What is REALTOR® Advocacy and why is it so important?

From time to time, REALTORS® will ask what REALTOR® Advocacy is all about and why it is so important to our customers, communities and profession. These are good questions and deserve good answers…

As you have heard me share on numerous occasions, REALTORS® work tirelessly to defend the American Dream of homeownership, protect private property rights and ensure our profession is alive and well for generations to come. Often it is not what you see that is a direct result of these efforts, but it is so often what you do not see that is a direct result of REALTOR® Advocacy. REALTORS® have been successful in educating our lawmakers on the impacts of dangerous, costly, and detrimental legislation and/or policy-making that would hurt families and hinder economic expansion in our community and around our nation.

We have worked on behalf of members and citizens to:

♦ Keep banks out of the real estate industry

♦ Keep property taxes low for all property owners

♦ Ensure additional taxes aren’t levied against real estate commissions

♦ Ensure Private Transfer Fees aren’t charged to property owners

♦ Ensure affordable insurance is available to property owners

♦ And the list goes on…

Of course, all of this cannot be accomplished without the hard work and dedication of members from around Osceola County and the United States. It is members, like you, that realize the value of our efforts and invest in our communities and businesses through REALTOR® Advocacy.

To that end, our association is hosting our annual REALTOR® Political Action Committee (RPAC) Auction on September 17, 2011 at the Kissimmee Civic Center. This is always a fun event and a highlight of our membership gatherings throughout the year.

-Please join me and your Directors in celebrating and supporting our industry at this exciting annual event. Let’s insure another successful year letting our state and national associations know that OSCEOLA’s voice speaks loud and clear in all our advocacy efforts!-

Whether you have never attended or have attended for years, I hope you will join me, and the rest of our leadership team, on this important evening. During September, our association offers numerous educational and networking opportunities, but our signature events are our annual Realtors Political Action Committee Auction and our second annual Law Symposium. Our RPAC Auction on September 17th, 2011 at the Kissimmee Civic Center is a great opportunity to have fun and invest in the future of our profession at the same time! In fact, this year you can win a major door prize just for the price of a $25 ticket to attend – an iPad2!

Our association has produced great leadership in contributions to RPAC over the years. That effort has allowed OSCAR to fund public policy issues and support candidates. OSCAR has received over $10,000 from RPAC in 2011 in grant requests for major donor recognition, RPAC activities and a National Association of REALTORS®’ SMART GROWTH course and forum. Advocacy and education are worthy goals – having fun while enjoying libations sponsored by Goodwin Realty and delicious barbeque sponsored by Stewart Title – is a great way to work toward reaching those goals!

Our second annual signature event, our Law Symposium is scheduled for September 8th at Stetson University in Celebration. 2010 was the inaugural year of OSCAR’s first proprietary educational course. Under the direction of 2010 Affiliate of the Year, Nancy Campiglia, over fifty members attended our Law Symposium at Stetson University in Celebration. In 2011, Nancy has created another outstanding presentation of pertinent legal information to assist members in successful transactions, reduce risk and earn continuing education credit, too! We will have another great day at Stetson University in Celebration on September 8th, 2011! This course is only offered at the Osceola County Association of REALTORS®!

Breaking new ground internally, we have added another REALTOR® Advocate to our team here at OSCAR. Stop by to meet our new Executive Assistant, Kim Wagar. Kim grew up in Osceola County and returns to us after much success in business and information systems in the mountains of North Carolina. She has a heart for membership service and team building. ■

This past August 5 and 6, 2011, OSCAR hosted its first CRB class entitled “Performance Leadership: Attract, Develop & Keep Successful Sales Associates”. This class was offered all over the country to Brokers, Managers and Team Leaders with support from CRB National and the CRB Florida Chapter. The OSCAR Staff did an excellent job of finding a very suitable location for the class at the Mona Lisa Hotel (a very chic boutique hotel) in Celebration and booking an exciting instructor named Brad Hanks, a past CRB National President who had overseen nearly 2,500 sales associates in four states in his career.

