ISLAMIC RELIEF WORLDWIDE (IRW) BACKGROUND Islamic Relief Worldwide (IRW) is an international relief and development agency working towards a caring world where the basic requirements of people in need are fulfilled. ISLAMIC RELIEF WORLDWIDE JORDAN OFFICE BACKGROUND IRJ has been working in Jordan since 1997, starting with distributing food packages targeting most vulnerable women and orphans. With the Syrian crisis in March 2011, the office has expanded fulfilling its mandate to respond to emergencies for the purpose of protecting lives and dignity for Syrian refugees. IRJ is managing an annual portfolio of £36,197,729.20, secured from institutional donors, UN agencies and Islamic Relief partner’s fund. In year 2014, IRJ has managed 25 projects in Health, orphans, food, non-food items and shelter sectors.

TENDER BACKGROUND IRJ intends to collaborate with local CBOs of South Jordan and conduct an assessment for unregistered Syrian refugees as well as vulnerable Jordanian households as they are the most vulnerable and marginalized since humanitarian actors are catering the registered refugees with multiple interventions in northern part of Jordan but the southern part of Jordan is being neglected and the vulnerable families settled in the south are facing a challenging situation.

Fighting hunger for unregistered Syrian refugees and vulnerable Jordanian families who live in the southern areas of Jordan by distributing food packages.

SCOPE OF WORK

1. Purchase of commodities according to the standard specified in the contract.2. Packaging the commodities into 525 parcels that display the logo of the donor as well as the CP and that this shall be of a international standard, strong quality, and suitable to be transported.3. The supplier shall hand over or make available the packed parcels, and IRJ shall recieve the parcels at the place for the delivery of the parcels and within the time for delivery specified in the contract.4. The supplier shall provide IRJ with all transferring documents, invoices, waybills, and all supporting documents. REQUIREMENT

White Rice

a. To be clean, with fresh natural smell,free of live insects, free of Salt and Jebbeh, and free of moisture intrusion.b. To pass the laboratory tests as per the Jordanian specifications.c. The white rice shall be free of balls and barley.d. To be free of other crops other than rice.e. To be free of gravel, sand and all foreign material and the dead insects are not considered from impurities ratio.f. To be free from whole grains and natural red breakage or a red veins.g. To be free from whole grains and breakage that the upper layer did not completely disarm during production processes and within specific grain ratio calcareous.h. To be free from whole grains and breakage affected by moisture, heat, effected by insects or fungi or other factors.i. To be free from whole grains and breakage, which is transparent and have half or more chalky colour.j. To be free from whole green grains and green breakage.k. To be filled in sound and solid bags, clean, dry and free from foreign smell made of pediculosis and Alltel or linen or a mixture of them, or any other suitable material.l. Tomato sauce

The sauce shall be well mixture and free of conglomerates.e. Tomato sauce to be free of bitter or burned taste.f. Tomato sauce to be free from insects and their parts.g. Vegetable ghee

Crushed Lentils

a. To be clean, with fresh natural smell,free of live insects.b. Adding colours is prevented.c. To be clean, mature, and properly fit for human consumption.d. The grains shall be colour, size, and classified homogeneous in one package as possible.e. Moisture ratio shall not exceed 14%.f. To be free of dirt and impurities of animal origin and dead insects that pose a threat to human health.g. Product shall be packed in containers provide protection, health and maintain the nutritional value.h. The containers shall be manufactured of safe and suitable material for the intended use and that does not have an impact or affect the taste and smell of the product.i. Packing bags shall be clean, strong, and airtight.j. Newly produced, and delivery to be during the first third of the validity period.k. To provide samples to be checked by the technical committee.

Sugar

a. To be clean, white, and free of exotic scents.b. To be free from any taste except its sweet taste.c. To be free of insects or their parts and any rodent droppings.d. To be free of foreign substances, preservatives and coloring items.e. To pass the laboratory tests as per the Jordanian specifications.f. To be packaged in large containers made of materials suitable to save and keep the items dry, clean, odorless and free from foreign materials.g. The containers shall be closed well and not be affected or ruptured when transferring the parcels.h. Newly produced, and delivery to be during the first third of the validity period.i. White beans

a. To be clean, free of breakage and moisture intrusion and should not be musty.b. High quality dry beans with same size.c. Newly produced, and delivery to be during the first third of the validity period.d. To provide samples to be checked by the technical committee.

