RESOLUTION NO. 001 Series of 2012

A RESOLUTION SUSPENDING THE OPERATION OF SMALL TOWN LOTTERY IN THE MUNICIPALITY OF PURA PENDING REMITTANCE OF THE LOCAL GOVERNMENT UNIT

(LGU) SHARE IN THE ALLOCATION OF CHARITY FUND

WHEREAS, the Philippine Charity Sweepstakes Office under the Office of the President of the Republic of the Philippines has launched the Small Town Lottery (STL) Project and promulgated the Revised Rules and Regulations Governing the Conduct of Second Phase of the Actual Test Runs for the PCSO Small Town Lottery (STL) Project; WHEREAS, pursuant to Section 26 of Article VII of the Revised Rules and Regulations Governing the Conduct of Second Phase of the Actual Test Runs for the PCSO Small Town Lottery (STL) Project, the Local Government Unit is entitled to a ten percent (10%) share in the STL Charity Fund; WHEREAS, section 19 (c) of the same rule provides that within the first ten (10) days of every month, the authorized corporation (operator) shall remit to the concerned local government unit the respective amounts determined under the rules for local allotments and charity projects; WHEREAS, despite the continuous existence of STL operation, the Municipality has not receive its share in the STL Charity Fund; WHEREAS, pending remittance of the LGU share on the STL Charity Fund, the operation of Small Town Lottery within the jurisdiction in the Municipality of Pura must be suspended, NOW THEREFORE, on unanimous motion presented, be it: RESOLVED, as it is hereby resolved, to suspend the operation of STL in the Municipality of Pura.

Series of 2012 A RESOLUTION CREATING THE PERSONNEL SELECTION BOARD OF THE

MUNICIPALITY OF PURA

WHEREAS, Section 80 (b) of Republic Act No. 7160 provides that there shall be established in every province, city or municipality a personnel selection board to assist the Local Chief Executive in the judicious and objective selection of personnel for employment as well as for promotion, and in the formulation of such policies as would contribute to employee welfare;

WHEREAS, Section 80 (c) likewise provides that the personnel selection board shall be

headed by the local chief executive and its members shall be determined by resolution of the sanggunian concerned;

WHEREAS, this body, in compliance thereto, hereby establish the Personnel Selection

Board of the Municipality; NOW THEREFORE, on motion of Coun. Felino C. Millo Jr., Chairman, Committee on

A RESOLUTION RESPECTFULLY REQUESTING UNDERSECRETARY BENITO T. RAMOS, ADMINISTRATOR, OFFICE OF THE CIVIL DEFENSE, AND EXECUTIVE

DIRECTOR, NATIONAL DISASTER RISK-REDUCTION AND MANAGEMENT COUNCIL, TO PROVIDE FUNDS FOR THE DESILTING OF THE SUSUBAEN AND

BALDO CREEKS

WHEREAS, the Municipality of Pura is prone to flood during the rainy season, mainly because of the absence of an outfall to contain rainwater;

WHEREAS, the perennial flooding during rainy season was aggravated by the construction of the lateral canal of the National Irrigation Administration at the southern portion of the Municipality and the Tarlac-Pangasinan-La Union Expressway;

WHEREAS, this Local Government Unit has identified the Baldo and Susubaen Creeks as the

major outfall of floodwater; WHEREAS, in order to minimize, if not totally eradicate, flooding, there is an urgent need to

desilt the Baldo and Susubaen Creeks which will serve as outfall of floodwater; NOW THEREFORE, on motion of Coun. Felino C. Millo Jr., Chairman, Committee on

Rules, Privileges and Legal Matters, duly seconded, be it: RESOLVED, as it is hereby resolved, to respectfully request the Office of the Administrator,

Office of the Civil Defense, and Executive Director, National Disaster Risk Reduction Management Council, to provide funds for the desilting of the Baldo and Susubaen Creeks.

