I : INTRODUCTION:

1). This is a Writ of Procedendo to compel Franklin County, Ohio Common

Pleas Clerk of Courts Mayellen 0'"Sbaughnessy9 and Eli:zabeth Biggins to

proceed to filing relator,s Harris "Declaratory Judgment", which were

transfer to the Franklin County Court of Common Pleas from the Cuyahoga

County Court of Common Pleas, wha,ch the Franklin County Clerk of Courtsoffice has held this case in abeyance for over 30 days now because relator

Harris didn,t pay the full filing fee,s but this case were granted leave

to proceed without payQnent, because relator Harris has filed an "Motion

IN FORMA PAUPERIS in this case, pursuant to Ohio Revised Code2969.25(C)(1)

(2). But the respondents refuses to filed this case in Franklin County,Ohio, under DWAYNE HARRIS VS. MELISSA ADAMS et al., #CV-14-831753.

Respondents 0"Shaughnessy, and Biggins has intentionally withheld this

case in abeyance and refuses to render a,judgment on this matter or they

has unnecessarily delayed the proceeding of this case.

II: JURISDICTION:

2). Jurisdiction is conferred on this Court by Ohio Constitution Articl

IV, 2(B)(1), to the Ohio Supreme Court.

III: WRIT OF PROCEDENDO:

3). Procedendo is a Writ issued to a lower court commanding the lower

court to proceed in cases in which the lower court has.refused to act

because of doubtful jurisdiction, or has erroneously determined that it

lacks jurisdiction, or otherwa.se improperly refuses to proceed to judgment.

4). Procedendo is also available wbere a Court has either refused to

render jud.gment or unnecessarily delayed proceeding to judgrnent. See

STATE EX REL. VERHOVEC VS. MASCIO, 691 N.E.2d 282.

5). The Relator must demonstrate a clear legal right to Procedendo inorder to obtain the Writ. See

STATE EX REL. RATLIFF VS. MARSHALL, 252N.E.2d 582. AND See STATE EX REL. BATTEN VS. REECE, 436 IV.E,2d 1027.

IV: LAW AND ARGUMENT:

Currently before the Clerk of Courts in Franklin County, Ohio of Common

Pleas, under Case Name DWAYNE HARRIS VS. MELISSA ADAMS, #CV-14-831753,

there,s an outstanding "DECLARATORY JUDGMENT" that is being held in

abeyance. This Declaratory Judgment were originally filed in the

Cuyahoga County Court of Common.Pleas on August 26, 2014.

On September 23, 2014, the Court of Common Pleas in Cuyahoga County, Ohio

has improperly directed this case to be transfer to the Court of Common

Pleas in Franklin County, Ohio because of improper venue.

On October 7, 2014, Relator Harris has received an Notice of Filing Fee,s

due in this case by the Franklin County Court of Common Pleas, whicb states

in part: "The above captioned case were transferred to the Franklin County

Court of Common Pleas. You are hereby notified the filing fee,s in theamount of $225.00 must be remitted in the form of a certified check,

money order, or Attorney firm check payable to the Franklin County Clerk

of Courts. See EXHIBIT (A), attacbed.

Now, according to Ohio Revised Code 2969.25(C)(1)(2), which states in

part: "If an inmate who files a civil action or appeal against a

government entity or employee seeks a waiver of the prepayment of the full

filing fee,s assessed by the Court in which the action or appeal is filed,

the inmate shall file with the complaint or notice of appeal an affidavit

that the inmate is seeking a waiver of the prepayments of the Courts Full

Filing Fee,s and an Affidavit of Indigency. Relator Harris was granted

leaved to proceed with this case because be did filed his AFFIDAVIT OF

INDIGENCY to waived the full filing fee,s in this case. See EXHIBIT (B),attacbed.

Now on October 5, 2014, Relator Harris filed an Motion Opposing a Change

of Venue, pursuant to CIVIL RULE 3(B)(3)(6), because the Cuyahoga County

Court of Common Pleas improperly transfer the VENUE in this case, because

Relator Harris sentencing Court in 1989 is the Court of Common Pleas in

Cuyahoga County, Ohio, and this pending "DECLARATORY JUDGMENT° case is

dealing with Relator,s Harris asking the Cuyahoga County Court of Common

Pleas to directed the Ohio Department of Rehabilitation and Correction

to correct my incorrect sentence by the Dept of Rebab and Corr., so the

proper Venue was Cuyahoga County Court of Common Pleas, instead of

Eranklin County Court of Common Pleas. See EXHIBIT ( C), attacbed.

