INTRODUCTION

These Rules and Regulations Pertaining to the Fee Structure for Licensing, Laboratory and Administrative Services Provided by the Department of Health [R23-1-17-Fee] are promulgated pursuant to the general authority set forth in RIGL §23-1-3(b), §23-1-17 and §23-1-54, and the authority to establish the specific licensing, laboratory or administrative fee contained in the individual statute(s) cited in these Regulations. These Regulations are being promulgated for the purpose of establishing a consolidated fee schedule for licensing, laboratory and administrative services provided by the Department.

Pursuant to the provisions of RIGL §§42-35-3(a)(3) and (a)(4), the following were given consideration in arriving at these Regulations:

(1) Alternative approaches to the regulations;

(2) Duplication or overlap with other state regulations; and

(3) Significant economic impact on small business.

Based on the available information, no known overlap, duplication or alternative approach was identified.

The fee schedule for licensing, laboratory and administrative services established in these Regulations shall supersede all previous fees for licensing, laboratory and administrative services promulgated by the Department, pursuant to the following seventy-five (75) rules and regulations1, and filed with the Secretary of State:

Section 1.0 Definitions

Wherever used in these Regulations, the following terms shall be construed as follows:

1.1 "Department" means the Rhode Island Department of Health.

1.2 "Director" means the Director of the Rhode Island Department of Health.

1.3 “License” means an authorization granted by the Department to engage in a business or occupation that is subject to regulation by the Department. For the purpose of these Regulations, a registration, certification, permit or similar authorization issued by the Department is also considered to be a license.

1.4 "Private Well Water Supply" means a source of well water used for human consumption and which is not a "Public Water System."

1.5 "Public Water System" means a system for the provision to the public of piped water for human consumption, provided such system has at least fifteen (l5) service connections or regularly serves an average of at least twenty-five (25) individuals daily at least sixty (60) days out of the year, pursuant to the Rhode Island Rules and Regulations Pertaining to Public Drinking Water [R46-l3-DWS].

1.6 “RIGL” means the General Laws of Rhode Island, as amended.

1.7 “State Health Laboratories” means the State Health Laboratories maintained by the Rhode Island Department of Health.

1.8 “These Regulations” mean all parts of Rhode Island Rules and Regulations Pertaining to the Fee Structure tor Licensing, Laboratory and Administrative Services Provided by the Department of Health [R23-1-17-Fee].

1.9 "Well Water" means water that is taken from below the ground through piping or similar installed device utilizing external force or vacuum.

Section 2.0 Applicability and Scope

2.1 Applicability and Scope. These Regulations are promulgated to establish a consolidated fee schedule for licensing, laboratory and administrative services provided by the Department.

2.2 The provisions of these Regulations are in addition to, and not in substitution for, other licensing rules and regulations promulgated by the Director pursuant to authority conferred by applicable RIGL statutes.

2.3 (a) Nothing in these Regulations shall be construed as requiring the use of the State Health Laboratories where other clinical laboratories, licensed by the Department pursuant to RIGL §23-16.2-4(a), are available to perform the requested laboratory services.

(b) Nothing in these Regulations shall be construed as requiring the use of the State Health Laboratories where other analytical laboratories, licensed by the Department pursuant to RIGL §23-16.2-4.1, are available to perform the requested laboratory services.

2.4 Designation of Certain Clinical Tests as a Covered Benefit. Pursuant to the authority conferred by RIGL §23-1-3(c), the clinical tests listed in Appendix G of these Regulations have been designated by the Director as a covered benefit and shall be reimbursable by all health insurers, as defined in RIGL §27-38.2-2(1), providing health insurance coverage in Rhode Island except for supplemental policies which only provide coverage for specific diseases, hospital indemnity Medicare supplements, or other supplemental policies. The charges for those testing programs shall be borne by the hospitals or other licensed health care providers and facilities in the absence of a third-party payor.

2.5 Fees for Lead Poisoning Screening. The fee for any lead poisoning screening or lead screening-related services provided by the State Health Laboratories shall be determined on the basis of rates paid by health care insurers to private laboratories for blood lead analysis.

Section 3.0 Licensing, Laboratory and Administrative Services Fees

3.1 The fees for licensing, laboratory and administrative services performed by the Department are contained in Appendix A through Appendix J of these Regulations, as follows:

Section 4.0 Payment of Fees

4.1 Unless otherwise specified in these Regulations, payment for all licensing, laboratory and administrative services performed by the Department shall be non-returnable and nonrefundable and shall be in the form of a check or money order made payable to the General Treasurer, State of Rhode Island.

4.2 (a) Payment for all clinical laboratory services, including all screening for lead poisoning and lead screening-related services, performed by the State Health Laboratories shall be submitted to the Department within thirty (30) days of receipt of the invoice or other period of time agreed to by the Department.

(b) Payment for all testing of private well water supplies performed by the State Health Laboratories shall be prepaid. The testing fee(s) shall be submitted at the time the sample is forwarded to the State Health Laboratories.

4.3 The application/initial licensure fee established in these Regulations shall be submitted in accordance with the requirements specified in the regulations governing the profession and/or activity for which the license application is being submitted.

4.4 All license and renewal fees in these Regulations are specified on a license cycle basis. Consequently, license categories common to more than one profession [e.g., Controlled Substances Registration (CSR)] will be assessed on an annualized fee basis x the number of years in the license cycle.

4.5 (a) The applicable renewal fee established in these Regulations shall be submitted prior to the expiration date of the current license. Failure to submit the applicable renewal fee prior to the expiration date of the current license may subject the licensee to assessment of a late fee, as established by these Regulations, as well as additional administrative sanctions specified in the regulations governing the profession and/or activity for which the license was issued.

(b) When on-line renewal is available for a license, payment shall be made in any of the forms designated on the renewal website.

Section 5.0 Compliance and Severability

5.1 All hearings and reviews required under these Regulations shall be held in accordance with the provisions of the Rules and Regulations of the Rhode Island Department of Health Regarding Practices and Procedures Before the Department of Health and Access to Public Records of the Department of Health [R42-35-PP].

5.2 If any provision of these Regulations or the application thereof to any person or circumstances shall be held invalid, such invalidity shall not affect the provisions or application of these Regulations which can be given effect, and to this end the provisions of these Regulations are declared to be severable.