A RESOLUTION EXTENDING THE TIME OF PAYMENT OF BUSINESS TAXES OF MARKET VENDORS IN ACCORDANCE WITH CHAPTER II, ARTICLE B, OF THE

REVISED TAX CODE OF THE MUNICIPALITY

WHEREAS, the Municipal Tax Code provides that failure to pay the tax prescribed within the time required shall subject taxpayer to a surcharge of Twenty Five Percent (25%) of the original amount of Tax due;

WHEREAS, Section 2B.05 of Chapter II, Article B of the Revised Tax Code of the Municipality provides that the sangguniang bayan, through a resolution may extend the time of payment of Business Tax without penalty or surcharge for a justifiable reason or cause provided that the period of extension shall not exceed six (6) months; WHEREAS, the Market Vendors Association have requested for an extension of the time of payment of their business taxes; WHEREAS, upon recommendation of the Local Finance Committee, the body agreed to extend the time of payment up to January 31, 2012. NOW THEREFORE, on motion of Coun. Felino C. Millo Jr., Chairman Committee on Rules, Privileges and Legal Matters, duly seconded, be it: RESOLVED, as it is hereby resolved to extend the time of payment of the Business Tax of the Market Vendors up to January 31, 2012;

RESOLUTION AUTHORIZING THE LOCAL CHIEF EXECUTIVE TO ENTER INTO AN AGREEMENT WITH THE PROVINCE OF TARLAC OF THE APPROPRIATION OF

FUNDS FOR SPECIALIZED RESEARCH AND PLANNING SERVICES

WHEREAS, Section 13 Article X (Local Governments) of the 1987 Constitution provides that: “Local Government Units may group themselves, consolidate or coordinate their efforts,

services and resources for purposes commonly beneficial to them in accordance with law”; WHEREAS, Section 33 of the Local Government Code regarding the cooperative undertakings among Local Government Units, states that “Local Government Units may, through

appropriate ordinances, group themselves, consolidate, or coordinate their efforts, services, and resources for purposes commonly beneficial to them. In support of such undertakings, the local government units involved may, upon approval by the sanggunian concerned after a public hearing conducted for the purpose, contribute funds, real estate, equipment, and other kinds of property and appoint or assigned personnel under such terms and conditions as may be agreed upon by the participating local units through Memoranda of Agreement.” WHEREAS, with the rapid urbanization pace of the Province of Tarlac, a development trend that is radiating towards the neighboring provinces is noticeable; WHEREAS, rapid urbanization pace will also bring about problems and issued resulting from population concentration such as traffic, flooding, high housing demand, solid waste disposal and management, and the provision of amenities such as water supply; WHEREAS, these factors would need specialized research and planning Services that the existing local planning and development offices cannot provide; WHEREAS, the Province and its component city and municipalities seek, through this Memorandum of Agreement (MOA), to engage in cooperative development activities in pursuit of their common desire to jointly address the development challenges facing the Province and ultimate

improve the welfare of their respective constituents, consistent with the Alliance Building strategy for development advocated by the Department of Interior and Local Government (DILG); WHEREAS. Section 444 (1) (vi) provides that the Local Executive of the Municipal Government, upon authorization by the sangguniang bayan, represent the Municipality in all its business transactions and sign on its behalf all bonds, contracts, and obligations, and such other documents made pursuant to law or ordinance; NOW THEREFORE, a motion of Coun. Felino C. Millo, Jr. duly seconded, be it:

RESOLVED, as its is hereby resolved to authorized the Municipal Mayor to enter into an agreement with the Province of Tarlac for the appropriation of funds for Specialized Research and Planning Services, subject to the conditions set forth in Republic Act No. 9184, together with its implementing Rules and Regulations. RESOLVED FURTHER, to furnish copy of this resolution all agencies concerned for their perusal and appropriate action.

RESOLUTION NO. 017

Series of 2012 A RESOLUTION ENJOINING THE CONCERNED OFFICIALS OF THIS MUNICIPALITY

(LOCAL CHIEF EXECUTIVE, MUNICIPAL ACCOUNTANT, MUNICIPAL BUDGET OFFICER AND BAC CHAIRMAN) TO IMPOSE LIQUIDATED DAMAGES TO THE

CONTRACTOR OF THE FOOD COURT OF THE PUBLIC MARKET

WHEREAS, the Municipality of Pura, represented by Mayor Concepcion A. Zarate, and R.R. Ricafort executed a Contract for the Construction of Food Court with six outlets at the dry section of the Public Market; WHEREAS, the provisions of the contract provides that the whole work shall be completed by the Contractor within seventy calendar days; WHEREAS, the same contract stipulates that where the contractor refuses or fails to satisfactory completer the work within the specified contract time, the said contractor shall pay the owner (Municipality of Pura) for liquidated damages and not by way of penalty, an amount equal to one tenth of one percent (.01%) of the total contract cost minus the value of the completed portions of the Contract certified by the proper government agency concerned as able as of the Expiration of the Contract time; or each calendar days delay, until the work is completed and accepted or taken over by the owner; WHEREAS, the Contractor, R.R. WHEREAS, the Bureau of Soils and Water Management, in support to the Executive Order 481, otherwise known as the “Promotion and Development of Organic Agriculture in the Philippines”,

