    L.P. ORDINANCE NO. 20 - 30 AN ORDINANCE AMENDING THE 2020 BUDGET AND ADOPTING THE 2021 BUDGET OF THE LIVINGSTON PARISH PRESIDENT-COUNCIL RELATIVE TO THE GENERAL FUND, SPECIAL REVENUE FUNDS, DEBT SERVICE FUNDS AND CAPITAL IMPROVEMENT FUNDS.

    BE IT ORDAINED by the Livingston Parish Council, governing authority of Livingston Parish, State of Louisiana, convened in legal session, that the amended 2020 budget for the fiscal year beginning January 1, 2020, and ending December 31, 2020, of the Livingston Parish President-Council, and the 2021 budget for the fiscal year beginning January 1, 2021, and ending December 31, 2021, of the Livingston Parish President-Council, adopted by ordinance 20-__ on December 3, 2020 are hereby adopted by title as if set out herein in full as follows: SECTION 1. The detailed estimate of revenues for the General Fund, Special Revenue Funds, Debt Service Funds and Capital Improvement Funds for the fiscal year beginning January 1, 2020 and ending December 31, 2020, and for the fiscal year beginning January 1, 2021 and ending December 31, 2021, are hereby adopted to serve as an Operating Budget of Revenues for the President-Council during the same respective period. SECTION 2. The estimates of expenditures by department for the General Fund, Special Revenue Funds, Debt Service Funds and Capital Improvement Funds for the fiscal year beginning January 1, 2020 and ending December 31, 2020, and for the fiscal year beginning January 1, 2021 and ending December 31, 2021, are hereby adopted to serve as a budget of Expenditures for the President-Council during the same respective period. SECTION 3. The adoption of the budget of expenditures be and the same is hereby declared to operate as an appropriation of the amount herein set forth within the terms of the budget classifications. SECTION 4. Amounts are available for expenditures only to the extent included within the 2020 and 2021 budgets. SECTION 5. Any adjustment made to the budget during the fiscal year should adhere to regulation set forth in Section 5-04 of the Livingston Parish Home Rule Charter. SECTION 6. Capital Improvement Funds budgets unexpended appropriations are carried over to the next fiscal year until the project is completed or abandoned or five fiscal years end from the inception of the original budget for the project. SECTION 7. The Parish Council may from time to time authorize grant applications, additional borrowings and or bonded debt for the Livingston Parish Government. These funds, estimated at more or less one dollar, are hereby included within the operating budget in the appropriate funds. SECTION 8. Amounts restricted at year end are hereby rolled over to the next fiscal year. SECTION 9. Whereas the general administrative offices of the parish provide oversight, financial controls, and other necessary services for the various funds identified in the parish’s budget and administered by the parish; Whereas these funds could not function without someone providing these services such as banking, accounts payables, payroll, purchasing, reporting, grants management, etc.; Whereas administrative controls provide assurances of compliance with federal, state, and parish laws, ordinances, rules, and regulations; Whereas all of the above constitute necessary costs of administering the parish funds; Therefore, the parish shall develop an administrative fund as a special revenue fund to capture these costs and bill a fair administrative fee to these funds for the services provided. For grants which prohibit the inclusion of various costs, such as an elected official’s salary and benefits, these costs shall be excluded from the necessary costs for that grant. For those grants with a state or federal cap on these types of costs, e.g. a state cap of 2% on certain pass-through funds, the cap shall not be exceeded. The Livingston Parish Utility Fund is an Enterprise Fund Type because of fees for service. A budget is not required on Enterprise Fund Types.

    The following ordinance, which was previously introduced in written form at a regular meeting of the Parish Council on November 12, 2020, a summary thereof having been published in the official journal together with a notice of public hearing which was held in accordance with said public notice, was brought up for final passage December 3, 2020, on motion of Gerald McMorris and seconded by Jeff Ard:

    L.P. ORDINANCE NO. 20 - 31 AN ORDINANCE TO AMEND SECTION 46-5 - PERMIT FOR LOGGING OPERATIONS REQUIRED; VIOLATIONS; PENALTIES - OF CHAPTER 46 – MOTOR VEHICLES AND TRAFFIC, PARAGRAPH (e) EFFECTIVE DATE, AS MORE FULLY SET OUT HEREIN.

    WHEREAS, the Livingston Parish Police Jury adopted Ordinance of 9-27-1988, as amended and reenacted by a motion of 10-19-1988, setting forth Permit for logging operations required; violations; penalties; in the Code of Ordinances of Livingston Parish; and WHEREAS, the Livingston Parish Police Jury established in said ordinance that the annual permit shall run from October 1 through September 30 of each year; and WHEREAS, the Livingston Parish Council now finds it advantageous to issue the Permit for logging operations for the period January 1 through December 31 of each year to coincide with the Parish fiscal year. NOW, THEREFORE, BE IT ORDAINED by the Livingston Parish Council, the governing authority of the Parish of Livingston, State of Louisiana, that Chapter 46 of the Code of Ordinances of Livingston Parish, Section 46-5(e) be amended to read as follows: (e) This Section of the Code of Ordinances of Livingston Parish, Louisiana, shall be effective throughout the unincorporated areas of the Parish. The annual permit shall run from January 1 through December 31 of each year. BE IT FURTHER ORDAINED that the effective date of this ordinance shall be as prescribed by law. The above and foregoing amendment to the Code of Ordinances of the Parish of Livingston, having been properly introduced and published by title, was thereupon submitted to a vote; the vote thereon was as follows:

    WHEREAS, the Livingston Parish Council has been awarded Federal assistance under the Hazard Mitigation Grant Program; and

    WHEREAS, the following eligible property owner has voluntarily elected to participate in the program; and

    THEREFORE, BE IT RESOLVED, that the Livingston Parish Council will acquire the following property:

    1. Homeowner: Address: 505 Centerville NW Street Denham Springs, LA 70726 Appraised Value: $51,000.00 Amount Offered: $31,250.00 Legal Description: Lot Y, Section 58, T6S, R2E Denham Springs, Louisiana 70726 BE IT FURTHER RESOLVED, that the duly elected Parish President of Livingston Parish is authorized to sign any and all documents related to the acquisition of said property pursuant to the Hazard Mitigation Grant Program Project Number FEMA-4277-DR-LA-0124- Livingston Parish.

