Govt. and who has executed similar nature of work successfully as mentioned in Qualification requirement criteria given in the tender document. Bidders should fulfill the all the qualification criteria. Otherwise their bids will not be considered & price bid will not be opened. All the bidders should have valid e-tender vender registration. 1) Any deviation found in Data / Details / Documents in on line offer (E-tendering) and physically submitted documents (Tender document fee, EMD, Vender Registration, Technical and commercial documents etc.) of bidder, offer of the same bidder will not considered and no any further communication in the matter will be entertained. Physical copy is

for reference only and tender will be evaluated on Data / Details / Documents of the on line offer. For any discrepancy between online & physical bid. Online bid is considered as final.

2) It is mandatory for all the bidders to submit their tender documents by both forms viz. on – line (E-tendering) and physically in schedule time. If tender documents submitted in only any one form, say either by on line or physically, in that case the same tender will not be considered.

3) The bidders are required to fill up all the online appendices (annexure) / forms. This is intended for transparency and speedy evaluation of the bids. Instead of simply confirming / attached in bid / refer physical offer, the Bidder shall fill in the particulars against appropriate place in respect of each line appearing in each online annexure. Wherever required, bidder shall invariably have to submit supporting authentic documents in the physical bid. (In the absence of required details in the online annexure, the purchaser has every right to evaluate the bids accordingly and bidder cannot raise any objection against any point during evaluation.)

4) Bidders are requested to remain in touch with the web-site for any amendment / corrigendum or extension of due date etc.

5) No tender shall be accepted / opened in case of receipt after due date and time of tender, irrespective of delay due to postal services or any other reasons and the Corporation shall not assume any responsibility for late receipt of tender.

6) The Earnest Money Deposit and tender fee will be accepted by demand draft of any Schedule Bank payable to “Gujarat Energy Transmission Corporation Ltd., Himatnagar.” Tender without EMD and tender fee shall be rejected.

7) The GETCO reserves the right to award the work to one or more bidders, considering their technical and financial capacity OR to reject any or all tenders or accept any tender without assigning any reason thereof.

Technical Specification

SPECIAL TERMS AND CONDITIONS:

The terms and condition of this section will be read in conjunction with general terms and condition of tender. However, wherever, ambiguity observed, terms and condition mentioned under Special Terms and Condition will supersede the General Terms and Condition of tender. 1) Tenders are invited for hiring of with A/C closed body diesel driven, 9seated (8+1) Minimum, for 12Hours/day on

ARC basis and head quarter at 220KV Vijapur GETCO office.

2) The vehicle to be offered for hiring shall been up-to-date condition including the tubes, tires, engine as well as

condition of outside body. The vehicle to be offered shall not have been registered before 2 year as on date

of tender opening (RTO registration Date). However, in case of a very poor response or to break off the likely

cartel, a relaxation can be granted for one year with the permission of Circle head. However, the Officers placing

an order should ensure that condition of such vehicle is tiptop.

3) The touring journey covers the area within Gujarat State and as per the instructions of the Officer.

4) The rates quoted shall be on ANNUAL RATE CONTRACT basis. Thus, rates quoted shall remain valid for

complete period of order. The rates must be inclusive of the salary of driver, cost of fuel, oil and other

consumables, wear & tear of tyres & tubes and maintenance charges including material cost to keep the vehicle

in full working and smooth condition.

5) PERIOD OF CONTRACT: The period of contract is 24 Months. However, contract may be extended further for

12 months on mutual agreement and on same rate, terms and conditions of the contract if performance of

contractor found satisfactory.

6) The GETCO reserves the right to terminate the contract at any time without assigning any reason by giving 30

days’ notice in writing. The contractor shall not be entitled to any compensation by reason of such termination of

contract.

7) The contractor will have to fulfill the condition of contract labour regulation abolition Act-1970 and furnish the

records failing which payment will not be made.

8) For 12/12 hours vehicle weekly one day W/off available.