will implement the Establishment of Trichoderma Production Laboratory funded under the Organic Fertilizer Production/Expanded Modified Rapid Composting Project; WHEREAS, the Bureau of Soils and Water Management, in pursuance to its mandate to manage and conserve soil and water resources, has the capability to determine the appropriate technologies and practices that will restore the inherent fertility of degraded soils; WHEREAS, the Bureau of Soils and Water Management advocates the utilization of rice straw in on-farm composting enhanced by Trichoderma harzianum as compost fungus activator (CFA), being one of the methods to restore soil fertility, mitigate the effect of global warming and promote the gradual adoption of Organic Agriculture nationwide; WHEREAS, this LGU, as focal agency in the province in charge of food security, has a logistical capability and network to handle the establishment, operation and management of Trichoderma Production Laboratory; WHEREAS, in view thereof, the Bureau of Soils and Water Management and this LGU agree to cooperate, collaborate and jointly implement the establishment of Trcihoderma Production Laboratory; NOW THEREFORE, a motion of Coun. A RESOLUTION GRANTING SPECIAL PERMIT TO THE BARANGAY COUNCIL OF MATINDEG TO HOLD FUND-RAISING ACTIVITY, THRU COCKFIGHTING

WHEREAS, the Barangay Council of Matindeg, in its desire to provide recreation and entertainment and at the same time raise funds for its priority projects, requested for a special permit to hold fund-raising activity, thru cockfighting; WHEREAS, this body, after careful deliberation, agreed to grant a special permit to the said Barangay Council to hold special cockfights starting February 23, 2012; NOW THEREFORE, on motion of Councilor Ferdinand C. Valdez, Chairman, Committee on Games and Amusement, duly seconded, be it: RESOLVED, as it hereby resolved, to grant a Special Permit for the Barangay Council of Matindeg, Pura, Tarlac, to hold special cockfights, subject to the following terms and conditions, to wit:

a. The fund-raising activity, thru cockfighting, shall conform with the provisions of Republic Act No. 7160, particularly Section 391 (11), to ensure compliance with national policy standards and regulations on morals, health and safety of the persons participating therein;

b. Cockfights shall be conducted in accordance with the rules and regulations set forth in Municipal Ordinance No. 08-002 and other related laws;

c. Cockfights shall be managed by duly qualified persons who shall abide with the pertinent provisions of the Municipal Tax and Revenue Code;

d. No gambling of any kind shall be permitted within the premises of the temporary cockpit; and

e. The Special Permit shall be valid for ninety (90) days starting February 23, 2012.

WHEREAS, the DEPARTMENT OF INTERIOR AND LOCAL GOVERNMENT (DILG), the PROVINCE and the CITY AND MUNICIPALITIES OF TARLAC recognize the need to adopt adequate measures to safeguard and conserve land, mineral, marine, forest, and other resources;

WHEREAS, the DILG, the PROVINCE and the CITY AND MUNICIPALITIES adopted the

Supreme Court Decision followed by a Resolution dated December 18, 2008 and February 15, 2011, that stakeholders must initiate efforts to clean up, rehabilitate and preserve Manila Bay, and to restore and maintain its waters to SB (Class B seawaters per Water Classification Tables under DENR Administrative Order No. 34) to make them fit for swimming, skin-diving, and other forms of contact recreation;

WHEREAS, the DILG, the PROVINCE and the CITY AND MUNICIPALITIES must act

and perform their respective duties and devise a consolidated, coordinated, and concerted scheme of action for the cleaning of major and minor rivers, creeks and connecting waterways in the entire province;

WHEREAS, the Regional Development Council of Region III in its full council meeting on

July 13, 2011 adopted the concept of Synchronized Regular Barangay Clean-Up through a resolution; WHEREAS, the DILG, the PROVINCE, and the CITY AND MUNICIPALITIES know the

importance of raising awareness to the general public with regards to the growing issues about environmental concerns that will greatly affect the communities from which they live in;

Scope of Coverage. Series of 2012 A RESOLUTION AUTHORIZING THE TRANSFER OF THE ADMINISTRATION OF FUNDS

