The 2013-2014 academic year saw great research achievements at ESADE, and because of this congratulations are in

order. I would like to share some of the indicators that are routinely used by “triple crown” international accreditors,

university authorities and business school rankings to assess the quality of research at international academic

institutions.

Over the past year, we have published 38 articles in first-quartile (Q1) journals (the excellent journals that are leaders

in their respective fields). Eighteen of these articles were published in journals on the Financial Times top 45 list

(authors: Aguilera, Arenas [2], Bertini, Brinckmann, Cano, Collet [2], Pless, Ragozzino [2], Thyiel, Van Cranenburgh,

Visnjic, Vives, Wareham and Wiengarten [3]).

Also in the past year, 7 doctoral candidates have defended their theses (supervisors: Batista, Dolan, Llebaría, Rodón [2], Sierra and Iglesias, Tornos), and 3 PhDs from ESADE have been hired in the international job market (Canboy at Toulouse Business School, Kanilhal at Università della Svizzera italiana [USI], and Rezazade at VU University Amsterdam).

Thirteen research groups have been accredited by the University Agency and 5 of them have also received funding (principal investigators [PIs]: Batista, Dumitrescu, Giménez, Wareham and Ysa).

Also this year, ESADE researchers have been awarded 7 competitively funded research projects – in other words,

projects obtained through competition with other projects. Six of these are European funded research projects (PIs:

Almirall, Dolan, Férez, Giménez, Papageorgiou and Vanhaverbeke), which, taken together with several other

(education-focused) European projects, amount to more than €1.5 million in income. We have also obtained 2

competitively funded research project from Spain’s National R&D&I Plan, bringing ESADE’s total number of active

projects funded by this plan to 6 (PIs: Agell, Batista, Giménez [2], Dumitrescu and Valls).

These competitively funded projects allow us to carry out high-quality networked research, recruit researchers, provide funding for attendance at international conferences and acquire research infrastructure (such as databases), while also ensuring the sustainability of the research.

Finally, this year the Catalan University Quality Agency (AQU) awarded a total of 6 accreditations to ESADE faculty

members: advanced research (Sierra, Wareham and Ysa), research (Duplà and Pless), and tenure-track lecturer (Collet).

Congratulations to all of you for your fantastic results and for contributing, through your commitment, to ESADE’s educational excellence and academic credibility.

The 2014-2015 academic year began with some changes in ESADE’s organizational research structure. The post of Dean of Faculty and Research held by Jonathan Wareham is now transversal, pertaining to both the Business and Law Schools. As the new Vice-Dean of Research, I would like to personally thank Jonathan for all his magnificent work for research at ESADE over the past several years: helping to enhance the international position of our research in management, enthusiastically encouraging our researchers to publish in top journals, redesigning our excellent doctoral program, developing transparency policies, building our academic community, and supporting infrastructure for rigorous, high-quality research. The main purpose of all those objectives was educational excellence and academic

credibility.

The substantial growth of our research in terms of quality and impact would not have been possible without the constant support of Alfons Sauquet, former Dean of the Business School and current ESADE Global Dean. He has my deepest appreciation for his commitment to raising ESADE’s stature as an institution of research excellence.

On 1st September, new directors were appointed for the PhD in Management Sciences (Vicenta Sierra) and the Master of Research (MRes) in Management Sciences (François Collet). I would like to thank Cristina Giménez for her extraordinary work as director of the research programs, and I wish her great success as Vice-Dean of Faculty.

In the coming years, our main challenges will revolve around the following aspects: continuing to emphasize the quality and culture of academic scholarship; continuing to grow and professionalize our funding capabilities (Horizon2020 and private donors) and research infrastructure; formalizing different contributions (professional literature, professional profiles); having an impact, voice and dissemination in the media; and aligning our management and law research

policies.

This paper investigates stock market responses to the different constellations of firm-level corporate governance mechanisms by focusing on foreign IPOs in the U.S. We build on sociology-grounded research on financial market behavior and suggest a "nested" legitimacy framework to explore U.S. investor perceptions of foreign IPO value. Using a fuzzy-set theoretic methodology, we demonstrate how different combinations of monitoring and incentive-based corporate governance mechanisms lead to the same level of investor valuations of firms. Moreover, institutional factors related to the minority shareholder protection strength in the foreign IPO's home country represent a boundary condition that affects the number of governance mechanisms required to achieve U.S. investors' high value perceptions. Our findings contribute to the sociological perspective on comparative corporate governance and the inter-dependencies between organizations and institutions.

Open innovation has received substantial business attention as a means of providing firms in hyper-competitive environments with the ability to create a stream of new products and services. For open innovation, organizing external sources correctly is a critical capability; current literature suggests that external sources should be organized either as collaborative communities or as competitive markets. While firms have generally been slow to adopt open innovation, many cities in the U.S. and Europe have been quick to embrace it-providing needed field-based experience on how to organize external sources. Based on our examination of six cities opening their data for innovation, we found that while cities often started with one or the other approach to organizing their external sources, each approach was inadequate in ways that could potentially be addressed by the addition of the other approach. Thus, we conclude with an integrated approach in which the needs of the entire ecosystem of sources and supporters of innovation are organized to address both competitive and community needs.

This article is directed at managers who seek to profit from differentiation. If you sense that your company is leaving good money on the table and struggling to convert product differentiation into revenue and profits, then you should consider enlisting the help of unlikely partners: your customers. To be sure, the thought of working with customers on a critical business activity such as pricing can be unnerving for managers. However, in the same spirit that companies today are recruiting customers to improve product design and marketing communications, managers need to recognize that it’s those who purchase a company’s products or services who ultimately determine what they are worth. While customers need not have sole discretion over these activities, they can certainly provide important input. It’s critical to recognize that outsourcing pricing to customers isn’t an all-or-nothing proposition: Managers can select pricing models ranging from complete oversight to complete delegation. The trick is to choose an approach that is suited to the characteristics of the market you’re in and that limits the costs, real and potential, that may arise.

This editorial article introduces this special issue of the International Journal of Human Resource Management devoted to the outcomes of expatriate assignments. We set the topic in context. We start by summarizing the traditional view on expatriate outcomes. We then argue that recent developments in the field suggest the need to build a more sophisticated and complex analysis on the topic that incorporates different perspectives (e.g. the organization, the expatriate, their co-workers and their families) and additional types of international experiences and organizations. We then present some difficulties in developing such an analysis. Specifically, using a new typology of complementary relationships among outcomes (i.e. temporal, among-group and among-outcome consistencies), we point out some complications to achieve those relationships. We conclude by introducing the papers in the special edition that all in some way aim to contribute to our understanding of expatriate outcomes.

Although entrepreneurship scholars highlight bootstrapping as a key resource acquisition approach to respond to the inherent resource constraints that nascent ventures face, little is known about what causes nascent ventures to engage in bootstrapping. Theory highlights the environment as an important determinant of bootstrapping activity. Analyzing bootstrapping behavior of 298 nascent ventures, we find that beyond perceived environmental factors, individual characteristics of the nascent entrepreneurs and factors relating to the embeddedness of the entrepreneurs in the environment determine their venture's bootstrapping behavior. In a more fine-grained analysis we gain insights into how these antecedents shape the use of particular bootstrapping strategies. Findings contribute to our understanding of factors driving resource management approaches in nascent ventures.

We surveyed 125 large firms in Europe and the United States with annual sales in excess of $250 million to examine the extent to which large firms are now practicing open innovation. Our results showed that open innovation is not a passing fad: 78 percent of the firms report practicing open innovation, none have abandoned it, and 82 percent of those practicing open innovation report that it is practiced more intensively today than three years ago. We also asked about specific practices for "outside-in" and "inside-out" open innovation. We found that customer co-creation, informal networking, and university grants were the three leading inbound practices in 2011; crowdsourcing and open innovation intermediary services were rated lowest in importance. Joint ventures, selling market-ready products, and standardization were the three leading outbound practices; donations to commons and spinoffs were least frequently used. We also found that large firms are more likely to receive freely revealed information than they are to provide such information.