Pasta

a. Pasta is made from adding water to semolina or wheat flour. Eggs and some improvers color and textures could be added.b. Production information should be marked depending on the Jordanian specifications keeping in mind the safety of packaging.

c. Pasta should be dry, clean and free of harmful substances and impurities.d. The pasta shall contain natural characteristics and free of odors. It shall keep its texture when boiling it in water for 10 minutes.e. To pass the laboratory tests by the Jordanian specifications.f. Newly produced, and delivery to be during the first third of the validity period.g. To provide samples to be checked by the technical committee.

Tuna

a. Fish that are used in the manufacturing should smell of fresh fish and should keep its color and taste and have no signs of damage.b. To be free of other types of fish.c. To be free from freezing burns.d. It shall be cut horizontally or diagonally to preserve the original shape of the fiber fish.e. To be packed with natural colored vegetable oil.f. The containers should not have oil, rust, or dirt on their outer surface.g. The inner surface of the containers should not have prominent signs resulting from the chemical reaction.h. Newly produced, and delivery to be during the first third of the validity period.

Maggi cubes

a. The weight of the piece should not be less than 20 grams.b. To be extracted from chicken broth.c. Melts easily.d. Components (chicken fat, salt, sodium Gelotomat, yeast extract, onion, spices).e. Newly produced, and delivery to be during the first third of the validity period.f. To provide samples that will be checked by the technical committee.

Powder milk

a. Full cream and dried cow milk.b. To pass the laboratory tests by the Jordanian specifications.c. Be clean milk that retains the natural properties of powder milk in terms of weight, taste and smell.d. To be free from impurities and exotic materials.e. To produce a homogeneous liquid milk having the properties of fresh milk if water was added according to the ratio shown on the cover.f. Melts easily in water at all temperatures.g. The milk shall be packaged in healthy bags that do not affect the taste of the milk and do not interact with it.h. Newly produced, and delivery to be during the first third of the validity period.i. Cheese (Triangles)

a. Triangular cheese with 8 pieces (120 Grams). Cheese created by cooking one or more kind of dry cheese and after some mixed with emulsifying salts and salt and stabilizers textures or dairy products and some food inlays.b. Cheese shall be provided according to the following conditions b.1 Cheese shall be packaged in carton that contains 8 pieces and shall be closed well and show the production information and each piece should weigh 15 grams.b.2 The cheese shall hold natural properties of color, taste and smell. Shall be packed and closed well to preserve the taste and to avoid infection or change in colour.g. Easy to be cut and free of separate oil.h. Vermicelli

a. To be produced of high quality flour.b. To be free from rot defects any strange odors.c. To be white yellowish and to keep its texture while cookingd. To be packed in transparent containers in accordance with the Jordanian specifications.e. Newly produced, and delivery to be during the first third of the validity period.f. To provide samples to be checked by the technical committee.

White Theineh

a. To be free of any strange taste or smell.b. Shall be viscous and has a special color.c. Shall not have oil separation.d. Shall be free of dtrange fat.e. To pass the laboratory tests as per the Jordanian specifications.f. To be packed in airtight containers and protected from leakage of liquids.g. Shall be packed and closed well to preserve the taste and to avoid infection or change in colour.

h. The container shall be clean from both inside and outside and the material shall not absorb oils.i. Newly produced, and delivery to be during the first third of the validity period.j. To provide samples to be checked by the technical committee.

White Salt

a. Shall be with a clean white color, and the taste shall be free of bitterness and strange taste.b. It shall be free from defects such as limestone, sand, gravel and other strange materials.c. It shall be dry which flows easily.d. Newly produced, and delivery to be during the first third of the validity period.e. To provide samples to be checked by the technical committee.f.Shall be packaged in a clean containers that are airtight, insulation for moisture, keeps the salt and does not affect it.g. It shall contains a list with any food additives.h. Incase of any added heat-sensitive materials, the container shall have a (Best Use Before date) printed.

