Her Excellency the Governor General in Council, onthe recommendation of the Minister of Labour, pursuantto sections 125*, 125.1**, 125.3*** and 126* and subsec-tions 157(1)*and (1.1)****of the Canada Labour Code, ispleased hereby to revoke the Coal Mines (CBDC) SafetyRegulations, C.R.C., c. 1011, and to make the annexedRegulations respecting occupational safety and health incoal mines in Nova Scotia made under Part II of theCanada Labour Code, in substitution therefor, effectiveFebruary 15, 1990.

INTERPRETATION DFINITIONS2.

In these Regulations,

Act means Part II of the Canada Labour Code; (Loi)

appointed means, in respect of a coal mine, appointedin writing by the mine manager; (nomm)

authorized means, in respect of a coal mine, autho-rized in writing by the mine manager; (autoris)

auxiliary fan means a fan that is used for secondaryventilation in an underground portion of a coal minewhich cannot be ventilated by the main fan or a boosterfan without separate mechanical devices; (ventilateur se-condaire)

blasting machine means a device that is designed foruse in a coal mine and that provides an electrical impulseto explode an electrical detonator; (exploseur)

booster fan means a fan that is situated undergroundand is used in conjunction with a main fan to assist in theprimary ventilation of a coal mine; (ventilateur dap-point)

breaking strength means, with respect to a hoist rope,the minimum static load applied to the rope that causesthe rope to fail in tension; (charge de rupture)

certificate means a certificate of competency issued onthe recommendation of the Provincial Board; (certificat)

chief electrician means a mine electrician who holds afirst class certificate as a mine electrician and who is ap-pointed to supervise all other mine electricians in a coalmine; (lectricien en chef)

chief mechanic means a mine mechanic who is ap-

pointed to supervise all other mine mechanics in a coalmine; (mcanicien en chef)

coal miner means an employee who holds a certificateas a coal miner and who is appointed to work under-ground at cutting, shearing, breaking or otherwise loos-ening coal or stone from a working face; (mineur decharbon)

designated means, in respect of a coal mine, designat-ed in writing by the mine manager; (dsign)

district office means, in respect of a coal mine, the dis-trict office of the Department of Labour that is

(a)

closest to the coal mine, and

(b)

in the administrative region of that Department inwhich the coal mine is situated; (bureau de district)

electrical equipment means equipment for the genera-tion, distribution or use of electricity; (quipement lec-trique)

engineer means an engineer who is licensed to practisein the Province of Nova Scotia; (ingnieur)

explosive does not include a detonator; (explosif)

factor of safety means, in respect of equipment, thenumber of times the breaking strength of the equipmentis greater than the maximum load for which the equip-ment is designed; (facteur de scurit)

first aid certificate means a certificate issued by theSt. John Ambulance or the Canadian Red Cross Societyfollowing the successful completion of a two-day firstaid course; (certificat de secourisme)

flameproof means, in respect of electrical equipment,that the equipment is in an enclosure that is capable of

(a)

withstanding, without damage, an explosion thatmay occur within the enclosure of any mixture ofmethane gas and air, and

(b)

preventing ignition of any mixture of methane gasand air surrounding the enclosure from sparks orflames from the explosion of such a mixture withinthe enclosure; (antidflagrant)

intrinsically safe means, in respect of electrical equip-

ment, that any spark or thermal effect in any part of theelectrical equipment and its interconnecting wiring is notcapable of causing the ignition of any mixture ofmethane gas and air; (intrinsquement sr)

locked out means, in respect of any equipment, ma-chine or device, that the equipment, machine or devicehas been rendered inoperative and cannot be operated or

Every record, report, plan or procedure re-ferred to in these Regulations, or any copy thereof, shallbe kept by the employer above ground at the coal minein respect of which it applies

(a)

in such a manner that it is readily available for ex-amination by a safety officer and by the safety andhealth committee or the safety and health representa-tive for the work place in respect of which it applies;and

(b)

subject to subsections 69(5) and 143(6), for a pe-riod of at least two years after the last entry therein.

keep a copy of the approved plans or proceduresreadily available at the coal mine for examination bythe employees.

In the event of an inconsistency between any stan-dard incorporated by reference in a provision of theseRegulations and any other provision of these Regula-tions, that other provision shall prevail to the extent of

the inconsistency.

Where shotfiring is to be done underground dur-ing a shift, the shotfirer shall verify that no more explo-sives or detonators than are required for the shotfiringare kept in the danger area referred to in para-graph 22(1)(a) in which the shotfiring is to be done.

no more explosive in any shot hole than theamount that is necessary for the work to be performedor the maximum amount of that type of explosive thatis set out in column II of Part I of Schedule II,whichever is the lesser;

(d)

tamping rods and stemmers that are constructed ofnon-metallic materials; and

(e)

a cleaner and crack detector that is capable ofcleaning the full length of the shot hole and detectingtransverse and longitudinal cracks of 3 mm or more inthe shot hole.

19.

(1)

Before initiating the preparations for charging ashot hole referred to in section 21, a shotfirer shall verifythat all broken coal is removed from the area of the shothole and shall allow sufficient time for dust in the air to

settle.

subject to subsection 27(3), verify, using amethanometer and a locked-flame safety lamp, thatthe concentration of flammable gas in the generalbody of the air in the area of the shot hole and in anyarea contiguous thereto does not exceed 1.25 per cent;

(b)

examine the shot hole to verify that it has beenthoroughly cleaned;

(c)

verify that the shot hole does not intersect anycracks or crevices greater than 3 mm;

(d)

verify that the shot hole is at least 3 mm largerthan the diameter of the cartridge of the explosive tobe used;

(e)

place a plug of stemming in the back of the shothole; and

(f)

verify that any dust in the area of the shot hole hasbeen treated with stone dust to a minimum of three

25 kg bags of stone dust per metre of advance.

21.

develop for employees procedures for the safe en-try to, exit from and occupancy of that portion;

develop emergency procedures that include

(i)

an emergency evacuation plan,

(ii)

a description of the procedures to be followed,

(iii)

the location of the emergency equipment pro-vided by the employer, and

(iv)

an up-to-date plan of the coal mine; and

(c)

develop and implement safe operating proceduresfor each employee occupation.

35.

(1)

(a)

inspect the machinery and equipment;

(b)

report to the underground manager any machineryor equipment found by the employee to be unsafe; and

(c)

post at the appropriate meeting station a record ofthe report referred to in paragraph (b).

shall make a report of the inspection in a book kept forthat purpose, including

(a)

the state of the roof support;

(b)

the state of the ventilation and all matters affect-ing ventilation;

(c)

the concentration of flammable gases; and

(1)

Where an overman who is responsible for anunderground portion of a coal mine becomes aware of adangerous condition in that portion of the coal mine, theoverman shall

(a)

evacuate all persons, other than an employee re-ferred to in subsection (3), from the portion affectedby the dangerous condition;

(b)

post a sign in a conspicuous place as close as pos-sible to the dangerous condition but outside the dangerarea created by the dangerous condition, to warn per-sons of the dangerous condition; and

(c)

report the existence of the dangerous conditionorally to the mine manager or the underground man-ager.

46.

(1)