9) The traveling of vehicle per month is limited for 3000 kM. However, for utilization of excess KM will be paid as per

rate of schedule “B.

10) The arrangement of expenditure for night halt of driver at any where in Gujarat shall have to be done by the

contractor.

11) The vehicle should have good upholstery covered with clean covers, comfortable seating arrangement and shall

be washed/service at regular intervals of a week. Vehicle shall always be kept neat and clean.

12) Penalty: If the contractor fails to provide a vehicle; the deduction from his RA bill should be made on prorate

basis considering the monthly rate payable for 26 days per months.,.

13) The bills for travelling of the vehicle shall be paid on monthly basis. No advance for hiring of vehicle shall be paid.

The bill in triplicate should be forwarded to concerned engineer and payment will be made by A/c payee cheque

only. Income tax if any will be deducted at source from monthly bill.

14) Opening and closing Kilometers reading and kilometers travelled should be got certified and duly signed by the

officers traveling the vehicle. In absence of these requirements the bill will not be paid.

15) The toll taxes to be paid during official travelling of vehicle shall be reimbursed to the contractor on production of

receipt duly signed by GETCO authority who have travelled or directed a travel. All road tolls / bridge tolls shall be

reimbursed on production of proof of payment along with monthly RA bills.

16) In case of accident to the vehicle, it is the responsibility of the driver or occupants of the vehicle. The whole and

sole responsibility of vehicle owner/ the contractor for accident to pay compensation or damages to the persons,

involved as per law or Act and the GETCO will not be responsible for any claim on this account.

17) In case of poor service provided by the contractor, circle head is empowered to terminate the contract as per

GETCO terms & condition.

18) In case of any dispute or any discrepancy, the decision of Supt. Engineer, Transmission Circle, Himatnagar will

be final and binding to the contractor.

19) If contractor fails to execute the order successfully, the order will be got completed through other agency and if

required to pay higher rate in that case difference of rate will be recovered from the contractor.

20) The contractor shall follow all rules and regulations pertaining to the vehicle and its running/working such as RTO,

traffic, etc. scrupulously. Any consequences arising due to non-observance of any such rules shall be borne by

the contractor.

21) Head Quarter of vehicle will be at 220KV Vijapur GETCO office and journey kilometers will be considered from

Head Quarters to Head Quarters.

22) Agreement: As per GETCO’s rules, contractor will have to enter into an agreement on Stamp paper of Rs. 100/-

with the GETCO in prescribed format before execution of work. The cost of stamp fees shall be borne by the

contractor.

23) The contractor will have to execute an indemnity bond on stamp paper of Rs. 100/- at his cost before

commencement of order stating that for any accidents or damages to the contractor’s staff/equipments or any

other persons/vehicle due to nonobservance of safety measures, GETCO shall not be responsible.

24) Contractor will start hiring services from the date of commencement letter of order and the contract will remain

valid as per terms and conditions.

25) Formula for considering price variation: No price variation will be payable on cost of oil/tyres, tubes etc. Only

changes in price of diesel will be adjustable. For every one rupee rise/fall in the price of Diesel per liter, following

adjustment will be given. Diesel driven vehicle – 10 paisa (increase / decrease in rate) per Kilometer or

any fraction Thereof for Kilometers traveled by the vehicle after the date of increase / decrease in

Diesel Price will be paid/Recovered for the actual Kilometers Traveled thereafter.

26) Bidder must quote prices on the basis of rates of Diesel prevailing 15 days before due date of tender. Please

submit the prevailing Govt. approved diesel price list of I.O.C. with tender copy.

27) EMD: It is required to pay Earnest Money Deposit along with tender in form of demand draft only in favor of

Gujarat Energy Transmission Corporation Limited. Payable at Himmatnagar only. EMD for all unsuccessfully

bidder release promptly after receiving application of party and unsuccessfully bidder EMD released after enter in

contract or paid SD.