FOR THE SANGGUNIAN BAYAN FROM THE EXECUTIVE TO THE MUNICIPAL VICE MAYOR

WHEREAS, the enactment of Republic Act No. 7160, otherwise known as the “Local

Government Code of 1991,” provided a way for check and balance among the Local Government Units by granting them separate powers; WHEREAS, Section 445 (1) of the Code grants the Municipal Vice Mayor the power to be the Presiding Officer of the Sangguniang Bayan and sign all warrants drawn on the Municipal Treasury for all expenditures appropriated for the operation of the Sangguniang Bayan; WHEREAS, in consonance to the above provision, there is a need to transfer the administration of the legislative funds from the Executive Department to the Vice Mayor of this Municipality; NOW THEREFORE, on unanimous motion presented, be it: RESOLVED, as it is hereby resolved, to authorize the transfer of administration of appropriated funds for the Sangguniang Bayan from the Executive Department to the Vice Mayor/Presiding Officer. RESOLVED FURTHER, to grant authority to the Vice Mayor to sign for and in behalf of the Municipality all warrants drawn from the appropriated funds of the Sangguniang Bayan. RESOLVED FINALLY, to furnish all concerned offices and agencies for their perusal and guidance. UNANIMOUSLY ADOPTED.

Series of 2012

A RESOLUTION AUTHORIZING THE LOCAL CHIEF EXECUTIVE TO ENTER INTO A RICE LOAN AGREEMENT WITH THE NATIONAL FOOD AUTHORITY

(NFA)

WHEREAS, the National Food Authority (NFA) is the government agency charged with, among others, ensuring the nation with adequate supply and distribution of grains;

WHEREAS, pursuant to the provisions of the Local Government Code of 1991, local government units have been vested the authority to discharge the functions and responsibilities of national agencies and offices devolved to them; WHEREAS, the local government units are authorized to set aside five percent (5%) of the twenty percent (20%) of their estimated revenue from regular sources as an annual lump sum appropriation for Calamity Fund and Special Development Fund, respectively;

WHEREAS, the local government units have been tasked with providing basic social services at all times, particularly in times of calamities; WHEREAS, in order to provide basic social services to the populace, the Pura Municipal Government had requested the NFA to allow them to purchase rice on credit for the following purposes: (1) for relief operations whenever a state of calamity is declared in their locality; and (2) for stockpiling purposes in preparation for any eventuality/emergency that may occur at any given time; NOW THEREFORE, on motion of Coun. Felino C. Millo Jr., unanimously seconded, be it: RESOLVED, as it is hereby resolved, to authorize the Honorable Municipal Mayor CONCEPCION A. ZARATE to enter into a Rice Loan Agreement with the National Food Authority (NFA), Tarlac Provincial Office, Tarlac City;

OF RAINFED AREAS THAT WERE TOTALLY AND/OR PARTIALLY DAMAGED BY TYPHOONS PEDRING AND QUIEL

WHEREAS, there are farmers in this Municipality who were adversely affected by typhoons Pedring and Quiel, but were not given any assistance from the government; WHEREAS, as per validated report from the Office of the Municipal Agriculturist, 584.38 hectares were totally damaged and 131.45 hectares were partially damaged hereat, involving 682 and 179 farmers, respectively;

WHEREAS, all the said affected farmlands are categorized as rainfed areas and the same were not benefited from the subsidy previously given by the government; NOW THEREFORE, on motion presented by Hon. Teodora D. Robino, Chairman, Committee on Agriculture, unanimously seconded, be it: RESOLVED, as it is hereby resolved, to request the Regional Director of the Department of Agriculture for the provision of certified seeds for the rehabilitation of the reported rainfed areas that were totally and/or partially damaged by Typhoons Pedring and Quiel; RESOLVED FURTHER, that a copy of this resolution be furnished to DR. WHEREAS, Section 21 of Republic Act No. 10121 mandates that there shall be a Local Disaster Risk Reduction and Management Fund of not less than five percent (5%) of the estimated revenue from regular sources to support disaster risk management activities; WHEREAS, the same provision of the said law mandates that of the amount appropriated for the Local Disaster Risk Reduction Management Fund, thirty percent (30%) shall be allocated as Quick Response Fund or Standby Fund for relief and recovery programs in order that the situation and living conditions of the people in communities or areas stricken by disasters, calamities, epidemics, or complex emergencies may be normalized as quickly as possible; WHEREAS, the Unexpended Local Risk Reduction and Management Fund shall accrue to a “Special Trust Fund” solely for the purpose of supporting disaster risk reduction management

