Page 4: Requirements for Hazardous Waste Generators in Wisconsin

Regulatory Agencies

• USEPA regulates environmental protection nationwide.

• Approved State programs may be more stringent and more broad.

• In Wisconsin: The WI Department of Natural Resources (WDNR).

@DanielsTraining 6

HAZARDOUS WASTE DETERMINATIONRequired for all the waste you generate.

Hazardous Waste in Wisconsin

Page 7: Requirements for Hazardous Waste Generators in Wisconsin

@DanielsTraining

All Generators Must Complete a Hazardous Waste Determination• Sole responsibility of the generator.• Must be documented.• Maintain records for 3 years.• Determination may be based on:

1. Analysis of samples.

2. Generator’s knowledge.

7Hazardous Waste in Wisconsin

Page 8: Requirements for Hazardous Waste Generators in Wisconsin

@DanielsTraining

Is it a Solid Waste?

• Any discarded material.

• Liquid, solid, semi-solid.• Garbage or trash.• Industrial waste.• Residential waste.• Food waste.• Containers &

packaging.

@DanielsTraining 9

Two Types of Hazardous Waste

1. Listed

• Identified by:

1. Process of generation

2. Technical name• Usually knowledge-based.

2. Characteristic

• Exhibits defined characteristics.

• Usually determined by sample analysis.

Hazardous Waste in Wisconsin

Page 10: Requirements for Hazardous Waste Generators in Wisconsin

@DanielsTraining 10

Listed Hazardous Waste

• F-Codes:• Non-specific sources.• Spent solvents, WWT sludge, more…

• K-Codes:• Specific sources.• Petroleum refining, primary metal processing, more…

Page 13: Requirements for Hazardous Waste Generators in Wisconsin

@DanielsTraining 14

More Characteristic Hazardous Waste

• Reactive (D003):• Unstable under normal conditions.• Water reactive.• Explosive.

• Toxic (D004 – D043):• Poisonous to living organisms.• Toxins will leach from waste above a threshold concentration.

Hazardous Waste in Wisconsin

Page 14: Requirements for Hazardous Waste Generators in Wisconsin

@DanielsTraining 15

Is it Excluded by Regulation?

• Excluded by rule from definition of solid waste.• Excluded by rule from definition of hazardous waste.

• Excluded from regulation due to recycling.• Excluded as material in an out-of-service process for ≤90 days.

• Excluded as a waste determination or treatability study sample.

Hazardous Waste in Wisconsin

Page 15: Requirements for Hazardous Waste Generators in Wisconsin

@DanielsTraining 16

Common Hazardous Waste Violations

• Misclassifying a hazardous waste as non-hazardous or vice-versa.

• Incorrect application of generator knowledge where sample analysis would yield better used.

• Use of a lab for sample analysis that is not certified by the WDNR.

Hazardous Waste in Wisconsin

Tip: Refer to list of

WDNR certified labs
