ern STREET EXTENSION
In 2008 the CRA obtained authorization to change the scope of the existing Bank ofAmerica
loan to include the construction ofthe extension of 7 Street east to Haben Boulevard
Currently approximately 714000 in loan proceeds is available for this project
The City Commission adopted the Department of Public Works CIP on April 6 2009 This
project was included on the CRAs project list for construction in FY 2010 attached The
current estimated cost of the project is 950000 committing the CRA to the utilization of these
loan proceeds and an additional approximate 250000 in FY 20092010
This project is consistent with CRA objectives in that it strengthens the Citys contribution to
the wellbeing of the community enables successful ongoing revitalization and strengthensPalmetto as aunique place in the region due to the proximity ofthe Civic Center and the EstuaryPark The extension of7 Street West would allow for FDOT activation ofthe signal at 7Street and US 41301 enhance the traffic flow to allow for the adjacent site to be appropriate for
hotel development enhancing the traffic flow parking and utilization of the Civic Center and
allowing for improved access to downtown Palmetto from Riviera Dunes Palmetto Trace and
other eastern locations The project has been contemplated from at least the consideration ofthe
development of Riviera Dunes DRI
The City currently has an approved work assignment for the design of the eastbound extension of
7 Street West attached Work is approximately 30 complete but has been suspended
QUESTIONSShould the CRA continue to maintain this funding for this project and commit to
budget an additional 250000 for next yearShould the CRA pay down the loan by this amount so that we stop paying interest on
this amount

Mayor Bustle called the meeting to order at402pm followed 6y a moment of silence for
overseas military personnel and the Pledge of Allegiance
UPDATE HIV AWARENESSKristen Pate HIVIAiDS Outreach Coordinator for Manatee County updated Commission on
Manatee Gountys ranking in the slate for cases involving AIDS and sexually transmitted
diseases stating the Rat Groover and Memphis areas were included in the RARE Projectsstudy
Project Smile currently utilizes a mobile unit that offers testing or HN sexually transmitted
diseases and pregnancy as well as support groups and educational meetings Ms Fate informed
Commission she is looking far a place in Palmetto where Project Smile can be located

Mr Lukowiak informed Commission a joint meeting is tentatively scheduled with the countycommission to discuss the Erie Road landfill Issue Mr Lukowiak updated the Commission on
the meeting thatwas between county staff and the county commission canceming the topic The
issue facing the City is that Manatee County staff is suggesting the county has met its
responsibilities fn monitoring the landfill and that the City should assume the responsibility Citystaff is ofthe opinion ail responsibilities associated with the andfitls closure permit still lie with the
county
Mr Lukowiak discussed the lease the City entered into with Manatee County Radio Controllers
MCRC the subsequent sublease the City approved to the Bradenton Lawn far a paintbailoperation at the landfill and events originated by the paintbatl organization that have led to the
current situation A point paper outlining recent history of the topic is attached hereto and made a
part ofthese minutes
Mayor Bustle admowledged the county is in possession of information from DEP That the City has
not yet received regarding the minor modification application Attorney Hap stated her opinion the
county atbomey wpt share information that has been gathered if no a formal public records
request will be made to the county Commission suggested that a formal public records request