In this study, we reconsider the classical positive association between the level of market uncertainty and an organization's propensity to form ties with organizations of similar status. Although prior research argues that the greater the uncertainty, the higher the level of status homophily, we suggest that this relationship is contingent upon framing that affects positive or negative valence towards uncertainty. In an up market, organizations tend to frame uncertainty as upside risk, and thus will subsequently favour explorative uncertainty-mitigation devices; whereas, in a down market, organizations primarily frame uncertainty as downward risk, and thus will rely on more conservative uncertainty-mitigation mechanisms. We therefore predict that a greater number of status-heterophilous ties will be formed in an up market than in a down market. We discuss the implications of our results for status theory and more broadly for research on strategic decision making under uncertainty.

Although the concept of interoperability is not completely new in the public sector, lately, it has become more important. More and more, the classic organizational structure of public administrations has proved to be unable to respond to the emergence of new citizen demands that cannot be addressed by only one organization. As a result, growingly, public administrations are considering the need to work transversely and cooperatively with other public institutions, but also with other agents, with regard to common goals that will improve both political and administrative processes and results. However, despite its important benefits and advantages, technological cooperation is not easy. Often, interoperability initiatives have to address important challenges which are technological but also organizational, legal, or cultural. Given this context, this work aims at presenting the first results of the research "Managing e-government interoperability in the Catalan public administrations", funded by the Catalan School of Public Administration. The general goal of this study is to identify and analyze those key variables in the implementation of interoperability projects within Catalan public administrations in order to contribute to the development of the conceptual and theoretical field of egovernment, on one hand, and to identify good practices that could be useful to decision makers, on the other. This article addresses two issues: 1) the literature review conducted, which puts emphasis on the meaning of interoperability but, also, on the different approaches that have been used to study it, and 2) the holistic model proposed by the research team, one that has been built under the public management.

Seriously engaging with the needs, hardships, and aspirations of future generations is an emotional experience as much as an intellectual endeavor. In this essay we describe a guided visualization exercise used to overcome the emotional barriers that often prevent us from dealing effectively with intergenerational decisions. The meditation and dreaming technique was applied to a diverse group of researchers who engaged in a visualized encounter with future generations. Following the exercise, we concluded that a serious analysis of intergenerational conflict requires us to confront our own mortality. Also, somewhat surprisingly to workshop participants, our desire to become stewards of the planet was driven by our fear of death as well as our egoist yearning for immortality. We posit that imagining the unknown with visioning practices might increase our emotional resilience, and hence improve our ability to confront the burdens of intergenerational responsibility.

This article examines the subjective antecedents of life satisfaction of workers. Adopting a 'bottom-up' perspective, we assessed the unique influence that satisfaction with multiple life domains have on evaluative judgments of overall life satisfaction. Based on a nationwide sample of 530 Chilean workers, we simultaneously tested the effects of seven life domain satisfactions that have been consistently included in extant models of life satisfaction and subjective well-being. These were satisfaction with health, financial situation, social relationships, one's self-worth, leisure-time, family, and work. Having controlled for age and gender, results showed that satisfaction with one's financial situation was the dominant predictor of overall life satisfaction of workers, with a weight of .36. Satisfaction with family, work, and health had effects of .25, .14, and .14, respectively. Interestingly, satisfaction with one's self-worth, leisure-time, and social relationships did not have statistically significant effects on life satisfaction, although the first two showed t values near the critical value.

This paper introduces the Special Issue of Neuropsychological Rehabilitation on Single Case Experimental Design (SCED) methodology. SCED studies have a long history of use in evaluating behavioural and psychological interventions, but in recent years there has been a resurgence of interest in SCED methodology, driven in part by the development of standards for conducting and reporting SCED studies. Although there is consensus on some aspects of SCED methodology, the question of how SCED data should be analysed remains unresolved. This Special Issues includes two papers discussing aspects of conducting SCED studies, five papers illustrating use of SCED methodology in clinical practice, and nine papers that present different methods of SCED data analysis. A final Discussion paper summarises points of agreement, highlights areas where further clarity is needed, and ends with a set of resources that will assist researchers conduct and analyse SCED studies.

In this editorial discussion we reflect on the issues addressed by, and arising from, the papers in this special issue on Single-Case Experimental Design (SCED) study methodology. We identify areas of consensus and disagreement regarding the conduct and analysis of SCED studies. Despite the long history of application of SCEDs in studies of interventions in clinical and educational settings, the field is still developing. There is an emerging consensus on methodological quality criteria for many aspects of SCEDs, but disagreement on what are the most appropriate methods of SCED data analysis. Our aim is to stimulate this ongoing debate and highlight issues requiring further attention from applied researchers and methodologists. In addition we offer tentative criteria to support decision-making in relation to the selection of analytical techniques in SCED studies. Finally, we stress that large-scale interdisciplinary collaborations, such as the current Special Issue, are necessary if SCEDs are going to play a significant role in the development of the evidence base for clinical practice.

Universidad de Murcia (UM) Vol. 30, no. 2, 05/2014, p. 597-607 El presente estudio analiza las propiedades psicométricas y la validez de una versión española del Team Climate Inventory (TCI). El TCI es un instrumento para la medición del clima de los equipos de trabajo, que se desarrolla a partir de una teoría de cuatro factores aplicada a la innovación de equipo (West, 1990). El estudio muestra una fiabilidad satisfactoria del instrumento, estimada con índices Alpha de Cronbach y Omega. El análisis factorial exploratorio retuvo cuatro factores más un quinto, tal como se encontró en otras validaciones del TCI. El análisis factorial confirmatorio permitió averiguar que el mejor ajuste a los datos se obtuvo con el modelo de cinco factores. En el estudio, además, se compararon dos muestras (una de equipos de trabajo sanitarios españoles y otra de equipos de trabajo latinoamericanos pertenecientes a una empresa de desarrollo informático) con un total de 1099 participantes, cuya comparación muestra evidencias de invarianza factorial. Finalmente, se aportan evidencias de validez basadas en la predicción del rendimiento de equipo y de la satisfacción de los miembros.

The article discusses the role of the UN Global Compact (UNGC) in the emerging global corporate social responsibility infrastructure. It evaluates the debate around the effectiveness and legitimacy of the UNGC alongside the arguments of its supporters and critics and thereby introduces the Thematic Symposium contributions. The article further identifies three theoretical perspectives that are used by scholars to discuss the performance of the UNGC: economic, socio-historical, and normative. It proposes that these perspectives can serve as generic distinctions with direct relevance for the evaluation of the UNGC. Once the perspective is chosen, it drives towards a certain purpose which implies assumptions and design features with regard to the UNGC. Finally, the article offers a future research agenda, emphasising the research needed on the UNGC in four areas: the identification of processes and influence mechanisms; legitimacy and effectiveness; local networks and regional development; and the interface of the UNGC and responsible leadership.

The paper delves into the concept of Open Government, analysing and characterising its participatory dimension. It proposes firstly a typology of participatory actions that illustrates the strengthening effect that ICT have on the different participation forms. Secondly, it presents the "Participation Schemas", a conceptual tool that facilitates the analysis and standardized representation of the most important dimensions of participation. This paper proposes a mathematical framework and methodology for group decision-making under multi-granular and multi-attribute linguistic assessments. It is based on distances between linguistic assessments and a degree of consensus. Distances in the space of qualitative assessments are defined from the geodesic distance in graph theory and the Minkowski distance. The degree of consensus is defined through the concept of entropy of a qualitatively-described system. Optimal assessments in terms of both proximity to all the expert opinions in the group and the degree of consensus are used to compare opinions and define a methodology to rank multi-attribute alternatives.