28) The ‘Earnest Money Deposit’ paid herewith should be absolutely forfeited by the GETCO if the full amount of

specified security deposit is not paid in specified time by the successful bidder SECURITY DEPOSIT: The 2.5% of

tender value is required to be paid by Demand Draft/FD in favor of “Gujarat Energy Transmission Corporation

Limited” Payable at Himmatnagar on acceptance of tender as security deposit at Circle office-Himmatnagar &.

The Security Deposit will be paid within 10 days of receipt of LOI. Remaining S.D 2.5% of Tender value will be

deducted from first & second R.A bill in equal installments. Bidder may be disqualified from participation in future

tender if SD is not paid within given time .It the discretion of GETCO part and communication will be entertain in

this regards.

29) The Supt. Engineer (TR) Himatnagar reserves the right to reject any or all the tenders without assigning any

reasons thereof.

30) Vehicle supplied should be comprehensively insured. Attested copy of insurance policy should be submitted to

this office before placement of order. Insurance for driver should also be arranged by the contractor and attested

copy of the same should be submitted to this office.

31) The successful tenderer will have to provide full details such as phone No / Mobile/phone No. / Full address

Name of responsible person etc for contacting him at any time. Any offer not fulfilling this requirement will be out

right rejected

32) GEB (i.e. Gujarat Electricity Board) & GETCO (i.e. Gujarat Energy Transmission Corporation Limited.) are

interchangeable wherever/ whenever context admits.

33) Vehicle will have to be sent along with well-experienced, well-dressed driver having good manners with necessary tools and tackles to meet the normal breakdown while on road. The driver sent with the vehicle shall have valid license for driving and Taxi badge. The driver shall be well versed with R.T.O. rules. The driver shall be preferably below the age of 40 yrs not more then 55 Years. The lodging and boarding of driver shall be borne by contractor.

34) No tools, tackles and manpower for execution of order will be provided by GETCO.

35) The driver should be provided with enough money to cover the cost of diesel, repairs and incidental expenditure

while in journey.

36) The driver should be fully instructed for the good behavior and to drive the vehicle only in accordance to the clear

directives of Officer In charge and as per RTO rules. In case, if driving is found rough, contractor shall have to

change the driver with genuine one.

37) The contractor shall be indemnify company’s personal against any claim arising out of accident or misbehavior of

the drivers. The vehicle shall be kept properly insured all the time to cover the 3rd party risk and simultaneously

immunize company on account of likely claims from public, police dept etc.

38) The prices quoted by the Contractor should indicate service tax separately. The same will be reimbursed as

applicable only against submission of documentary proof of payment of service tax submitted to concern office

along with monthly bill. If service provider is not liable for service tax due to turnover does not exceed prescribed limit

under Finance Act, 1994 and rules, notification published there under time to time then it has to submit declaration on

non judicial stamp paper of Rs.100 for the same each year. In that case, service provider is not liable to pay service

tax and service tax portion is reduced to that extent.

39) The general use of vehicle is for line maintenance work to transport man & material, used on Kaccha/Pakka

road/Bullock cart way where vehicle approach is possible.

40) During the period of maintenance, breakdown of the vehicle, when the vehicle may not be sent, the contractor will

have to send another vehicle of same class and model year. In case of failure to meet this condition, another

vehicle shall be hired by the GETCO from the market at the prevailing market rates and difference of amount

paid, if any, shall be recovered from the contractor’s bill.

41) The validity of the tender shall be 180 days from the date of opening of tender.

42) Conditional tender will not be accepted and straight away be rejected.

43) The contractor is bound to furnish his rate justification in the form of rate analysis, if asked.

44) The contractor bidding for the work must have vehicle registered in his name or on his firm’s name. Failing to

produce such proof EMD / SD paid by the contractor shall be forfeited.

45) Full size carrier should be provided on vehicle.

46) Rates for excess Kms travelled by hired vehicle, beyond 3000 km /month is admissible occasionally, with written

permission of Circle head.

