The Main Project Design is developed in accordance with the Law on Spatial Planning and Construction (OG of Montenegro No 51/08, 40/10, 34/11, 47/11, 35/13, 39/13), The Rolebook on the Conditions and the Manner of Adaptation of the Facilities for the Persons with Reduced Mobility (OG of Montenegro No 10/09), with the Rolebook on the design and the content of technical documentation (OG of Republic of Montenegro No 22/02) and with The Rulebook on Forms That are Used in the Construction Procedures (OG of Montenegro No 47/13).

Considering that it is a project of adaptation, the project does not require a building permit, but the work should be reported to the competent authority.

The opinion of the Environment Protection Agency is obtained which confirms that

Environmental Assessment is not needed for planned activities (02 No UPI 1293/2 dated on October 21 2013).In accordance with the Law on protection of cultural property (OG No 49/10), the opinion and compliance of the Ministry of Culture-Authority for the Protection of Cultural Property is obtained ( No UP/I 03-112/2013-5 dated on November 18 2013.) with the following guidelines:

- The dimensions and disposition of all external openings, doors and windows keep in inception form and dimension;

- Expansion of the existing and punching of new doors is not permitted;- Structural elements of the walls must not be damaged.

Waste management (a) Waste collection and disposal pathways and sites will be identified for all major waste types expected from demolition and construction activities.

(b) Mineral construction and demolition wastes will be separated from general refuse, organic, liquid and chemical wastes by on-site sorting and stored in appropriate containers.

Annex 1

REPORT FROM THE PUBLIC CONSULTATION

on the Checklist and EMP for Minor Civil Works for Pupil-Student Hostel in Cetinje

Following the World Bank's requirements, the public consultations on the Checklist and EMP for Minor Civil Works for Pupil-Student Hostel in Cetinje were held from 21- 28 February 2014.

The Ministry of Education announced an invitation for public consultations for the interested public, bodies and organisations through various media, as follows:

- In Daily Newspaper "Pobjeda", on February 21 2014 (Attachment 1);- On web-site of the HERIC project, on February 20 2014:

Checklists and Environmental Management Plans for all Students' Hostels were published on the web-site of the HERIC project – Section: ABOUT THE PROJECT/ENVIRONMENTAL ASSESSMENT/STUDENTS HOSTELS.

The notifications were sent to the following institutions and NGO (on February 20 2014):

- The Environmental Protection Agency (by mail and fax);- The Ministry of Sustainable Development and Tourism (by mail and fax);- Old Royal Capital Cetinje - Department for Spatial Regulation and

Environment Protection (by mail and fax);- Directorate for Protection of Cultural Property (by mail and fax);- Aarhus Center Podgorica (by mail and fax);- NGO “Green Home” Podgorica (by e-mail);

Aarhus center published the invitation for public consultation on their web-site: http://www.arhuscentri.me/?p=2040, (Attachment 4);

Interested parties had been able to get insight into the hard copies of the Checklist and Environmental Management Plan every working days from February 21 to February 28, 2014 from 10 a.m. to 1 p.m. as follows:

- In HERIC Office in Podgorica, Rimski trg 19, first floor, the public insight into the Environmental Management Plans was provided for all Hostels.

- In Pupil-Student Hostel in Cetinje, Njegoseva Street, in the Office No. 105, the public insight into the Environmental Management Plan was provided for this Hostel.

Interested parties had been able to submit all comments and opinions to the HERIC Project Office address, to Pupil-Student Hostel in Cetinje address and to the e-mail address: [email protected] by March 3, 2014.

Interested stakeholders (the representative of the local government and tenants of the Hostel) have got insigt into the hard copy of the the Checklist and EMP for Minor Civil Works for Pupil-Student Hostel in Cetinje. However, there were not specific written comments or statements here, except the general statement in the attached file written by the Head of the Hostel, stated that all students were satisfied with the planned activities which should not induce any negative impact on the environment. (List of persons with the cover letter is in the Attachment 5).

Some objections submitted by Department for Spatial Regulation and Environment Protection of Municipality of Niksić and Department for Planning and Spatial Regulation and Environment Protection of the Capital Podgorica are accepted and inserted the changes in the Checklist and EMP for Minor Civil Works for Pupil-Student Hostel in Cetinje, as follows:

The Law on Nature Protection (Official Gazette of Montenegro No 51/08, 21/09 and 40/11) will be added to Environmental regulation that are applicable on planned activities, considering that it prescribes the general measures of protection and conservation of nature; protection of natural goods; sustainable use of natural resources and natural goods and the control of their usage etc.

The Rulebook on Forms That are Used in the Construction Procedures (Official Gazette of Montenegro No 47/13) will be added to legislation that are applicable on planned activities.

In the Part II of the EMP – Activity A. General Conditions, the following clause is replased: “The local construction and environment inspectorates and communities have been notified of upcoming activities”, with: “The Communal Police (local inspection), the relevant building local authority (which shall notify the Building Inspection) and Inspection Directorate (Environmental and Labor inspection) have been notified of upcoming activities”. This is because there are not local inspection authorities, except the Communal Police, which performs inspection in transport and waste disposal, maintenance of public areas and protection against the noise in the environment.

Comments and objections collected during the public consultation are reflected in the Checklist and Environmental Management Plan for Pupil-Student Hostel in Cetinje, as indicated above. Finalized document will be reposted on the web-site of the HERIC project: http://www.heric.me

The opinion and compliance of the Ministry of CultureAuthority for the Protection of Cultural Property

The Ministry of Education of Montenegro, Pupil-Student Hostel, CetinjeVesna Miranović, Manager

SUBJECT: Issuing guidelines and giving consent for execution of works on the refurbishment of certain number of in-room bathrooms in the PI Student Hostel – Cetinje In accordance with the request of the Ministry of Education of Montenegro for Issuing guidelines and giving consent for execution of works on the refurbishment of certain number of in-room bathrooms in the PI Student Hostel – Cetinje, Directorate for Protection of Cultural Property state the following:By the inspection of the Registry of Cultural Property it was established that the Building of former Girls` Institute “Carica Marija” has the status of the immovable cultural property, pursuant to the Decision 03-71/1 of 06th February 1960 and Decision 01-846/1-61.The cultural property “Building of former Girls` Institute “Carica Marija” is the first female secondary school institute in Montenegro, founded in 1869, with the selfless assistance of the Russian empress Marija Alexandrovna. It stopped with the work in 1913. Some thirty years ago it was adapted to the needs of a student hostel, PI “Student Hostel”, serving as such the function in science and culture.Originally it was a two-floor building, with the wide porch entrance, with adjacent garden, defined with a stone fence. In the second half of 20 th century, the fence wall was removed and the building façade painted. Over time, the building was subjected to substantial changes, so it had not been preserved in its original state. Today, the building consists of three wings, with ground and first floor and winged attic, with arched eaves over the front door. The building structure is stable and solidly maintained. The structure is within the boundaries of the historical centre of Cetinje which is protected as a historical urban complex, which makes it subject to the protective measures under the stipulations of the Law on Cultural Property Protection. They stipulate severe measures of cultural property protection as follows:

Secure sustainable use of cultural property in line with its traditional or newly defined purpose and respective sustainable use;

Preservation and improvement of the cultural property integrity and providing conditions for survival of cultural property and its passing to future generations;

Establishing timely cooperation and encouraging owners and users to sustainable use of cultural property and raising awareness on the significance of cultural property, risks it is exposed to needs for its protection and preservation;

Timely, efficient and effective application of the conservation measures and other expert, scientific measures, and timely, efficient and effective application of prescribed measures and activities;

Management of risks the cultural property is exposed to and prevention of activities that could change the appearance, characteristics, particularities and significance of the cultural property;

Cultural property structure, “Building of former Girls` Institute “Carica Marija” had been, since it is construction, adapted to functionally meet different needs. Its appearance and condition had undergone most significant changes during 1980s, when its facades were painted, the number of floors altered, carpentry, interior and exterior details changed. As foreseen subject works on maintenance and increasing standard of the Student Hostel are in concrete terms related to the refurbishment and adaptation of the bathrooms (which implies changing non-authentic doors at the bathrooms, change of the bathroom utilities and ceramics), there is no need for the development of conservatory design and engagement of the contractors with the conservatory licence.Following guidelines should be implemented during the regular refurbishment of the bathrooms:

Dimensions and disposition of all external openings, doors and windows shall be kept in the present shape and dimensions;

Increasing existing and adding new doors is not permitted;

Structural elements of the walls should not be damaged.

After the inspection of existing Directorate documentation and submitted request, as well as a site visit, it was concluded that subject works and planned interventions will not jeopardize the integrity of the respective cultural property. The Directorate for Protection of Cultural Property thus issue consent to the respective works, in accordance with the provided guidelines.