This class offering was a primary goal of the Osceola Brokers Committee (OBC) for 2011 fulfilling an initiative of OSCAR’s 3-Year Strategic Plan specifically addressing the needs of OSCAR’s “advanced member”. The Committee is comprised of OSCAR Brokers. A

drawing for one “free $299 tuition” was sponsored by the Committee as a marketing incentive.

10 participants mostly from Florida travelled to attend this 2-day class. OBC member, Wanda Linscott (Broker), and myself attended this class which was credited towards the prestigious CRB designation (NAR) considered to be the essential credential in brokerage management. The class was an awesome mix of Brokers managing small offices to as large as managing 350 agents. There were 2 participants from Galveston, TX, and one of them, Claire Reiswerg (Owner/Manager of Sand ‘N Sea Properties), was the winner of the $299 scholarship. Congratulations, Claire!

David Scherer, Osceola County Association REALTOR® Member, is a recent graduate from the 2011 Central Florida Political Leadership Institute.

The Central Florida Political Leadership Institute is the “Political Action Arm” for the Business Force. This uniquely designed program was developed to equip and strengthen our region’s next generation of elected leaders before they formally choose to run for a specific public office.

“Our association understands the importance of being engaged in public policy, including regional issues, and encourages our members to get involved,” says Tim Weisheyer, 2011 OSCAR President. “We are proud of

They are here! Your first international clients have just arrived; you are anxious and excited, but well prepared. You are dressed to impress and raring to go! You have been looking forward to their arrival for the past 3 months and already roughly calculated what this sale would mean to you. Don’t feel bad, we all do it, after all it’s our bread and butter.

Jahal & Jahaan Rampalsingh look like a really nice couple; originally from India they have been living in Canada for 20 years. It’s their first visit to Florida with their two lovely children, a boy age 8 and a girl age 10 and you can tell the kids are excited about going to see Mickey.

As you start the drive to view homes, Jahal asks “What are the property taxes? I’ve heard that as foreigners we have to pay more” You respond with confidence; “That’s a great question Jahal, I get this question a lot from my foreign buyers. The truth is that if the property is not your primary or Homestead residence you will have to pay the same amount of taxes as anyone else, even if you are a citizen of the United States. So for example, if a couple from New York purchases a property in Florida and does not make it their homestead residence, they will pay the same amount in property taxes as you. Roughly what are property taxes in Canada where you live?” Jahaan chimes in letting you know that taxes there are relatively high, especially in the area where they live.

“Now I would also like to advise you that property taxes reset once the property is sold, I’m sure it’s the same in Canada. Since property tax is based on property value, it would increase in a normal market but in the depressed market that we’re in, it should remain roughly the same provided that what you are looking at is the taxes with it not being a homestead property.

While we are on taxes, I will also like to let you know about the Foreign Investment Real Property Tax Act (FIRPTA). This act was passed to ensure that foreign owners don’t leave the country without paying their taxes. You know

what they say; in America you can count on two things…Death & Taxes.

Basically, once you sell the property the buyer will withhold 10% of the sale price; paperwork is filed with the IRS and any applicable refund will be sent to you. The way the law is written, it is the buyer’s responsibility to withhold this 10% from the seller. In reality, the title company will process the paperwork and take care of getting the money to the IRS. I will email you the IRS website for more detailed information along with the names of a few accountants versed in this.” http://www.irs.gov/businesses/small/international/article/0,,id=105000,00.html

“Thanks, that was very helpful” Jahal says. “but just one more question on taxes. As you know I am planning to rent out the property, how much will I have to pay in taxes?”

Again you reiterate to Jahal letting him know that you are not qualified to discuss tax details and he should consult an Accountant, but you can let him know that it is mandatory to file income taxes on any income derived in the US.

“From what I’ve have heard, if you are taxed on the income in the US chances are you will not be taxed on it in your home country. Tax rate is generally around 30% but again, an accountant will best advice on this as there may be deductions, depreciation, recent changes, etc that can be claimed that the accountant will advise on.”

