions, committees and boards shall be
available in the Town Clerk’s Office or on the Town’s website. 2. Applications shall be completed and submitted to the Town Clerk no later than the
advertised filing date also unless otherwise approved by the unanimous consent of the council only applications received before the scheduled appointment date shall be considered for appointment.

to determine if that individual wishes to be considered for reappointment. Members are reappointed at the discretion of the Town Council.

All board, committee or commission members that are presently serving a term will complete that term as the first term. All board, committee or commission members with expired terms and awaiting reappointment are eligible for reappointment for one last consecutive term with an effective start date from the date their previous term expired. Any terms served as an alternate member will not count toward term limits. Members of boards, committee or commissions may serve the second term consecutively if appointed. This will be implemented as of October 4, 2021.
5. Individuals wishing to be considered for reappointment shall notify the Town

TOWN OF NARRAGANSETT RULES FOR COMMISSION, COMMITTEE AND BOARD APPOINTMENTS
I. SELECTION PROCESS OF MEMBERS 1. As authorized by the Town Council, the Town Clerk shall advertise once a year in
a local newspaper, the commissions, committees, and boards that will have upcoming appointments. When a vacancy occurs it will be placed on the Town’s website.
2. Upon receipt of an application, the Town Clerk shall date stamp it and retain the
original. 3. The application shall remain on file for a period of two (2) years from the date
received. The Town Clerk will contact applicant after the two year period to seek availability and interest. The Town Clerk will forward all applications on file for an open board when a vacancy becomes available on that particular committee, commission or board to the Town Council and to the Town Manager.
4. All new vacancies on the Planning or Zoning Boards will require that the Town
Council interview those candidates. Individuals currently serving on these Boards need not be interviewed when applying for reappointment to a successive term on the same Board. However, an attendance record will be included to the agenda item for those individuals wishing consideration for reappointment.
5. The Town Council motion to appoint a candidate to a particular committee,
commission or board, shall have the names of each applicant candidate listed on the summary.
6. A written staff recommendation may be submitted to the council through the
Town Manager. 7. All applications received shall be available for public review to the extent under
law, in the office of the Town Clerk. 8. The mission for each board, commission or committee shall be available in the
office of the Town Clerk and on the town’s website.
II. REQUIREMENT FOR MEMBERSHIP 1. Applications for the various commissions, committees and boards shall be
available in the Town Clerk’s Office or on the Town’s website. 2. Applications shall be completed and submitted to the Town Clerk no later than the
advertised filing date also unless otherwise approved by the unanimous consent of the council only applications received before the scheduled appointment date shall be considered for appointment.
3. The Town Clerk shall notify individuals whose terms are about to expire by letter,
to determine if that individual wishes to be considered for reappointment. Members are reappointed at the discretion of the Town Council.
4. Membership on a board, committee or commission shall be limited to two
consecutive terms, with a one term hiatus before a member can be eligible to serve on the same board, committee or commission again. All board, committee or commission members that are presently serving a term will complete that term as the first term. All board, committee or commission members with expired terms and awaiting reappointment are eligible for reappointment for one last consecutive term with an effective start date from the date their previous term expired. Any terms served as an alternate member will not count toward term limits. Members of boards, committee or commissions may serve the second term consecutively if appointed. This will be implemented as of October 4, 2021.
5. Individuals wishing to be considered for reappointment shall notify the Town
Clerk prior to the expiration of the date in the letter sent to them. 6. The chairperson of each commission, committee or board shall submit an Annual
Report including an attendance record, to the Town Clerk, for those individuals wishing to be considered for reappointment.
7. No person shall be appointed to serve concurrently on more than one commission,
committee, or board created by the Town Council, with the exception of Ad Hoc commissions, committees or boards, or dual appointments required by Charter, Ordinance or Resolution. Dual office may be permitted if all applications on file are given appropriate consideration before a person is appointed to a second board or committee and the appointment will not violate the town charter.
8. Any appointee who is absent without cause for three (3) consecutive meetings may
be subject to removal by the Town Council.
9. When any member of a commission, committee or board is absent for (3) consecutive meetings, the Chairperson shall notify the Town Clerk, who shall in turn notify the Town Council for direction. Should the Chairperson recognize any other attendance deficiencies, the Town Clerk shall be notified, who shall in turn notify the Town Council for direction.
10. The applicant shall comply with all State Laws and Regulations, as well as Ethics
Commission requirements for appointees. 11. The applicant shall be a full time resident and elector in the town to be considered
for an appointment to the Planning Board, Pension Board and Zoning Board Review.
III. APPOINTMENT REVIEW PROCESS 1. The Town Council shall review each application and may invite specific
candidates to an interview with the Council prior to a regularly scheduled meeting or work session. Candidates interviewed by the Town Council will be sent a letter of appreciation by the Town Clerk.
2. When making a nomination, the Council member making the recommendation

SUBJECT: Compensation for Town Sergeant Position
RECOMMENDATION:
That the Town Council approves the increase of compensation for the Town Sergeant to $55.00
per meeting for meetings up to three (3) hours and for meetings over three (3) hours to $55.00
plus $15.00 per hour thereafter.
SUMMARY:
Currently, compensation is fifty five dollars ($55.00) per Town Council session regardless of the
length of time of a session. I propose that for any session lasting 3 hours, the compensation
remain at $55. For sessions lasting more than 3 hours, the compensation should be modified to
fifteen dollars ($15.00) per hour thereafter, effective upon Town Council’s approval.
Section 14-1-1 Town sergeant of the Town Ordinances, the Town Council is responsible for
setting the compensation for this position. (See ordinances regarding this position below.)
Sec. 14-1-1. - Town sergeant.
There shall be a town sergeant who shall be appointed by the town council to serve at the pleasure of the council. The town sergeant shall have all the powers, privileges and immunities of his office, and shall perform all the duties as prescribed by the general laws and applicable special laws and ordinances. The compensation of the town sergeant shall be set by the town council.

