Background Local Governments are empowered under a number of State Government Acts to perform certain duties and exercise certain powers. Local Government also has the ability to delegate some of these powers and duties to their Chief Executive Officer, certain other Officers or to Committees in order to expedite their implementation. A requirement of Councils’ delegating their authority is that a register of delegations is maintained and reviewed annually. A list of all of Council’s previous delegations is provided at Schedule 8.1(a). Statutory Environment Local Government Act 1995 Sections 5.16 and 5.42 empower Council to delegate. S5.46 (2) requires an annual review of delegations. The Act allows the Chief Executive Officer to sub-delegate any of his/her powers to another employee; such sub-delegations must be done in writing. The Chief Executive Officer is also permitted under the Act to place conditions on any sub-delegation passed onto another staff employee. Policy Implications Many of Council’s existing Policies also reflect delegations and there will be some minor over-laps until a full review of the Policy Manual has been undertaken. These over-laps will not create any logistical problems for Council operations. Strategy 5.2.2 Ensure compliance with all relevant legislation and regulations.

Voting Requirements Section 5.46(2) states Council must review the Delegation Register annually; however, if no amendments are made to the existing register a simple majority can accept it without amendment.

Section 5.42 (1) states any decision to amend or revoke a delegation by a Local Government is to be by an absolute majority.

Comment The Delegation Register formalises Council’s “day to day” functions/operations and minimises the potential for the Council to being legally challenged for possible breach of the Local Government Act and associated Regulations. The attached revised Delegation Register has had all recommended amendments highlighted in YELLOW. All amendments are simply title changes due to the revised Organisational structure or those required by subsidiary legislation (e.g. Building Code, Planning Act, etc.) OFFICER’S RECOMMENDATION Council hereby resolves the revised Delegation Register as presented is adopted as it is considered appropriate to ensure good governance by the local government. ……………………………………..(Author) …………………………………(Manager/CEO)

1009 Delegation Subject Policy on Legal Representation – Cost Indemnification

Function to be performed: Council has adopted a Policy on Legal Representation and Cost Indemnification. The Chief Executive Officer is delegated authority in accordance with Clause 6 of the policy as follows: - 6. Delegation to Chief Executive Officer 6.1 In cases where a delay in the approval of an

application will be detrimental to the legal rights of the applicant, the CEO may exercise, on behalf of the council, any of the powers of the council under clause 5.1 and 5.2, to a maximum of $5,000 in respect of each application.

6.2 An application approved by the CEO under clause 6.1,

is to be submitted to the next ordinary meeting of the council. Council may exercise any of its powers under this Policy, including its powers under clause 5.4.

1010 Delegation Subject Local Laws Administration

Function to be performed: A local government is to administer its local laws and may do all other things that are necessary or convenient to be done for, or in connection with, performing its functions under the Local Government Act 1995.

1011 Delegation Subject Functions Outside Own District

Function to be performed: A local government may perform its executive functions outside its own district, but before it can do anything on land outside its own district that is not local property of that local government, it is required to have obtained the consent of:

(a) the owner of the land; (b) if the land is occupied, the occupier of the land; and (c) if the land is under the control or management of any

other person, that other person.








1012 Delegation Subject Performing Executive Functions

Function to be performed: In performing its executive functions, a local Government, so far as is reasonable and practicable, is to ensure that:

(i) the lawful use of any land, thoroughfare or premises is not obstructed, and any reasonable request that a person makes to avoid such obstruction is met.

(ii) as little harm or inconvenience is caused and as little damage is done as is possible.

(iii) danger to any person or property does not arise from anything done on land.

(iv) anything belonging to it, or to a person who has exercised a power of entry on its behalf, that has been left on any land, is removed as soon as practicable.

(v) buildings, fences, and other structures are not disturbed or damaged.

(vi) when it enters land that is fenced, it enters through the existing and usual openings in the fence unless it is expressly authorised to open the fence, and

(vii) any physical damage done to any land, premises or thing, is immediately made good unless compensation has been or is to be paid.

Function to be performed: A local government can authorise a person to issue and enforce owners or occupiers to do anything prescribed in Schedule 3.1 - Powers under Notices to Owners and Occupiers of Land.








1014 Delegation Subject Emergency Entry to Land

Function to be performed: In an emergency a local government may lawfully enter any land, premises or thing immediately and without notice and perform any of its functions as it considers appropriate to deal with the emergency as determined by the Chief Executive Officer.

Function to be performed: A local government may authorise an employee to remove and impound goods from a public place if the goods present a hazard to public safety or they obstruct the lawful use of any place.

Function to be performed: When any non-perishable goods have been removed and impounded under Section 3.39 the local government is required to either institute a prosecution against the alleged offender, or give the alleged offender notice that the goods may be collected from a place specified during such hours as are specified.

