At the close of the auction the deposits of earnest money made by the unsuccessful bidders shall be refunded to them against the production of receipts of such deposits. 4. The licence shall be granted to the bidder who shall undertake to manufacture the highest quantity of liquor of 25% under proof or corresponding quantity of lesser strength after full payment of bid amount. 5. The amount of duty payable on the quantity of liquor undertaken to be produced by the bidder shall be paid by him in two equal installments. The first installment shall be paid by the bidder on the spot as soon as the bid is accepted and 2nd installment shall be paid by him within fifteen days from the date of acceptance of his bid. 6. The successful bidders shall withdraw the earnest money deposits in the same manner as above within 10 days after the payment of first installment of the bid amount. 7. A bidder shall not be allowed to transfer the bid once the right to manufacture the highest quantity of liquor is adjudicated to him/her. 1 2 3

2. No bidder shall be admitted to the auctionunless he/she makes a deposit of Rs. 100/- as earnestmoney separately in respect of each zone. Theearnest money can be deposited in the Departmentbetween 20th January, 2014 to 24th January, 2014and thereafter deposits shall also be accepted atthe place of auction before commencement ofauctions of respective Talukas zone.

3. At the close of the auction the deposits ofearnest money made by the unsuccessful biddersshall be refunded to them against the production ofreceipts of such deposits.

4. The licence shall be granted to the bidderwho shall undertake to manufacture the highestquantity of liquor of 25% under proof orcorresponding quantity of lesser strength after fullpayment of bid amount.

5. The amount of duty payable on the quantity ofliquor undertaken to be produced by the biddershall be paid by him in two equal installments. Thefirst installment shall be paid by the bidder on thespot as soon as the bid is accepted and 2ndinstallment shall be paid by him within fifteen daysfrom the date of acceptance of his bid.

6. The successful bidders shall withdraw theearnest money deposits in the same manner asabove within 10 days after the payment of firstinstallment of the bid amount.

7. A bidder shall not be allowed to transfer thebid once the right to manufacture the highestquantity of liquor is adjudicated to him/her.

8. Attention to the bidders is drawn to theprovision of Rules 76 of the Goa Excise Duty Rules,1964. In case the licensee refuses to pay for thejuice supplied by cashew extractors or fails to obtainsuch supply from the cashew juice extractors forany reasons whatsoever, he shall not be entitled toclaim for refund of duties on these grounds andtherefore, the responsibility of getting the juice fromzones bided shall fully rest upon him/her.

9. In event of failure to comply with the aboveconditions and the provisions of Rules 72 bid orfailure to pay the first installment of the bid amountas required by sub-rule (3) of Rules 71, the earnestmoney of Rs. 100/- deposited by the bidder withreference to sub-rule (4) of Rules 72 shall beforfeited. If second installment of bid amount is notpaid within the period of 15 days as prescribedabove, the first installment paid shall be forfeitedin favour of the Government. Any loss in ExciseDuty caused to the Government by reason of freshauction being held as result of non-payment of theinstallment, shall be recoverable from the firstbidder as an arrears of land revenue.

10. As per the Goa (Excise Duty) Rules, 1964 theaccepted bidding price shall be the amount ofExcise Duty for the zone put to auction and norefund shall be admissible if the duty assessed onthe production in such zones is less that amount ofthe highest offer.

AFTER THE DUTY HAS BEEN PAID BYSUCCESSFUL BIDDER HE/SHE SHALL DECLAREWITHIN 5 DAYS THEREFROM TO THE EXCISEINSPECTOR OF THE RESPECTIVE TALUKA THENUMBER OF STILLS AND THE PLACE WHERE HE//SHE SHALL WORK THEM AS REQUIRED UNDERRULES 73 OF THE GOA EXCISE DUTY RULES, 1964.

The price of cashew juice for the purpose of Rules76 of the Excise Duty Rules shall be Rs. 3.50 perlitre and Rs. 2.50 per kilogram of ripe cashew appleswithout seed conveyed vide letter No. 1/11/78-Fin(R&C) part dated 11-11-2013.