activities of the Local Risk Reduction Management Council; WHEREAS. WHEREAS, most recent data from the 7th National Nutrition Survey (2008) conducted by the Food and Nutrition Research Institute of the Department of Science and Technology revealed that prevalence of under and over nutrition still persists among Filipino children and has significantly increased as compared to the last survey; WHEREAS, the latest survey (2006) of the Family Income and Expenditures Surveys (FIES) conducted by the National Statistics Office every three years reported that about eleven percent (11%) of Filipino families had incomes that cannot buy the food needed by family members for nutritional well-being and health; hence, these families could be considered as hungry and food-poor; WHEREAS. Section 444 (1) (vi) of Republic Act No. 7160, otherwise known as the “Local

Government Code of 1991”, provides that the Local Executive of the Municipal Government, upon authorization by the sangguniang bayan, represent the Municipality in all its business transactions and sign on its behalf all bonds, contracts, and obligations, and such other documents made pursuant to law or ordinance;

the national economy are a more equitable distribution of opportunities, income and wealth of life for all especially the underprivileged”; WHEREAS, Article XIII, Section 2, of the 1987 Philippine Constitution provides that the promotion of social justice include the commitment to create economic opportunities based on freedom of initiative and self-reliance; WHEREAS, Section 3 of Republic Act 5416 otherwise known as the “Social Welfare Act”

mandates the DSWD to provide a comprehensive program of social welfare services designed to ameliorate the living conditions of distressed Filipinos particularly those who are handicapped by reason of poverty; WHEREAS, pursuant to the above mandate the DSWD has designed the SEA Kaunlaran scheme which focuses on the promotion of viable people’s organizations and effectively address the

livelihood needs of the disadvantaged groups; WHEREAS, Republic Act No. 7160, otherwise known as the “Local Government Code of

1991”, provides for the consultation and coordination with Local Government Units (LGU’s); WHEREAS, the SEA Kaunlaran is considered as an innovative approach to livelihood development credit assistance and people empowerment;

FOR THE SMOOTH AND ORDERLY OPERATION OF THE COCKPIT WHEREAS, Section 447 (3) (v) of the Local Government Code of 1991 vested the power to the sangguniang bayan to authorize and license the establishment, operation and maintenance of cockpits and regulate cockfighting; WHEREAS, after conducting public hearings, the sangguniang bayan enacted Ordinance No. 3, Series of 2012, granting permit to Mr. Carlito I. Pascua to operate cockpit in Barangay Matindeg; WHEREAS, the sangguniang bayan believes that there exists no legal impediment for the operation of the cockpit; WHEREAS, the operator promised to comply with all the mandates of existing law and manifested his willingness to pay all the necessary fees that will be imposed by the Local Government Unit; WHEREAS, the issuance of the corresponding business permit will pave the way for the smooth and orderly operation of the cockpit and the proper imposition and collection of fees and charges thereto; NOW THEREFORE, on unanimous motion presented, be it:

Additional Benefits and Privileges to Senior Citizens, Amending for the Purpose Republic Act No. 7432, Otherwise Known as “An Act to Maximize the Contribution of Senior Citizens to Nation-Building, Grant Benefits and Special Privileges and for Other Purposes”” provides that the senior

citizens shall be entitled to the grant of twenty percent (20%) discount from all establishments relative to the utilization of services in hotels and similar lodging establishment, restaurants and recreation centers, and purchase of medicines in all establishments for the exclusive use and enjoyment of senior citizens, including funeral and burial services for the death of senior citizens; WHEREAS, numerous complaints were received by this Sanggunian that there are business establishments within the territorial jurisdiction of this Municipality that are not observing the afore-quoted provision the law; NOW THEREFORE, on motion of Coun. Nenita M. Cabarios, unanimously seconded, be it: RESOLVED, as it is hereby resolved, to enjoin all business establishments within the territorial jurisdiction of this Municipality to observe the afore-quoted provision of law;

A RESOLUTION EXTENDING THE TIME FOR THE PAYMENT OF BUSINESS TAXES IN ACCORDANCE WITH CHAPTER II, ARTICLE B, OF THE REVISED TAX CODE OF THE

