The wide sidewalks found in Washington, DC, commercial areas are well suited for sidewalk cafés. Cafés are one of the best ways to activate city streets and enhance the character of neighborhoods. Sidewalk cafés are where residents and visitor can enjoy good food and good weather, while enjoying our beautiful city. The District encourages restaurants and other qualify‐ ing businesses to, wherever feasible, open sidewalk cafés. Since sidewalks are pri‐ marily intended for pedestrians and regu‐ lated by the District Department of Transportation (DDOT) as part of the city’s transportation network, the District reviews each sidewalk café application to make sure minimum requirements for clear sidewalks and seating are followed. This guarantees that cafés are a welcom‐ ing and safe addition to city streets. Regulations for Enclosed and Unenclosed Sidewalk Cafés Permit Requirements No person can operate a sidewalk café in public space until they are issued a Sidewalk Café Permit and a Certificate of Use for a café (DCMR 24‐301.2). Sidewalk café permits are issued to property own‐ ers only, and each application for a café must be signed and approved by the owner of the property abutting the public space to be occupied by the café (DCMR 24‐303.3). Seating Capacity Sidewalk cafés must have 15 square feet for every seat within their seating area. The number of seats within a side‐ walk café is determined by dividing the total square feet of the café by 15. (The Public Space Committee uses the standard for indoor restaurant seating established in the International Building Code, Section 1004.1 and 1004.2, Table 1004.1.1) Furnishing and Fixtures All furnishings and fixtures, such as chairs, tables, umbrellas, and lights, must be non‐permanent and removable within floor ceiling of the adjoining building, whichever is less (DCMR 24‐315.2, 24‐ 315.3, and 24‐315.4). Fences and Planters The height of a railing, fence, or planter (including vegetation) around a sidewalk café cannot be higher than 36 inches (DCMR 24‐315.5). Flooring Artificial turf, carpet, platforms, or any other surface cover in a sidewalk café is allowed on the floor area only when spe‐ cifically approved by the Fire Chief and the Public Space Committee (DCMR 24‐315.6). Approval Process Sidewalk cafés occupy public space that is typically set aside for pedestrians. To make sure the interest of the public is protected, applications are reviewed by multiple District agencies and the local Advisory Neighborhood Commission. The application process takes several weeks. While the District strongly supports sidewalk cafés in public space, applicants must meet minimum standards for an application to be approved. In some loca‐ tions public space constraints make it impossible to approve a sidewalk café. Sidewalk café permits are obtained from the DDOT Public Space Permit Office after approval by the Public Space Committee. To be considered by the Public Space Committee, all applicants must submit a completed public space application to DDOT’s Public Space Permit Office. The Public Space Committee meets on the 4th Thursday of each month ‐ meeting dates and deadlines for filing permits are posted on DDOT’s website. Café permits that comply with all regulations and have no outstanding issues may be approved on the Committee’s consent agenda. Some sidewalk cafés may need more than one permit: Public Space Sidewalk Café Permit for Rental ‐ all applications Sidewalk Café Certificate of Use from Director of the Department of Consumer and Regulatory Affairs (DCRA) ‐ all applications Building Permit (enclosed cafés only ‐ see DCMR 12: 314.3) Electric Permit (cafés with lighting or electrical fixtures – DC Electrical Code 110‐50, 410, 430) ABC license (sidewalk cafés serving alcohol) For More Information… Contact DDOT’s Public Space Permit Office at 202.442.4670 to learn more about sidewalk café application requirements and the Public Space Committee review process. lessthan10feetinwidthatallpoints.

However,thePublicSpaceCommitteehas

theauthoritytoapproveanadjacentpas‐

sagewaynolessthan6feet(DCMR24‐

204.1,204.2,and316.9).Iflocatedat

streetintersectionscafésmustprovide

clearanceof10feettothecorner.No

sidewalkcafésshallbewithin15feetofa

busstop,abusshelter,oraMetrorail

stationentrance(24‐311.6and24‐

311.7.7).

Theclearsidewalkspaceismeasured

fromthefarthestextendedportionofthe

sidewalkcaféfrontagetothecurblineor

thenearestobstruction,whicheveris

nearesttothesidewalkcafé.Forthepur‐

poseofdeterminingclearsidewalkspace,

trees,streetlightpoles,signpoles,fire

hydrants,andotherobjectslocatedonthe

surfacespaceareconsideredobstruc‐

parentmaterial.Tofurthermaximize

transparency,boththehorizontalandver‐

ticalstructuralmembersmustbenomore

than10incheswide(DCMR24‐210.2,24‐

Wallsandothermaterialsofanen‐

closedsidewalkcafémustbeofnon‐

combustibleorfire‐resistantmaterials.