47) It is advised to mention here that all parties to fill up advance stamp receipt along with DD of EMD so that in case

of party except L1, EMD can be released promptly on receipt of request letter from the party.

48) Successfully bidder shall obtain PF registration within 30 Days of awarding the contract. This condition is

applied for the bidder who is not self-employed means he does not drive this hired vehicle on his own. Vehicle owner who is self-employed shall furnish undertaking for the same on non-judicial stamp of Rs 100 in specific formats for PF related liability.

49) Physically fitness certificate shall be obtained from the Government civil Hospital .It shall be furnished to GETCO concern office.

50) Vehicle should be name of owner/Bidder.

51) Bidder must quote diesel prices on the basis of prevailing 15 days before the due date of tender. This basic rate shall be indicated in the offer with documentary proof.

52) Over time will be given if vehicle is used for more than hours specified in the tender(i.e-wherever applicable).if tentative timing given in that case to bidder must satisfy condition of actual usage of vehicle for more than hours specified in tender (i.e. wherever applicable).

53) Any bid received by the Owner after the time and date fixed or extended for submission of bids prescribed by the Owner, will be rejected and not considered for evaluation and same will be return as seal condition.

54) No Copy of PRICE-BID requires in Physical copy of bid. It is compulsory to submit price-bid through on-line (n-code) only. Same will observe in physical bid during opening time. Online price bill shall be considered as final.

55) Any verbal/telephonic clarifications and information given by the Owner or his employee (s) or his representative(s) will not in any way be binding on the Owner.

56) In case an intending Bidder finds any discrepancy or omission in the documents and specifications or is in doubt as to the true meaning of any part, he shall make a request, in writing not later than the date of pre Bid discussion to the owner in triplicate. The owner will issue explanations, interpretations and clarifications as deemed fit in writing as a response to this request. On receipt of such interpretations/clarifications, the Bidder may submit his Bid within the date and time stipulated in the Bid invitation, all such explanations,

interpretations and clarifications from the Owner shall be deemed as part of Bid Documents and shall invariably accompany the Bidder’s proposal.

57) Amendment of bidding document.

• At any time prior to the deadline for submission of Bids the Owner may, for any reason, whether at his own initiative or in response to a clarification requested by the intending Bidder, modify the Bidding Document with amendment(s).

• The amendment will be notified in writing or Fax /web site to all intending Bidders who have received the Bidding Document at the address contained in the letter of request for issue of bidding document from the Bidders. Owner will bear no responsibility or liability arising out of non-receipt of the same in time or otherwise.

• In order to afford prospective bidders reasonable time in which to take the amendment into account in preparing their bids, the Owner may, at his discretion, extend the deadline for the submission of bids.

• Such amendments, clarifications etc. shall be binding on bidders and will be given due consideration by the Bidders while they submit their bids and shall invariably enclose such documents as a part of the bid

58) No bid may be withdrawn in the interval between the deadline for submission of bids and the expiration of the period of bid validity specified by the Bidder on the Bid Form. Withdrawal/modification of a bid during this interval may result in the Bidder’s forfeiture of its bid security.

59) The Owner will open the technical bids (Cover –I, II, ) in the presence of Bidder’s representatives who choose to attend on the date and time mentioned for opening of bids in the Invitation to Bid or in case any extension has been given thereto, on the extended bid opening date and time notified to all the Bidders who have purchased the bidding document. The Bidder’s representatives who are present shall sign a register evidencing their attendance.

60) The price bids of all the “Techno-Commercial” Responsive Bidders shall be opened in the presence of representatives (up to two per firm) of such bidders who choose to be present. The date & time of opening the Price Bid shall be intimated to all such qualified bidders by Fax/Telex, at least one week in advance besides inviting final price bid if found appropriate after evaluation of Technical bids.

61) No electronic recording/transmitting devices will be permitted during Bid opening.