should also be made to DEP Mr Lukowiak stated research into the Citysrecords regarding the
landfill continues
4 7iST2EET EXTENSIdiVTo begin the discussion Mrs Lukowiak confirmed she had met wihcounsel o review the statute
governing CRAB as hey relate to the C1P Shereiterated that the CRA is very careful not to putprojects funded by TIF on the CIP She explained the engineering far the project totaling 98000was included an the 2007 CIP butthe project corbstruction was never included on the CIP She
alsoconfirmed she had consulted with FRA Director Carol Westmoreland to verily that what she
rues proposing was permissible which Ms Westmoreland canfimed
Mrs Lukowiak informed Commission the CRA has 730000 remaining in foan proceeds from the
2006 Bank of America loan The original amount of the loan was 15 minion and wasdedicated
to the Ward 1 Phase 1 project and other projects for which we did not need ail the money Mrs
Lukowiak requested that Commission amend the projects dedicated to the 2006 Sank of America
loan to add the 7ih Street extension project as FDOT has indicated that full activation of the
Street light can occur once the extension project is undercontract
Mrs Lukowiak discussed the Riviera Dunes DRi requirements concerning traffio She also
confirmed Riviera Dunes has mat its 5 improvements requirements in addition to the land
dedications to the City
Mrs Lukowiak explained alternate funding sources far the project have not been found She also
discussed CRAs borrowing capabliities until the Strand decision Bend counsel has confirmed
the Gity can take a lean and GRA pay the City but CRA cannot independently take a loohat this
time She also stated the loan proceeds can only be used far public facilities and 7 St is
probably the best utilization for the limited funds that are available far use Mr Lukowiak agreedthat 7St is one of his top three priorities
Mr Lukowiak stated he win have a mare defined drawing after our engineer meets with countystaff Regarding the land swap for the street a reverter clause when the property wasconveyedto the cfiIccenter requires the land to be used only for a public purpose The county wants the
City to be sure there will not be aviolation ofthe clause Attorney Halt explained the tight to the
reverter clause still lies with the joint venture that dedicated the Eand not Linda Svenson as was
beneved After these two issues are resolved the interlocal agreement will then have to go to the
county commission for approval
Discussion ensued on whether the project should be delayed until alter the Strand decision Mr
Free stated it is desirable to spend the loan proceeds prior to the loansthird anniversary to avoid
arbitrage laws He also recommended paying downthe loan if the loan proceeds are not used for
the project He agreed with Mrs Lukowiak that it appears a legal option would be for the City to
borrow money and there be an agreement with CRA for the repayment of the debt
Mrs Lukowiak stated Commission must approve changing the foan description and then the CRA
would have to approve and execute the contract but a resolution would be brought to GityCommission for official action Mayor Bustle questioned if the contractshould be executed by the
City rather than CRA Mrs Lukowiak affirmed that was acceptable Mr Lukowiak stated awork
assignment could be issued under acurrent piggyback contractwtthWestra Construction
Commission agreed to move the topic to the700agenda for action

Discussion ensued on the Noise Exception Temporary Use Permit application submitted byChris Catering Service toalow a wrestling event one Saturday of each month at the business
location specifically that there was no time limitation an the pemitand thatpartaets would be
utilized at each event Matt Sfarikis explained why he found it necessary to use the partclefs
rather than the bathroom facilities on site Staff confirmed tits Temporary Use Permit was
submitted because code restricts the use of portolets to a total of five times per year Mr
Lukowiak suggested that the Temporary Use Permit be withdrawn and afivemonth trio be
allowed Mr Schmitt informed Commission he has spoken with Mr Sfarikis but he will also
follow up to get the necessary information regarding the placement of the portasets Mr Sfarikis
agreed stating the trial would prove if the event is profitable and would allow donation of some of
the profits to the Sickle Cell Foundation as planned and give him time to further research how
best to provide for the athletes competing and provide permanent bathroom facilities Ms
Comweii informed Mr Sfarikls that she wilt not support any extension of the permif if the
permanent facilIes are noton site by August

MOTION Mr Ball moved Mra Lancaster seconded and motion carried 40 to
approve the October 15 2007400 pm agenda
2 MANATEE SCHOOL FOR THE ARTSKerry Ward Wachovia Bank informed Commission Manatee School for the Arts is seeking a
bank qualified bond issue of 65 million The school currently has a 5 million outstandingbalance approved by Commission in three different issues Of the Citys 10 million per calendar
year allotment 58 million has been used Mr Ward further explained his bond counsel is tryingto confirm if the three prior issues totaling 5 million can be grandfathered and then the school
will request only 15million Mr Ward stated the schoolsrequest at this point is approval from
the City for two separate issues 35 million before the end of the year and 3 million in Januaryof 2008 The challenge is that the City would have to commit now to the future 3 million 2008
issue
Mr Freeman confirmed that if Commission approves the 3 million request for 2008 that amount
would be removed from the Citys 10 million allotment in 2008 Mr Lukowiak reviewed the
potential 2008 projects that could be funded from loan proceeds Several Commissioners voiced
concern with having to commit to a future bond when the Citysdecisions for 2008 funding needs

