3. Description of the partnership

drawn for an Investment and Development Group which reviews the work of the partnership and feeds into the Commissioning Body.

4a. What are the aims/objectives of the partnership? The partnership’s objectives are agreed through its constitution (paragraphs 2.1 to 2.5) which, in short, recognise the opportunity to obtain government grant to provide welfare services in the best interest of the people of Staffordshire and for that grant to be spent in a way that is most efficient and corresponds to agreed strategies. The SP programme’s objectives are to ensure good quality housing related support services are available for vulnerable people in Staffordshire, to help them live independently and be part of the local community. The partnership has a 5 Year Strategy in place ‘Supporting the Future’ which includes an annual plan. (Copies of this are available at the following link – click here)

4b. Indicate milestones for delivery of the aims and objectives of the partnership as outlined at 4a.

• Annual plan as outlined in the Strategy reviewed annually by the Commissioning Body.

• Delivering agreed outcomes for service users, as detailed by the CLG National Outcomes Framework.

• Delivering the key areas of the 2007 national Supporting People Strategy ‘Independence and Opportunity’:

o keeping service users at the heart of the programme; o building on successful partnerships with the Third Sector; o delivering effectively in the new local government landscape; and o working towards better efficiency and less bureaucracy.

• To deliver quality and choice for vulnerable people by focussing on local need. • Move from a legacy funding situation to a commissioning environment • Monitor the performance of service providers through applying the Quality

Assessment framework (QAF) and implementing an ongoing service review and contract monitoring and compliance programme.

• Effective delivery of the programme within Staffordshire by ensuring continuous improvement of services through the above mechanisms.

The aims and objectives above are outlined within the Supporting the Future Strategy are to be achieved within the lifespan of the Strategy which is 5 years. The Strategy Standards and targets for delivery are also included in the Strategy.

Staffordshire County Council 8. The eight district councils represented by senior officers from their Housing departments. Staffordshire PCT’s represented by an Assistant Director from the North Staffs PCT and a senior member of staff from Staffordshire Probation service. A strong operational relationship exists with providers to ensure that contracted services are being delivered effectively and efficiently in meeting the needs of service users. Services quality is assessed through a formal Quality Assessment Framework which is validated through robust contract compliance and monitoring arrangements. Performance is measured on a quarterly basis through the submission of service performance data against key national performance indicators. Value for Money is assessed through service reviews, contract monitoring and strategic reviews. Providers are required to be accredited through a formal assessment process which is reviewed every 3 years. A provider forum (Staffordshire Supported Housing Network) has been established and is operating effectively. Service users are involved in the delivery of service through a range of mechanisms to suit their needs. The framework for engagement has been formalised through the development of a User Involvement and Consultation Strategy and a consultation and communication action plan (Involving Everyone) which have been widely publicised. Further discussion is ongoing relating to the involvement of service users in the governance arrangements for the programme.

12. What does the County Council expect from the partnership?

Effective delivery of the Supporting People programme ensuring clear strategic direction, value for money and delivery of agreed service outcomes. Ensure that the governance framework is adhered to and that any risks are identified and managed effectively by officers on behalf of the Commissioning body Through the constitution, all parties agree to the following: (a) making Supporting People work effectively in Staffordshire will require from them a commitment of unmeasured resources in terms of member and officer time; (b) the parties will have a wider involvement through links between Supporting People and (for example) community planning; (c) all members of the Members’ Board and the Officers’ Board will be concerned to consider the interests of the whole county and will not be confined to matters affecting only the bodies that nominated them.

13. What does the Partnership expect from the County Council?

Delivery of the 5 Year Strategy (April 2005). Good management – a commitment to being inclusive and engaging with all partners on strategic issues. Management of the governance framework to ensure robust decisions and clear strategic direction. Supporting People is a partnership programme and requires active involvement from key members through the inclusion of key officers and members at board level.