This case study illustrates the dilemmas facing multinational companies in meeting social challenges in Sub-Saharan Africa (especially health-related ones). It also discusses the purpose, responsibilities and limitations of business involvement in social development. From a business standpoint, social challenges in developing countries differ greatly from those in nations where governments or markets effectively provide for the population's health needs. The case illustrates what led a multinational to set up a corporate foundation and focuses on three strategic and operational dilemmas it ran up against. The case discussion shows that the ethical issues intertwined with these dilemmas are best understood using a variety of ethical approaches. We also show that Ethics of Care are just as relevant to analysing corporate social responsibility and corporate philanthropy as the Deontological and Utilitarianism theories commonly used in business ethics

This paper proposes a framework and a methodology to identify international patterns of innovation at the firm-level as well as at the national level. According to a reconstruction of the R&D owner-inventor structure, we develop the analytical framework as a 3 x 3 matrix and identify three different patterns for both EMFs and DMFs in the organisation of their R&D internationalisation activities. We derive from this matrix three patterns at the national level to describe the ways how a developing country can reach the global innovation stage. We use China as a case to verify this framework.

This paper examines the relationship between (outside-in) open innovation and the financial performance of R&D projects, drawing on a unique dataset that contains information on the open innovation practices, management and performance of 489 R&D projects of a large European multinational firm. We introduce two types of open innovation partnerships - science-based and market-based partnerships and examine their relationships with project financial performance. In addition, we investigate whether the open innovation project performance relationships are influenced by the way how R&D projects are managed. Our results show that R&D projects with open innovation partnerships are associated with a better financial performance providing that they are managed in the most suitable way. Market-based partnerships are positively correlated with project performance if a formal project management process is used; however these partnerships are associated with a lower performance for loosely managed projects. In contrast, science-based partnerships are associated with higher project revenues for loosely managed projects only.

Technology platform strategies offer a novel way to orchestrate a rich portfolio of contributions made by the many independent actors who form an ecosystem of heterogeneous complementors around a stable platform core. This form of organising has been successfully used in smartphone, gaming, commercial software, and industrial sectors. Technology ecosystems require stability and homogeneity to leverage common investments in standard components, but they also need variability and heterogeneity to meet evolving market demand. Although the required balance between stability and evolvability in the ecosystem has been addressed conceptually in the literature, we have less understanding of its underlying mechanics or appropriate governance. Through an extensive case study of a business software ecosystem consisting of a major multinational manufacturer of enterprise resource planning software at the core and a heterogeneous system of independent implementation partners and solution developers on the periphery, our research identifies three salient tensions that characterize the ecosystem: standard-variety, control-autonomy, and collective-individual. We then highlight the specific ecosystem governance mechanisms designed to simultaneously manage desirable and undesirable variance across each tension. Paradoxical tensions may manifest as dualities, where tensions are framed as complementary and mutually enabling. Alternatively, they may manifest as dualisms, where actors are faced with contradictory and disabling "either ... or" decisions. We identify conditions where latent, complementary tensions become manifest as salient, contradictory tensions. By identifying conditions in which complementary logics are overshadowed by contradictory logics, our study further contributes to the understanding of the dynamics of technology ecosystems, as well as the effective design of technology ecosystem governance that can explicitly embrace paradoxical tensions toward generative outcomes.

Today, manufacturing firms encounter pressure from multiple stakeholders to manage occupational health and safety issues properly, systematically and transparently. While manufacturing firms commonly use internally developed Occupational Health and Safety Management Systems, there is growing pressure to adopt externally certified system such as OHSAS 18001. However, there are conflicting views and little empirical evidence that examines the linkage between OHSAS 18001 certification and operating performance. Hence, this paper examines the impact of OHSAS 18001 on operational performance through three theoretical lenses: Institutional Theory, Normal Accident Theory, and High Reliability Theory. We also investigate how complexity and coupling moderate the relationship between OHSAS 18001 and operational performance. Based on a sample of 211 U.S. listed manufacturing firms with OHSAS 18001 certification, we find that certification leads to significant increases in abnormal performance on safety, sales growth, labor productivity, and profitability and that these benefits increase as complexity and coupling increase.

El presente estudio analiza la regulación de la prueba pericial en la Ley 1/2000, de 7 de enero, de Enjuiciamiento Civil. como es sabido se trata de una de las instituciones que sufrió un mayor cambio en su regulación legal con respecto a la Ley de Enjuiciamiento Civil de 1881. Se ha pasado de una pericial única, oficial e intrajudicial, a un modelo dual de pericial que admite los dictámenes a instancia de parte y los dictámenes de los peritos de designación judicial. La prueba pericial ha sido objeto de diversos estudios doctrinales, e incluso ya de alguna propuesta de reforma, en orden a la simplificación de su regulación legal, tales como la aportación de los dictámenes, los sistemas de designación de peritos, las listas de peritos, la capacidad del perito, la aceptación del cargo, la provisión de fondos, los derechos y deberes del perito, el reconocimiento, emisión y contradicción del dictamen pericial y, finalmente, su valoración. En el análisis de estos aspectos se efectúan propuestas de lege ferenda. El estudio concluye recogiendo de forma ordenada las distintas propuestas de lege ferenda, con la finalidad de ofrecer una visión más completa de la regulación de la prueba pericial.

Information and communication technology is changing the way in which cities organise policymaking and urban growth. Smart Cities base their strategy on the use of information and communication technologies in several fields such as economy, environment, mobility and governance to transform the city infrastructure and services. This paper draws on the city of Barcelona and intends to analyse its transformation from a traditional agglomeration to a twenty-first century metropolis. The case of Barcelona is of special interest due to its apparent desire, reflected by its current policies regarding urban planning, to be considered as a leading metropolis in Europe. Hence, an assessment of the Smart City initiative will cast light on the current status of Barcelona’s urban policy and its urban policy of Barcelona and its future directions. This article analyses Barcelona’s transformation in the areas of Smart City management; drivers, bottlenecks, conditions and assets. First, it presents the existing literature on Barcelona’s Smart City initiative. Then, the case study analysis is presented with the Barcelona Smart City model. After describing this model, we further explore the main components of the Smart City strategy of Barcelona in terms of Smart districts, living labs, initiatives, e-Services, infrastructures and Open Data. This paper also reveals certain benefits and challenges related to this initiative and its future directions. The results of the case study analysis indicate that Barcelona has been effectively implementing the Smart City strategy with an aim to be a Smart City model for the world.

El Derecho del Trabajo, desde sus orígenes, ha considerado que la judicialización de los conflictos laborales y, particularmente, el despido injustificado era una amenaza para la rápida compensación del trabajador. Circunstancia especialmente preocupante en aquellas situaciones en las que el despedido no tiene acceso a ningún tipo de prestación por desempleo. En este contexto, el principio de economía procesal se ha convertido en el factor precipitador de una sucesión de cambios normativos dirigidos a agilizar el proceso laboral en caso de despido, con el objeto de ofrecer una compensación económica por los daños sufridos lo más rápida posible y sin necesidad de su prueba y cuantificación. En contrapartida, el Derecho del Trabajo, por un lado, ha conferido al deudor incumplidor de la prestación (el empresario) la opción – poco frecuente - entre cumplir la prestación in natura (readmisión) o por equivalente (indemnización). Y, por otro lado, ha limitado el importe de la indemnización por despido injustificado. Tasación que si bien permite cuantificar ex ante el “precio de salida injustificada”, también se ha traducido en situaciones de infracompensación. Lo que ha redundado en un uso excesivo de esta vía extintiva, pues, el responsable no está asumiendo (internalizando) la totalidad de los perjuicios que provoca con su conducta. En este sentido, esta configuración de la naturaleza jurídica de la indemnización legal tasada y de la nueva regulación de la LJS (en concreto, arts. 286.2 y 281.2) permiten sostener que un modelo de compensación alternativo que acerque la indemnización a los daños efectivamente padecidos por el trabajador es posible. O, dicho de otro modo, que la indemnización legal tasada por despido improcedente es jurídicamente compatible con una indemnización de daños y perjuicios.