The licensee shall make use of proper vessels forstorage of cashew juice and distilled liquor anderect proper still apparatus for distillation. No coaltar barrels will be used at any stage. The licenseeshall maintain a register in terms of Rule 78.

The Licensee shall be subject to the provisionsof Goa (Excise Duty) Act, 1964 and Rules madethereunder as amended from time to time.

CONSTITUTION OF SHREE NAGNATHBHUMICA VETAL PANCHAYATAN

DEVASTHAN,SITUATED AT AGARWADO, PERNEM-GOA

Article No. 1: The name of the temple shall be“Shree Nagnath Bhumica Vetal PanchayatanDevasthan”.

Article No. 2: That the activities of theDevasthan shall be regulated by the Members ofthe Devasthan Committee in consultation//co-operation from the Mahajani which shall bemandatory.

Article No. 3: That the properties of theDevasthan such as monies, movable and immovableaccruing out of donations, purchase, fund raising,sale, assignments, bequest, transfer, gift, etc., shallbelong to the Devasthan.

Article No. 4: The management and control ofthe Devasthan shall vest absolutely with theMahajans thereby constituted who shall functionas per the terms and conditions mentioned below.

Article No. 5: That after formation of theMahajani, the Mahajans shall maintain a register ofmembers of “Shree Nagnath Bhumica VetalPanchayatan Devasthan” with up-to-date list of thenames, date of the entry as a member, and theaddresses of the members along with the age andthe Mahajan shall have to pay a prescribed feewhich shall be decided by the Mahajans and theMahajans shall have the power to revise the feesstructure as and when they feel it is required.

Article No. 6: That any person wanting to be anew member of the Devasthan, shall apply to theMahajani in writing along with the prescribedpayment and other details as decided and approvedby the Mahajans.

Article No. 7: It shall be mandatory for all themembers of the Devasthan to form a corpus fromamongst whom the future Mahajans shall beelected and with which corpus or body, all theresiduary powers not specifically mentioned in thisinstrument but conferred by Devasthan RegulationAct.

Article No. 8: The following shall be the aims,objects and duties of the Mahajani:-

a. To undertake and encourage religious, culturaland social activities.

b. To conduct satsangh and impart bhakti margand to carry on the activities of welfare ofmembers.

c. To felicitate students and persons of merit andoutstanding nature who have contributed forthe upliftment of the social activities of thefamilies of Shree Nagnath Bhumica VetalPanchayatan Devasthan.

d. To co-operate with the Shree NagnathBhumica Vetal Panchayatan DevasthanCommittee to celebrate customary functionsas follows:-

i. Divjotsav.

ii. Varshik Jatrosav.

iii. Vardhapan day of Shree Nagnath.

iv. Tulsi Vivah.

v. Holi.

vi. Drama on the Vardhapan day.

vii. Palki of Divjoysav, Jatra and Vardhapanday.

viii. Vadval.

ix. Continuation of Bhajan every Monday.

x. Satyanarayan Pooja.

xi. Baska.

Any other programme with the approval of theDevasthan Committee.

Article No. 9: A person may qualify as aMahajani if the following conditions are fulfilled:-

a. The individual has to complete 18 years of hisage.

b. The individual shall be a member of “ShreeNagnath Bhumica Vetal PanchayatanDevasthan”.

c. He should be of sound health.

d. He should not be involved in any unlawful//illegal activities which is detrimental to theinterests of the Devasthan.

Article No. 10: A person may be disqualified asa Mahajani under the following conditions//circumstances:-

a. If he is suffering from any disabilities withrelation to his capacity to enter into contracts.

b. If he is charged with any criminal offence or ifinvolved in any immoral activities.

Article No. 11: A person shall have to fulfill//comply with the following conditions to be amember of the Mahajani:-

a. He shall have to be an Indian National.

b. He shall pay prescribed membership fee asdecided by the committee from time to time.

c. Yearly Membership Fees shall have to be paidby the 4th day of the month of January for thecalendar till 31st December of the same year.

d. Upon complying the condition under Article11 sub-clauses a and b, he shall be enrolled inthe register so maintained by the Devasthan.