Function to be performed: If any goods have not been collected in accordance with a notice given the local government may sell or otherwise dispose of them.







1018 Delegation Subject Impounding Periods

Function to be performed: If any impounded goods have not been collected in accordance with a notice given under Section 3.41(1) within a period of:

• 3 days for perishable goods

• 7 days for animals

• 2 months for non-perishable goods (including vehicles) after the notice is given the local government may sell or otherwise dispose of them.

1019 Delegation Subject Impounded Goods – Cost Recovery

Function to be performed: If goods are removed and impounded under Section 3.39 and the alleged offender is convicted, the local government may, by action in a court of competent jurisdiction, recover from the alleged offender the expenses incurred by the local government in removing and impounding them and in disposing of them.

Function to be performed: A local government is to employ such other persons as the Council believes are necessary to enable the functions of the local government and the functions of council to be performed.

Function to be performed: If a person can inspect certain information, the person may request a copy of the information and the local government is to ensure that copies are available and that the price at which it sells copies does not exceed the cost of providing the copies.

2003.1 Delegation Sub-Heading Temporary Road Closures

Function to be performed: The Chief Executive Officer is delegated authority to temporarily close a thoroughfare or a portion of a street for a period not exceeding 28 days (without providing local public notice) of the opinion that by reason of heavy rain a street is likely to be damaged by the passage of traffic generally or traffic of any particular class.

The Chief Executive Officer is delegated authority to close a thoroughfare for a period in excess of 28 days by providing local public notice in accordance with Section 3.50 of the Local Government Act 1995.








2003.2 Delegation Sub-Heading Public Notice of Road Closure

Function to be performed: Before it makes an order in accordance with Section 3.50 (1-3) of the Local Government Act 1995 wholly or partially closing a thoroughfare to the passage of vehicles for a period exceeding 4 weeks the local government is to give local public notice of the proposal inviting submissions.

In addition the local government is to give written notice to each person who either owns or occupies affected land or who is prescribed as having an interest.

A local government may close a thoroughfare to vehicles for up to 4 weeks without giving public notice.

Function to be performed: The Chief Executive Officer is delegated the authority to issue licences to deposit materials on a street, way or other public place and to excavate on land abutting or adjoining a street, way or other public place pursuant to Section 377 of the Local Government (Miscellaneous Provisions) Act 1960. The Chief Executive Officer should first obtain confirmation from the Environmental Health Officer/Building Surveyor and the Works Supervisor that the proposed activity will not create undue interference with the operation of the street, way or public place. application for approval, where the application is deemed not to comply with relevant scheme, policy and R Code provisions, or where an application seeks to vary or dispense with a scheme provision;

(vii) To vary the provisions of the ‘Northwater, Carnarvon

Residential Development and Design Standards’ applicable to single house development in the ‘Northwater Estate’ where provided for by the standards;

(viii) To grant approval to an application for a grouped or

multiple dwelling development, designated as an ‘AA’ use in the Residential zone under Table 1 of the scheme, and is deemed to comply with relevant provisions prescribed by the scheme and the ‘Acceptable Development’ provisions of the Residential Design Codes of Western Australia (the ‘R’ Codes).

determine whether the proposed use/development for which approval is sought falls within the classes of development exempt from obtaining approval pursuant to the scheme;

(iv)To effect the advertising of an application for approval

pursuant to clauses 8.2.2, and 8.2.3; (v)To determine and effect consultation with relevant

statutory authorities pursuant to clause 8.3.1; (vi)To grant approval to an application where the proposed

use/development is designated as a ‘IP’ use,‘P’ use or ‘AA’ use in Table 1 of the scheme, and is deemed to comply with relevant provisions prescribed by the scheme and a local planning policy. Background - Councillors are aware of the Carnarvon Space Festival to be held on 22nd and 23rd June 2012. Transportation of dignitaries, visitors etc has been arranged by SkyWest in the form of two charter flights, both flights are F50 Aircrafts. Both flights land on Friday 22nd and depart on Saturday 23rd. An application has been received from the Event manager of this event for council to waive the landing fees of these two flights. Councils current landing charges for an aircraft of this size is as follows

c) More than 15,001kg and less than or equal to 40,000kg, $21.75for each 1000kg or part thereof plus GST.

Discounted to $15.00/1000kg (GST Inc.) if Cash Payment is made into On-Site Honour Box

Statutory Environment Section 6.16 (2) of the Local Government Act 1995 enables the charging of fees for “….providing the use of, or allowing admission to, any property or facility wholly or partly owned, controlled, managed or maintained by the local government”. Fees and charges imposed or amended outside of the normal budget process must be advertised locally. Policy Implications - No existing Policy affected. Financial Implications - Loss of income to the value of approximately $913.15 Strategic Implications -

Voting Requirements Absolute Majority Comment Council is already committed to a reasonable amount of resources towards this project, however this waiver is still considered appropriate.