In February 2005, Jesús Cepeda, Director of Grupo Santander's Management Control Area, reviews a Chilean pilot test of a new management information system, MIS America. Grupo Santander, a global financial institution, had grown rapidly through acquisitions in recent years, giving rise to a great need for reliable, timely information to help Santander managers compare performance across globally distributed units and make better strategic and operational decisions. The pilot test in Chile had suffered numerous delays. Cepeda had to decide what to do next regarding MIS America. The original plan had specified that following the Chile pilot, the new system would be rolled out throughout Latin America, but Cepeda was not sure if he was ready to authorize the rollout. This case study highlights the information systems challenges associated with rapid growth via acquisition. Top executives had an urgent need for both consolidated and precisely disaggregated information. The case also examines questions of centralized versus decentralized control in a corporate MIS that addresses different needs in different Latin American countries, while responding to Grupo Santander's own needs at the corporate level. The challenges presented by this large and complex project are applicable to many IT projects in other industries and geographic settings.

Investigación realizada con una metodología cualitativa de revisión sistemática de las investigaciones previas. Las peculiaridades del sector hostelero han sido ampliamente investigadas en términos de responsabilidad social empresarial; pero su potencial utilización como ventaja competitiva y las tipologías posibles de actuación estructuradas por varios autores en forma de marketing social corporativo son más recientes y desarrolladas en menor grado. Los principales resultados muestran que las actividades se centran en gran parte en el área de las prácticas empresariales socialmente responsables y en aquellas vinculadas a aspectos medioambientales, con un amplio espectro de actividades adicionales a realizar. Las empresas del sector hostelero tienen la oportunidad y el desafío de utilizar sus actividades de responsabilidad social empresarial como una ventaja competitiva. Por esta razón, sin duda será necesario profundizar mediante investigaciones empíricas en el uso y los resultados de las políticas de marketing social corporativo en el sector hostelero en el futuro.

First, it develops a systematic mechanism to examine corporate social orientation (CSO) by contextualizing the research around the 2007 global financial crisis and second, it applies this mechanism to compare the CSOs across the U.S., Germany and India. Using a 7-code index of CSO on a sample of financial companies across the three countries, this paper captures the dissolution of loose couplings between corporate private intentions and corporate public pretentions thereby exposing the de-facto CSOs. The results provide evidence of country of origin effects on CSO and capture the dynamic aspect of CSO, not yet shown in previous studies.

The CSR of SMEs in developing countries is difficult to promote mainly for two reasons: the characteristics of SMEs ni these areas, and the special context (deficits in infrastructures and a weak State) where such SMEs operate. One oslution to address these problems is the creation or enforcement of SME networks, where trust and relational contracts replace impersonal market exchanges and legal contracts. This paper investigates the role of support organizations in the promotion of SME networks and of their socially responsible behaviours. It presents the case of CADICEC, a support organization for SMEs in thew Deomocratic Republic of the Congo. CADICEC edevelops its mission based on transparency and the enforcement of public institutions, in a business and political context invaded by secret chapels that promote under the table particular and ethnic interests.

The purpose of this research is to explore the relationship between the positive and negative psychological states of work (i.e. engagement and burnout, respectively) and their effects on an individual’s mental and physical health. This study analyzes their separate and joint manifestations. In total, 2,094 nurses were segmented into quadrants that represent a 50/50 median split on both engagement and burnout. The four resulting quadrants were then examined in a series of analyses including logistic regression and ANOVA. This is a cross-sectional study based on a very large survey (> 2,000 people) in Spain. Data were collected from nurses in collaboration with the official nurses corporations in half a dozen provinces in Spain. Data were analyzed in stages which included zero-item correlations and ANOVA to determine their independence and suitability for predicting states of engagement and burnout. This was followed by a series of binary logistic regression analyses. The findings suggested that engagement and burnout were generally inversely related (67 per cent of the sample) which is the conventional wisdom in this regard, but 33 per cent of the sample manifested concurrently at either extreme. Burnout was chiefly driven by work demands, as both quadrants of low burnout had lower demands and both quadrants of high burnout had higher demands. Engagement was primarily driven by resources and affinity. Social support acted independently (perhaps as a moderator) by aligning with states of burnout. Worker health was primarily driven by burnout, wherein both states of low burnout exhibited better health and both states of high burnout exhibited poorer health. Much of the current research on this topic considers engagement and burnout to be linear dimensions and focuses on building structural models of the precise relationships between variables. That approach is to be encouraged, but there is also a need to jointly deconstruct dimensions and relationships in a tactile manner that can inform future structural models. The

secondary benefit of this approach is that these findings can be submitted directly to managers to provide an easily understood approach for assessments and interventions.

International service learning is a new trend in management development and a new field of research. International Service Learning Programs (ISLP) are experiential corporate volunteering initiatives designed to give employees the chance to work for a short spell abroad (often in a developing or emerging market) on a service assignment with a partner from the social sector (e.g. NGO, social enterprise). The service assignment is a project defined with a social-sector partner on which the corporate employee works full-time on a pro-bono basis and contributes his/her knowledge and expertise in exchange for a rich learning experience. The purpose of this paper is to focus on the use of ISLP in business firms and conducts a comparative analysis of six programs set up by multinational corporations from three industries (health, technology, and accounting and professional services). It identifies characteristics and similarities among programs, discusses differences, offers criteria for program classification and areas for future research. As such, it is an important starting point for quantitative studies. This is a qualitative study based on six ISLP. The data were gathered through desk research, interviews with program representatives and a structured questionnaire containing closed and open-ended questions. Regardless of the stated aims (which usually stress value for the participants, the company and the communities), most programs had one clear focus (two programs in the area of leadership development, two in the area of community development) while two showed closely linked foci (with slightly greater emphasis on organization development than on the other areas). The authors suggest that the type of ISLP has an effect on the learning outcomes. Since companies are still testing usefulness and outcomes of these programs, academic research that provides comparative quantitative data on the outcomes of such programs is of great value for business practice. This systematic overview and classification of ISLP is a starting point for empirical program comparisons as well as for the evaluation of different service learning approaches. This could prove very useful for other companies planning to set up or refine their own ISLP to achieve certain outcomes. This is the first paper that compares ISLP run by multinational corporations. It identifies a number of category areas in which they differ (e.g. in placement length, nature of the assignment – individual or in teams, learning methods used) and provides a typology for program classification (leadership development, organization development or community development).

design?

There has been considerable discussion recently about business schools’ shortcomings and how their curriculum should be changed. Many presume discipline-wide agreement that managing is a rational and model-able decision-making practice. But practitioners are not convinced and often suggest rationality-dominated business schools are teaching impractical ideas. The purpose of this paper is to look at this discussion's micro foundations and offers a novel approach that presumes managerial judgment is crucial to firms’ processes and, indeed, is the reason firms exist. The paper combines discussion of the conceptual nature of firms and managing them with data about business schools’ growth and curriculum evolution. If we presume firms are rational apparatus for achieving known goals, managing is little more than computing; and if Knightian uncertainty is taken seriously, managerial judgment becomes the core of the analysis. But schools that attempt to train

students’ judgment are extraordinarily difficult to manage, especially in the current academic environment. While many are aware of Knight's influential thinking, it has not yet been brought into a theory of the firm or of managing. The paper works toward a novel theory of the managed firm (TMF) in which management's uncertainty-resolving judgments are key.

The purpose of this paper is to deepen the discussion about religious organisations’ (ROs) potential to practise their faith by means of their investments, rather than keeping both issues separate.The authors adopted a qualitative exploratory approach

using seven cases of social shareholder engagement (SSE) by Christian organisations. It focused on creating knowledge from best practices. Within the three Christian organisations studied, the authors identified three significant features that relate to their religious nature and affect their SSE: having a structured belief system, a grassroots network and a long-term perspective. These features can be instrumental in impacting company behaviour and society at large. The authors chose three ROs for their relevance and comparative features, but this limited sample size makes it hard to generalise the research findings. This paper invites ROs to review their potential for actively owning their shares to be consistent with their faith and create change in business and society at large. Besides, ROs, with their unwavering belief system, extensive grassroots networks and long-term approach, are a force in the shareholder engagement field to be reckoned with by business. The paper presents multi cases of ROs active in using their investments to create change in companies and society at large.

Parece obvio que en épocas de restricciones, políticos, gestores y profesionales deberían ponerse de acuerdo para averiguar dónde se esconden las lagunas de efectividad clínica, porque lo que es evidente es que los recortes transversales y las reducciones salariales lineales no producen reformas estructurales, ya que sólo sirven para cuadrar presupuestos complicados.

restructuring: Testing the direct and the moderating

effects among Spanish workers

Journal of Workplace Behavioral Health Routledge Vol. 29, no. 2, 04/2014, p. 143-174 This explorative study aims at finding the effects of organizational restructuring on older workers’ well-being. A cross-sectional survey was conducted in companies in the Catalonia region in Spain, which have implemented restructuring prior to the study. The sample consists of 89 respondents, 46 of whom are age 50 and older (26 males, 20 females) and 43 of whom are younger than age 50 (19 males and 24 females). The Shirom-Melamed Burnout Measure was used for measuring burnout and scales developed by Arsenault and Dolan were used for measuring anxiety and depression. It was found that layoffs contributed significantly to the respondents’ burnout and depression levels. This effect diminished if the respondent had a managerial position but was not as much influenced by managerial and coworkers’ support as was expected. In this data set social support does not play a substantial mitigating role in the impact of the layoffs, besides some modest contributions at certain levels. Coworkers’ general support is highly positively correlated with coworkers’ handling of the change and negatively correlated with anxiety only among the younger employees, though negatively related to physical burnout only among elder employees. Elder employees tend to perceive implementation of changes more negatively than

their younger counterparts, which may be reflected in their higher anxiety level.

The Spanish economy will grow by roughly 1% in 2014. This figure is towards the top of the range forecast in the January edition of ESADE’s Economic Report. In the First Quarter of 2014, GDP grew by 0.4%. Household consumption rose by 0.3%. This confirms the change in trend noted in the Fourth Quarter of 2013, when consumption rose by 0.5% — breaking a run of falling consumption over the previous three years. Investment also rose in the First Quarter, maintaining the pace begun in 2013, in which companies’ plant purchases rose by 9.5% over the year. This offset falling house purchases. As a result, internal demand grew by 0.2% both in the Fourth Quarter of 2013 and in the First Quarter of 2014. While this is good news, it also reveals that growth is still very weak.

El consumo de las familias ha aumentado un 0,3%, confirmando el cambio de tendencia del último trimestre de 2013, en que creció un 0,5%, después de casi tres años de descensos continuos. También la inversión creció positivamente en este primer trimestre, manteniendo la pauta iniciada el pasado 2013, en que la mejoría de la compra de bienes de equipo por parte de las empresas, que creció un 9,5% a lo largo de todo el año, compensó la caída de la inversión residencial. Como resultado de todo ello, la demanda interna creció un 0,2% en términos trimestrales, tanto en el último trimestre del pasado 2013 como en el primero de este 2014. Son cifras positivas, pero que evidentemente muestran aún un crecimiento muy débil.

El segundo mandato del canciller Gerhard Schröder (2002-2005), como indicábamos en un artículo anterior estuvo muy agitado por la necesidad de llevar a la práctica reformas estructurales en el mercado de trabajo y en la seguridad social para mejorar la situación económica. Aquel artículo concluía refiriendo la necesidad de convocar la Comisión de Intermediación, establecida por la Constitución alemana, para resolver los conflictos entre ambas cámaras legislativas cuando una ley aprobada por la Cámara de los Representantes (Bundestag), en este caso la reforma conocida como Hartz IV, era rechazada por el Senado (Bundesrat). La decisión judicial resolviendo un proceso pone fin al mismo y, dentro de ella, ocupa un papel decisivo la valoración probatoria. Aun cuando es muy difícil comprender el proceso mental de la decisión judicial, puede afirmarse que, idealmente, comprende tres fases: 1ª) la interpretación de los resultados probatorios, en la que el juez entra en contacto con los medios de prueba para oír y comprender qué dicen las partes o los testigos, leer los documentos, extraer las máximas de experiencia técnicas aportadas por el perito, o percibir un lugar, objeto o persona; 2ª) la valoración de los medios de prueba, en la que el juez aplicará reglas, tasadas o libres; y 3º) la motivación del juicio de hecho, en la qu eel juez plasmará en la resolución las razones que ha tenido en cuenta para estimar probados unos hechos y desestimar, como no probados, otros tantos e imputar, en su caso, la deficiencia probatoria. En la presente obra, y teniendo en cuenta las aportaciones del Derecho Probatorio, de la Filososfía del Derecho y de la Teoría de la Argumentacón, se analizan profundamente cada una de las fases del proceso decisorio del juez, con la finalidad de ofrecer pautas y reflexiones que ayuden a sistematizar este proceso, y puedan ser de utilidad a todos los operadores jurídicos para situarse ante el mismo. Desde los años 1970 es práctica relativamente habitual en los Estados Unidos de América y más recientemente se está abriendo camino en distintos países europeos la celebración de pactos prematrimoniales. La cuestión que surge en el contexto en el que ahora nos hallamos es, sin embargo, si se trata realmente de un instrumento útil para la prevención y, en su caso, solución del conflicto si finalmente se acaba desatando la crisis matrimonial para la que fue previsto. Ante la pregunta de si el pacto en previsión de una ruptura matrimonial sirve para prevenir, en el sentido de evitar un riesgo, el conflicto de pareja, la respuesta ha de ser negativa. Si lo que nos preguntamos es si ayuda a la prevención, en el sentido de preparación y disposición que se hace anticipadamente para ejecutar algo, del conflicto, la respuesta requiere mayores matices, y a ello se destina fundamentalmente el trabajo. En todo caso, el análisis es realizado tomando como modelo normativo de referencia el relativamente reciente e innovador desarrollo legislativo llevado a cabo en el Libro II del Código Civil de Cataluña (en adelante, CCCat), porque se trata de una experiencia jurídica próxima y vanguardista, en la que, sin lugar a dudas, cabe apreciar la inspiración en fuentes del Derecho norteamericano (así, la Uniform Premarital Agreements Act y los principios sobre la disolución de la familia del American Law Institute).

Como manifestación que es de la autonomía privada, su vulnerabilidad puede venir explicada por tres distintas causas cuyo origen es también desigual: causas intrínsecas, extrínsecas, deslegitimadas y extrínsecas legitimadas. Las causas intrínsecas pertenecen al propio sujeto que pretende formar su voluntad, yendo asociadas a las naturales limitaciones que, por razones de edad o de enfermedad, no tiene más remedio que padecer toda persona (general la edad, eventual la enfermedad).

Among the many topics covered by CSR and sustainability, the subjects currently run the risk of being trapped in their own agenda. This is neither a bad thing, nor is it contemptible; on the contrary. Much of their impact on business management has to do with developing practical tools to further develop and refine how these issues are dealt with. From accountability to philanthropy; from corporate volunteering to reconciliation; from environmental management to the requirements of the supply chain; from human rights policies to incentive policies and careers criteria; from... let's leave it there, shall we - Because, in the end, what is becoming increasingly clear is that changes can be made ¿ and significant changes at that - in many of these areas without altering the entrepreneurial spirit, the company vision or the frame of reference based on which their priorities are set. In other words, it is possible to have a company policy that talks about sustainability and CSR which, deep down, is in fact little more than a schedule adapted to new social demands, but one that is managed from a totally conventional corporate mentality. So the real debate, sometimes blocked by the CSR and sustainability rhetoric itself, is the debate as to the purpose of the company: who it is serving; what its contribution is; how it is governed; how it assumes the challenges facing society; how it responds to these same challenges. It is no longer merely a question of impacts and business practices. It is about the place and contribution of businesses in the emerging new society: A society that cannot emerge without companies; but one which may not be able to emerge depending on the dominant and winning business model.

In the present chapter, we introduce the mindfulness concept into the leadership literature and offer a preliminary analysis of its importance in the context of leader ethical decision making. To explain how leader mindfulness affects leader ethical decision making, we draw on findings in clinical psychology and delineate the processes triggered by mindfulness: the metamechanism of reperceiving and the additional direct effects of (a) compassion and interbeing, (b) cognitive flexibility and insight, and (c) integrated functioning. These processes are argued to help leaders develop an integrative stakeholder-oriented, values-based original solution when faced with an intricate moral dilemma. We illustrate our argumentation by drawing on the Levi Strauss case of child labor in Bangladesh.

Cross-sector inter-organizational partnerships, alliances and networks have become extremely popular. Such phenomena bring together diverse actors with differing, and often competing, institutional logics. Understanding how these logics interact and often hinder the collaborative is important for the management of the alliance. The management of competing institutional logics is central to alliance success. Competing logics are of particular relevance in alliances bring together public- and private-sector actors, as actors from these different sectors draw on very dissimilar premises, assumptions and valid rules. This chapter describes how competing institutional logics are present in public-private joint ventures, and proposes some managerial practices that allow participants in public-private joint ventures to successfully manage competing logics. The chapter draws on a case study of a private economic development company, PTB, set up by various town halls, a savings bank and a small group of leading local entrepreneurs near Barcelona, Spain.

In the discussion about governance it is very interesting to explore the meaning of context since context in many ways has an important position in that discussion (Emerson et al., 2012). After all, practically every conceptualization of governance emphasizes that because the context in which governments operate has changed (Agranoff, 2011) this has consequences for the social patterns in which concrete decision processes and service delivery takes place. Thus one could say that at the macro level, relation between society and government changes, which has consequences for the meso level (the patterns of social relationships) and that has impact on the concrete strategic interactions (policy making and service delivery, thus the strategic level and the outcomes). This is reflected, or should be, when authors draw normative conclusions in the way governments try to solve societal problems.

Universities nowadays have to endow their students not only with technical knowledge but also with practical experience, skills, and competencies. At a Spanish master’s programme, an interdisciplinary project work in teams to promote experiential learning was combined with a personal development programme based on Boyatzis’ Intentional Change Theory to create a framework of self-directed change. In addition to eight workshops and various tutorials, students are offered three individual coaching sessions to ensure the best possible alignment of personal and team goals. Emotional and Social Competencies (ESC) are measured twice during the academic year with a multi-rater assessment instrument: first, after 3 months into the programme and then again at the end of the academic year. Despite the small sample size of 18 volunteers, results show promising indications that the suggested framework can help students develop ESC in higher education within one academic year. Further research is needed to confirm these tentative findings.

This presentation proposal shares the case of the transition of a Master in Law program which added an interdisciplinary project to the curriculum combined with the framework of Intentional Change Theory. Learning is expected to take place in two dimensions: On the one hand, working groups generate their own knowledge and skills through action learning on an interdisciplinary project which is applicable and useful to the professional reality. At the same time, each person enhances emotional and social intelligence competencies, to ensure the success of their personal development and, consequently, also that of the practical project. This module is distributed over the whole academic year and offers eight workshops which continuously interchange the focus between the external learning through the interdisciplinary project and the internal learning through self-knowledge exercises or evaluation tools. Students are offered three individual coaching sessions to ensure the best possible alignment of personal and team goals and enhance the desired personal change. Emotional and Social Intelligence Competencies are measured twice during the academic year with the ESCI-U: First after a period of 3 months into coursework in order to enable students to get to know each other and thus deliver valid peer evaluations; and second at the end of the coursework. Positive change on emotional and social intelligence competencies established as individual development objectives is expected. Feedback on this course from students, professors, coaches and other stakeholders can help define possibilities of improvement for the next cohorts. This new curriculum can be applicable to any other faculty or program.

The broaden-and-build theory posits that experiences of positive emotions broaden people’s momentary thought-action repertoires, which in turn serves to build their enduring resources, ranging from physical and intellectual resources to social and psychological resources. Intentional change theory conceptualizes the iterative, cyclical stages of desired, sustained change, and how recurrent arousal of positive and negative emotion characterizes these stage transitions. By combining both theories, this study aims to unveil how a coaching experience within a Leadership Development Program at a European Business School may impact the MBA students’ affective processing in terms of their levels of positive-negative emotions, agency thinking and pathways thinking. A total of 15 students participated in this pilot study with a pre-post design around a coaching session. Preliminary analyses showed that the coaching experience has a positive impact on goal directed energy (in terms of agency thinking and pathways thinking) and positive affect. Additionally, results revealed less polarized levels of negative affect after the coaching session. Despite the limitations given by a small sample, this pilot study exposed interesting findings with implications for further research.

This article examines whether extending rater sources beyond the traditional organizational setting provides complementary feedback for a manager through 360° assessments. Using 14 emotional, social, and cognitive competencies, we compared 358 MBA students’ ratings from supervisors, work-peers, subordinates, friends, relatives, and spouses. Results show that personal and professional sources were similarly suited to evaluate these competencies. While differences among co-workers’ ratings were found not to be statistically significant, personal sources’ ratings were higher than co-workers’ assessments across most of the competencies. We advocate that, in spite of a leniency bias, including personal sources in 360° assessments can increase managers’ acceptance of the feedback.

Although research on disability inclusion has increased in recent decades, it is still considered scarce. Disability continues to be one of the under-researched areas in diversity inclusion (Özbilgin et al., 2011; Connel, 2009; Hardcourt et al., 2005). Disability affects 15% of the world population (WHO, 2011). At the European level, employment rates in 2008 were 73.6 % for people without disabilities but only 45.8 % for people with disabilities (ANED, 2011). The difference is also similar in other areas of the world (WHO, 2011).While inclusion in the labour market is encouraged in legislation and public policies, the approach when dealing with disability in organizations is rather on what impairment may prevent from doing rather than on what people with disabilities may contribute (Baldridge & Veiga, 2001; Campolieti, 2009; Cunningham, James & Dibben, 2004, (Kulkarni & Lenginick-Hall, 2011; Williams-Whitt & Taras, 2010). The research presented here proposes an alternative approach to disability inclusion policies which is captured in the sentence “You see what they are not able to do. I see what they are able to do.

The ever-growing literature on shareholder engagement has, understandably, focused much of its attention on the most visible aspects of engagement despite claims that this represents only the tip of the iceberg. Behind-the-scenes engagement remains largely unexplored. Dialogic and participatory approaches have become widely supported in stakeholder engagement. However, the behind-the-scenes nature of much of shareholder engagement and the privacy on which it is said to depend for its success appear to conflict with these approaches. This large-scale, in-depth study of behind-the-scenes engagement investigates how participatory and dialogic practices are used, with whom, and at what stage of the engagement process. Through a discourse ethics lens we use the motifs of Habermas’ ideal speech situation to interrogate the responses of shareholder members of the Interfaith Center on Corporate Responsibility (ICCR). We find evidence of participative and dialogic practices at different stages of engagement, which is facilitated by ICCR. However, there is a perceived trade off between having direct conversations with companies and inviting broader societal participation in engagement; the latter is feared to erode the trust relationship built up through direct conversation between the company and engager over time. We claim that is it not participation per se which erodes trust and argue in support of greater participation in direct dialogue.

Increasing attention has been drawn in recent years to social shareholder engagement (SSE), the phenomenon of shareholders engaging with companies on social, environmental and ethical issues. Different approaches have been used to address the different mechanisms of SSE, each strongly influenced by different theoretical underpinnings. These approaches are mapped here into agency, stakeholder, institutional and societal approaches. However, they have not dealt with the ethics of SSE. This article proposes an alternative, normative lens based on discourse ethics. While already widely used in the stakeholder democracy literature it is as yet unexplored in the SSE literature. We use discourse ethics to develop an ethical, normative standard for SSE shareholders which responds to calls for the development of normative theory in company and civil society interactions (Baur and Arenas 2014) and more specifically for the need for a credible and legitimate engagement process (Dhir 2012) and norms and standards in SSE (McLaren 2004). This poses considerable challenges to activists as well as to researchers. The key motifs of discourse ethics in relation to SSE are explored and propositions for ethical SSE are developed initiating a discussion on normative standards for SSE.