Attorney Hall informed Commission that staff had met with School Board representativesconcerning language amendments the City proposes to the School Facility Interlocal AgreementAttorney Hall reviewed the draft language she had prepared briefly reviewing the shall and
may terms contained throughout the document She concentrated her discussion on sections
91School Site Selection 92 Planning of Educational Facilities and 93Site Improvements of the
agreement After thoroughly discussing the proposed language and the negotiated pointsbetween staff and the School Board representatives that remain in the document and languagethat was removed Commission accepted the draft agreement as proposed The final document
will be presented to Commission for formal approval on November 5 2007
Nick Lett Renaissance Planning reviewed a presentation of the traffic mobility study that was
performed Key considerations used during the study were

Peak hour commuting patterns
Components of the findings discussed with Commission included
Existing and 2012 projected levels of service
2012 recommended improvements and projected capital improvement costs
Stop sign and signalized intersections

Discussion ensued on how the study can be used as a development review tool when
considering large scale developments and their impacts to City traffic and how it will benefit the
City in developing long range plans Mr Lukowiak discussed the projects that are alreadyunderway and their funding He also stated a plan for stop signs will be presented at theNovember 5 2007 Commission meeting and staff will begin preparing a plan for addressing on
street parking

opportunities and develop a series of recommendations to improve traffic
circulation accessibility safety and overall mobility in the City The
objective of the project was to examine specific traffic circulation and
mobility strategies and develop recommendations that are feasible from a
financial operational and community perspective The project study area

I am writing in response to your letter dated August 7 2008 regarding the traffic signal at US41301and 7 Street West intersection and status ofthe improvements required in the development order for theRivera Dunes Development ofRegional Impact DRI
First let me address your comments related to the traffic signal at US41301 and 7 Street West
intersection The traffic signal was approved by the department based on a traffic study prepared byTindale Oliver and Associates This study demonstrated the traffic signal will be needed with theextension of 7s Street West from US 41 to Haben Boulevard The SarasotaManatee CountyMetropolitan Planning Organization MPO and the department assisted the City of Palmetto with the
funding for construction ofthe traffic signal at this intersection
The traffic signal is currently operating in flash mode since the city has not accomplished the extension of
7 Street West It is the departments intent to leave the traffic signal in this mode until such time the citydemonstrates 1 an executed agreement with Manatee County regarding the necessary rightofway forthe extension and 2 aconstruction contract for the extension is awarded
You a so mentioned concerns with the enforcement ofthe development order for the Rivera Dunes DRIAs you may be aware enforcement of development order conditions is the responsibility of the local
jurisdiction in this case the City ofPalmetto According to the city we have learned the Rivera Dunes
DRI has not triggered the trip threshold even though they exceeded the development intensity thresholdSince the widening ofUS41 between Haben Boulevard and the US301 ramps is a requirement in the
Rivera Dunes DRI development order the department will not support allocation ofwork program dollarsfor these improvements unless prioritized by the MPO We also understand the Rivera Dunes DRI
development has already contributed their proportionate fair share to the city and the necessaryimprovements are covered by the citys current Capital Improvement Program CIP We have requesteda written response from the city confirming the above referenced conversation
Tha SarasotaManatee County 2034 Long Range Transportation Plan LRTP shows the need for eightlanes along US 41 in this area but also shows this is a constrained facility The conditions in the
development order as required by the city do not contradict this need Based on these fmdings it appearsthe City ofPalmetto is not in conflict with the MPOsLRTP and the DRI process