WHEREAS, Section 2B.05 of Chapter II, Article B of the Revised Tax Code of the Municipality provides that the sangguniang bayan, through a resolution may extend the time of payment of Business Tax without penalty or surcharge for a justifiable reason or cause provided that the period of extension shall not exceed six (6) months; WHEREAS, upon recommendation of the Committee on Finance, Budget and Appropriation, the members of the body unanimously agreed upon to provide the time of payment up to August 10, 2012; NOW THEREFORE, on motion of Coun. A RESOLUTION AUTHORIZING THE LOCAL CHIEF EXECUTIVE TO ENTER INTO AN AGREEMENT WITH THE ALLIANCE OF CHAPLAINS FOR TRANSFORMATION

SOCIETY (ACTS) PHILIPPINES

WHEREAS, the Alliance of Chaplains for Transformation Society (ACTS) Philippines is directed on its operations manual to implement to the best of its ability the spirit of good governance and good citizenship program, as mandated by the 1987 Philippine Constitution, Republic Act Nos. 7160 and 6713, Presidential Proclamation No. 62 (Moral Recovery Program) dated 30 September 1992, Presidential Proclamation No. 828 (Declaring a Decade (2005-2015) of Good Governance and Good Citizenship to Fight Corruption and to Eradicate Poverty dated April 14, 2005), Administrative Order No. 255, Sec. 2, and Executive Order No. 713 (Strengthening the Authority of a Just and Moral Philippine Society, Amending Executive Orders 314 and 347 for the Purpose dated March 12, 2008). WHEREAS, the ACTS Philippines commits itself in promoting the Government’s Moral Renewal Program: MAKADIYOS, MAKATAO, MAKABAYAN, AT MAKAKALIKASAN. WHEREAS, the Pura Municipal Government is willing to support and adopt measures to promote the programs of the ACTS Philippines;

ACCOMPLISHMENTS AGAINST PERFORMANCE STANDARDS APPLIED IN UNDERTAKING DEVELOPMENT PROJECTS REPORT

WHEREAS, Section 316 (h) of Republic Act No. 7160, otherwise known as the “Local

government Code of 1991”, mandates the Local Finance Committee to conduct a semi-annual review and general examination of cost and accomplishments against performance standards applied in undertaking development projects. A copy of this report shall be furnished to the local chief executive and the Sanggunian concerned and shall be posted in conspicuous and publicly accessible places;

WHEREAS, the functions of the Local Finance Committee deal with evaluation of local budgets, how the same may be supported by tax measures and maintenance of appropriate levels of expenditures, observing ceilings of spending, as well as reviewing effects of implementation specially if there is a deficit;

WHEREAS, to date, no pertinent report has been submitted by the Local Finance

Committee; NOW THEREFORE, on unanimous motion presented, be it: RESOLVED, as it is hereby resolved, to enjoin the Local Finance Committee to submit the

Semi-Annual Review and General Examination of Cost and Accomplishments Against Performance Standards Applied in Undertaking Development Projects Report to this Sanggunian.

A RESOLUTION AUTHORIZING THE LOCAL CHIEF EXECUTIVE TO ENTER INTO AN AGREEMENT WITH THE DEPARTMENT OF THE INTERIOR AND LOCAL

GOVERNMENT (DILG) RELATIVE TO THE LEGISLATIVE TRACKING AND PERFORMANCE MONITORING SYSTEMS PROJECT

WHEREAS, the local government units (LGU’s) are mandated to uplift the lives of its

constituents and as a whole to be progressive and competitive community; WHEREAS, the Department of the Interior and Local Government (DILG), thru the Bureau

of Local Government Development (BLGD), is mandated to assist/strengthen the capabilities of LGU’s, particularly their administrative, technical and fiscal capabilities to enable them to effectively

deliver basis services to its constituents; WHEREAS, the information technology, through the computer-based administrative system

is one tool of improving the administrative capacities of LGU’s for effective governance; WHEREAS, the DILG, through the BLGD, developed the computer-based administrative

systems under the Legislative Tracking and Performance Monitoring Project (LTPMP): Sanggunian Information System which can be installed and implemented in all LGU’s;

WHEREAS, the installation of the above-mentioned system can only be made upon official

request from the LGU; WHEREAS, the Municipality of Pura is desirous of adopting the said application system and

its accompanying policies as authorized under Sangguniang Panlungsod/Bayan Resolution No. 048, Series of 2012.

