HB 526 – SEXUAL OFFENSES

• It is a top priority of the legislature to make Florida the most unfriendly state in the nation for sexually violent predators.• Increases the penalties for specified sexual battery and lewd or

lascivious offenses against children.• Increases the minimum mandatory sentence for dangerous sexual

felony offenders to 50 years.• Requires the court to impose a split sentence in which an offender

convicted of specified sexual offense, is sentenced to 2 years of community supervision after serving his or her term of imprisonment.

HB 526 – SEXUAL OFFENSES CONTINUED

• Creates a new sentencing multiplier for specified adult-on-minor sexual offenses.• Ensures that the probationary period of an offender in DCF’s

custody pursuant to the Jimmy Ryce Act doesn’t begin until the person is released from DCF’s custody.• Passed House & Senate; signed by Governor Scott.

HB 7015 – AN ACT RELATING TO VETERAN AND MILITARY SUPPORT

• We want to make Florida the “welcome home” state for our veterans.• Increases funding for Educational Dollars for Duty program to allow more

members of our National Guard to earn degrees for little to no out-of-pocket expense.

• Creates the Congressman C.W. Bill Young Veteran Tuition Waiver Program, which will waive out-of-state fees for veterans. It is our hope this will encourage more veterans to move to and remain in Florida.

• With this program, we can save these veterans approximately$15,000 and help more pursue their dreams.

• Expands Florida’s Veterans’ Preference to give preference to all veterans during the hiring process for state government employers rather than just a select few.

HB 7015 – AN ACT RELATING TO VETERAN AND MILITARY SUPPORT

CONTINUED

• Creates a nonprofit corporation, Florida Is For Veterans, Inc., to encourage and assist retired and recently separated military personnel to keep or make Florida their home. • Allows veterans to be admitted to one of the state’s six veterans’

nursing homes upon gaining Florida residency. • Creates the Florida Veterans’ Walk of Fame and Memorial Garden

on the Capitol Complex grounds.• Passed House & Senate; signed by Governor Scott.

HB 7117 – SCHOOL ACCOUNTABILITY

• Simplifies the calculation of school grades for elementary, middle, and high schools by eliminating extraneous point categories and focusing on student performance, graduation, industry certifications, and eligibility for college credit.

• Requires development of a district report card that includes indicators of success such as closing the achievement gap among high- and low-performing subgroups and grade-level promotion of low-achieving students.

• Establishes a hold harmless provision for the 2014-2015 school year, which insulates schools and districts from any penalty or reclassification based on 2014-2015 grades as new statewide, standardized assessments in mathematics and English language arts are implemented.

• Companion Bill CS/SB 1642 passed House & Senate; signed by Governor Scott.

HB 7141 - HUMAN TRAFFICKING

• Provides greater assistance to children who are victims of commercial sexual exploitation.• Commercial sexual exploitation of children is human trafficking

where children are coerced through violence, drugs, and emotional manipulation to be sold for sex. This is happening across Florida.• Supports local efforts to develop and coordinate resources and

services for victims.• Requires the use of standardized assessment instruments, the

collection of data, the involvement of specially trained child protective investigators and case managers, and the development of local response protocols.

HB 7141 - HUMAN TRAFFICKING CONTINUED

• Requires state certification by DCF of safe houses and safe foster homes to provide good quality homes for victims.• Will help Florida identify and serve some of the most vulnerable

children in our state.• Passed House & Senate; signed by Governor Scott.

HM 381 – ARTICLE V CONVENTION OF THE STATES

• Proposes amendments to the US Constitution that impose fiscal restraints on the Federal Government, limit the power and jurisdiction of the Federal Government, and limit the terms of office for federal officials and members of Congress.

• Founders wrote safeguards in our Constitution, like Article V Convention of the States, to protect against overreach by a powerful central government.

• 34 state legislatures must pass a resolution or memorial calling for an Article V Convention of the States, which Congress must then call.

• At least 38 states must ratify each amendment in order for it to become part of the Constitution.

• Companion Bill SM 476 passed House & Senate unanimously; signed by Officers and filed with Secretary of State

HB 559 – MILITARY VETERANS

• Creates a Combat Medical Badge license plate.• Changes in statute & on the license plate “Korean Conflict” to “Korean

War”.• Changes in statute & on the license plate “Vietnam Era” to “Vietnam

War”.• Requires that a likeness of the Combat Medical Badge, Korean Service

Medal, Vietnam Service Medal, Southwest Asia Service Medal, Iraq Campaign Medal, Afghanistan Campaign Medal, and Global War on Terrorism Expeditionary Medal be included on the license plates.

• Requires proof that the applicant was awarded the badge or campaign medal in order to receive the designated license plates.

• Passed House & Senate unanimously; signed by Governor Scott.

HB 587 – CHARITABLE EXEMPTION FROM AD VALOREM TAXATION

• Provides that with charitable exemption from ad valorem taxation, the exempt organization must take affirmative steps to prepare the property for a charitable purpose. • Provides charitable organizations with the same treatment already

afforded to religious organizations.• Passed committees in the House; died in Senate Appropriations

Committee.