14. What are the risks to the County Council of entering into the Partnership and how will these be mitigated?

Financial risk – the County Council as the accountable body is responsible for financial management. There is no sharing of risk between all partners with the County Council responsible for financial and risk management of the partnership. There is a waiver in the constitution however, to enable the county to veto any decisions made by the Commissioning Body which could result in any financial risk to the partnership. A programme Risk Register has been completed identifying potential risks across the the programme. This document identifies the risks, key controls and mitigating actions

that are required to minimise the risks. This is shown at Appendix C

The financing of Supporting People services is funded from two government grants, the main services grant £11.972m and an Administrative grant of £0.453m covering the year 2007/08. The Administrative grant as its name implies covers administrative costs essentially staff, premises, supplies and the software licences for the Trojan computer system. The main service grant is a ring fenced grant with specific grant conditions that ensure all the grant can only be spent on supporting vulnerable people. A detailed analysis of the expenditure on a client group basis is set out in Appendix D

of lead officer.

16a. What are the consequences to the County Council/residents of Staffordshire if

the County Council withdraws from the Partnership (or benefits to the community for being involved)?

Non payment of the Supporting People grant would ultimately mean non delivery of services to vulnerable adults across the county and the destabilising of the market. The services commissioned through the partnership support over 10,000 vulnerable people within Staffordshire. The service is primarily preventative and there is a growing body of evidence which is showing that investment in this type of low level services reduce the need for more costly acute services. If the partnership was to fail and £11.9m of grant were taken away from Staffordshire it would be reasonable to assume the demand on acute social care and NHS services would increase. In addition the services provided which employ over 493 (FTE) people would cease to exist thereby increasing unemployment in the county and reducing economic prosperity.

Such contracts to be drawn and processed so as to incorporate best value principles, proper certification/monitoring and other appropriate controls. In a partnership environment the collective partnership would normally appoint one of its members to be the accountable body. PART 2- EVALUATION Contract/written agreement:- The contract/written agreement are written documents and/or oral agreements that, provided they comply with the law of contract, can be litigated upon to force to happen or pay out damages, basically the right to get the courts involved. Service level agreement (SLA):- A SLA can be a contract which is binding in law, but staff internal to an organisation sometimes view such a document as a lesser arrangement than a contract, but only when the service level agreement is between two separate legal entities e.g. the County Council and Police as distinct from an agreement between two departments of the same legal entity i.e. Children and Lifelong Learning (CLL) and Social Care and Health (SCH). In reality the agreement between CLL and SCH is merely the County Council only and a contract with itself or one entity cannot be enforced at law. Memorandum of association:- A memorandum of association tends to refer to companies and tends to contain limited specific information such as the company's name, the situation of the registered office, its objects, and the liability of members. Whereas the Articles of Association tend to be the powers by which the company can operate e.g. whether the company has the power to borrow money etc. However, collectively together they create what is known as the legal personality of the company. In other words the written word about how far and what the company can do. Memorandum of understanding:- A memorandum of understanding is a document which effectively sets out the heads of an agreement between parties, or an understanding between them, about how they wish to take something forward on which they are agreed in principle. It would not normally create detailed legal obligations between the parties in the sense that it defines things that they are agreed upon which will form the basis for the next steps in the carrying out of the matter on which they have reached the understanding; occasionally, though, the memorandum may be sufficiently definitive to be a contract in its own right. Scheme of delegation:- This is where it is written down who can do what. For example, the County Council members can do lots of things, but that is impracticable so they allow others to do things in place of them. The County Council constitution contains an example of a scheme of delegation. The form will then be reviewed and considered by the Partnerships Evaluation Team. The Team has been set up to assist the Partnership Scrutiny and Performance Panel in their role, providing base information relating to the operation of each partnership. Directors/partnership contacts on the content of the Partnership Approval and Evaluation Form;

• Assist the Scrutiny and Performance Manager by highlighting key issues that Members of the Partnerships Scrutiny and Performance Panel may wish to consider; and

• Assist in the development of the Financial Rules- Partnerships Policy and Code of Practice in relation to partnerships.

The amended form is then returned to Rebecca Redman and then to Carol Bloxham to dispatch the papers to the Partnerships Scrutiny and Performance Panel ahead of their meeting. The Partnerships Scrutiny and Performance Panel will consider the completed form at their meeting. Again lead officers are required to attend the meeting to present an overview of the partnership to Members of the Panel and answer any questions they may have in relation to the form.