WHEREAS, Section 444, par. (b) (1) (vi), of Republic Act No. 7160, otherwise known as the “Local Government Code of 1991,” provides that for efficient, effective and economical governance the purpose of which is the general welfare of the municipality and its inhabitants pursuant to Section 16 of this Code, the municipal mayor shall upon authorization by the Sangguniang Bayan, represent the municipality in all its business transactions and sign on its behalf all bonds, contracts, and obligations, and such other documents made pursuant to law or ordinance;

NOW THEREFORE, on unanimous motion presented, be it: RESOLVED, as it is hereby resolved, to authorize the Local Chief Executive to enter into an agreement, for and in behalf of this Local Government Unit, with Department of the Interior and Local Government relative to the Legislative Tracking and Performance Monitoring System Project. Section 1. TITLE: This Ordinance shall be known as “AN ORDINANCE RECLASSIFYING LOT NO. 681-E-2 REGISTERED UNDER TCT NO. T-276386 FROM AGRICULTURAL TO COMMERCIAL PURPOSES”. Section 2. The aforementioned land, after proper determination by this August Body, shall be reclassified from agricultural to commercial purposes. Section 3. There is hereby imposed a reclassification fee of Two Pesos (P2.00) per square meter for the reclassification of the above-described land from Agricultural to Commercial purposes. The Municipal Assessor is hereby authorized to register the reclassification of the subject parcel of land in the tax declaration upon payment of the fee, which shall exclusively accrue to the General Fund of the Local Government Unit. A RESOLUTION ENJOINING THE PURA WATER SYSTEM TO GRANT FIVE PERCENT (5%) DISCOUNT TO THE MONTHLY WATER BILLS OF SENIOR

CITIZENS, AS PROVIDED UNDER SECTION 4 (c) OF THE “EXPANDED SENIOR

CITIZENS ACT OF 2010”

WHEREAS, Article XIII, Section II of the Constitution of the Philippines provides that the State shall adopt an integrated and comprehensive approach to health development which shall endeavor to make essential goods, health and other services available to all the people at affordable cost. There shall be priority for the needs of the under privileged, sick, elderly, disabled, women and children. Section 4 of Article XV of the Constitution further declares that the family has the duly to take care of its elderly members but the State may also do so through just programs of social security; WHEREAS, consistent with these constitutional principles, Republic Act No. 9994, also known as the “Expanded Senior Citizens Act of 2010”, was enacted in order to recognize the rights of senior citizens to take their place in society and make it a concern of the family, community and government; to give full support to the improvement of the total well-being of the elderly and their full participation in society; to encourage and motivate the senior citizens to contribute to nation building and to encourage their families and the communities they live with to reaffirm the valued Filipino tradition of caring for the senior citizens; WHEREAS, Section 4 (c) of Republic Act No. 9994 provides the grant of five percent (5%) discount on the monthly water bills of the senior citizens;

(Page 2 of Resolution No. 082, Series of 2012) WHEREAS, this body fully aware of its mandate and concern for the elderly, agreed to adopt this resolution enjoining the Pura Water System to implement the provisions of the “Expanded Senior Citizens Act of 2010 (RA No. 9994), particularly section 4 (c) thereof or the grant of a minimum of five percent (5%) discount relative to the monthly utilization of water and electricity supplied by the public utilities; NOW THEREFORE, on motion of Coun. Felino C. Millo Jr., Chairman, Committee on Rules, Privileges and Legal Matters, duly seconded, be it: RESOLVED, as it is hereby resolved, to enjoin the Pura Water System to provide a minimum Five Percent (5%) discount to senior citizens of their monthly Water Bills; RESOLVED FURTHER, to request the Pura Water Council to prepare the necessary Rules and Regulations in providing such discount; RESOLVED FINALLY, to furnish copies of this resolution to the Pura Water Council and all agencies concerned for their perusal and appropriate action.

A RESOLUTION APPROVING THE ANNUAL INVESTMENT PLAN OF THE MUNICIPALITY

WHEREAS, Section 354 of Republic Act No. 7160 provides that the Secretary of Budget and Management and the Chairman of the Commission on Audit (COA) shall jointly promulgate a Budget Operations Manual for local government units to improve and systematize methods, techniques, and procedures employed in budget preparation, authorizing, execution and accountability;

WHEREAS, Article 410 of the Implementing Guidelines of RA 7160 provides that the Local

Development Council shall submit to the local finance committee a copy of the local development plan and annual investment program prepared and approved during the fiscal year in accordance with applicable laws, specifying therein the projects proposed for inclusion in the local government budget;