Tea

a. Shall be colored homogeneous and without color additives.b. Shall be free of strange materials.c. To pass the laboratory tests as per the Jordanian specifications.d. Shall have very good taste and smell.e. Shall be filled in bottles made from healthy cartons which maintain the quality of the product.f. Newly produced, and delivery to be during the first third of the validity period.g. To provide samples to be checked by the technical committee.

Flour

a. Shall be healthy flour filled in bags that are new and clean, made of materials that protect the product from contamination and flow.b. That bags shall maintain the quality taste and smell of the product.c. Shall have very good taste and smell and free of rot.d. Shall be free of strange and contaminated materials.e. Shall be free from living or dead insects or parts of them.f. Newly produced, and delivery to be made during the first third of the validity period.g. Canned meat

a. The source of the meat must be Halal according to Islamic Law (Shariah).b. The aminals must be Slaughtered according to the Islamic Law (Shariah).c. The meat must not be from stunned animals or those animals with defects

d. The meat shall be free from epidemics and radiation.e. The meat shall be free of sticky material, fungi, and bacteria.f. Shall not be salted.g. The meat shall be clean and have very good taste and smell and shall be free of strange taste.h. The meat shall be free of industry defects such as air spaces.i. ROLES AND RESPONSIBILITIES

Supplier Roles and Responsibilities:

a. Make sure to provide highest quality of the 18 commodities mentioned above.b. Maintain the required quantities and weights submitted.c. Make sure that the expiration date of these commodities is not before June 2016 and to be delivered during the first third of the validity period.d. To deliver 525 parcels that are properly packaged and free of damages and corrosion .e. To transfer the parcels to the distribution points a day before the scheduled distribution.f. IRJ will have three distribution points in three different governorates (Ma’an, Karak, and Tafilah).

REPORTING

The supplier shall be responsible to the Finance department and the Programme department represented by the project manager for IRJ

METHODOLOGY

a. Packaging of commodities according to the standard specified in the contract into 525 parcels that show the logo of the donor as well as the CP and that shall be as of international standard, strong quality, and suitable to be transferred.b. Transfer the parcels to the targeted distribution points according to the distribution order from IRJ side.c. After transferring the parcels, the supplier shall provide IRJ with all transferring documents, invoices, waybills, and all supporting documents.

DELIVERABLES

a. Do a presentation of the services that you offer. b. Provide IRJ with samples of the parcels to be checked.

ELIGIBILITY It would be the responsibility of the supplier to ensure transporting parcels in covered trucks where the parcels should be packaged in high quality cartons and packed into blocks to prevent from any likely damages.

TENDER GUIDELINES General Instruction a. Transfer of bidding document: the bidding document is not transferable.b. Cost of bidding: The bidder shall bear all costs associated with the preparation and submission of its bid, and IRJ will in no case be responsible or liable for those costs, regardless of the conduct or outcome from the bid closing date.c. e. Language and signing of bid: the bid prepared by the bidder and all correspondence and documents relating to the bid exchanged by the bidder and IRJ shall be written in the Arabic language or English.f. IRJ retains the right to modify the terms of the bid, or any of the model contract, sections, attachments, and formats at any time.g. Bidders must review the technical specifications, scope document and ensure that the services being offered are as per specifications prescribed in this document.h. Bidder must review the contract terms and conditions (Appendix 4) before providing details on the commercial part as specified in this tender document. Bidders shall be deemed to have understood and taken into account all terms and conditions prescribed in the contract. Any exceptions or deviations to clauses affecting prices must be clearly stated. In the event no exceptions or deviations are made or taken, bidders must stamp and sign the compliance statement. Specific Instructions

a. Bidders will submit the bid from its entirety and no alterations will be made to the form or the wording therein. The proposal must be filled in completely and all pricing shown as required. It shall be inclusive of the cost (including all taxes) relating to provision of food parcels as prescribed in the technical specifications and scope document etc.

c. The technical un-priced bid of the bidder will be opened and evaluated first. If the bid is technically acceptable; and has provisions or acceptable alternatives to the requirements specified in the tender and conforms to other non-commercial requirements as may be decided by IRJ committee members, then the commercial priced offer of these bidders will be opened for commercial evaluation.d. In the technical un-priced bid, all the technical attachments (Appendix 1), (Appendix 3) and (Appendix 4) should be submitted which would include compliance with technical specifications and all the price information should be left blank, including owner ship documents, company registration documents plus technical specification of the proposed food parcels and a brief description of the proposed items being quoted. e. In the commercial part should be a comprehensive package, which should include all price information as well as “technical” bid information. If any exception in either the technical part or commercial part is taken, the bidder must advise IRJ separately in the technical bid as per guidelines and format provided.

Deadline for submission of bids:

Bids and samples must be received by IRJ at address specified in the documents not later than the prescribed date and time in the invitation letter and tender document. IRJ may at its discretion extend the deadline for the submission of bids by amending the bidding documents in which case all rights and obligations of IRJ and bidders previously subject to the deadline will thereafter be subject to the deadline as extended.

In case of unscheduled holiday in Jordan being declared on the prescribed closing day of the tender or tender closing date falling on a holiday, the next working day will be treated as the scheduled prescribed day of closing of the tender.

Late Bids

IRJ reserves the right to reject or accept the bid submitted after the deadline for submission of bids.

Unsolicited Communications:

In case any bidder makes any unsolicited communication in any manner, after the bids have been opened (for tenders processed either on single bid or on two bid system) the bid submitted by the particular bidder shall be summarily rejected, irrespective of the circumstances for such unsolicited communication.

Commercial Proposal Requirements

a. Prices quoted shall be in Jordanian Dinar only.b. Prices quoted should be the bidders’ best possible prices.c. Prices should be quoted in price bid conforming to the format provided therein (Appendix 2). Prices quoted in the bid shall be firm and binding for the providing agreed services or any additional service requested by IRJ from time to time during the validity of the contract or any extension from the date of signing of the contract. No interest shall be payable on delayed payments by IRJ.d. Price in words and figures: In case of any discrepancy between price quoted in words and figures, the prices in words shall prevail.e. Unless otherwise specified, the price specified in the "Commercial Priced Bid" shall be inclusive of all taxes and other duties/levies applicable as per the prevailing rules.f. PRICED PART "COMMERCIAL BID" (In Sealed Cover) This part shall contain only price details and shall be as per the format attached (Appendix 2). Conditions or specifications if any, mentioned in this part will not be taken cognizance of schedule of prices, with prices qualifications to general conditions of contract –priced technical exceptions or qualifications-priced commercial details via prices, etc. of alternative proposals.

NOTE: SCHEDULE OF RATES: THE BIDDER SHALL HAVE TO SUBMIT SCHEDULE OF RATES FOR EACH LINE ITEM OF THE SCOPE OF WORK THEREIN.

Technical Proposal Requirements.

a. The bidder must adhere to the technical specification requirements as mentioned in the tender and state the same in the “technical Bid”. Bidders to direct their technical clarifications and requests within a week from the tender issue date.

b. In the "Technical Unpriced Bid", all the technical attachments should be submitted and all price information should be left blank. The commercial part should be a comprehensive package, which should include all price

information only. If any exception in either the technical or commercial part is taken, the bidder must advise IRJ separately in the "Technical Unpriced Bid" as per guidelines and provided format.

UNPRICED PART "TECHNICAL BID" (in sealed cover)The technical part shall contain all details as mentioned below. This part shall not contain price. 1 - Duly filled in and signed and stamped form of tender.2 - Information requested in the Instructions to bidders.3 - Schedule of prices, without mentioning prices.4 - Qualifications to general conditions of contract-Unpriced.5 -Technical exceptions and qualifications- Unpriced.6 - Alternative proposal (if any) - Unpriced.7 -Past history of similar services.8 - Bidder to confirm time required to start the requested services.9 - Bidder to confirm that in the event of award of contract, the agreed contract rates shall be valid for 120 days.10 - Bidders to submit of this tender duly signed and stamped on each page as per receipt of acceptance to agreeing all our terms and conditions of this contract.

Technical Bid Evaluation Criteria

The bidders are requested to strictly follow the instruction to bidders and accordingly submit the information,confirmation and documents in the technical bid. The technical bid(s) received for this tender shall be technically evaluated based on the information, samples, confirmation(s) and documents requested in clause of instruction to bidders.

The Bidder is also required to submit the documentary proof for following:a) Criteria regarding bidder's network of offices or operations.• It is very important to technically qualify, that the bidder must have his own network of offices, or offices• The bidder must submit the details and documentary proof of his own offices or offices of his Joint venture. the bidder also needs to submit the copies of following valid documents proofs of with the technical bid.• IT PAN• Service Tax Registration No.• VAT Registration No.• Bidders complete details i.e. Name, Address, Tel No., Fax No., mobile No., email id’s, state whether it is a proprietary/partnership/Pvt. Ltd./Ltd company. Names of the proprietor, partners, directors.• Bidder's authorized representative: name, contact details.• Bidder shall provide complete details of base from where he intends to operate for these proposed services.

Criteria regarding work experience of Bidders:

The bidder must meet the following criteria:a) The bidder shall have experience in carrying out "SIMILAR NATURE" of work with any Govt/Semi Govt. /NGO/Private company. The bidder shall provide necessary documentary evidence for the same.

b) "SIMILAR NATURE" means the bidder must be in the business of providing food parcels and the experience of successfully executing at least one single contract for such products and services during last 3 (three) years (ending bid closing date). Bidder to submit copies of work order or contract for the same. Payment Terms.

Compensation to the bidder shall be made as per the prices quoted and in accordance with terms of the payments as may be finalized with bidder and stipulated in the contract. Payment will be made within two (2) weeks after receipt of official invoice from the supplier, and as per terms of payment for products and services provided.

Taxes and Duties and Approvals

a. The bidders shall quote their prices inclusive of all taxes and duties.b. Bidder shall be responsible to obtain at its own cost, all required permits and consents, wherever applicable and required for the performance of the bidder's obligations under the contract, from Jordan concerned state governments, authorities or agencies or political sub-division. IRJ will provide reasonable assistance wherever required, but all expenses related to obtaining the permits or consents shall be to the bidder's account. Bidder shall enclose with the bid, copy of the PAN, VAT, and Service Tax Reg.

Change Orders

The negotiated and quoted rates shall be valid and firm for primary period of the contract and extension from award letter date or up to the completion of the contract whichever is later. IRJ will be entitled to issue oral orders to the bidder/contractor in the event of emergency. IRJ shall ensure that such oral orders shall be followed up with written communication. Possession Time

Time is of essence of the contract and bidder shall perform the services diligently in accordance with the terms of this contract. In the event it becomes apparent that the contractor fails to comply with the instructions of IRJ, the bidder shall, as instructed by IRJ, at its own cost, take all necessary steps to expedite the process, failing which the provisions of liquidated damage as specified in the contract shall be applicable.

Right to accept or reject Bids

IRJ may, at its discretion, reject any bid or all bids received or may accept any bid or part bid which in IRJ's sole judgment, is the most advantageous to IRJ. IRJ reserves the right to reject any or even all bids for the scope of work indicated in the tender or terminate the tender at any time by giving due intimation to all the participated bidders.

If required, bidder's attendance may be required at a bid clarification meeting at IRJ's offices in Amman office or any other filed office designated by IRJ. A meeting agenda will be transmitted to bidders before the scheduled meeting date through mail or hard copies.

Use of Arabic / English language

All correspondence, documentation and drawings shall be in the English language the contract and the registration documents shall be in the Arabic language.

Products & transfer services

All provided products and transfer services must meet the requirements of the applicable technical specifications of the technical criteria.

Contract and other terms:

IRJ and or its representative reserve the right to make any changes, including additions or deletions from the quantities originally ordered or in the specifications of particulars.