    The Athletic/Staff Committee met in the School Board Office Conference Room on Thursday, November 5, 2020, at 4:30 PM. Committee Members present: Chairperson Mr. Devin Gregoire, Ms. Kellee Dickerson, Mr. Brad Harris, Mr.

    Cecil Harris Board Members present: Mr. Jeff Cox, Mr. Bo Graham Others present: Superintendent Alan Murphy, Assistant Superintendent Jody Purvis, Special

    Education Director Dr. Eric Penalber and others Chairperson Devin Gregoire called the meeting to order and stated that the purpose of the meeting was for discussion and action on the following:

    A. SPED Interpreter Proposal

    Dr. Eric Penalber presented a proposal to increase the salary of SPED interpreters. There are currently nine interpreters employed in the district, and two interpreters provided through an agency at a significant cost to the district. The new salary schedule will be created to fill the positions currently outsourced to an agency and recognize the different levels of certification for interpreters. This new salary schedule will be conducive in attracting and retaining qualified SPED interpreters. Following the discussion, a motion was offered by Ms. Dickerson, seconded by Mr. Cecil Harris to approve this cost saving measure with the creation of the new SPED Interpreter Salary Schedule. The vote was unanimous to present to the full Board for approval. A motion was offered by Ms. Dickerson, seconded by Mr. Brad Harris to adjourn the meeting. The motion carried.

    There being no further business before the Committee, the meeting adjourned.

    WHEREAS, GEORGE BAKER dedicated his life to the service, rescue and protection of others; often placing the welfare of strangers before that of his friends and family, ultimately making the greatest sacrifice of all on May 24, 2020; WHEREAS, GEORGE BAKER was born on October 1, 1986 to George and Audette Baker, making Albany, Louisiana his home for years to come; WHEREAS, GEORGE BAKER graduated from Albany High School in 2005, where he was the consummate student-athlete, excelling in football, in baseball, in the classroom and throughout campus; WHEREAS, GEORGE BAKER, in addition to his achievements on the campus of Albany High School, was already beginning his life of service and sacrifice at the age of 16, when he ran calls for the District 11 Fire Department, comforting many within the district; WHEREAS, GEORGE BAKER continued to answer the call to service, proudly joining and serving his country in the United States Marine Corps Reserve Unit 3/23 Weapons Company. He served his country and its citizens for six (6) years, even serving a one (1) year tour overseas in Operation Iraqi Freedom. He was honorably discharged with a rank of Corporal. WHEREAS, after having been deployed, GEORGE BAKER answered another call to service and became a law enforcement officer. He was recognized as Officer of the Year for the Greensburg Police Department in 2013. He also served as a deputy for the St. Helena Parish Sheriff’s office, rescuing countless members of the community during the Great Flood of 2016, and eventually being promoted to K-9 Deputy. He worked alongside his K-9 partner, Gundy, for the next several years. WHEREAS, GEORGE BAKER once again reaffirmed his life of sacrifice and service, graduating from the Louisiana State Police Trooper Academy on March 23, 2018—a member of Cadet Class 97. He worked tirelessly at becoming the best state trooper he could be, embodying all that is good in law enforcement. WHEREAS, GEORGE BAKER made his final call on May 20, 2020, as he was critically injured in the line of duty, succumbing to those injuries on May 24, 2020. He was posthumously awarded the Life Saving Award, and his LSP number was retired with the Louisiana State Police. He continued his life of service and sacrifice through organ donation, insuring that he will live on in the hearts, minds and memories of others.

    WHEREAS, GEORGE BAKER married the love of his life, Heather Gandolfo Baker, on November 22, 2014, after a lifetime of friendship. He and Heather were blessed with a beautiful daughter, Harper Baker. May this honor be a reminder to his wife, his daughter, and our community of the courageous, caring, selfless, and noble man that was GEORGE BAKER. WHEREAS, the Livingston Parish School Board wishes to establish an enduring reminder and to celebrate the life, contributions and sacrifice of GEORGE BAKER to the Albany community, Livingston Parish, the State of Louisiana and the Untied State of America;

    THEREFORE, the Livingston Parish School Board does hereby honor and commemorate the lifetime of service and sacrifice of GEORGE BAKER by naming the Albany High School baseball field the “GEORGE BAKER MEMORIAL BASEBALL FIELD”, to bear her name in perpetuity.     The Livingston Parish Government has secured funding through FEMA & GOHSEP for the August Flood (DR-4277) Hazard Mitigation Grant Program for wind retrofitting of four critical facilities in Denham Springs, Livingston Parish. The parish is interested in procuring the services of an engineering firm. The selected firm will provide professional engineering services to complete studies, environmental and necessary permitting and to prepare engineering design plans and specifications for the Denham Springs Critical Facilities Wind Retrofits Project.
