NOTICE INVITING TENDER

CONSTRUCTION OF OFFICE BUILDINGS FOR RSETIs AT THIRUVANANTHAPURAM AND NAGERCOIL

Selection of a Prospective Architect

RSETIs are Rural Self Employment Training Institutes, an initiative of Ministry of Rural Development (MoRD) to have dedicated infrastructure in each District of the Country to impart training and skill up-gradation of rural youth geared towards entrepreneurship development. RSETIs are managed by Banks with active co-operation from the Government of India and the State Governments.

Indian Overseas Bank, manages many RSETIs in the State of Tamil Nadu and an RSETI at Thiruvananthapuram, Kerala. It has been proposed to construct own buildings for RSETIs managed by the Bank and in this regard, this notice has been published for selection of a prospective Architect, to help the Bank / RSETIs, in construction of Buildings at the following two locations, one each at Kerala and Tamil Nadu:

1. Thiruvananthapuram

2. Nagercoil

Each of the above RSETIs are proposed to be constructed with a built up area of about 8000 Sq.ft. The basic infrastructure includes the following:

1) Building: The proposed building is to house a Reception, Class Rooms, Workshop, Computer Lab, Director’s Chamber, Administrative Office, Kitchen, Dining Hall, Dormitories (GENTS / LADIES), Toilets, Guest Rooms etc.

2) Overhead Tank, Septic Tank (if required) 3) Compound Wall / Fencing

The scope of work for the prospective Architect is detailed separately. However, the same is given in brief as below:

1. Preparation of Building Plans as required by the Bank. 2. Submission of plans to Local Authority and obtention of their approval. 3. Preparation of - detailed estimate for building & services; tender documents /

specifications of works; working drawings; structural design & drawings etc. 4. Scrutiny and evaluation of Tenders received and recommendation of L1

contractor.

5. Co-ordination with RSETI and contractor in execution of work, periodic site

inspections, ensuring compliance to approved plan and tender specifications. 6. Scrutiny and verification of contractors bills and recommending to Bank

7. Issue of Virtual Completion Certificate. 8. Assisting the Bank in obtention of permanent service connections so as to put

the building to useful occupation.

The eligible and interested Architects may collect the Tender Document for “Selection of Architect for Construction of RSETIs - II” from the above office by paying non-refundable fee of Rs.300/- (Three Hundred only) by way of Cash/Demand Draft favouring “Indian Overseas Bank, Regional Office” payable at Thiruvananthapuram.

Alternatively, the document can also be down loaded from the website of Bank namely www.iob.in and a document fee of Rs.100.00 (ONE Hundred Only) by way of Demand Draft favouring “Indian Overseas Bank, Regional Office” payable at Thiruvananthapuram may be submitted along with the duly filled in document. The document submitted without the prescribed fee will be liable for rejection. Applicants who have already paid Rs.300/-, while purchasing the application directly from our office, need not enclose DD while submitting the filled in application form. The duly completed document in the prescribed format with all supporting documents shall be sealed in a cover and super-scribed as “Selection of Architect for Construction of RSETIs – II” and shall be submitted to the INDIAN OVERSEAS BANK, Regional Office, IOB Building, MG Road, Thiruvananthapuram, Kerala 695001, on or before 22.04.2019 up to 14.30 Hrs.

The tender for this work will comprise of two parts and shall be submitted in two covers:

Cover 1 shall contain Part A of the tender comprising of particulars of the Architects, conditions of contract and Commercial conditions. Cost of the tender document, if down- loaded from web site shall be placed in this cover. This cover shall be clearly super-scribed as PART – A (Technical Bid) and the name of the work.

Cover 2 shall contain Part B of the tender comprising of Schedule of Works i.e., Bill of Quantities only. This cover shall be clearly super-scribed as PART – B (Financial Bid) and the name of the work.

Both covers shall be placed in a third cover which shall be subscribed with the name of work, date of receipt of tender, name of the tenderer etc and submitted at the Office of the employer on or before the specified time and dated specified for the receipt of the tender.

The eligibility criteria of applications shall be evaluated as on cutoff date (i.e., 31.03.2019).

A Pre-Bid meeting has been organized at Regional Office Thiruvananthapuram on 10th April 2019 @ 11:00 Hrs. All interested Bidders are requested to be present, to get clarification on the Bid and to understand Bank requirements.

The Bank reserves the right to accept or reject any or all the applications without assigning any reasons thereof and their decision of selection will be final.

INSTRUCTIONS TO THE INTENDING APPLICANTS

1. Applicability:

The intention of this notice is to select a prospective Architect for providing Architectural, Engineering and associated services to enable the Bank to construct own buildings for each of the two RSETIs mentioned earlier viz., Thiruvananthapuram and Nagercoil. Only Architects, having Registered Office / Branch Office in any of the four locations need apply. The idea of selecting a local Architect for this group of two RSETIs from any of the two locations, is due to the following reasons:

familiarity with local conditions;

proximity of project sites.

presence / availability of Architect’s services at short notices etc.

The Architects would be shortlisted based on a given Pre-Qualification criteria, as per the information and documents to be submitted by the intending applicants. The Evaluation Criteria is detailed separately. In addition, Bank may at their discretion, visit few of the works already completed by the applicants, for further evaluation. The Architect quoting the lowest professional fee, from amongst the shortlisted applications, would become successful Architect. The work would be awarded to this successful Architect.

Though the Price Bids have been provided separately for each of the two sites, the successful Architect would be arrived after taking a summary of Price Bids I and II.

2. Scope of Short-listed Architects:

The shortlisted Architects would form a pool, from which the Bank may, at its discretion, utilize the services of any Architect(s), should there be any disruption in service extended by the appointed Architect, for whatever reason. This pool would be maintained for construction of the said two RSETIs and any other RSETI that might come up in any adjacent locality, in near future.

Architects are liable to be removed from the above approved pool, if found to be inactive and or whose performance in quality and time is not up to the expectations of the Bank or indulge in any kind of malpractice.

Being in this shortlisted pool of Architects will entitle the Architect to be considered for issue of tender documents subject to Bank requirements and other conditions that may be stipulated in those Notice Inviting Tenders (NITs). However, it shall not confer any right on the Architect either to be necessarily issued with the tender documents or for award of work.

3. The details of the applicants and their experience shall be submitted in the Bank’s prescribed “Application Format” only. Wherever required and if the space provided is not sufficient, particulars can be furnished as Annexures but such details shall be clearly mentioned in the respective columns of the Application Format. Applicant shall enclose latest copies of brochures and technical documentation giving additional information about the applicant. Each page of the document shall be duly signed by the Applicant or their authorized representative along with their company seal.

4. No costs incurred by the applicant in applying, in providing necessary clarifications or attending discussions, conferences or site visits will be reimbursed by the Bank.

5. Documentary proof with respect to the prequalification criteria shall be furnished along with the completed application form. In this regard, copies of the work orders and performance certificates and or such other documents shall be submitted. Incomplete applications or applications without proper proofs for establishing their credentials will be liable for rejection and no correspondence will be entertained in this regard.

6. The authorized person of the firm/ company shall sign in all the pages of the application with seal of the company/ firm.

7. The shortlist & selection will be made for the intended specific purpose depending on the credentials submitted and acceptable to Bank, as on cutoff date.

8. For consideration of experience, works should have been executed in same name & style of the firm in which selection is sought.

9. If found necessary, Bank may also consider inspecting the works undertaken by the applicants, for which necessary co-ordination shall be made by them. Based on the details furnished in acceptable format, inspection of works (if any) and eligibility criteria as on cutoff date, the applicants will be shortlisted.

Decision of the Bank regarding selection / rejection of Architects will be final and binding and no further correspondence will be entertained.

10. If, information and details furnished by applicants are found to be false at any time in future or any information withheld, which comes to the notice of the Bank at a later date, the shortlist / selection of such applicant will be cancelled immediately.

11. Applications received after the due date and time are liable to be rejected.

12. The Applicants having their office in the geographical jurisdiction of Thiruvananthapuram and Nagercoil only will be preferred.

13. Applicant Obligations:

1. The applicant should intimate change of address to the Bank. Failure to do so may result in removal of his name from the short- list.

2. The registration with various authorities like Council of Architecture, GST, IT etc shall be possessed during the short-list period.

3. The applicant should not indulge in unethical practices. 4. Any Change in Constitution of firm without prior approval will render the

applicant to be removed from the shortlist / work.

14. Disciplinary Actions:

The Bank will have the right to terminate the services of an Architect, suspend business with him, debar him / remove his name from the approved short-list, after issue of a show cause notice, as the case may be. Decision of the Bank will be final and binding.

Indian Overseas Bank reserves its right to reject any / or all the applications without assigning any reasons whatsoever.

15. Agreement:

The successful Architect has to enter in to an agreement with the Bank, in Bank’s approved format.

16. Arbitration:

In the event of any dispute, difference or question, arising out of or touching or concerning this agreement or the execution of the project, the same shall be referred, at the option of either party (Bank or the Architect), to the arbitration of a sole Arbitrator mutually agreed upon and in default of such agreement both the parties shall appoint one arbitrator each and both the arbitrators shall appoint one presiding arbitrator (Umpire). All the arbitrators shall be the Fellows of the Indian Institute of Architects or the Institution of Engineers (India). The said arbitration proceeding shall be under the provision of the Indian Arbitration and Conciliation Act, 1996 together with any statutory modifications thereof. The award of the arbitrator(s) or umpire, as the case may be shall be final and binding upon the parties.

SCOPE OF WORK

DUTIES AND RESPONSIBILITIES OF ARCHITECTS

a) Taking the employer’s instructions, visiting the sites, preparing sketch designs which shall be in accordance with local governing codes/standards, regulations, etc. (including carrying out necessary revisions till the sketch designs are finally approved by the employer), making approximate estimate of cost by the cubic measurements, square meter, or otherwise and preparing reports on the scheme so as to enable the employer to take a decision on the sketch designs.

b) Submitting a proper PERT Chart / BAR Chart incorporating all the activities required for the completion of the project well in time ie., preparation of working drawings, structural drawings, detailed drawings, calling tender etc. The programme should also include various stages of services to be done by the Service Consultants in co-ordination with the Architect.

c) Submitting required drawings to the Municipality and other local authorities and obtaining their approval.

d) Preparing Architectural working drawings, structural calculations and structural drawings, layout drawings for water supply and drainage, electrical installations, telephone installations, air conditioning, Fire Fighting etc., detailed estimates, Market rate Analysis for same and all such other particulars as may be necessary for preparation of bill of quantities

e) Preparing pre-qualification documents / detailed tender documents for various trades viz., general builders work and specialist services such as water supply and sanitary installation, electrical installation, etc., complete with articles of agreement, special conditions, conditions of contract, specification, bill of quantities, including detailed analysis of rates based on market rates, time and progress charts, etc., covering 100% activity at site.

f) Preparing tender notices for issue by Bank or inviting tenders from pre-qualified/shortlisted parties on behalf of Bank, as the case may be for all trades and submitting assessment reports thereon, together with recommendations specifying abnormally high and low rated items. Preparing contract documents for all traders and getting them executed by the concerned contractors.

g) The assessment report shall be based on proper analysis of rates with constants from an approved Standard Hand Book and market rates of materials and labour for major items of works costing about 90% of the estimated cost of the work.

h) All commercial conditions shall be evaluated in financial terms instead of merely saying whether a condition may be accepted or not.

i) Preparing for the use of the employer, the contractor and site staff, 4 copes of contract documents for all trades including all drawings as are necessary for proper execution of the works.

j) Assuming full responsibility for supervision and proper execution of all works by General and specialist Contractors who are engaged from time to time, including control over quantities during the execution to restrict variation, if any to the minimum.

k) Arranging for periodical site meetings between Bank, Architects and connected Contractors, minuting the proceedings and forwarding copies to RSETI, Regional Office and Site Office.

l) No deviations or substitutions should be authorised by the Architect without working out the financial implication, if any, to the contractor, and obtaining approval of the Bank. However, where time does not permit and where it is expedient, the Architect may take decisions on behalf of the Bank, the total cost of the item/deviation should not exceed Rs.10000/-. This deviation shall be got subsequently ratified from the Bank duly justifying his action at the earliest.

m) Working out the theoretical requirement and actual consumption of cement and Steel and any other material specified for each bill.

n) Assist the employer in appointing a full time/temporary Site Engineer / Supervisor for supervision of construction of a particular project and guiding the Site Engineer as required.

o) Checking measurements of works at site. Checking contractor’s bills, issuing periodical certificates for payments, and passing and certifying accounts, so as to enable the employer to make payments to the contractors and adjustments of all accounts between the contractors and the employer. Architects shall assume full responsibility for all measurements certified by them. It shall be made mandatory on the part of the Architect to check the measurements of various items to the extent of at least 25% of each item of work claimed in each running bill.

Architect’s / Consultant’s certification of Contractor’s Bills shall be as per the specimen format given below;

Certified that the various items of work claimed in this---------------running bill/final bill by the contractors ----------------have been completed to the extent claimed and appropriate rates and that the items are in accordance with and fully conforming to the standard/prescribed specifications and drawings. We further certify that we have checked the measurements of each item claimed in the bill. Hence, the bill is recommended for payment of Rs.---------------.

p) Submitting a detailed account of Steel, Cement and any material that the employer may specify and certifying the quantities utilized in the works.

q) Obtaining final building completion certificate and securing permission of Municipality and such other authority for occupation of the building and assisting in obtaining refund of deposit, if any, made by the employer to the Municipality or any such other authority.

r) Appearing on behalf of the employer before the Municipal Assessor or such other authorities in connection with assessment of building for tax purpose and tendering advice in the matter to the employer.

s) On completion of the project, prepare “as made” completion drawings of architectural, structural, water supply and drainage works, and electrical and other services along with a brief report on the project and relevant structural design calculations and submitting 4 copies of the same for the records of the employer.

t) Further, the Architect shall verify and confirm that identification for the records marks are made on all service installations/cables/wiring etc. for easy identifications to carry out maintenance jobs.

u) The Architects shall be wholly responsible for the successful completion of the project in all respects consistent with safety and structural stability from the inception up to the handing over for occupation to the employer.

v) The Architect shall assist the Bank in all arbitration proceedings between the contractors and the Bank and also defend the Bank in such proceedings.

w) The Architect shall furnish one complete set of structural designs, calculations and structural drawings for the Bank’s record.

x) Architect shall assist Bank in complying with the requirements of State/Central Government authorities.

y) Any other services connected with the works usually and normally rendered by the Architects, but not referred to herein above.

PROFESSIONAL FEE – TERMS OF PAYMENT

Professional Fee Payable as Percentage:

The Architects professional fee is payable as a percentage of cost of works in terms of guidelines of the Indian Bank’s Association (IBA) as well as in terms of extant Bank policy.

1) The fee, calculated at ____ % of the actual cost of work / accepted tender cost whichever is less, is called the Basic Fee. In case there is an escalation in the actual project cost over the accepted tender cost, the payment to the Architect shall be worked out as below: a) 100% of the Basic fee on the accepted tender cost plus

b) 50% of the Basic Fee on the escalated cost over & above the accepted tender cost.

Subject to a ceiling of 110% of the Basic Fee worked out on the accepted tender cost.

2) Travel Allowance: Bank has decided to engage a local Architect for the said construction works and as such the Architects will not be paid any Travel or other allowances for site visits or office visits. Hence, Architects who operate from these geographically adjacent locations viz., Thiruvananthapuram and Nagercoil need only apply for these construction projects.

Terms of Payment:

The Architects with supervision responsibilities will be paid their professional fee as per the below mentioned terms of payment:

1. On Bank’s approval of sketch design and preliminary estimates.

2 Satisfactorily preparing relevant drawings and particulars for statutory approval and submission of the same along with applications to Town Planning / Local Statutory Authorities for their approval.

3. On obtention of plan approval by Statutory Authorities and on Bank’s approval of detailed architectural working drawings and structural drawings (sufficient for preparing detailed estimates of cost) along with detailed estimates and market rate analysis including techno-commercial specifications as per Bank requirements.

4. Preparation of tender documents to be issued to short listed contractors and advising on tenders received including recommendation of successful tenderer with final cost of work to the Bank and on approval of the tender by the Bank. Also, if provided for, on posting one full time experienced site supervisor after issue of Work Order to successful tenderer by the Bank.

5. For making periodic visits for inspection and quality surveillance, arranging & attending fortnightly progress review meetings at site including preparation and submission of Minutes of Meeting duly signed by all parties, preparing other details and drawings as may be required during execution along with variation control, and certification of all Contractor’s bills for Bank’s payment.

6. Issue of completion certificate, indicating the beginning & end of defect liability of period of contracts and when the new building is fit for occupation.

Balance payment to cover 100% of fee calculated on cost of actual work done.

NOTE:

The fees as stated above will also be applicable to services.

The fees as stated above will be adjusted on the basis of the latest available estimated cost or if tenders have been received then on the lowest bonafide tendered cost. For stage (5) progressive payment will be made on the cost of works done.

The final installment of fees shall be adjusted on the basis of actual cost of works, subject to the stipulation and ceiling as agreed.

PRE-QUALIFICATION / ELIGIBILITY CRITERIA

The professionals experienced in planning, designing, preparation of detailed specifications for works & tender documents, supervision of works wherever required, assisting the Bank in techno-commercial aspect preferably with exposure to IBA, Government & Central Vigilance Commission Guidelines.

The cost of each of the RSETI construction project is tentatively estimated to cost about Rs.135 Lakh.

General Eligibility:

The Architect should satisfy the following minimum eligibility criteria:

i) Should have valid registration with Council of Architecture.

NOTE: In case of partnership firm, all the partners must be Architects registered with COA. In case of LLP or a Pvt. Ltd. Company, NOC (No Objection Certificate) from the Council of Architecture is a must and should be enclosed.

Proof Documents to be Submitted:

Submit self attested copy of Council of Architecture Registration particulars.

ii) Possess a minimum experience of seven years in the relevant professional field, prior to cut off date i.e., 31/03/2019. Should have experience in planning, designing and supervising Civil Engineering Construction works for the Banks / Financial Institutions / large Corporates / Multinational Companies.

Proof Documents to be Submitted:

Necessary proof of works taken up for clients such as Governments / Banks / FIs / Large corporate / Multinationals shall be provided.

iii) Should have registered Office at any of the geographical locations viz., Thiruvananthapuram and Nagercoil. Reasonable presence for professional work in and around the area, functioning for the last three years or more as on 31.03.2019.

Proof Documents to be Submitted:

Proof of establishment including registration certificates of firm, tax registration etc shall be submitted.

iv) The Architect should have provided consultancy services for similar works of project cost limit as given below;

One project costing 80% of the estimated cost

during the last seven years prior to cutoff date

or

Two projects - each costing 60% of the estimated cost

during the last seven years prior to cutoff date.

Proof Documents to be Submitted:

Fill up Proforma 2a and 2b provided along with the Application Format,

depending upon the number of works (one or two) which satisfy PQ criteria 1

and submit proof of works completed (Performance Certificates from previous employers) for these works.

v) The Architect should produce PAN & GST registration numbers and details of registration / affiliation with technical bodies etc.

Submit copies of PAN, GST Registration particulars.

PRE-QUALIFICATION / EVALUATION CRITERIA

All interested and eligible bidders shall submit their duly filled bids, in two cover system, on or before the due date and time specified for submission of in the tenders, signed in all pages along with all relevant annexures to be submitted as proof of experience, financial capabilities etc.

Evaluation Criteria (Technical bid):

1. Professional Qualification / Affliation and Technical Competence

2. Tax Compliance

3. Ability to complete the work on Schedule based on past records

4. Experience in Similar Construction project works.

5. Company Organization and Appropriate Project Staff Organization

6. Appropriate Supervision staff & Skilled Labour committed to be mobilized

I. Technical Bid Evaluation Criteria:

Stage 1: Preliminary Examination: To ascertain the responsiveness of the bidders and reject those bids who have;

Not submitted the tender in time

Submitted tender without Application Fee

Not submitted the tender in Bank’s approved format

Submitted unsigned / illegible tender

Not accepted the Bank’s techno-commercial conditions

Submitted the tender with counter conditions

Not registered with CoA, TAX authorities etc.

Only those bids that are responsive shall be subject to further processing. Bids not complying to the above would be rejected and their unopened Price Bids will be returned.

Stage 2: Pre-Qualification

To determine the compliance of bidders with specified Pre-Qualification (PQ) criteria, as below:

i. Bidders must have successfully executed, general Building Construction project works, in the last seven years as on 31.03.2019.

Bidder(s) must have successfully completed in the past seven years:

a) One work of value at least Rs.108.00 Lakh in a single work order.

b) Two works of value at least Rs.81.00 Lakh each. Value here means the completed cost as reflected in the final bill/ completion certificate.

ii. The Bidders should have a registered office at either of the geographical locations viz., Thiruvananthapuram, Nagercoil, functioning for the last three years or more as on 31.03.2019.

A bidder has to comply with each of the PQ criteria (mandatory requirement) to qualify for further evaluation and opening of Price Bid. If the contractor fails to satisfy any one of the PQ criteria, then the agency would be disqualified.

Stage 3: Site Inspections: In addition to Stage 2 Criteria, Bank at its discretion may inspect projects previously undertaken by the Architects and interact with clients to understand the quality & nature of services extended by the Architects, professional competency of the Architects, etc.

II. Price Bid Evaluation Criteria:

On opening of Price Bids, the same shall be evaluated based on the rates quoted. The Bidder quoting the lowest professional fee would be the successful Architect.

For the purpose of arriving at the L1, based on the rates quoted by the Architects, the professional fee would be quantified for an estimated cost of Rs.135 Lakh for each RSETI. The L1 would be arrived accordingly, after taking a summary of Price Bids I and II.

Format to be filled up, signed by the authorized signatory and submitted in two parts (Part A and Part B) to the Chief Regional Manager, Indian Overseas Bank, Regional Office, Thiruvananthapuram, Tamil Nadu, in TWO Parts in separate sealed covers, superscribing the name of the work, indicating either Technical Bid (Part-A) or Price Bid (Part-B), on top of cover on or before 22/04/2019 by 14:30 Hrs. The same day the Technical Bid (Part A) would be opened by 15:00 Hrs.

4. The Bids would be evaluated based on Evaluation Criteria by a Committee of Officials and on prescribed date and time, the Price Bid (Part B) of those shortlisted bidders alone would be opened.

5. Bank will not be responsible for any postal delay / courier delay, in the event of completed applications sent by post / courier not reaching the concerned Office in time.

6. Bank will scrutinize the offers based on information provided in Part – A tender. Banks decision on selection of the prospective Architect is final.

7. Architects shall quote their Professional Fee only in Part – B. The Professional Fee shall be within the guidelines stipulated by Indian Banks’ Association. The professional fee shall be quoted as a % of the total cost of project, exclusive of GST. GST on the Professional fee will be paid separately, as applicable from time to time.