إتفق الفريقان على ضرورة إلتزام الفريق الثاني بالتنفيذ حسب المواصفات وحسب ما ورد في أمر اإلحالة رقم…………………

سادسا : إتفق الفريقان بأن يتحمل الفريق الثاني التكاليف المرتبطة بالعمال والتي تشمل التأمينات وأجور النقل

والتعويضات في حالة األصابات و خالفه وال يحق للفريق الثاني الرجوع للفريق االول بخصوص اي تكاليفاوحقوق تتعلق بهذا البند .

سابعا : اتفق الفريقان على أن هذه األتفاقية ال عالقة لها بأي تغيير يطرأ على أسعار المواد وأجور العمال سواء

بإنخفاضها أو إرتفاعها طيلة مدة سريان هذه األتفاقية . ثامنا :

على الفريق الثاني األلتزام بتقديم كتاب رسمي بأن المواد الغذائية حديثة األنتاج وسيتم توريدها خالل الثلث األول من فترة الصالحيتها و ذلك من تاريخ التوريد وأن جميع المواد مطابقة للمواصفات والمقاييس

األردنية . تاسعا :

يلتزم الفريق الثاني بتنفيذ األعمال بالكميات والمواصفات المراد تنفيذها من خالله حسب أمر األحالةالصادر من الفريق األول ووفق جدول الكميات.

عاشرا : …….( …………… دينار أردنيا عن كل يوم تأخير عن المدة المقررةJODتطبق غرامة تأخير )

% من قيمة األتفاقية وفي حالة تجاوز ذلك يحق للفريق األول تكليف10والمذكورة أعاله وبحد أقصى مورد أخر بتوريد المواد ويتحمل الفريق الثاني أي تكاليف جديدة وفروق األسعار .

أحدا عاشرال حاجة لتداول أي إنذار او إخطار بخصوص تنفيذ أعمال هذه األتفاقية.

أثنا عشر : يقر الفريق الثاني بأنه وفي حال لم يلتزم بالمواعيد المتفق عليها في هذه اإلتفاقية فإنه ال يحق له

مطالبة الفريق األول بأية مبالغ نتجة عن هذه األتفاقية ويقتصر حقه في مطالبة الفريق األول في حالة تم األلتزام فقط بالمواعيد المحددة , وان اي اخالل من قبل الفريق الثاني يجعل العقد مفسوخا حكما

وباألتفاق المسبق وال يلزم الفريق األول باية مطالبات مهما كان منشأها حتى لو تم تسليم جميع المود المتفق عليها وان اخالله بأي بند من بنود العقد يسقط حقه بمطالبة الفريق األول بأي مبالغ نشأت عن

العقدوال يقبل من الفريق الثاني اي فاتوره او اي مواد متفق عليها بعد انتهاء مدة األتفاقية.

ثالث عشر: في حال حدث خالف ال سمح الله فإن محكمة بداية عمان _ قصر العدل هي المختصة مكانيا للنظر في

.هذا الخالفرابع عشر :

اإلغاثة اإلسالمية ال تسمح ألي من موظفيها بالتصرف بطريقة فاسدة عند القيام بأعمالها أو عند تمثيلها , يتوجب على أي موظف من موظفي اإلغاثة اإلسالمية عدم إعطاء أو قبول أي نوع من الرشاوي أو

تسهيالت , و عدم إعطاء أو قبول أي نوع من أنواع الضيافة ويتوجب عليه التحلي بأعلى المعايير األخالقيةو القانونية عند تمثيل اإلغاثة اإلسالمية

اإلغاثة اإلسالمية تتبع سياسة عدم التسامح في مكافحة الفساد و الرشوة القاعدة بسيطة :يجب عدم عرض أوقبول أي نوع من أنواع الرشاوي سواء كانت مباشرة أو غير مباشرة .

وعلى ما جاء أعاله تم الرضا و األتفاق بين الفريقين ووقعاه بحريتهما بعد أن تفهما مضمونه حرفيا و تعهدا بعدم الرجوع عنه أو عن أي بند من بنوده مهما كانت األسباب و إختلفت الدواعي و عليه جرى التوقيع

أمام شهود الحال حسب األصولتم تحرير هذه األتفاقية من أربعة عشر بندا ومن ضمنه هذا البند :