Jahal is very astute and he returns to his questions. “As I mentioned earlier, we want to rent out the property so we need to find out about property management and will need your help in recommending one. Also, do you think we should get Condo/Townhome or single family home and which will get the best rent and appreciate better?”

Here is where your Product knowledge comes into play. Don’t get caught not knowing this information because this is something any sharp investor will ask. It will be time well spent learning about the pros and cons of each.

“You see Jahal, while Condos are priced lower; they usually have a high monthly HOA / Condo fee. People generally prefer to rent single family homes, plus resale of condos is generally more difficult than single family homes, etc. On the upside, there are usually a lot of amenities in the community. Again, this is a personal choice but we will go by and look at a few condos.

Also it depends on if you are looking to do short–term rental or long-term rental. If you decide to go short term, it should be in an area zoned for short-term as the areas around it would usually have a lot more activities to keep tourist interested, like around the Disney area.

In short term rental you would get a higher weekly rate, but occupancy is generally around 30 weeks for the year. You will need to pay a Sales tax on the income in addition to regular taxes. On the upside you can use it for your vacation when it is not in high demand.

I know of some companies that specialize in Short Term rentals and should you decide to go this route I will introduce you. Some of them do have arrangements with tour groups from Europe, etc so there is a good likelihood it may get occupied quickly.

If you are looking for long term rental, which is a more stable income source then definitely I would recommend a single family home. Again I can recommend some great property management companies that will do their due diligence to make sure that the tenant is solid; they will conduct background check, income verification, etc. They also have an eviction procedure in place in the event the tenant does not pay the rent. Don’t worry Jahal & Jahaan; I will guide you through the process.

Like most investors, you are also looking for a property that will have good cash flow and appreciate over time. I suggest looking for a home in a high demand area with easy access to the major roadways, employment areas, activities, shopping, etc. I have selected some homes for us to view that in my opinion would satisfy these criteria. Currently, a 3 bed x 2 bath in these areas would rent for around $1,000 - $1250 a month. Once you narrow down the list to say 2 or 3 properties I will get more specifics on rental data.”

Even though Jahaan has been relatively quite you can sense that she is the decision maker, so when she says, “That is really good Jahaal!” you know you are on the right track.

Gradually you have been gaining credibility; they can see that you have dealt with foreign buyers before. You are knowledgeable and helpful and have put them in a comfortable frame of mind. Their confidence in you has soared and they now recognize you as the professional you are.

Remember, while a sale is your immediate priority, your overall goal is to get them to be your ambassadors to their many friends & families. You cannot pay for that type of advertising!

I know since it’s summer, we’ve been discussing safety basics and we will resume that next month. But in today’s newsletter, I must address this violent trend going on in our industry. Already in 2011 we have seen a 40% increase in crimes in our industry compared with all of 2010. This past year has been the most violent year in real estate in all my 26 years of teaching safety to REALTORS®. Your safety is important to me, so here are some basic safety reminders.

1. Showing Your Listings

When a client calls from one of the houses you have listed, please do not go over to the house. Have that client meet you somewhere public, like Starbucks, McDonald’s or a gas station parking lot. Meeting the client at the property is simply dangerous and has been proven to be life ending.

2. Driving with Clients in Your Car

This service should have disappeared with the horse and buggy. However, if it is absolutely necessary, please have someone else ride with you.

3. Listing Appointments

Going over to someone’s home alone who you do not know and have only spoken to over the phone is not a good choice. Just because all the information they gave you checked out, doesn’t mean it’s safe. Your going over to a listing appointment by yourself is like playing Russian roulette with a gun. Please take someone with you.

4. Social Media

Social media is a wonderful thing. However, you are in the people business, so please be mindful of the images you project to the world. Pictures of you relaxing with family and friends at your pool is not the professional image you want to present. Neither is posting messages about the wonderful vacation you’re on or that you’re bored, sitting at an open house by yourself.

I realize my tone may be a bit harsh, but your safety is important to me and I want you to just be safe!