Article No. 12: Election to the Mahajani.

a. Election to the governing body shall be heldon 3rd August every year.

b. Any Mahajan who fulfills conditions underArticle 11 can contest the Election providedhis name is found registered in the register ofMahajan.

c. Any Mahajan whose name is mentioned in theregister shall be eligible to contest the electionand shall have a right to vote.

d. Any member violating provisions of Article 10cannot contest the election.

e. Voting shall be by raising of the hands or secretballot in the circumstances of the case.

f. Election shall be held on a day stipulated bygiving prior notice of a month mentioning theagenda, date, time and place of election.

g. The election shall be held on the day fixed forgeneral body meeting which shall form aquorum of 3/4th of the members.

h. In case the quorum is not fulfilled the electionshall be conducted after waiting for 30 minutesfrom the original time fixed for the meetingand in this case the members present shall beconsidered as the required quorum and theelection be held.

i. The election of the members of the governingbody shall be the Mahajans and maximum 15members shall be elected from the voters list.

j. The President, Secretary and Treasurer shallbe elected by the members of the GoverningBody.

Article No. 13: Governing Body.

a. The Mahajans shall elect the members of theGoverning Body.

b. The Governing Body shall consist thefollowing:-

i. President.

ii. Vice-President.

iii. Secretary.

iv. Joint Secretary.

v. Treasurer.

vi. Joint Treasurer.

vii. And 9 other members.

c. The Mahajans shall elect the AdvisoryCommittee of seven members to advice theGoverning Body.

d. The President shall ordinarily preside over atall the meetings of the Mahajans and in hisabsence the Vice-President shall preside overthe meetings.

e. The chairman shall generally supervise theconduct and activities of the Mahajaniespecially in relation to the objects of theMahajani and take timely steps as deemednecessary for the due compliance of the duties,functions and procedures of the Mahajani.

f. The Tenure of the Governing Body shall be3 years from the date of election.

Article No. 14: Role/Duties of the Secretary.

Subject to general supervision of the Presidentand specific directions of the Mahajans, theSecretary shall conduct correspondence andother normal affairs of the Mahajani, writeminutes books at meetings and similarly issuethe notices of meetings.

Article No. 15: Role/Duties of the Treasurer.

a. He shall be in charge of money matters.

b. Treasurer shall keep the book of accounts,prepare annual statements of accounts.

c. Money received by the Mahajani shall bedeposited in the bank within 24 hours or incase of unavoidable circumstances within48 hours and any lapse should be necessarilynoted in a special book of irregularity and thetransactions and explained at the next meetingof the Mahajani.

Article No. 16: Income and Expenditure.

a. The official accounting year for the Mahajanishall be from the 1st of April to 31st March ofthe following year.

b. Within one month of the closing of everyaccounting year, the Mahajans shall keep onrecord the statement of income andexpenditure of the Mahajani for that year andthe balance sheet at the close of the year, dulycertified by the qualified auditors and signedby the President, Secretary, Treasurer togetherwith a statement of report of the activities ofthe Mahajani during the year signed.

c. Mahajans shall receive donations, assistancein the name of “Shree Nagnath Bhumica VetalPanchayatan Devasthan”, for which thecommittee shall issue the receipt to that effect.

Article No. 17: Accounts.

a. In addition to the activities and deeds asmentioned in Clause 12 above, the Mahajansshall maintain and operate accounts in anyNationalised Bank as per the decision of theManaging Committee.

b. The account of the Mahajani shall be operatedjointly under the signatures of three persons,namely, the President, Secretary and Treasurer.

c. The Governing Body shall have power towithdraw cash to a maximum limit ofRs. 25,000/- per annum for the affairs of theDevasthan.

d. Large and huge amount to be invested and/orspent shall have to be first approved by theGeneral Body.

