I have spoken to production regarding lead time, of course it’s a very busy time of year for us. They are at this point saying if we received your order now, that they may require   to complete due to some long lead time items and current workload. Of course, if that doesn’t work for you, let me know  ASAP and I will try to re‐negotiate with production manager. 

Please see attached updated quote with new pricing reflected. 

I have also spoken with Fuso head office, they have sent me your pricing (attached and refer below) and advised that they have one of these vehicles in stock available for immediate delivery to us. Once we have completed,  it will be transported to ACT dealership for P.D, rego etc and they will do the handover.  

Again, we can organise a Byron Group Staff member to do our part of the handover and explain how to operate everything correctly.

I wanted to make sure you were happy with the length of the lease, I’ve put down 96 months or 8 years and 80,000 km’s averaging 10,000 per year. Let me know if you would like this adjusted or if there are any other changes you would like me to make. I will send this back to our fleet section and discuss any remaining points with Dave O’Connor next week when he returns to work.

Good morning, I’ve been given notification today that the new CTU vehicle should arrive towards the end of January 2016. There is an approval to be signed off by Bernadette which will finalise the formal order.  

This vehicle is being leased through SG Fleet so any servicing, breakdowns etc will be dealt with through the current arrangement.

Thank you for taking my call this afternoon. I draw your attention to the email below received from Corrective Services and more importantly to the email sent by SG Fleet  ) addressed to Josh Rae (Corrective Services).  

As discussed, in November 2015 the ED, Capital Works and Infrastructure approved a work order to SG Fleet for the vehicle plus the build cost. The order has been with SG Fleet for more than a year (see attached). 

I note SG’s advice “…The business of Byron Group is seeking expressions of interest in purchasing so we are waiting on seeing the outcome of that process before we recommend to you way forward. Short answer is no quick fix on this problem as we are informed that other business like Varley are over stocked due to Byron Groups misfortune. ……if you have suggestions please let me know”. I further note from this same email traffic that the first we knew about Bryon’s involuntary administration was by Bryon themselves! 

I would be grateful, as the Territory’s representative for managing the SG Contract, if you would pleas look investigate this issue as a matter of urgency. I am particularly interested in confirming SG’s contractual responsibility in relation to Byron Group – noting that the Territory does not have a contractual responsibility for third party providers. I am also concerned about the commentary made by SG that there is no quick fix to the problem noting that they have had this request for 12 months and their original quotation noted a build construction time frame of 

. I would have thought a professional organisation like SG Fleet would have, as part of its contract management responsibilities for third party providers and specifically for ensuring that Bryon Group’s delivery program was being met, would have had early indications that Bryon was experiencing financial difficulty long before now e.g. continued extension of the delivery program. 

Would you please advise what action plan will be implemented to ensure that Corrective Services’ vehicle is delivered as soon as possible. In the meantime I will ensure that Corrective Services does not enter into further discussions with SG Fleet and or other nominated contacts (see below) mitigating further potential risk to the Territory in relation to this project.

Subject: FW: ACT Corrective Services Vehicles [SEC=UNCLASSIFIED] Importance: High  Hi Luigina,  Therese Goodman has requested I contact your team in regards to the below vehicle and suggested you may be able to assist, I am unsure if you are the best person but please point me in the correct direction if not.   ACTCS Has had a Prison Transport vehicle on order for some time now and has experienced many delays and reviewed delivery dates. This has forced ACTCS to request continued extensions on the lease for our Mercedes Sprinter Vehicle that has become a high risk due to its age etc. This is the only vehicle of its capability that ACTCS possess for the required daily transport duties of detainees so a breakdown or unscheduled maintenance or repair could cause significant issues. The new vehicle is already around 12 months overdue for delivery and as you can see below, the manufacturing company has recently been placed into voluntary administration.   Communication between SG Fleet and Byron Group has been very limited in terms of receiving any updates on this build and since going into administration is proving even harder.  I managed to track down the contact details for the Production Supervisor at the Victorian Byron Group plant where the construction is taking place. This morning he has informed me that most staff have been stood down and he has been notified by the administrators to cease all work on our vehicle until further notice, but continue to build 13 Ambulances for VIC.  At this stage, with the uncertainty around the future of the Byron Group Holdings we think it may be necessary to explore alternative options and suppliers in order to have a new vehicle operational as soon as possible. Please also see attached emails from SG Fleet who have indicated this project has come to a standstill.  

  

  

 If you could please advise of the best way to move forward and progress this project I would greatly appreciate it . Waiting around for a possible restructure of Byron Group Holdings does not seem like an adequate solution for ACTCS and offers high risks.  My contacts to date if required for further information;

1. The body build works are not covered under the SG Fleet arrangement. Body builds do not, and are not likely in the future to, form part of the scope of services under the Fleet Services Contract (FSC). Financing of these vehicles, however, it would seem is covered by the scope. Quite how this works in practical terms is something that we would need to clarify going forward with SG Fleet. I feel it important to note that any involvement that SG Fleet have had on this issue is based purely on goodwill and is not as a result of any contractual obligation they have. 

2. As with any procurement, if, at the outset, it was estimated that the build was going to cost more than $200 000, a procurement activity should have been registered and the appropriate procurement process followed to ensure that the Territory was adequately covered from a contractual perspective. Generally speaking this would have meant approaching the market in order to seek quotes and ultimately setting up the required contracts between the parties. I am making the assumption that this process was followed, that Byron was the successful supplier and that Corrective Services has a contract in place between itself and Byron. This, of course, may no longer be relevant given the fact that Byron went into liquidation and were bought over by the Wade Group but that is something that we suggest you check with ACTGS (this may be what you checked with them in your RFLA?) 

3. In the event that the previous contract is no longer enforceable, it is of critical importance that Corrective Services set up a new contractual arrangement to cover off obligations of the new entity (Wade?) as well as cover off (in detail) the production schedule such that the vehicle is completed as soon as possible. Should the value of this arrangement exceed the $200 000 threshold, please register this activity with Goods & Services.