WHEREAS, the Annual Investment Plan has already been reviewed at the Sangguniang Bayan

and found to have complied with the substantial requirements set forth by law; NOW, THEREFORE, on unanimous motion presented, be it: RESOLVED, as it is hereby resolved, to approve the 2013 Annual Investment Plan. WHEREAS, the Department of Social Welfare and Development (DSWD), is mandated to provide social welfare and development programs, particularly through technical assistance and resource augmentation;

WHEREAS, the DSWD is continuously implementing programs/projects and providing

augmentation assistance to the local government units (LGU’s), non-government organizations and other partner agencies that would help alleviate poverty and ensure the welfare of the disadvantaged and vulnerable groups;

WHEREAS, the Social Pension for Indigent Senior Citizens is an additional government

assistance to augment the daily subsistence and other medical needs of indigent senior citizens; WHEREAS, Fund Transfer to LGU is identified as a mode of payment to fast-track the

distribution of stipend to the beneficiaries and to strengthen partnership with the LGU’s in the effective

delivery of programs and services;

NOW THEREFORE, on unanimous motion presented, be it: RESOLVED, as it is hereby resolved, to authorize the Local Chief Executive to enter into an agreement, for and in behalf of this Local Government Unit, with the Department of the Social Welfare Development (DSWD) Field Office No. 3.

A RESOLUTION AUTHORIZING THE LOCAL CHIEF EXECUTIVE TO ENTER INTO AN AGREEMENT WITH THE RAMOS WATER DISTRICT FOR THE PROVISION OF WATER

SUPPLY TO PUROK 4 TO 7 OF BARANGAY MAUNGIB

WHEREAS, the Sangguniang Barangay of Maungib, thru its Resolution No. 10, Series of 2012, requested the Sangguniang Bayan to grant permission to the Ramos Water District to extend their services to the said barangay; WHEREAS, as provided for by law, the Local Government Unit, in the exercise of its proprietary function, may enter into a contract with private or corporate entity for the provision of basic services to the inhabitants;

WHEREAS, Section 22, Chapter 2, Title 1, of Republic Act No.7160 provides that unless otherwise provided in this code, no contract may be entered into by the local chief executive in behalf of the local government unit without prior authorization from the Sanggunian concerned; WHEREAS, Section 444, par. (b) (vi), of Republic Act No. 7160 provides that for efficient, effective and economical governance the purpose of which is the general welfare of the municipality and its inhabitants pursuant to Section 16 of this Code, the Municipal Mayor shall, upon authorization by the sangguniang bayan, represent the Municipality in all its transactions and sign on its behalf all bonds, contracts, and obligations, and such other documents made pursuant to law or ordinance;

NOW THEREFORE, on motion of Coun. Felino C. Millo Jr., be it: RESOLVED, as it is hereby resolved, to authorize the Local Chief Executive to enter into an agreement with the Ramos Water District to extend its services to Purok 4 to 7 of Barangay Maungib.

A RESOLUTION AUTHORIZING THE GRANT OF PRODUCTIVITY ENHANCEMENT INCENTIVE TO QUALIFIED EMPLOYEES OF THE MUNICIPALITY UTILIZING THE

SAVING ON THE PERSONAL SERVICES

WHEREAS, Executive Order No. 80 issued by President Benigno S. Aquino III provides that a Performance Based Incentive System, consisting of the Productivity Enhancement Incentive and the Performance Based Bonus, shall be adopted; WHEREAS, Section 90 of DBM Circular No. 2012-3 provides that LGU Employees, including those in barangay governments who are compensated through monthly honoraria, may be granted the one time PEI for FY 2012, at rates to be determined by the respective sanggunian, depending on the LGU financial capability and subject to the conditions set forth; WHEREAS, the Municipality, based on the endorsement of the Municipal Mayor, have unutilized fund from the salaries of the unfilled positions as well as savings from the salaries of employees who retired in the early part of 2012 amounting to ONE MILLION THREE HUNDRED SEVENTY THOUSAND SEVEN HUNDRED SEVENTY PESOS & SIX CENTAVOS ( P 1,370,770.06); WHEREAS, this body in session assembled decided to grant the amount of TEN THOUSAND PESOS (P10,000.00) to every qualified Municipal Officials/employee; NOW THEREFORE, on unanimous motion presented, be it: RESOLVED, as it is hereby resolved, to allow the savings in the unfilled positions and savings derived from the salaries of employees who retired in the early part of 2012 for the grant of PEI to qualified Municipal Officials/employees amounting to TEN THOUSAND PESOS (P 10,000.00) per official/employee;
