TermsandConditions:

1) Thevehicleisstrictlytobehiredforthemaximumof3000km.ExtraKmbeyond3000kmwillnotbeadmissible.

2) Vehicleshallbehiredwithgoodscarryingcapacityofminimum2.5metrictonnes.3) The vehicle to be offered for hiring shall be in up‐to‐date condition including the tubes, tyres,

engine as well as condition of outside body. The vehicle to be offered shall not have beenregisteredbeforemorethan03yearsasonthedateoftenderopening.However,incaseofaverypoorresponseortobreakoffthe likelycartel,arelaxationcanbegrantedforoneyearwiththepermissionofcirclehead.However,theofficersplacinganordershouldensurethatconditionofsuchvehicleistiptop.

4) Contractorshouldprovideanotherdriverinabsenceofdailydriverasvehicleishiredon24hoursbasis.

5) The vehicle should have good upholstery covered with clean covers, comfortable seatingarrangementandshallbewashed/serviceatregularintervalsofaweek.Vehicleshallalwaysbekeptneatandclean.

6) Vehiclemust be available at 400kv Hadala s/s of 24 hours round the clock except engaged inpatrollingoflinesandsub‐stationsorotherofficework.

7) ThevehicleshallbeutilizedforpatrollingofEHVlinesandsub‐stationsorotherofficeworkunderGETCO,Hadala or anywhere in Gujarat. However the contractor should provide the vehicle forcontinuous24hours.ThegeneraluseofvehicleisforpatrollingofEHVlinesand/orsub‐stationsworktotransportman&material,usedonKaccha/Pakkaroad/Bullockcartwaywherevehicleapproachispossible.

8) ThevehicleshallbeutilizedforanyotherofficialpurposeofGETCOasperEIC.9) Contractorwillnotbeentitledforweeklyofffor24hoursvehicle.10) Drivershallbepreferablybelowtheageof40yearsandneverabove55years.Thelodgingand

boardingofdrivershallbebornebyowner.11) Thedrivershouldprovidewithenoughmoneytocoverthecostofdiesel,repairsandincidental

expenditure while in journey. Driver should provide mobile phone facility for communication.Drivershouldalwayskeepalldocumentsrelating tovehiclesuchasR.C.Books, insurance,validlicenseandPUCcertificateoranyotherimportantdocumentsinoriginalcopywithvehicle.

12) Whendaytoday,vehicleforitsdutyonspecifictimegivenbyGETCO,atthattimedrivermustbefullyequippedi.e. includingrequiredMoneytokeeptheCarrunninginfullcondition.Heshouldnotdemandmoneyfromtheofficertravelingforrepairingthevehicleonroadetc.

13) Thecontractorshallalsomakehisownarrangementsforrefueling,repairsandmaintenanceofhisvehicleandprovideothervehicleduringmaintenanceorrepairperiodwithallabove‐mentionedconditions.

14) Contractor should appoint a driver with valid license according to vehicle. Drivermust not beaddicted of any habits. Changing of driver shall be intimated by contractor to concern user ofvehicleinprior.

15) Beforestartingjourney,vehicledrivermustbeinthepositiontohavethelogbookofjourneyoftheregisteredvehicleanditmustbefilledupthevehicleuserofficersbymentioningopeningandclosingkmofthejourney.




16) The starting and closingkilometerswill be admissible from thepoint of starting and closingofjourney.Thiswillbeconsideredfrom400kvHadalas/s&back.NoadditionalKilometerswillbeallowedfortoandforjourneyfromtheheadquarteri.e.400kvHadalas/s.

17) Log book of the vehicle is also to be filled up day to by the user/officersmentioning the placevisitedbyhimalongwiththedurationofjourney,traveledanddulysigned.

18) Vehiclehiredshouldbedisplayedboardinpaintwithwords“ONGETCODUTY”.19) Ifthevehiclesentbythecontractorisnotasperthespecification,chargeswillnotbepaidthough

thevehicleisusedbecauseofemergency.20) RTOrules,insurancerules&safetyrulesaretobecompliedbycontractorandDriver.Alsolabour

andP.F.lawsaretobestrictlycompiled.21) The contractor shall employ qualified and well behaving drivers having valid permanent for

drivingvehicleasperRTOandinsurancerules.Thisshallbesubjectedtoscrutinyandchecksbytheofficerinchargehandlingtheexecutionofthecontractfromtimetotime.Ifanylegalliabilityoccursonaccountofanylapseinthisregards,thesamewillbeatcontractor’saccount.Thedrivershouldbehavecourteouslyandrespectfullywithtravellingofficers.Heshouldbefreefromhabitsofsmoking/drinkingintoxicantliquors.ThedriversentwiththevehicleshallhavevalidlicensefordrivingandTaxibadge.NoanyallowanceshallbepaidbyGETCOtothedriver.Anymisbehaviorof thedriverwillbe reported tovehicleownerand ifvehicleowner fails toprovidenewdriverwithin 24 hrs. GETCO reserves the right to terminate the contract or hire vehicle from openmarketat riskandcostof thecontractor.Driver shouldwearauniformsuppliedby contractor,well‐dressed driver having goodmannerswith necessary tools and tackles and Contact facility(Mobile‐Phone)tomeetthenormalbreakdownwhileonroad.Thelodgingandboardingofdrivershallbornbycontractor.

22) IncaseofbreakdownofvehicleorincaseofavehiclenotacceptabletoGETCOthecontractorwillimmediatelyreplacethesamebygoodonewithinshortesttime(saywithin1houronly).FailuretoreplacethevehiclewillentitleGETCOtoimposepenaltyequivalenttotheaveragedailyhiringchargesforthatperiodoractualexpendituredonewhicheverishigherfortheperiod,forwhichvehicleisunderbreakdownandnotbeenacceptedbyGETCO.

23) The contractor shall provide standby vehicle to ensure prompt substitute arrangements shouldanyhiredvehiclegooffroad.

24) Accidentliability:Thecontractorshallatall‐timeindemnifiesGETCOanditsofficers,servantsandagentagainstall thirdpartyclaims,whatsoever(Includingbutnot limitedto)property losses/damages,personalaccident,injuryordeathofpersonsofanysub‐contractor,and/oragentsofthecontractorand/orofGETCO,damagetothepropertyofGETCO,arisingoutbytheHiredvehicle,thecontractorshallbareathisowncostandinitiativeatalltimestillthesuccessfulcompletionofthecontractperiod.Contractorshallhavetomaintaincomprehensiveinsurancepolicyinrespectofallinsurableliabilities,underMotorvehicleAct,workman’scompensationact,Personalinjuriesact,Emergencyriskinsuranceact,ApprovedbySecretary/GETCO.

25) Ifduetoanyreasonwhatsoever,theGETCOhastomakeanypayment,forvehicleordriveretc.theamount so paid by GETCO payable by the contractor to GETCO and all such payment shall berecoveredbyGETCOfromtheduespayabletothecontractorand/orfromthesecuritydepositofthecontractor.Balanceamountifanyisstillpayablebycontractor;ithastobepaidimmediatelytoGETCO.

26) The vehicle once inspected and approved by the Engineer for hire shall not be changed orsubstitutedby the contractor exceptonorders from theEngineeror onbecomingdefective/offroad due to accident, breakdown, etc. In such an event, the contractor shall give immediate




intimation to theEngineer. Where a changeof vehicle is likely to last formore thanoneweekpriorapprovalofthisEngineershallhavetobetaken.

27) ThevehicletobedeployedshallbeinspectedbyauthorizedrepresentativeofGETCOatanytimeduringperiodofcontract&ifanydefectisnoticed,itshouldberectifiedbythecontractor.GETCOshallhaverighttorejectvehicleifconditionofvehicleisnotsatisfactory.28) IncaseofbreakdownofvehicleorincaseofavehiclenotacceptabletoGETCOthecontractorwill

immediatelyreplacethesamebygoodonewithinshortesttime(saywithin1houronly).FailuretoreplacethevehiclewillentitleGETCOtoimposepenaltyequivalenttotheaveragedailyhiringchargesforthatperiodoractualexpendituredonewhicheverishigherfortheperiod,forwhichvehicleisunderbreakdownandnotbeenacceptedbyGETCO.

29) The speedometers recording the kilometers by the vehicle should always be maintained inworkingconditions.Ifatanytime,thespeedometergoesoutoforder,thekilometertravelledwillbe admissible according to routekilometers till the speedometer isbroughtback in toworkingcondition.Noaverageshallbeadmissiblebasedontheearlierjourneystothesameplaces.

30) ThevehicleshallhavetobeproperlyinsuredsoastocovertheriskofthelivesoftheofficersandstaffoftheGETCOtravellingbythesame,withtheirproperty.

31) GETCOhaverighttocancelthecontractifserviceofdriverorvehiclearenotsatisfactorywithoutanyreasonandjustificationissuetocontractor.




COMMERCIALTERMSANDCONDITIONS:

1. Rate: TheratesmaypleasebesubmittedasperSchedule‐B.Theratesshallbegivenbothinfiguresand words. There should not be any over writing and crossing. If any changes are to be donecrossingtheoriginalwritingthesameshouldbecountersignedbythetenderer.IncaseofdifferencebetweenratesinfiguresandwordstheratesmostfavorabletotheGETCOshallbeconsideredwhichhavebeenquoted.

2. AGREEMENT:The successful tenderers will have to execute Agreement on stamp paper of valueRs.100/‐atourTransmissionCircleOffice,GondalbeforecommencementofworksasperGETCO’sprescribedPerforma.

3. INCOMETAX:Incometaxasperruleswillbedeductedfromthebills.4. EarnestMoneyDeposit:

a. Biddersare requested topayanearnestmoneydeposit (1%ofestimatedcost)bydemanddraft only on any Nationalized Bank at Gondal for the amount as specified in the tendernotice.PaymentofEMDinformofChequeoranyotherformshallnotbeaccepted.

b. TheEMDshallbesubmittedalongwithsubmissionofTechnicalbidonly.c. TendersnoaccompaniedbyEMDshallberejected.d. Ifduringthetendervalidityperiod,i.e.180days,thetendererwithdrawshistender,theEMD

shall be forfeited and the tenderermaybe disqualified from tendering for futureworks ofGETCO.

e. TheEMDwillbereturnedpromptlytotheunsuccessfultenderer.TheEMDwillbereturnedtothesuccessful tendererafterhe furnishestheSecurityDeposit forperformanceanddulyenters intothecontract. Ifhefailsto furnishtheSDortoexecutethecontract fortheworkoffered to him, his EMD shall be forfeited and the tenderer may be disqualified fromtenderingforfurtherworksforGETCO.

5. Arithmeticalerrorwillberectifiedonthefollowingbasis:a. If there is a discrepancy between the unit price and the total price that is obtained by

multiplyingtheunitpriceandquantity,theunitpriceshallprevailandthetotalpriceshallbecorrected.Ifthereisadiscrepancybetweenthetotalbidamountandthesumoftotalcosts,the latter shall prevail and the total bid amountwill be corrected accordingly. If there is adiscrepancybetweenworkandfigures,theamountadvantageoustotheOwnerwillprevail.Ifthebidderdoesnotacceptthecorrectionoftheerrorsasabove,hisbidwillberejectedandtheamountofEMDwillbe forfeited.Thebiddershouldensure that theprices furnished invariouspriceschedulesareconsistentwitheachother.

b. Inthecaseofanyinconsistencyinthepricesfurnishedinthespecifiedpricesschedulestobeidentified in Bid Form, the Owner shall be entitled to consider the highest price for thepurposeofevaluationandforthepurposeofawardofContractusethelowestofthepricesintheseschedules.

c. Priortothedetailedevaluation,theOwnerwilldeterminethesubstantialresponsivenessofeachbid to theBiddingDocument.Forpurposeof theseClauses,asubstantiallyresponsivebidisonewhichconformstoallthetermsandconditionsoftheBiddingDocumentwithoutmaterialdeviations.Amaterialdeviationisonewhichaffectsinanywaytheprices,quality,quantityordeliveryperiodoftheequipment,completionofworksorwhichlimitsinanywaytheresponsibilitiesorliabilitiesoftheBidderofanyrightoftheOwnerasrequiredinthese




specificationsanddocuments.TheOwner’sdeterminationofabid’sresponsivenessshallbebasedonthecontentsofthebiditselfwithoutresourcetoextrinsicevidence.

d. AbiddeterminedasnotsubstantiallyresponsivewillberejectedbytheOwnerandmaynotsubsequentlybemaderesponsivebytheBidderbycorrectionofnon‐conformity

6. SECURITYDEPOSIT:ThecontractorwillhavetopaytheSecurityDepositat5%oftheordervalueonplacingtheorderoutofwhich2.5%willhavetobydemanddraftinfavorof‘GUJARATENERGYTRANSMISSION CORPORATION LTD’ or FDR in name of ‘GUJARAT ENERGY TRANSMISSIONCORPORATIONLTD/A/cnameofBidder’within7days from thedate of the issue of LOI, and theremaining 2.5%will be recovered from the first two R.A. Bills and higher percentage of securitydepositmaybe fixed at thedirectionof the SuperintendingEngineer. The securitydepositwill berefundedonlyafterthecompletionexecutionperiodofcontractsuccessfully.

7. SETTLEMENTOFDISPUTE:Incaseofanydispute,thedecisionoftheSE(TR),CircleOffice,GETCO,Gondalwillbefinalandbindingtothetenderer.

a. AnydisputeordifferencearisingunderandinconnectionwiththecontractshallbesubjecttoexclusivejurisdictionofGondal.

8. TendermustbesentonlyinsealedcoveraddressedtoTheSuperintending.Engineer(Trans),CircleOffice,StationPlot,OldPowerCompound,GETCO,Gondal.

8APayment:PaymentwillbemadeeverymonthonactualworkexecutedforwhichcontractorhastosubmitthebilltoEE(TR),GETCO,RajkotortotheofficerinstructedbySE(TR)Gondalalongwithcopyoflog‐book.ThepaymentwillbemadebyRTGS/NEFTonly.

9. TheTenderNo.and“Tenderfor(herestatethetitle)”shouldbeprescribedonthecover.10. The100%billsfortravelingofthevehicleshallbepaidonmonthlybasis.11. Ifyoufailtoexecutetheordersuccessful,theorderwillbegotcompletedthroughotheragencyandif

requiredtopayhigherrates,inthatcase,differenceofrateswillberecoveredfromyou.12. Ifthecontractorfailstoprovideavehicle,thedeductionfromhisRAbillshouldbemadeonprorate

consideringthemonthlyratepayablewithin26dayspermonth.13. TheHeadQuarterofVehiclewillbeat400kvHadalas/showeveritmaybechangedifrequired

foradministrativepointofview.Andthesuccessfultenderershallhavemakearrangementaccordingly14. Formulaforconsideringpricevariation:Foreverytenpaiseincreaseinpricesoffuel,perkmpayable

priceshallgoupbyonepaise.Thiswillbeapplicabletotheactualkmtravelledduringthemonth.Nopricevariationwillbepayableoncostofoil,tyres,tubeetc.Onlychangesinpriceofdieselwillbeadjustable.Contractormustquotepriceson thebasisofprevailing15daysbefore theduedateoftender.Thisbasicrateshallbeindicatedintheoffer.

15. Allroadtolls/bridgetollsshallbereimbursedonproductionofproofofpaymentalongwithmonthlybills.Theparkingchargesat therailwaystation,Airportanypublic/privateplaces for thevehiclewhenutilizedbyGETCOwouldbeadmissiblesubjecttotheproductionofsuchparkingslips.Theseslipsmaybesubmittedalongwiththemonthlybillsforreimbursementoftheseparkingchargeswillbepaidonproductionofdocumentsalongwithmonthlybill.

16. TheperiodofthecontractshallbeforTwoyears.Theperiodoffurtheroneyearcanbeextendedformutual agreed terms as per same rates, terms and conditions. However in case of poor servicesprovidedby the contractor, superintendingengineer,Gondal shallbeempowered to terminate thecontractafteroneyear.

17. The contractor shall immunize company’s personal against any claim arising out of accidents ormisbehaviorof thedrivers.Thevehicle shallbekeptproperly insuredall the time tocover the3rd




party risk and simultaneously immunized companyon account of likely claims frompublic, policedept.etc.

18. Thebillfortravellingofthevehicleshallbepaidonmonthlybasis.19. IfcontractorfailtoprovidethevehiclerequisitionedbyGETCOauthoritiesreservestherighttohire

WHEREAS the aforesaid GETCO has accepted the tender of the aforesaid contractors for
