5) Tenderer have to submit Bio-degradable Test Certificate from Govt. laboratory

for last 3 years.

6) Bag’s thickness should be 50 microns .

7) Tenderer should have to submit solvency certificate of 50 lacks from

nationalized Bank.

8) Tenderer should have average turnover of 1 crore for last 3 years for the

job of Bio-degradable bag. Enclose last 3 years C.A certificate indicating

turnover of Bio-degradable Bio-Medical waste bag.

9) Sales Tax Clearance/ Vat Clearance Certificate: Notorised copy of Sales Tax /

Vat clearance preceding certificate mentioning clearance up to last quarter or

where applicable sales tax exemption certificate from sales tax authority.

10) Tender Work order will be given to L 1 or distribute the work to others, all the

rights kept reserved by DMER.

11) Registration certificate under Shop Act. and SSI registration of manufacturer.

12) Mahila Arthik Vikas Mahamandal, Saving Groups, Unemployed/mahila

Organizations etc. can apply for the same work (50%) with last 3 years C.A

certificate indicating turnover, registration , A G mark, FDA , BSI certificate and

supporting documents of experience

13) E.M.D. amount shall be Rs.4.5 Lacks. All other details are in Tender Form.

14) Certified copy of Income tax returns(last 3 years), PAN card No. of the

Party/Agency/Organization to be enclosed.

15) Tenderer should have to submit two free samples in the office of DMER

(Properly labeled and sealed) at the time of tender submission with Sample

testing report from any laboratory mentioned ahead (Central Institute of Plastic

Enginerring & Technology, Chenni / Shri Ram Institute of Science and

Research, Banglore / National Chemical Laboratory, Pune). Sample testing

charges should be beared by the tenderer as per laboratory charges.

Procedure :

Blank Tender forms are available on department’s e-Tendering portal

https://dmer.maharashtra.etenders.in having cost of Rs. 2000/- during the time period

mentioned in e-Tendering schedule.

Submission

The tender shall be prepared & submitted using Digital Signature Certificate issued by

Govt. approved Certifying Authority on above mentioned e-Tendering portal of

department in stipulated time given for each stage in Tender Schedule. Technical bid

will be opened online on above mentioned e-Tendering Portal on day mentioned in

Tender Schedule, if possible. In same manner, price bid will be opened. Tenders

without EMD will not be accepted. DMER has kept all the rights to accept or reject the

tenders without assigning any reason thereto.

Conditions of Contract

1.0 DEFINITIONS :

1. “Contractor” shall mean the individual or firm or company or supplier whether

incorporated or not, undertaking the contract and shall include legal

representatives of such individual or persons composing such firm or

unincorporated company or successors of such firm or company as the case

be synonymous with term “Tenderer” used in the Detailed Tender Notice and

shall mean the successful “Tenderer”.

2. “Services” shall means the supply of dietary items such as food grains, fruits

& vegetables for Government Hospitals and supply of stationary/cutlery items

(petty supply) etc. to the Govt. medical Colleges & Hospitals all over

Maharashtra

3. “Contract” shall mean and include the terms and conditions of contract. Letter

of acceptance, the offer, the Agreement and mutually accepted conditions in

the authorized correspondence exchanged with the offer by the DMER and any

other document forming part of the contract.

4. “Contract Amount “shall mean the sum quoted by the Contractor agreed upon in agreement in his offer and accepted by DMER.

5. “Competent Authority “shall mean DMER or any officer authorized by the DMER to act on behalf of the DMER.

6. “Government” shall mean the Government of Maharashtra and shall include the Governor of Maharashtra.

7. “DMER” shall mean Directorate of Medical Education & Research, Mumbai.

8. “Director” shall mean the Director of DMER, for the time being holding that office and also his successor and shall include any officer authorized by him.

9 “Approved” shall mean approved in writing including subsequent confirmation of previous verbal approval. “Approval” shall mean approval in writing including as aforesaid.

10“Specification” means the specification referred to in the Tender and any modification there of or addition or deduction thereto as may from time to time be furnished or approved in writing by the Competent Authority. In case where no particular specification is given, the relevant specification, where one exists, of the Bureau of Indian Standards shall apply.

11“Tender” means the Contractor’s priced offer to the DMER for the supply of food grains, fruits & vegetables and supply of stationary/cutlery items ect. (petty supply) to the Govt. medical College & Hospitals all over Maharashtra. remedying

of any defects therein in accordance with the provisions of the Contract as accepted by the Letter of Acceptance.

12 “Letter of Acceptance” means the formal acceptance by the DMER.

13 “Commencement Date” means the ordered date or upon which the Contractor receives the notice or actual starting of work whichever is earlier.

14“Time for completion” means the time for completing the supply of services or any part thereof as any part thereof as stated in the Contract calculated from the Commencement Date.

15“Annexure” referred to in these conditions shall means the relevant annexure(s) appended to the Contract or the tender form.

16 “e-Tendering Portal” referred here onward means https://dmer.maharashtra.etenders.in

2.0 PARTIES TO THE CONTRACT:

The parties to the Contract shall be the Contractor, whose offer is accepted by the DMER.The person signing the offer or any other document forming the part of Contract on behalf of other persons of a firm shall be deemed to have due authority to bind such persons or the firm as the case may be in all matters pertaining to the Contract. If it is found that the person concerned has no such authority, the DMER may, without prejudice to any other Civil/criminal remedies, terminate the Contract and hold the signatory and / or the firm liable for all costs and damage for such termination.

3.0 CONTRACT DOCUMENT.

The several Contract documents forming the Contract shall be taken as mutually explained to one another, but in case of ambiguities or discrepancies the same shall be explained and harmonized by the Competent Authority who shall issue to the Contractor necessary instruction thereon and in such event unless otherwise provided in the contract .the priority of the document forming the Contract shall be as follows.

i. Detailed Tender Notice. ii. The conditions of Contract. iii. Letter of Acceptance iv. The contractor’s Offer. v. Contract Agreement.

4.0 IN CASE OF RATE CONTRACT: -

The Quantity for which offers can be placed is liable to change. The DMER takes / provides no assurance & takes no responsibility as to the quantity for which offers shall be placed with the Contractor.

The services can be ordered by any of the authorities who are authorized by the DMER to place orders against this Contract. This may include any of the officers of the DMER or any of the contractors to whom the DMER has entered into a contract.

The services would be required to be supplied anywhere within the DMER Hospital Limits all over Maharashtra.

5.0 TRANSPORTATION:

The material OR the services required for the subject work shall be delivered OR performed at location indicated and shall include loading, unloading and transportation and the performances Services.

6.0 QUALITY OF SERVICES:

All Services to be supplied by the contractor shall be in conformity with the specifications laid down in the Contract. The services supplied under the Contract must be of the highest quality and standard.

7.0 INSPECTION OF SERVICES:

The Competent Authority will carry out inspection by notice OR by surprise checking of the Services supplied to confirm their conformity to the Contract specifications.

The Competent Authority or authorities who are authorized by the DMER shall be entitled at any time to inspect the services.

8.0 IMPOSITION OF FINES / PENALTY:

The Contractor shall be liable for Penalty OR Fines for deficiency in the Services as indicated in penalty clause of tender document.

9.0 PAYMENTS ;

The rates quoted shall be inclusive of work Vat,/ Sales Tax, Cess, Octroi or any other duty or taxes levied by the Central or State Govt. or Local Body. Which will be paid at actual, as applicable, based on the bill amount. The rates shall be firm and fixed and shall not be subject to any change, variations, or any other conditions whatsoever nature and shall hold well till completion of supply of the Services.

Bills for Services supplied under this contract shall be prepared in duplicate by the Contractor at the end of every month. The payment of bills and other claims arising out of the Contract will be scrutinized by the Head of Institute and on satisfactory performance shall be paid by the Account Payee Cheque drawn in the name of the Contractor firm.

It may be noted that under the provision of the Indian Income Tax Act, the Head of Institute are is required to deduct Tax (TDS) /Sales tax/Turnover Tax/Service Tax with surcharge at source at prevailing rates from the gross amount of each bill submitted. The Contractor shall perform such duties in regard to such deductions thereof as may be imposed on him by such laws and regulation.

10. ASSIGNMENT OF CONTRACT, ALTERNATION IN FIRM :

Except where otherwise provided by the Contract, the Contractor shall not subcontract any part of the Contract without the prior express consent of the Director, Medical Education & Research, Mumbai.

11. SECURITY DEPOSIT:

The Security Deposit for an amount of 3 to 5% of the yearly value of the Contract, valid till contract period from the date of commencement of work, shall be required to be provided by the contractor. Wholly in form of Bank Guarantee pledged in favor of the DMER

12 FORFEITURE OF SECURITY DEPOSIT :

If during the term of this Contract the Contractor is in default of the due and faithful performance of its obligations under this Contract, or any other outstanding dues by the ways of fines, penalties and recovery of any other amounts due to it, the DMER shall, without prejudice to its other rights and remedies hereunder or at the Applicable Law, be entitled to call in, retain and appropriate the Security Deposit.

Nothing herein mentioned shall debar the DMER from recovering from Contractor by a suit or any other means any such losses, damages, costs, charges and expenses as aforesaid, in case the same shall exceed the amount of the Security Deposit.

13 RETURN OF SECURITY DEPOSIT :

The Security Deposit shall be retained until all disputes, if any, between both the parties have been settled to the entire satisfaction of the DMER. The Security Deposit shall be returned to the Contractor by the DMER provided that there are no outstanding claims of the DMER on the Contractor.

14 DISPUTES & ARBITRATION :

The DMER and the Contractor shall make every effort to resolve amicably by direct informal negotiation, any disagreement or dispute arising between them under or in connection with the Contract.

If a dispute of any kind whatsoever that can not be resolve the same shall be referred to the sole arbitration of the Director of Medical Education & Research Mumbai-32 is unable or unwilling to act as such, then the matter in dispute shall be referred to sole arbitration or such other person appointed by the Director of , Medical Education & Research, mumbai-32 who is willing to act as such Arbitrator, it is also a term of this Contract that no person other than a person appointed by the Director of , Medical Education & Research, Mumbai -32 as foresaid should act as an Arbitrator.

As aforesaid the provisions of the Arbitration and conciliation Act 1996 or any statutory modification or reenactment there of and the rules made there under and for the time being in force shall apply to the arbitration proceedings under this clause.

15 MODE OF SERVING NOTICE :

Communications between Parties which are referred to in the Contract, are effective only when in writing. A notice shall be effective only when it is delivered (in terms of Indian Contract Act.)

Subject to as otherwise provide in this Contract all notices to be issued on behalf of the DMER and all other actions to be taken on its behalf may be given or taken by the Competent Authority.

If sent by registered post to the last known place or abode or business of the Contractor, it shall be deemed to have been served on the date when in the ordinary course of post these would have been served on or delivered to it.

16 PUBLICITY :

Any publicity by the Contractor in which the name of the DMER is to be used should be done only with the explicit written permission of the DMER.

17 GOVERNING LANGUAGE:

Governing language for the entire contract and communications thereof shall be in English or Marathi only.

18 LAW :

The Contract shall be governed and construed in accordance with the law in India.

19 LEGAL JURISDICTION:

No suit or other proceedings relating to performance or breach of Contract shall be filed or taken by the Contractor in any Court of Law except principal court of Ordinary Civil Jurisdiction at Mumbai which shall have exclusive jurisdiction to the exclusion of any outside court.

20 STAMP DUTY :

The Contractor shall bear and pay any stamp duty and registration charges of the Contract.

21 JOINT VENTURE :

Joint venture not allowed.

22. SPECIAL CONDITIONS

22.1.The Rates of financial bid may kept valid for 120 days minimum from the date of tender

22.2.Every bag should be printed as Bio-Hazard logo, Not For Sale, For Govt. Supply only. and Bio-degradable

22.3. No Joint venture shall be permitted.

22.4.Price Escalation will not be allowed during the contract period.

22.5.Speed & Quality of work is very important at DMER Hospitals.

22.6. If the tenderer fails to supply material within stipulated time and Institutes have to bear additional expenditure due to local purchase. The differential amount will be deducted from the tenderer’s bill amount without assigning any reason therefore.

22.7. All charges on account of loading / unloading , transport, Ontario, Cess, terminal or sales tax and other duties on material supplied by the contractor in the execution of the work shall be borne by the Contractor.

22.8. In case of any ambiguity in the interpretation of any of the clauses in Tender Document or the Contract Document, interpretation of the Clauses by the DMER shall be final and bindings on all Parties.

22.9. The DMER reserves the right to purchase 50% material from Mahila Arthik Vikas Mahamandal, Saving Groups, Unemployed /mahila Organizations etc .

22.10.The DMER reserves the right to suitably increase/ reduce the scope of material supply put to this Tender. In case of a Rate Contract, the DMER does not in any way guarantee the quantity for which an order may be placed and the Tender quantity may only be treated as indicative.

22.11. Packing material will be left with the material supplied in the institute and no charges will be paid for the same.

22.12. If the supplied material not found as per specification such material should be replaced by the tenderer immediately and Govt. will not be responsible for any loss. If not replaced the payment of such bill will not be paid to tenderer.

22.13.The Head of Institute/ DMER/ or any officer authorized by the DMER has the right to check material and send doubtful material sample to laboratory . As per the report of the laboratory contractor will be liable to lodge complaint.

22.14. weight of the material supplied is as per Weight & Measurement Act 1958 Mumbai.

22.15. Tender should be attested by two witnesses. Tenderer has to sign each page of tender document.

22.16. To ensure consistency of Quality of the services being provided by the Contractor, he shall have in possession valid ISO 9001:2000 series certification for which should include supply Service will be preferred.

22.17. All documents required as per Eligibility Criteria (to be submitted in the same chronological order as asked in the Criteria)

23.GENERAL SECURITY RESTRICTION:

23.1.Contractor shall be responsible for behavior and conduct of his Labour appointed (with the permission of Head of Institute) for material supply .

23.2.Tenderer has bound to give information & regarding relation with other tenderer . Particularly black listed tenderers. If tenderer found guilty will be disqualified and E.M.D will be stand forfeited to DMER

24. DETAILED TENDER NOTICE

1. Notice Inviting Tenders

Digitally signed eTenders invited by and on behalf of Director, DMER from eligible Tenderers for the proposed work specified in the Schedule ‘A’.

25. ISSUE of TENDER

25.1 The blank tender Documents will be available during the period indicated in the Tender Notice on department’s eTendering Portal on payment of cost of Tender form indicated in the Tender Notice in the form of a demand draft drawn in favor of ‘Administrative Officer, DMER’

25.2 The Tender Document is not transferable. Only the tenderer who has purchased the tender form shall be entitled to bid in the Tender.

26. LANGUAGE OF TENDER / CONTRACT

The language of the Tender shall be in English and all correspondence, drawings etc. shall conform to English/Marathi language.

27. VALIDITY OF TENDERERS

The tender will be valid for two year from the date of commencement of work. DMER has kept all the rights to extend the period of contract till next tender process.

28. EARNEST MONEY

28.1 The Tenderer shall deposit the amount indicated in the Tender Notice as Earnest Money Deposit (EMD)., The Earnest Money shall be deposited in the form of Bank Guarantee/ Demand draft / Pay order in favour of ‘Administrative Officer, Directorate of Medical Education & Research Mumbai’, The failure or omission to deposit the Earnest Money shall disqualify the Tender and the DMER shall exclude from its consideration such disqualified Tender(s). No interest shall be payable by the DMER in respect of such deposited Earnest Money.

28.2 If the DMER accepts the tender, the Earnest Money shall be converted towards Security Deposit payable by the Tenderer in accordance with the Conditions of Contract. Alternatively on payment of the required amount of the Security Deposit and the execution of the Contract Agreement, the Earnest Money shall be returned to the Tenderer.

29. FORFEITURE OF EMD

29.1 The Tenderer shall not revoke his Tender or vary its terms and conditions without the consent of the DMER during the validity period of Tender, failing which the Earnest Money deposited by it shall stand forfeited to the DMER without prejudice to its other rights and remedies and the tenderer shall be disentitled to submit a Tender to the DMER for execution of any work during the next twenty-four (24) months effective from the date of such revocation.

29.2 If the successful tenderer does not pay the Security Deposit in the prescribed time limit or fails to sign the agreement bond, The Earnest Money Deposit will be forfeited by the DMER. Security Deposit shall be returned to the contractor by DMER provided that no outstanding claims of the DMER on the contractor, after the expiry of contract period.

30. REFUND OF EARNEST MONEY

The EMD shall be retained until all disputes, if any between both the parties have been settled to the entire satisfaction of the DMER and the Earnest Money of unsuccessful tenderers shall be refunded after the successful Tenderer furnishes the required Security Deposit to the DMER and signs the Contract Agreement or within thirty (30) days of the expiry of validity period of Tenders, whichever is earlier.

31. COST OF TENDER

The tenderer shall bear all costs associated with the preparation and submission of its Tender. The DMER shall in no case be responsible or liable for these costs, regardless of the conduct or the out come of the Tendering Process.

32. ELIGIBLE TENDERERS

Only those Tenderers who fulfill the eligibility criteria as mentioned in Schedule A of the Tender Notice are eligible to submit their Tenders for this work. The documents indicated against each of the eligibility criteria shall be required to be submitted along with the technical bid to establish the eligibility of the Tenderer. However all criterions mentioned in the Eligibility Criteria of the Tender Document over-rides all other criterions.

33. RELATIONSHIP WITH OFFICIALS

The Tenderer shall not be associated presently or in the past with any of the office bearers of DMER, either directly or indirectly. The Tenderer shall furnish an affidavit on a Non-Judicial stamp paper of Rs.100/- for the same. If any information so furnished shall be found to be untrue or false, the tenderer shall be liable to be disqualified and the Earnest Money accompanying such Tender shall stand forfeited to the DMER. If the Information so furnished shall be found to be untrue or false during the currency of the contract, the tenderer shall be held to be in default and the Contract if any awarded to it shall be liable to be terminated with its consequences.

34. PLACE OF SUBMISSION OF TENDER

All aspiring bidders required to prepare & submit their bid in given stipulated time mentioned in Tender Schedule on department’s e-Tendering Portal using valid Digital Signature Certificate & appropriate user-ID.

35. LAST DATE FOR SUBMISSION

35.1 e-Tendering System won't allow aspiring bidder to prepare, digitally signed Tender & online submission on department’s e-Tendering Portal later than the time and date specified in the Tender Notice as well as in Tender Schedule. In the event that the specified date for the online bid preparation & online bid submission of Tender is declared a holiday, the offers will be received up to the appointed time on the next working day.

35.2 The DMER may, as its discretion, extend this deadline for online bid preparation & online bid submission of Tenders by amending the Tender Documents, in which case all rights and obligations of the DMER and Tenderer will thereafter are subject to the deadline as extended.

36. MODIFICATIONS AND WITHDRAWAL OF OFFERS

The Tender cannot be Modified after expiry of Online Bid Preparation stage. Tenderer who submitted Tender Document Fee & prepared their online bid, but by any chance, skipped online bid submission stage will be considered as withdrawal of its Tender. Under such circumstances, department is not liable.

37. MANNER OF SUBMISSION OF TENDER (Two Bid system)

Tenders should be prepared & submitted online on e-Tendering Portal in forms given in TWO SEPARATE ENVELOPE CODES. One envelope containing the Technical documents & documents related to eligibility criteria is given as “Technical Bid (T1)”. Second envelope containing the price details is given as “Price Bid (C1)”. HASH Portal.

The two online envelopes containing the following:

Envelope No.1 (Technical Bid): As per Annexure 1.

7.Sales Tax Clearance/ Vat Clearance Certificate: Notarized copy of Sales Tax / Vat clearance preceding certificate mentioning clearance up to last quarter or where applicable sales tax exemption certificate from sales tax authority.

38. RATES

Rate should be quoted inclusive of all State/Central/Local Government taxes, duties and other expenses as applicable on date.

39. IMPORTANT POINTS

a. On receipt of blank Tender form the Tenderer should ensure that no corrections or over writings or erasures are left for attestation by the Gazetted Officer except DMER office.

b. The financial bid shall be inclusive of all taxes, Octroi, Local taxes, etc. to be paid by the Tenderer for the Work / Service, and any claim for extra payment on any such account shall not be entertained.

c. No alterations or additions anywhere in the Tenderer Document are permitted. If any of these are found, the Tender may be summarily rejected.

d. In case of a firm, Digital Signature Certificate of partner or power of attorney holder needs to be used in eTendering. The attested copies of power of attorney of person signing the Tender shall be enclosed with The Tender. The power of attorney shall be signed by all partners. In case of Private limited /public limited companies, digital signature certificate of the power of attorney holder required for eTendering & power of attorney shall be supported by Board Resolution and appropriate and adequate evidence in support of the same shall be provided.

e. All pages and pasted slips should be signed and numbered consecutively by the Tenderer. Corrections, if any, must be signed.

f. No page shall be added or removed from the set of Tender Document.

g.The Tenderer shall submit the Tender which satisfies each and every condition laid down in this Tender Document, failing which the Tender will be liable to be rejected. Conditional Tenders will be rejected.

40. Corrupt or Fraudulent Practices

40.1 The DMER requires that the Tenderer under this Tender observe the highest standards of ethics during the procurement and execution of such Contracts. In pursuance of this policy, the DMER defines for the purposes of this provision.

40.2 The DMER will reject a proposal for award if it determines that the Tenderer recommended for award has engaged in corrupt or fraudulent practices in competing for the Contract in question; The DMER will deem a firm ineligible, either indefinitely or for a started period of time, to be awarded a Contract if at any time it determines that the firm has engaged in corrupt and fraudulent practices in competing for, or in executing, a Contract.

41. Manner of Opening of Tender

The e-Tender submitted before the time and date specified in the Tender Schedule will be opened as per the specified program in the Tender Schedule as mentioned in the e-Tender Schedule (If Possible). The tenders will be opened on department’s e-Tendering Portal using tender opening authorities Digital Signature Certificate. Being an e-Tender, tenderers or their authorized representatives who choose to remain present may come to office or tenderer can see opened bids from his/her office using e-Tendering user-ID.

42. Process to be Confidential

Information relating to the examination, clarification, evaluation and comparison of Tenders and the award of a Contract shall not be disclosed to Tenderers or any other person not officially concerned with such process until the award to the successful Tenderer has been announced.

43. Preliminary Scrutiny

43.1 The DMER will scrutinize the Tender to determine whether they are complete, whether any errors have been made, whether required technical documentation have been furnished, whether the documents have been properly signed, and whether the Tenders are generally in order. The DMER will also determine the substantial responsiveness of. the Tender. For purpose of these clauses, a substantially responsive Tender is one that confirms to all the terms and conditions of the Tender Documents without material deviations. The DMER’s determination of an Tender’s responsiveness is to be based on the contents of the Tender itself without recourse to extrinsic evidence.

43.2 A Tender determined as not substantially responsive will be rejected by the DMER and may not subsequently be made responsive by the Tenderer by correction of the non-conformity. The DMER may waive any minor infirmity or irregularity in a Tender which does not constitute a material deviation. This shall be binding on all Tenderers and the DMER reserves the right of such waivers.

44. Clarification of Offers

To assist in the scrutiny, evaluation and comparison of Tenders, the DMER may, at its discretion, ask some or all Tenderer for technical clarification of their Tender. The request for such clarifications and the response shall be in writing. To speed up the Tender process, the DMER, at its discretion, may ask for any technical clarification to be submitted by means of facsimile by the Tenderer. In such cases, original copy of the document describing the technical clarifications must be sent to the DMER by means of courier/in person.

45. Opening of Financial Bids

Date of Online Financial Bids opening given in eTendering Schedule is Tentative. Department may or may not open financial offer on given date. Under such circumstance, The DMER shall notify the date of opening of the

Financial Bids to all the Tenderer. On such notified date, the Envelope No. 2 (C1) of only the technically qualifying Tenderer will be opened on eTendering Portal and the rates in Scheduled B or percentage above / below the estimate shall then be opened using tender opening authority’s Digital Signature Certificate.

46. Acceptance of Tender

Acceptance of Tender on behalf of the DMER shall be done by the Director or an officer(s) to whom the powers are delegated by the Director. The DMER is not bound to accept the lowest of any Tender. The DMER reserves the right to reject any or all Tenders received without assigning any reason whatsoever.

47. Intimation to Successful Tenderers

The acceptance of Tender may be communicated to the successful Tenderer in writing or otherwise either by the Tender opening authority or any authority in the DMER.

48. Security Deposit / Performance Security

48.1 The Security Deposit for an amount of 3 to 5% of the yearly value of the Contract, valid for 1 year from the date of commencement of work, recurring every year till the contract period, shall be required to be provided by the contractor within seven (15) days after receipt of intimation in writing of acceptance of Tender.

48.2 The mode of making this deposit is as Bank Guarantee .

49. Execution of Contract Document

49.1. The successful Tenderer after furnishing the Initial Security Deposit, is required to execute an Agreement in duplicate in the form attached with the Tender Documents on a stamp paper of proper value. The proper value at present is Rs.100/- The Agreement should be signed within 15 days from the date of acceptance of the Tender. The Contract will be governed by the Contract Agreement, the Conditions of the Contract (CoC) and other documents as specified in the C o C.

49.2. It shall be incumbent on the successful Tenderer to pay stamp duty for the Contract Agreement, as applicable on the date of the execution.

50. Rights of the DMER

50.1. In case of any ambiguity in the interpretation of any of the clauses in Tender Document or the Contract Document, interpretation of the Clauses by the DMER shall be final and bindings on all Parties.

50.2. The DMER reserves the right to purchase 50% material will be from Mahila Arthik Vikas Mahamandal, Saving Groups, Unemployed Organizations etc.

50.3. The Contract period will be valid for two year from the date of contract. DMER has kept all the rights to extend period of contract till next tender process.

50.4. The DMER reserves to right of checking original documents regarding

53. Review & Termination

It may be noted that Tender for the supply of Bio-degradable Bio-Medical waste

bags to the Govt. Hospitals all over Maharashtra as per Schedule A is the essence

of the Contract. If at any time it is seen that , a result of the poor quality & below

standard material the contract may be terminated.

54. Contract Price

All charges on account of Octroi, Cess, terminal or sales tax and other duties on material obtained for the Services from any source including the tax applicable as per Maharashtra Sales Tax Act in the goods involved in the execution of the Services, etc. shall be borne by the Contractor . By deducting TDS bills will be paid.

55. Penalties

If the quality of supplied material is found un- satisfactory or any such complaint in this regards Rs. 500/- per Bag Size per instance will be charged and deducted from the contractor’s payment .

56 . Termination of Contract:-

The Contract will be terminated by default , after the contract period mentioned in clause 29.1 above. However, DMER , Similarly the contractor can withdraw from the contract for justified reasons, by giving Two Months Prior notice to the DMER .