62) The Bids received/accepted/opened will be evaluated by the Owner to ascertain the technical responsiveness of the bid for the complete scope of the proposal, as covered under these specifications and documents. All technically responsive bids shall then be examined to determine the LOWEST EVALUATED COMMERCIALLY AND TECHNICALLY RESPONSIVE BIDS.

63) To assist in the examination evaluation and comparison of Bids the owner may on his own ask the Bidder for a clarification of its bid and demanding document. The request for clarification and the response shall be in writing and no change in the price or substance of the bid shall be sought, offered or permitted.

64) Submit declaration on non-judicial stamp paper of Rs.100 for the same each year. In that case, service provider is not liable to pay service tax and service tax portion is reduced to that extent.

65) The contractor quoting for the tender is deemed to have gone through General Terms & Conditions of this work / Contract booklet / Special conditions and same will be treated as binding on him.

66) The contractor has to give his letter for below or above for the total amount indicated against item no. 1 only.

The rate against item no. 2 of the schedule is unilaterally decided by GETCO and shall not under go any change. However the item no 2 shall be subject to variation as per relevant clause of general specification (i.e. variation in diesel price.)

67) Getco will pay 50% of Service tax by itself on abated value basis. However contractor has to furnish under taking that CENVAT Credit on Inputs capital goods and input services used for providing the taxable services ,has not been taken under the provision of CENVAT credit rules 2004.

68) As this service falls under Rant and Cab. Hence contractor add rant and cab service in his ST-2 for service to be provide under contract.

69) However if service provider is not liable for service tax registration as per prescribe under finance Act 1994 then he has to submit declaration or same on 100 rupees NON –judicial stamp..

GENERAL CONDITIONS OF CONTRACT

1) The contractor shall be required to supply diesel driven closed body vehicle jeep having Taxi / Maxi passing

from RTO of the models not before two year as on the date of tender opening and strictly in accordance with the

specification laid down in the tender papers. Any vehicle not confirming to the said specifications shall not be

accepted.

2) The vehicles intended to be placed for hiring must have the following documents completed in all respects and

produced to Engineer In charge for verifying:

2.1. Insurance certificate covering period up-to-date.

2.2. Registration certificate book with tax paid up-to-date.

2.3. Fitness Certificate.

2.4. Road permits

2.5. Any other documents relevant relating to hiring of vehicle.

2.6. Registration as “TAXI” or “MAXI”.

3) The contractor shall make his own arrangements for the Boarding and lodging of his drivers, agents and

servants.

4) The vehicles when in service shall have to be parked at the GETCO’s premises or as near as the work site is

possible.

5) The contractor shall ensure that representative on his behalf is deputed by him to keep in touch with the

Engineer with regard to detailing of vehicles, providing arrangements for substitutes in case of any vehicles

going off road looking after to general need of vehicle.

6) The contractor shall also make his own arrangements for refueling, repairs and maintenance of his vehicle and

provide other vehicle during maintenance or repair period with all above-mentioned conditions.

7) The contractor must follow all the rules, regulations and enactments of the labour laws relating to engagements

of persons by him.

8) The vehicle once inspected and approved by the Engineer for hire shall not be changed or substituted by the

contractor except on orders from the Engineer or on becoming defective/off road due to accident, breakdown,

etc. In such an event, the contractor shall given immediate intimation to the Engineer. Where a change of

vehicle is likely to last for more than one week prior approval of this Engineer shall have to be taken.

9) The speedometers of the vehicles must be maintained with full accuracy and in working condition/order at all

times. Any defect noticed therein must be rectified at the earliest in a period not exceeding two days. Till such

time, the meter starts working; the KMs. of journeys for various places shall be decided by the users/ Engineers.

10) No interest shall be paid by the GETCO on Security deposit.

11) Tender fee paid for purpose of tender papers is non-refundable.

12) The security deposit shall be refunded to successful bidder only after satisfactory completion of the contract or

on its termination by the GETCO. The GETCO reserves the right to recover any dues, outstanding against the

contractors, from the Security Deposit or towards any loss caused to the GETCO owing to negligence or default

of the contractor, his servants or agents. The refund shall be done only on production of No Objection

Certificates of all concerned Officers.