This study is an initial exploratory attempt to investigate the topic in the automotive industry communication in Europe. Recent research has produced concern about incongruence (the gap between conveyed and actual decision rationale) in strategic opportunity evaluation. Such incongruence can lead to inefficient decision-making, ineffective learning and will subsequently have performance implications in the entrepreneurial process. In this article we build on cognitive theory to investigate individual differences in opportunity-related decisions incongruence. Our assertion is that decision congruence is in large part based on the salience of the decision makers’ opportunity schema—formed through cognitive entrenchment—that is facilitated or impeded by individuals' images of self. In a study on 146 individuals with in total 7,008 opportunity decisions we investigate how images of vulnerability and capability affect opportunity decision congruence. The results indicate that the images of vulnerability negatively impact congruent decision making, while images of capability have a U-shaped effect on decision incongruence. Our findings extend prior literature on cognitive reasoning in opportunity evaluation and entrepreneurial expertise.

Effective implementation of HR practices is being recognized as critical for firm performance and it is opening a new frontier for research on HRM. Yet much of this research has focused so far on line managers’ role as HR implementers at the neglect of other critical actors. In this study we aim at moving forward by illuminating how the HR department may contribute to the effective implementation of HR practices. Analyzing twenty-seven cases of HR policy implementation processes, we found that the HR department is able to make significant contributions at different stages of the implementation process. Specifically, our analysis suggests that the HR department may influence implementation outcomes through its decisions on practices’ design, its advocacy strategies for the practices, and its ability to take advantage of the windows of opportunities provided by the organizational context. An emerging model articulating our findings is proposed.

The idea of being authentic at work is gaining track on both academia and organizations. Drawing from a sample of 192 participants we tested whether four types of organizational culture (hierarchical, clan, market, and adhocracy) influence employees’ authenticity at work and whether behaving more authentically influences the extent to which employees are engaged with their jobs. Results indicate that as a whole, an environment that is more inclusive, participative, and that incentivizes individual and group autonomy (i.e. clan and adhocracy cultures) is positively associated with employees behaving more authentically at work. Cultures emphasizing stability order and control (i.e. hierarchy and market culture), on the other hand, negatively influence authenticity. In addition, our results confirm that employees that behave more authentically at work are more engaged with their jobs. Limitations and directions for future research conclude this article.

In this exploratory study, we examine the factors that underlie the emergence and salience of an entrepreneurial identity in academics involved in the creation of spinoffs. The emergence and salience of an entrepreneurial identity matters because it has been linked to a number of relevant entrepreneurial processes and outcomes, although academics rarely adopt it. Data from in-depth interviews with 26 academic entrepreneurs occupying stable positions at public universities reveals that academics experience role identity conflicts when involved in new venture creation activities and that they tackle this conflict by engaging in three types of distinct resolution strategies. We find that the level of involvement in the spinoff formation activities associated with each of the three conflict resolution strategies, along with the self-assessments of their entrepreneurial traits, seems to influence the emergence and salience of an entrepreneurial identity and the hierarchical

position of this identity in a hybrid combination. These results offer useful insights for policy makers interested in promoting spinoff formation.

Private label brands (PLB) have experienced fast growth in almost every market, capturing the attention of academics and practitioners. Using a latent segmentation, this paper studies consumers¿ brand choice of shampoos, according to their values and lifestyles. Results signal the emergence of a segment characterized by a polarized buying behavior, that purchases both top-tier brands and PLB. They value advertising but also search for promotions and offers, showing a smart buying behavior. Confronted to this segment there are other two very sensitive to brands, where there is no room for PLB.

La economía española va a experimentar en 2014 un crecimiento positivo pero demasiado débil. Será, pues, el séptimo año consecutivo de recesión o estancamiento económico.En el Informe Económico de hace un año dibujábamos un escenario en que se abría una ventana de oportunidad al crecimiento de la economía española para este 2014. Tal como explicamos en el presente número, finalmente este crecimiento será muy débil (anémico). Pero, si se cumplen determinadas condiciones, en 2015 podría darse el principio de una recuperación económica más sólida. Para ello será necesario que se mantenga el mejor escenario a nivel europeo y que se solucionen problemas concretos de la economía. A nivel europeo, es imprescindible que el Banco Central Europeo (BCE) mantenga su disponibilidad para mantener los costes de financiación de los países a niveles razonables (el programa de OMT) y se debe, además, seguir adelante con la unión bancaria. Los aspectos de esta que implican algún tipo de mutualización de riesgos (el mecanismo único de resolución bancaria y el esquema de protección de depósitos) son los que presentan más dificultades para llegar a un acuerdo. Pero son precisamente estos aspectos los que darán la señal más clara del compromiso de los estados con el buen funcionamiento futuro de la moneda única europea. A nivel español, la prioridad es recuperar el flujo de crédito hacia las familias y, sobre todo, las pequeñas y medianas empresas viables. Sin ello no se recuperarán el consumo y la inversión. Y parece imposible crecer de forma sostenida solo con el impulso de las exportaciones. Una vez saneados los balances bancarios, si el crédito no vuelve a fluir, el BCE debería estudiar medidas concretas para impulsarlo.

El crecimiento económico ha vuelto desde hace un año a la zona euro, pero se trata de un crecimiento débil, que no alcanza el 1% en términos anuales. Además, con el índice de precios aumentando tan solo un 0,5% en términos anuales, existe un evidente peligro de deflación. Si esta amenaza se hiciera realidad, la economía volvería a la recesión y se produciría un aumento de la carga real de la deuda en unas economías que ya están muy endeudadas. El Banco Central Europeo (BCE) tiene el mandato legal de mantener la estabilidad de precios y, por tanto, debe luchar a toda costa contra la deflación. Al cierre de la edición de este informe, el BCE acaba de anunciar importantes medidas de política monetaria que van en esta dirección. El tipo de interés oficial se ha reducido hasta el 0,15% y los depósitos que los bancos tienen en el BCE se remunerarán a un tipo negativo del –0,1%, con el objetivo que estos hagan fluir la liquidez obtenida del banco central. Pero, sin duda, la medida más importante ha sido poner a disposición de las entidades financieras de la zona 400.000 millones de euros, que estarán

condicionados a que concedan con ellos créditos a la economía real. Además, esta liquidez se proporciona a un tipo de interés prácticamente cero y a un plazo de cuatro años. Con ello, el BCE realiza un cambio de estrategia y se adentra en el terreno de las medidas monetarias no convencionales utilizadas desde hace ya algunos años por otros grandes bancos centrales, especialmente la Reserva Federal estadounidense. Esta inyección de liquidez condicionada tiene la ventaja de estar especialmente diseñada para permitir la recuperación del flujo de crédito, algo muy necesario en las economías del sur de la zona euro.

