2005 law relating to Right to Information has been enacted. Section 4, 5, l2, l 3, l 5

, l 6, 24,27 and 28 which are related to thc preparations for the implementation of Right to

Information Act, have come into force from l 5th June, 2005 and the remaining provisions

lnwill come into effect after l 20 days i

Preparation of various guides, manuals and the literature for orficers and

Utlaranchal State has started these preparations from June, 2005 and the Chief

Secretary of tlie State has been reviewing the progress on a regular basis. Almost aII the

departments have already nominated PlOs, APIOs and DAAS in respect of Public Authorities

.k 'in the State. The preparation of manuals/handbooks as Pro-Active disclosure by al1 the Public

Authorities is in full swing and this work w i 11 be completed by 30th Septem ber, 2005. Steps

/* have already been initiattd for the constitution of the State lnformation Commission and it

will be established very soon. A State Level Workshop for senior officers was organised on

23-24 July, 2005 with the help of CHRI, New Delhi and YASHADA, Pune. Workshops in alI

districls of the State art scheduled to be held between 241h August and 6th Septemberz 2005.

l 00 M aster Trainers are being trained from 1 5th August, 2005 to 20th August, 2005 at

Uttaranchal Academy of Administration, Nainital. These M aster Trainers will train all Plos

and AAs between 10th and 25th Seplember, 2005 in al1 districts of the State. A detailed

Government Order in respect of the action plan with a time schedule tbr each activity has

been issued by the State Government. A copy of this order is enclosed for your kind perusal.

The implementation of Right to Information Act in an effective manner

involves stlbstantial expenditure and for a small State like Uttaranchal it is very difGcult to

spare extra f-unds in the m idst of the financial year. A broad estimate of funds required for

various preparations for the effbctive implementation of RTI Act, 2005 has been prepared

and enclosed herewith according to which Rs. 10.25 crore are needed as non recurring

expenses and Rs. 1 crore annually as recurring expenditure.

lt is requested that funds as per above requirement may kindly be sanctioned

to Uttaranchal Government at the earliest so that alI preparations may be done timely.

The enactment of tile Right to lnfonnauon Act in June, 2005 is anim portant step towards ensuring trarsparency and accountabilityin goeernrnqnt and empowering tie peoplc far real participation ingovernance,' The Gokernment of Gujarat is 'also committed to theconcept of Right to Inform auon and we have atready takenpreliminary steps for implementntion of this Act in Gujarat.

However, I would tike to point out certain difliculties enum eratedbelow, ' which are likely to arise w hile tm plem enting this Actbecause of certain provisions in the Act.

. The thne frame of l20 days for starting thejmplementation of the Act is very short in view of thenum ber of activitics which are required to be undertakenprior to tlne im plementation date. M any countries of theworld had a transition/preparation period of as much as

' 5 years before the Act was im plem ented, W hite this ldndof tim e-frame may bc' considcred too long, 120 days isinadequate .to complete a11 the actions required prior tothe implem entation of the Act.

2. . The success of the Act lies iI1 bringing about the changeof m indset of the civil servants who are to im plem ent this

The State of Chhattisgaqh very implementing the Right to Information Act, 2005in right earnest. We are progressing well In terms of appointing PIOS and APIOS andalso in preparations for the document on ùroactive disclosures. Preparations have alsobeen made for uploading these documents in the Internet.

The Chief Minister of our State is very committed in implementation of the Act.This can be seen from the fact that he has selected his home district for in depthimplement-ation of the Act. Also, as per his guldance we are organizing one-dayworkshop each for Council of Ministers, Chairpersons of Municipal Corporations andCouncils, Distrid and Block Panchayats where he himself will guide the participani.

We have worked out the budget requirements for effective implementation ofthe Act that is attached in the adjoining page. Kindly arrange the fund of Rs 14.62Crores to eqable us to e/ectively implement the Act, '