So, the Franklin County Court of Common Pleas are withhelding this case

in abeyance and refuses to allowed Relator Harris to Defended this case.

The Supreme Court of Ohio and the Board of Commissioners on Grievances

and Discipline has set precedent, this type of delay is very prejudical

to the system of justice. In DISCIPLINARY COUNSEL VS. SARGEANT, 889

N.E.2d 96, the Board of Commissioners on Grievances and Discipline file

a complaint and recommended the Supreme Court publicly reprimand Judge

Sargeant with the Sandusky County Court of Common Pleas, for allowing six

civil cases languish in his court for an inordinate amount of time. The

Supreme Court of Ohio agreed witb the board, that Judge Sargeant unjustified

delay in these cases and in other cases on his docket, violated the CODEOF JUDICIAL>CONDUCT.

This outstanding "Declaratory Judgment has been pending on the Court,s of

Common Pleas in Cuyaboga County, Ohio; and Franklin County Common Pleas

Court,s dockets sheet since August 26, 2014, and the O HIO,S ATTORNEYGENERAL OFFICE bas failed to Defended this case and failed to present an

answer to Plaintiff Harris complaint; in violationof CIVIL RULE 12(A)(1)

(2). Which the Defendant,s only have 28 days to response to this case,

after the Defendant,s were served with the summons. Well 90 days has passed

since the Defendant,s were served witb there summons and the Defendant,s

still refused to response to the outstanding DECLARATORY JUDGMENT and that,s

violates the code of conduct. The timely resolution of cases is a major

fundmental issues to the judicial system. To none will we sell, to none will

we deny, to none will we delay right or justice. MOGNA CORTA CLAUSE, 40,reprinted in senate Document No. 232, 66th cong, 2sess. 17. While Courts

inherently have the power to supervise and control their dockets. See

STATE EX REL. BUCK VS. McCABE, (1942), 45 N.E.2d 763, this power is temperedby the responsibility to effeciently administer juctice.

SARGEANT Rule 2.5(Former Canons 3) of the code of Judicial Conduct requires judges to perform

their duties with impartiality and diligence, to give their judicial dutiesprecedence ever

all other activities, to dispose of cases and other judicial

matter promptly effecticiently and to hold their staff, conduct officials

and other to these high standards. Id. "Prompt disposition of the Courts

business requires a judge to devote adequate time to judicial duties, to

be punctual in attending court and expeditous in determining matters

under submission and to require that court officials, litigants and their

lawyers cooperate wi.th the judge to that end. Id.

According to Ohio Superintendence Rule 40, the Courts must rule upon a

pending Motion within (120 days). See MARTIN VS. MANNER, 2006 OHIO APP.

LEXIS 3809 and see STATE EX REL. RODGERS VS. CUYAHOGA COUNTY COURT OF

COMMON PLEAS, 615 N.E.2d 689. Relator Harris "Declaratory Judgment" has

been pending in the Cuyahoga County Court of Common Pleas, and Franklin

County Court of Common Pleas, for over 90 days now, since August 26, 2014,

under entitled case DWAYNE HARRIS VS. MELISSA ADAMS ET AL., #CV-14-831753,

and this court of clerk office are holding this case in abeyance, by

refusing to filed this Declaratory Judgment, which cause the Defendant,s

in this Declaratory Judgment to defended or response to this complaint

within 28 days after serves of the summons, pursuant to CIVIL RULE 12(A)

(1)(2). This Court must make an judgment on this case being filed, to

proceeded on the merits of this case.

CONCLUSION

For the foregoing reasons, Relator Harris pray that this Honorable Court

wouLd grant his Writ of Procedendo and direct the Frankli.n County Court

of Common Pleas to file this case that are being held in abeyance and direct

the Court of Common Pleas to render an decision on Relator Harris Affidavit

of Indigency that were filed with this case on August 26, 2014.