Alegre de Miguel, Jorge Llebaría Samper, Sergio (dir.) La anticresis: función y finalidad en el Código civil español y en el Código civil de Cataluña Universitat Ramon Llull (URL). ESADE 11/2013 El presente trabajo constituye un estudio sobre el contrato de anticresis planteado de formar comparativa entre la regulación establecida en el CCE y la más reciente del CCCat. El estudio persigue examinar esta figura contractual de manera íntegra, analizando todos sus elementos y las obligaciones que de él se derivan tanto para el acreedor como para el deudor. El estudio se centra fundamentalmente en determinar la verdadera naturaleza jurídica de este derecho, bien como derecho real de garantía, que es la consideración tradicional que se le ha atribuido, o bien como derecho de goce, que es la postura que venimos a defender aunque de forma más precisa hayamos acabado por determinar que su función jurídica y económica es la de un derecho de goce en función de pago. Y definido este carácter también hemos acabado por concluir que ni en la anticresis del CCE debe entenderse comprendida a favor del acreedor la facultad de enajenación o ius distrahendi, ni en la regulación del CCCat debiera haberse reconocido tal facultad, puesto que al hacerlo se altera esa función jurídica y económica dejando ese contrato vacío de toda utilidad práctica. Profundizar en esa función es lo que nos ha permitido su diferenciación respecto de otras figuras que generalmente se consideran afines como son el propio pacto anticrético, la prenda inmobiliaria o el usufructo en garantía. Y en definitiva será esa función liquidativa de la deuda la que puede hacer que la anticresis tome relevancia como derecho real que encauce el cumplimiento de las obligaciones, permitiendo al acreedor percibir el cobro de la deuda y al deudor hacer frente a ellas mediante el uso por aquel de su patrimonio inmobiliario, no siendo pues un derecho de reacción ante el incumplimiento que permita atacar el patrimonio del deudor y oponiéndose de esta forma a los derechos reales de garantía con los que tradicionalmente ha sido entremezclado.

las cámaras de comercio

ESADE 11/2013 El objetivo principal del presente trabajo de investigación se centra en determinar el nivel de sujeción a la normativa de contratación del sector público de las fundaciones y de las Cámaras de Comercio, Industria y Navegación. Dentro del elenco de entidades fundacionales, se ha mostrado especial interés por las del sector público —tanto estatales, como autonómicas—, las fundaciones públicas sanitarias, las fundaciones en mano común y las que vamos a denominar “fundaciones stricto sensu”. La necesidad de extraer unas conclusiones rigurosas del tema va a requerir del análisis previo de la normativa comunitaria reguladora de la contratación pública, y en concreto de la definición de “poder adjudicador” contenida en el artículo 1.9 de la Directiva 2004/18 del Parlamento Europeo y del Consejo de 31 de marzo, sobre coordinación de los procedimientos de adjudicación de los contratos públicos de obras, de suministro y de servicios. Para su precisa delimitación conceptual se ha acudido a la jurisprudencia del Tribunal europeo como instrumento esencial en la comprensión de términos nada fáciles de interpretar como “necesidades de interés general”, “carácter industrial o mercantil”, “control en la toma de decisiones” o “financiación mayoritariamente pública”. A partir de aquí, se ha procedido al estudio del ámbito subjetivo contenido en el Real Decreto Legislativo 3/2011, de 14 de noviembre, mediante el cual se aprueba el Texto Refundido de la Ley de Contratos del Sector Público y sus distintos niveles de sujeción a la normativa de contratación del sector público, mostrándose especial interés por el de máxima intensidad —el de Administración Pública—, el intermedio —poder adjudicador, no Administración Pública— y el mínimo, correspondiente al resto de entidades del sector público. La correcta integración de los entes regulados en el Derecho nacional en cualquiera de los niveles de sujeción a la norma exige de un análisis exhaustivo de las características previstas en las distintas disposiciones sectoriales y un correcto entendimiento del complejo y extenso artículo 3 del citado Texto Refundido. La difícil interpretación que se deriva del citado precepto, eje central del ámbito subjetivo, procede, entre otras circunstancias, de la utilización de la misma definición en la delimitación de dos conceptos, el de entidad del sector público contenido en la cláusula residual, letra h) del artículo 3.1 y el de poder adjudicador referido en el artículo 3.3, letra b). Tras el examen pormenorizado del citado artículo 3, será cuando podremos fijar con exactitud el nivel de sujeción del elenco de entidades fundacionales seleccionadas, siendo necesario para ello determinar su naturaleza pública o privada; el tipo de necesidades que satisfacen y el control público al que se encuentran sometidas. En este particular extremo, será esencial delimitar el alcance del control que ejerce el Protectorado sobre las fundaciones stricto sensu. La sujeción a la normativa de contratación del sector público de las Cámaras de Comercio, Industria y Navegación requerirá del mismo ejercicio analítico que la de los entes fundacionales, siendo determinante su carácter de Corporación de Derecho Público, las necesidades que satisfacen, y el control público al que se encuentran sometidas, circunstancia, esta última, que exigirá de un estudio exhaustivo tras la supresión del recurso cameral permanente.

Canboy, Basak Batista Foguet, Joan M. (dir.) Emotional and social competencies: Developing and measuring emotional and social competencies in higher education Universitat Ramon Llull (URL). ESADE 05/2014 During the last three decades, research on emotional intelligence (EI) has continuously increased in order to understand its nature and its effects on diverse life variables including outstanding performance, leadership or life satisfaction. In parallel and independently from the different competing models of EI and the subsequently applied measurement tools, research has shown that in each of these approaches EI can be developed. However, evidence on how and how effectively this is done in higher

education is still scarce. After covering the areas of the theoretical models, the three paper sections of this doctoral thesis focus on establishing construct validity among different measures of emotional and social competencies (ESC) and on the possibilities of developing them in higher education: The first study taps into some of the major criticisms on the concept of EI, mainly referring to the quality of previous empirical studies due to the lack of construct or incremental validity of some of the measurement instruments. Here, a closer look is taken at two different instruments used to measure ESC: the Emotional and Social Competencies Inventory - University Edition (ESCI-U) as a multi-rater questionnaire and the Critical Incident Interview (CII) Informant results of the 360 degree questionnaires are compared to the results from the CIIs for 87 students. Results show significant correlations among colleagues’ assessments of teamwork and spouses’ assessment of developing others with the results from the CIIs. Findings suggest the presence of social desirability in some indicators for achievement orientation. Some competencies seem more difficult to assess through external observers. Significant correlations were also found between some competencies as measured through the self-assessments and the CIIs, which indicates that self-assessments might be more “realistic” than expected. The second study shares how interdisciplinary project at a masters’ program at a Spanish law school is introduced. This pedagogical innovation rose from the need to better prepare students for the expectations of their future employers which required the development of competencies. The curriculum of a new course called “Module 9” was framed according to Experiential Learning Theory (ELT). While student teams worked on self-selected projects, their learning processes were accompanied by workshops and tutorials. Coding of learning memoranda showed that each team applied each learning mode during the different stages of the projects. While evaluations about the experience were generally positive, awareness of the learning process itself could be increased throughout the course. Reflections from professors included the need to improve the support system for students to manage the emotions during the learning process. This led to changing the curriculum design for the following cohort by including the assessment and development of emotional and social competencies. The third study describes how Boyatzis’ Intentional Change Theory (ICT) is combined with the interdisciplinary project work in teams with the objective of creating a framework for self-directed change based on the assessment and development of ESC. Workshops, tutorials and individual coaching sessions were offered to ensure the best possible alignment of personal and team goals. ESC were measured with the multi-rater ESCI-U after 3 months into the program and then again at the end of the academic year. The results of exploratory evaluations for 18 participants showed positive change on the development of ESC in general. The quality of the present research is discussed critically and future research lines recommended as well as the implications of the present studies reviewed

support Universitat Ramon Llull (URL). ESADE 06/2014 As organizations, regardless of their sizes, seek opportunities to become multinationals, the significance of expatriates is expanding. While expatriation is not a new concept, the known identity of expatriates is adjusting to the new demands of new generations. Following World War II, expatriation began when organizations initiated sending their own employees abroad to work in their subsidiaries However, along with the new generation, a new type of expatriates emerged as self-initiated expatriates; people who decided to work abroad without the support of a parent organization in their home countries. This thesis attempts to understand the differences between organization expatriates and self-initiated expatriates by presenting three papers that consider different samples and diverse methods. Each chapter has its own conclusions and limitations; following on, the final chapter of the thesis will summarize, compare and contrast the findings of these papers. The overall findings reveal that self-initiated expatriates and organizational expatriates seem to contrast in their meaning of 'success', as well as in their motivation for going abroad, but face similar obstacles in terms of spousal adjustment and language. The findings are supported with quotes from interviewees. .