RECOMMENDATION: A MOTION TO APPROVE the purchase, not to exceed $10,000, of video and audio live streaming equipment to outfit the Large Boardroom for YouTube Live Streaming. SUMMARY: The IT Director, Dan Holland, provided the Town Council with three options to provide live video streaming for the Large Boardroom to be utilized by the Planning Board and Zoning Board, as well as for special meetings of other town boards and committees. We are recommending the Town Council approve Option 1, which would include good quality video, full HD, and good audio quality. Hardware would include Laptop, encoder, PTZ camera, network drops, microphones, mixer, cabling, rack, etc. The approximate cost is estimated at $8,000 to $10,000.

That the Town Council introduce, read, pass and accept as a first reading a resolution amending the Official List of Parking Restrictions and Regulations in the Town of Narragansett in accordance with the Narragansett Code of Ordinances to restrict parking on the west side of Center Road.
SUMMARY:
Center Road is a short narrow roadway off Bridgetown Road where parking on the West Side of the roadway has restricted Home Owners on the East Side from entering or exiting their respective properties safely. Have received several complaints from Home Owners who reside on the East Side of this narrow roadway. Vehicle parking is generated from rental properties which front Bridgetown Road that have adequate parking at their respective addresses but are drawn to park on the West Side of Center Road creating a safety hazard for Center Road Residence…

A RESOLUTION AMENDING THE OFFICIAL LIST OF PARKING RESTRICTIONS AND REGULATIONS IN THE TOWN OF NARRAGANSETT IN ACCORDANCE WITH
THE NARRAGANSETT CODE OF ORDINANCES
WHEREAS, Chapter 74, Article II, Section 74-35 of the Code of Ordinances of the Town of Narragansett, provides a procedure to amend the parking restrictions and regulations on specific streets in the Town of Narragansett; and
WHEREAS, it is recommended, in accordance with Section 74-35, that the parking restrictions be regulated for Center Road;

CONSTITUTION OF THE STATE OF RHODE ISLAND PREAMBLE
We, the people of this State which state shall henceforth be known as the state of Rhode Island, grateful to Almighty God for the civil and religious liberty which He hath so long permitted us to enjoy, and looking to Him for a blessing upon our endeavors to secure and to transmit the same, unimpaired, to succeeding generations, do ordain and establish this Constitution of government.
Section 16. Compensation for taking of private property for public use — Regulation of fishery rights and shore privileges not public taking. Private property shall not be taken for public uses, without just compensation. The powers of the state and of its municipalities to regulate and control the use of land and waters in the furtherance of the preservation, regeneration, and restoration of the natural environment, and in furtherance of the protection of the rights of the people to enjoy and freely exercise the rights of fishery and the privileges of the shore, as those rights and duties are set forth in Section 17, shall be an exercise of the police powers of the state, shall be liberally construed, and shall not be deemed to be a public use of private property.
Section 17. Fishery rights — Shore privileges — Preservation of natural resources. The people shall continue to enjoy and freely exercise all the rights of fishery, and the privileges of the shore, to which they have been heretofore entitled under the charter and usages of this state, including but not limited to fishing from the shore, the gathering of seaweed, leaving the shore to swim in the sea and passage along the shore; and they shall be secure in their rights to the use and enjoyment of the natural resources of the state with due regard for the preservation of their values; and it shall be the duty of the general assembly to provide for the conservation of the air, land, water, plant, animal, mineral and other natural resources of the state, and to adopt all means necessary and proper by law to protect the natural environment of the people of the state by providing adequate resource planning for the control and regulation of the use of the natural resources of the state and for the preservation, regeneration and restoration of the natural environment of the state.
Last edit: 9/13/21 4:05 PM Coastal Access Improvement Committee Requests Surveys of Five Rights of Way
The Coastal Access Improvement Committee (CAIC) respectfully requests that the Narragansett Town Council encumber funds and find an accredited land surveyor for the purposes of evaluating the boundaries of several rights of way (ROWs). As the town body that reviews the status of all coastal ROWs in Narragansett a majority of the CAIC has agreed that there is a critical need for current land surveys given the effects of climate change, sea level rise, and coastal development.
It has come to the attention of the CAIC that 5 ROWs in particular are difficult to access and have problematic parking schemes which can inhibit public access and the ability of first responders to the coast in the event of an emergency. Additionally these access points are heavily used for fishing, surfing, swimming, and coastal hiking amongst other activities. Furthermore access may be encroached from adjacent property owners, and access to the water is restricted at some of these locations.
A survey of these ROWs would help to establish property lines and allow for an evaluation of the parking schemes, position of signage, foot paths, and potential impacts to public safety. Funding for these efforts could be procured through two "Green" bond initiatives from the State of RI, with a proposal deadline of October 29, 2021(https://www.ri.gov/press/view/41789). The specific ROWs that the committee is requesting to be surveyed are along Ocean Road and Calef Avenue and detailed below in Figures 1-5.