HB 835 – COMMISSION ON FEDERALISM

• Would create a legislative Commission on Federalism to review federal laws and communicate with other states about Florida’s actions taken pursuant to Article V of the U.S. Constitution. • The Commission on Federalism would be comprised of seven state

legislators appointed by the Speaker of the House and the President of the Senate. • The commission would have the authority to review new federal laws for

adherence to the principles of federalism contained in the U.S. Constitution, and advise the legislature of their findings. • The commission would meet quarterly and be supported by existing

committee staff.• Failed House & Senate.

HB 1121 – HAZARDOUS WALKING CONDITIONS

• The goal is to improve how we identify and correct hazardous walking conditions, improving the safety of our students.

• Requires district school boards, state, and local governmental entities to work together to identify and correct hazardous condition within a reasonable time, and specifies a better process for that to happen.

• While a hazardous walking condition exists, state funding will still be provided (as it is currently) to school districts to transport affected students.

• Once the condition is corrected state funding will cease (as it does currently).

• Prohibits a governmental entity’s designation of a hazardous walking condition to be admitted into evidence in a lawsuit, to remove the chilling effect of designating hazardous walking conditions due to liability concerns.

• Passed House; Passed two Senate Committees and Failed in Senate.

HB 1237 – SPECIAL DISTRICTS

• Reorganizes and reorders Chapter 189 into eight separate parts, by subject matter.• Deletes unnecessary or redundant statutory language.• Clarifies the roles of the legislative and executive branches with

respect to special district oversight and accountability.• Revises when special districts may be declared inactive and prohibits

special districts declared inactive from collecting taxes, fees, or assessments.• Clarifies and strengthens the role of the Legislature to oversee

special districts created by special act.• Clarifies and strengthens the authority of local governmental entities

to oversee special districts created by local ordinances or resolutions.

HB 1237 – SPECIAL DISTRICTSCONTINUED

• Clarifies and simplifies public reporting of required information via websites by each special district.• Clarifies and strengthens the authority of Florida’s governor to

remove a special district governing body member from office if he/she fails to perform the duties required by law.• Repeals several sections of Chapter 189 related to Community

Improvement Authorities which were enacted in 2000 and never used.• Companion Bill CS/CS/CS/SB 1632 passed House & Senate

unanimously; signed by Governor Scott.

CS/HB 1327 – GOVERNMENT ACCOUNTABILITY

• Creates statutory duty of each state and local government to: • Maintain internal controls designed to prevent and detect fraud,

waste, and abuse.• Assure the administration of assigned public duties and

responsibilities in accordance with laws, rules, contracts, grant agreements, and best practices.• Promote and encourage economic and efficient operations.• Ensure reliability of financial records and reports and to

safeguard assets.• Passed all House Committees & Failed in Senate.

CS/HB 7003 – COURT SYSTEM

• Repeals statutes containing redundant provisions in the state constitution.• Repeals statutes that create additional criteria for judicial office

because such requirements are likely to be found to conflict with constitutional qualifications for office.• Repeals or amends statutes to reflect current practices or to

eliminate outdated or unnecessary provisions.• Companion Bill CS/SB 828 passed House & Senate; signed by

Governor Scott.

HB 7085 – SECURITY OF CONFIDENTIAL PERSONAL INFORMATION

• Priority of Attorney General Pam Bondi. • Recent data breaches to Target and other retailers have raised

concerns as to how, and if, consumers should be notified when their information has been compromised. • Requires proper notice to be provided to consumers within 30 days

unless good cause is shown for an additional 15 day delay. • Requires proper notice to be provided to the Office of the Attorney

General for a breach affecting 500 or more individuals. • Defines what information must be included in a proper notice.

HB 7085 – SECURITY OF CONFIDENTIAL PERSONAL INFORMATION CONTINUED

• Expands the data breach statute to include state governmental entities and their instrumentalities.• Requires businesses and state government entities to take reasonable

measures to protect data.• Requires the Office of the Attorney General to provide an annual

report to the Legislature regarding any data breaches by governmental entities.• A violation of this Act is an unfair and deceptive trade practice under

FDUTPA.• Companion Bill CS/CS/SB 1524 passed House and Senate; signed

by Governor Scott.

SJR 1188 – PROSPECTIVE APPOINTMENT OF JUDICIAL VACANCIES

• Currently, the Governor’s authority to appoint a Supreme Court Justice or district court of appeal judge is not clear until the expiration of the sitting judge’s or justice’s term. • Under the existing timeframes for filling a judicial vacancy, the potential

exists for a judicial office to be vacant for 120 days after a vacancy occurs, impeding the ability of the courts to function. • This amendment defines a prospective vacancy and requires the judicial

nominating commission to begin its work once a prospective vacancy occurs, i.e., in advance of the expiration of the departing justice or judge’s term. • Requiring the commission to provide the Governor with a list of nominees

sooner, so the process will conclude before the expiration of the term of the sitting justice or judge if a justice or judge is ineligible for retention or fails to qualify for retention.

SJR 1188 – PROSPECTIVE APPOINTMENT OF JUDICIAL

VACANCIES CONTINUED• If a justice or judge is not retained at the general election, the

judicial nominating commission will begin its 30 day work in November instead of January as the current law requires. • Instead of vacancies on a court potentially lasting 120 days, some

vacancies may be eliminated on the Supreme Court and district courts of appeal while others may be significantly reduced.• This amendment will be submitted to the voters for approval and

must be approved by a vote of at least 60 percent of voters voting on the measure during the 2014 General Election.• Passed House & Senate; signed by Officers and filed with Secretary

of State.