Article No. 18: Conduct of Meetings.

a. The meeting of the Governing Body of theMahajani shall be held every 2 months in acalendar year.

b. The Governing Body of the Mahajani can callfor urgent meeting if the issue to be decidedis urgent in nature.

c. The General Body Meeting of the Mahajanishall be held once in a year, however specialgeneral body meeting may be called in case ofurgency.

d. The Notice for General Body Meeting shall beissued by the Secretary thereby affixing thenotice on the door of the office of the Mahajani//Devasthan or shall affix the same on anyconspicuous place, or by publishing the samein the local newspapers like Gomantak or TarunBharat or in any other newspaper as decidedby the committee.

e. For the Mahajans meeting, at least 1/3rdMahajans shall have to be present to form aquorum.

f. For the formation of a quorum for the GeneralBody Meeting of the Mahajani, there shall beat least 1/3rd of the Committee present.Quorum will be considered after waiting for 30minutes from the scheduled time of themeeting.

Article No. 19: Power of the Mahajans to makerules.

Considering the effective carrying out of theobjects of the Mahajani, the Mahajans may fromtime to time make rules not inconsistent withthe aim and object of the Devasthan RegulationAct and the same shall be recorded in aseparate rule book.

Article No. 20: Death, Resignation, Mentalincapacity of Mahajan.

In the event of any Mahajan or Mahajansresigning, dying or being mentally incapa-citated or when his office otherwise falls vacantin the middle of the term, the other servingMahajans shall have the power to nominateany member who is capable of being electedto act as a Mahajan for the remainingunexpired duration of the term of the vacatingtrustee.

Article No. 21: Powers of a Nominated Mahajan inthe event of Death, Resignation, Mental incapacityof Mahajan.

The Mahajan nominated under the precedingArticle 20, shall have the same powers andobligations as the other elected Mahajans andsuch nomination of the new Mahajan shall beratified in the first meeting of the memberstaking place immediately after suchnomination.

Article No. 22: Remuneration, Reward orHonorarium for services.

The Mahajans shall not be entitled to anyremuneration, reward or honorarium for theservices. However they would be entitled toany reimbursement of the bare costs andexpenses necessarily incurred by them in thecourse of the business of the Devasthan or metby them from their personal funds and shall beapproved by the Governing Body, howeverpayments of pujari or of any other person other

than the Mahajan shall be paid from the fundof the Devasthan after deciding the same inthe meeting.

Article No. 23: Dissolution, winding up of aMahajani.

In the event of dissolution or winding up ofthe Mahajani the assets remaining as onthe date of dissolution shall under nocircumstances be distributed among theMahajans/members of the Governing Body,Managing Committee but the same shall betransferred to another Mahajani, society toassociation or institution whose objects aresimilar to those of this Mahajani.

Article No. 24: Powers and Functions of the GeneralBody.

a. To approve annual expenditure and budget ofthe Devasthan and appoint Audit Committee.

b. To approve any new project of construction//development under Government or PrivateParty Scheme.

c. To fix annual contribution of Mahajans.

d. To approve and decide about the major issuesin the interest of the Devasthan.

Article No. 25: Miscellaneous/General Provisions.

a. The funds of the Mahajani shall be invested inthe modes specified under the provisions ofSection 13 (1) (d) r/w section 13 (5) of the IncomeTax Act, 1961.

b. Mahajani is irrevocable.

c. The objects of the Mahajani shall be achievedwithout involving any activities of profit.

d. The funds of the Devasthan shall be solelyutilized for the purpose of the Devasthan andno portion of it shall be used for payment ofbonus, dividends and profit to the Mahajans.

e. The Mahajans, their members of the family andtheir relatives shall not be entitled to thebenefits of the Mahajani.

f. The benefits of the Mahajani shall be availableto all irrespective of caste, community, creedand religion.

Article No. 26: Jurisdiction.

The Jurisdiction of this Mahajani/Devasthanshall be for the entire State of Goa.

Article No. 27: Residuary.

In cases not anticipated or covered under theArticles of the Mahajani, the provisions of theDevasthan Regulation Act shall apply.