13) The rates quoted by the bidder in the schedule of rates must include all charges of every type such as fuel,

taxes, and levies maintenance / repairs, driver or contractors servant/agent wages, service taxes etc.

14) The contractor shall provide standby vehicle(s) to ensure prompt substitute arrangements should any hired

vehicle go off road.

15) In case any vehicle remains absent or fails to report for duty or a vehicle if provided, as a substitute is not in an

acceptable condition, the GETCO shall recover penalty at the rate hereinafter specified. And in case of an un-

acceptance of substituted vehicle, any journey covered by it may also be disallowed apart from recovering

penalty as if the vehicle is ‘absent’.

16) GETCO shall have right to hire vehicle from other agency at the risk and cost of contractor in case of default.

17) Driver of vehicle shall have valid driving license for transporting of Good.( I.e- if vehicle gross weight

less than 7500KG required LMV (T) ,LTV, driving license and more than 7500KV Gross weight then

required HTV,HMV,HGV+PSV endo.

(Respective Amendments)

And whereas according to the condition of the Contract the CONTRACTOR is under obligation to execute this

Safety cum Indemnity Bond before the commencement of actual execution of work

Now the indenture witnesses that I/We the CONTRACTOR do hereby undertake to follow the guidelines as per Annexure-A prepared by the GETCO.

Further we the CONTRACTOR agree that the GETCO shall be sole judge of and as to whether there has been any breach of the guidelines as per Annexure-A of this bond and as to the extent of the loss, damages, costs, charges and expenses caused to or suffered by the GETCO.

We the CONTRACTOR further agree that our liability under this bond shall not be discharged because of the change in the constitution of the GETCO or for the extension of the time limit or for any other reason.

We the CONTRACTOR further agrees to the given terms and conditions:

a. That the CONTRACTOR undertakes /undertake to indemnify and keep harmless the GETCO from all

claims, actions, proceedings and risk, damage danger to any person whether belonging or not belonging to the. CONTRACTOR.

b. That the CONTRACTOR shall keep harmless the GETCO from all claims, compensation, damages any proceedings in respect of any of its employee / workmen under the Workmen Compensation Act or any other laws for the time being in force.

c. That, if during the course of execution of work as stated in the contract order mentioned hereinabove issued by the OBLIGEE, it is found that the CONTRACTOR has not complied with guidelines as per Annexure-A or terms and conditions / formalities within the meaning of Employees’ State Insurance Act,1948 (ESI) or Workmen Compensation Act 1923 or any other laws relating to the Labour Welfare for the time being in force, and also has not observed the safety norms in accordance with the law prevailing at the place of work/job to the satisfaction of the GETCO, the GETCO shall have the right to stop the execution of work/job and the period of such stoppage shall not be taken into account for the calculation of the total period of completion of work for which the CONTRACTOR is responsible to complete the work/job and it will be deemed that discontinuance was due to default of the CONTRACTOR .

d. That, if any time, due to exigency, GETCO as the Principle Employer, becomes liable to pay any such compensation

mentioned hereinabove, whether on failure of the CONTRACTOR or for any other reason, the GETCO shall have the right to recover the said amount from any amount receivable by GETCO or any bank guarantee deposited or anything payable whether in connection with this contract or other contract by the CONTRACTOR to the OBLIGEE.

e. That the CONTRACTOR is/are aware and accept that for the persistent or

repeated violation of any guidelines as per Annexure-A and terms and conditions mentioned in this Safety cum

Indemnity Bond, GETCO shall have right to terminate the contract of work issued to the CONTRACTOR . f. In case if any safety related fatal Electrical / Mechanical accident occurred to any employee of agency or outsider

due to negligence or non-compliance of GETCO safety norms then in addition to the compensation and liability as per statutory requirement, contractor / agency is hereby agreed to pay the penalty amount as given below:
