    Article IX. FACULTY

    Section 44. Minimum Faculty Qualifications . The minimum qualifications for faculty for the differencegrades and levels of instruction duly supported by appropriate credentials on file in the school shall beas follows:

    a. Pre-school and Elementary: Holder of a bachelors degree in elementary education, orits equivalent. Pre-school teachers shall have at least six units of professional subjectsrelating to pre-primary education.

    b. Secondary:

    1. For academic subjects: Holders of a bache lors degree in secondary education or itsequivalent, or a Bachelor of Arts degree or its equivalent, with at least 18 units ofprofessional education subjects, to teach largely in the major field.

    2. For vocational subjects:

    (a) Holders of any four-year college degree with knowledge andcompetence of the technical/vocational course he is to teach;

    (b) College undergraduates who, by training, experience or both, canteach the subject or subjects assigned; or nay vocationally trained orexperienced person, engaged in the occupation or trade, who mayserve as resource person in any aspect of his expertise.

    c. Tertiary:

    1. For undergraduate courses, other than vocational:

    (a) Holder of a maters degree, to teach largely in his major field; or, forprofessional courses, holder of the appropriate professional licenserequired for at least a bachelors degree. Any deviation from this

    requirement will be subject to regulation by the Department.

    (b) Special technical-vocational courses: Any graduate of thecorresponding program or course with successful demonstratedoccupational or trade experience of at least one year.

    (c) For Physical Education; Holder of the degree of Bachelor of Science inPhysical Education, or Bachelor of Science in Education, with major orminor in physical education, or any other bachelors degree withcertificate in physical education.

    (d) For music education: Holder of the degree of Bachelor of Music, orBachelor of Science, with major or minor in music, or any otherbachelors degree with certificate in mus ic.

    2. For post-undergraduate programs or courses:

    (a) Holder of the appropriate professional degree or license, to teach inhis field of specialization. In special fields of study which requirespecial and technical training, an instructor without a doctors ormasters degree may be admitted into the faculty if he possessesexceptional demonstrated competence and scholarship in his field ofstudy or discipline.

    3. For graduate level programs or courses:

    (a) For the masters program: Holder of the appropriate earned mastersdegree, to teach in his field of expertise.

    (b) for the doctoral program: Holder of the appropriate earned doctoraldegree. ( Refer to Section 74 id. )

    Section 45. Full-time and Part-time Faculty . As a general rule, all private schools shall employ full-timeacademic personnel consistent with the levels of instruction.

    Full-time academic personnel are those who meet all the following requirements:

    a. Who possess at least the minimum academic qualifications prescribed by the

    Department under this Manual for all academic personnel:

    b. Who are paid monthly or hourly, based on the regular teaching loads as provided for inthe policies, rules and standards of the Department and the school;

    c. Whose total working day of not more than eight hours a day is devoted to the school;

    d. Who have no other remunerative occupation elsewhere requiring regular hours of workthat will conflict with the working hours in the school; and

    e. Who are not teaching full-time in any other educational institution.

    All teaching personnel who do not meet the foregoing qualifications are considered part-time. ( Refer toSection 70 id. )

    consecutive regular semesters of satisfactory service for those in the tertiary level, and nine 99)consecutive trimesters of satisfactory service for those in the tertiary level where collegiate courses areoffered on the trimester basis. ( Refer to Section 67 id. )

    Section 93. Regular or Permanent Status . Those who have served thee probationary period shall bemade regular or permanent. Full-time teachers who have satisfactorily completed their probationaryperiod shall be considered regular or permanent. ( Refer to Section 67 id. )

    Section 94. Causes of Terminating Employment . In addition to the just causes enumerated in the LaborCode, the employment of school personnel, including faculty, may be terminated for any of thefollowing causes:

    a. Gross inefficiency and incompetence in the performance of his duties such as, but notnecessarily limited to, habitual and inexcusable absences and tardiness from his classes,willful abandonment of employment or assignment;

    b. Negligence in keeping school or student records, or tampering with or falsification of thesame;

    c. Conviction of a crime, or an attempt on, or a criminal act against the life of any schoolofficial, personnel, or student, or upon the property or interest of the school;

    d. Notoriously undesirable;

    e. Disgraceful or immoral conduct;

    f. The sale of tickets or the collection of any contributions in any form or for any purpose orproject whatsoever, whether voluntary or otherwise, from pupils, students and schoolpersonnel, except membership fees of pupils and students in the Red Cross, the GirlScouts of the Philippines and the Boy Scout of the Philippines;

    g. In the event of phasing out, closure or cessation of the educational program or course of theschool itself; and

    h. Other causes analogous to the foregoing as may be provided for in the regulationsprescribed by the Secretary or in the school rules or in a collective bargainingagreement. ( Refer to Section 80 id. )