The driver will proceed futhervia the lane made with barricading fromFatorda Stadium towards Fatorda Chapeljunction and will turn right to proceed towardsSwimming Pool Circle and after reaching therethey will take left to park their vehicles atRavindra Bhavan premises. In case parking isfull inside Ravindra Bhavan parking lot, theywill proceed towards South Goa CollectorateOffice (inside premises of Mathany SaldhanaAdministrator Complex) via Old Market Circle,KTC Margao, etc.

3. The route for VVIP will be from Ambajijunction towards Fatorda Stadium andvehicles will enter through the Gate No. 1and their Car Carcade will be parked insidestadium on VVIP parking lot. (Around 15 VVIPcars only).

4. The stretch of Padre Pedro Ferrao Road fromSilva Bar at Ambaji junction to Fatordajunction will be closed for general traffic. Onlythe local residents with passes and VIP’s withcar passes will be allowed to enter.

5. The SH-5 road will be divided with barrica-ding from Fatorda junction to Swimming PoolCircle as “One way lane” used for pedestrianmovement and VIP cars movement.

6. Vehicular traffic coming from Ponda/Raia//Eastern Bypass road will be segregated atArlem junction. The general traffic will bediverted on the Nuvem Bypass/EasternBypass to proceed for their onward journey//destination towards South Goa. Only ticketholder vehicles/accredited vehicles will beallowed to proceed towards Fatorda Stadiumside upto Sincro Hotel junction and furthertheir vehicles will be diverted towards DonBosco College side for parking.

7. The general public ticket holders from Northside i.e. Vasco/Panaji/Mapusa side (NH-17) willbe allowed to park their vehicles near KTCBus Stand, Margao. From KTC Bus StandShuttle Buses for transportation to PJNStadium will be made available (To ferrygeneral public coming for events) and theywill be dropped off near Swimming Pool Circle(Ravindra Bhavan). The driver of these ShuttleBus Service will take turn at Swimming PoolCircle and proceed towards KTC Margao.

8. The general public ticket holders from Southi.e. from Quepem/Cuncolim/Colva, Margao city(South side) will enter through Abade FariaRoad, Old Market Circle and will take “U”turn at KTC Margao to proceed towardsSGPDA Market and will park their vehicleson SGPDA Ground near Osia Multiplex.

9. All the other Buses (School or any other)coming for Opening/Closing Ceremony willbe parked near KTC Bus Stand, Margao.

10. The general ticket holders coming with their2 Wheelers will take diversion at Old MarketCircle and park their vehicles at Holy SpiritChurch Ground.

11. The Athletes/Players Buses coming fromdesignated Hotels will enter from Old MarketCircle and will be dropped off near theSwimming Pool entrance road and their buseswill be parked at SGPDA Market Pickup Stand.

12. Fatorda bound vehicular traffic coming fromMargao city will be stopped at Borda nearEurico Silva house and diverted via BolsheBig Foot Circle-Eastern Bypass for theironward journey.

13. Local Buses proceeding to and coming fromPonda/Borim side will be diverted to take theroute via Borda/Eastern Bypass/NuvemBypass for their onward journey/destination.

14. On the day of the Opening and ClosingCeremony, the Mumbai Bus Stand will betemporarily shifted from the KTC Bus Stand tothe old Bombay Bus Stand situated on thewholesale Fish Market road, Madel-Margao.

15. The small stretch of road from Davandem toArlem will be temporarily closed withbarricading till the end of Ceremony/Event.

16. The Agali-Fatorda junction near Modern Clinicwill be closed and only pass holders and localresidents with passes will be allowed.

(6) The persons other than the applicant winningthe bid should deposit one year’s lease rent andalso double the costs incurred by the applicant forprocessing the file on the spot. The EMD in such acase will be adjusted against the above payments.In case successful bidders fail to deposit one year’slease rent and double the costs incurred by theapplicant for processing the file on the spot, insuch a case the EMD deposited shall be forfeited.In such case the second highest bidder and so onwill be considered for acceptance of their bids andfulfillment of payment conditions as laid down.
