Rather than have anything to do with the French legislature’s recent banning of the Burka, the above formed part of evidence before an English Employment Tribunal in 2009. No doubt the Employment Judge hearing the above response from Tesco defending a claim for discrimination on grounds of religious belief, brought by a member of the “Church of Jediism” no less, wondered what on earth or indeed on any planet in the known universe, they had done to deserve ending up in that job.

Mr Jarvis claimed discrimination when Tesco ejected him from the branch when he refused to lower his hood. Seemingly any Jedi powers of persuasion failed on the Tribunal. He lost.

Pity even more the Tribunal Panel trying to keep a straight face hearing evidence from a flatulent employee trying to convince them that being excessively “windy” amounted to a disability under the Disability Discrimination Act – ie: substantially affected her ability to perform everyday activities. The unforgiving evidence from co-workers may have suggested that their ability to perform their day to day activities (work) was more adversely affected by their colleague’s unfortunate condition than was hers. She lost.

Compare that with the successful Claimant with a proven philosophical belief in climate change, who was, said the Tribunal, discriminated against because of his beliefs.

What is an employer, employment lawyer, or a Tribunal Judge to do? Hopefully the monster of a piece of new legislation coming in later this year will shed some light? The Equality Act 2010 is a codifying act – it collects and simplifies and expands the protection given to particular individuals that has evolved in separate acts, legal decisions, and a raft or Regulations since 1970.

Employers and certain providers of services will have greater responsibility to those with “protected characteristics” (gender, gender re-assignment, sexual orientation, age, race, religion and disability), and in certain circumstances, to those associated with protected persons, such as carers. Positive discrimination is also taken a step further, and equal pay legislation will have more bite than ever before.

Every day we hear appalling tales of genuine discrimination and humiliation. We can’t always prove it. We can’t always defend it. But the law recognises the need to prevent and remedy it. The Equality Act requires employers and employees to re-evaluate working practices and policies.

Having such protective legislation in a simplified form of one Act may help to discourage merit-less claims, and afford proper protection for employees and employers alike. But for flatulent Jedi’s – discrimination is serious, whatever galaxy you live in.

SIMPLY FULWOOD EDITORIAL Workhouses : An Historical Recollection

A few workhouses for the able-bodied poor were founded, from the late 17th century onwards, by local Acts. More were established under the Acts of 1722 and 1782. From 1722 parishes were allowed to farm out their responsibility for the poor to a contractor at a fixed fee. Gilberts Act (1782) allowed parishes to join forces in the erection of a workhouse, in an arrangement by which each parish paid the cost of maintaining its own poor but achieved savings by sharing the premises. The establishment of these 18th century workhouses is noted in the accounts of the overseers of the poor, but detailed records usually do not survive, since the operation was often let to contractors.

By the Poor Law Amendment Act of 1834 the whole of England and Wales was divided into unions of parishes, in each of which a board of guardians was elected to administer poor relief. These unions were often centred on a market town, and they sometimes stretched beyond county boundaries. The new Poor Law met with considerable opposition in the north of England. Each union built a workhouse to house those people who were in receipt of relief. Some unions merely took over existing workhouses, and others were slow to build their own. Contrary to the intention of the Act, the guardians often continued to pay relief to people who lived in their own houses. Workhouses gradually evolved into orphanages and hospitals, especially for the feeble-minded, the aged, and the infirm.

Workhouse WomenIn workhouses, families were split up and made to wear drab clothing deliberately intended to destroy individuality. A standard workhouse haircut also made them instantly recognizable if they went out in public. Inside they worked pointlessly at stone-breaking and oakum-picking. The situation gave rise to many philanthropic initiatives, such as the founding in 1878 of William Booth’s Salvation Army, which set up soup kitchens and hospitals to help the very poor. The old, the infirm, the handicapped and the able bodied poor were all accommodated together. Husbands and wives were separated into dormitories and not allowed to meet, and many children were housed separately from their parents on the premise of giving them a Christian upbringing.

Workhouse Children Orphaned and children of long term inmates were given basic education and training. And often from the age of 12 years, were apprenticed for up to seven years to work in the local community as domestic servants and farm labourers etc. where their masters were liable for their welfare. All able-bodied inmates, men, women and children were put to work locally or on onerous tasks such as scrubbing floors, laundry, breaking stones and picking Oakum.

In the mid-19th century some workhouses established schools for the children in their care, until local board schools were built in the 1870s. Children were finally removed from the workhouse in 1908. County and district councils took over responsibility for workhouses from the guardians in 1894. The system was replaced in 1948 upon the creation of the National Health Service.

New Workhouse at Fulwood, Preston, Lancashire

A new workhouse has been opened for the purposes of the Preston union. The building has cost between £40,000 and £50,000 and has been designed by Mr. Leigh Hall of Bolton. The site is at Fulwood, about a mile from Preston. Hitherto there have been five workhouses in the union, but the new establishment will do away with them all.

This impressive building opened its doors for the first time in 1868. After the 2nd World War it changed its name to ‘The Civic Hostel’ and became a place for the destitute to stay overnight or until they could find other accommodation, and an ‘old folks home’.

It closed for a while in 1979 and later became the Headquarters of the Regional Health Authority, followed by being part of the University of Central Lancashire. It is now owned by local businessman Yousof Bhailok, who redeveloped the building as the Preston Business Centre, part of which is occupied by Lancashire Teaching Hospitals NHS Foundation Trust.Preston Union Workhouse (front cover image)
