What does being licensed really mean?What does being licensed really mean? Fighting

unlicensed activity continues to be at the forefront for this organization. As a contractor, it is extremely important to me. As licensed contractors, we are required to have higher standards, insurance and ethics.

A license brings proven experience. We as licensed contractors have met experience and examination requirements. Censure by the License Board remains on the contractors’ public record for an indefinite period of time. A licensed contractor who violates the law may be disciplined by the Board with censure, fines or, in the worst cases, loss of their license. If a consumer hires an unlicensed and uninsured contractor, they have no protection against injuries to themselves or others which may occur at their home due to unsafe working procedures, improper workmanship, as well as innocent accidents. The problem is educating the consumer of these possibilities.

Sadly some of this does not mean much to a consumer who is strictly looking at the bottom line. Recently I had a consumer call my office and report a problem with a re-marcite job. When questioned about the work the consumer informed

me they had “paid the contractor under the table – we paid him cash.” I told her my company could not help her. I am sure many of you have received the same type of calls.

We often spend lots of time talking to the homeowner about the value of hiring a licensed contractor. Our local building departments have signs everywhere stating the reasons to hire a licensed contractor. We have signs on our trucks stating the same (these stickers are available through the FSPA state office). The news stations provide updates about people who have been ripped off by non-licensed contractors.

We, as licensed contractors, must deliver a quality product to our consumers. We must continue to educate our consumers about the importance of hiring licensed and insured contractors. We must continue to report unlicensed activity in an effort to protect the consumers as well as our industry. Don’t think that your one call will not make a difference, it does.

By the time this is published I will have just attended the last state Board meeting as your President. A bittersweet moment – but I am not gone! I will be proudly serving as immediate past-president and continue to work hard for this organization. The friendships I have made during my tenure will always remain special. I thank all of you for helping me while I am president and for helping to make me a better person. Everyone who serves on this Executive Committee is committed and dedicated and I truly thank them. The Executive Committee that I have had the pleasure of serving with has volunteered many hours of their time on conference calls, meetings and emails between the normal state Board meetings.

Being president has been a great two years and an experience I will never forget. Thank you all for the support and encouragement you have provided me. I will miss my phone calls with Wendy who made sure she kept me updated on any issues that arose. My job was made much easier by Wendy and her incredible staff. Wendy truly loves her job as executive director! Thanks to all of you for your tireless efforts and loyalty shown to me and this association. I would also like to thank Jennifer Hatfield for all her hard work and dedication to this association as well.

I am proud to be a part of this association where you find the best of the best in the pool and spa industry. Thank you and God Bless America!

Growth in membership and staffOver the past 18 months your association has been

growing and currently has more members than we’ve had in eight years. With membership growth comes the need for FSPA to adapt so we can continue to serve the pool professionals in Florida at the very best levels. Last spring I started evaluating the office staffing and what is needed to fill expectations of the chapters, Board members and professionals in the field. In addition, earlier this summer the state Board held a strategic planning session which helped provide a vision for the next three years.

The result is a state office structure that is going to be stronger, more responsive and better able to help membership continue to grow and become more engaged. For a few years the membership and education positions were combined into one; they are once again two positions in order for the association to focus and grow in each area. There is a newly created position which will focus on pro-active public relations campaigns as well as all things digital including the website and social media.

In July, Mary LaGasse Anderson joined us as the Education Program Manager. She comes to FSPA from a college setting and will be working to raise the bar of our continuing education courses, get the 16-hour course and 60-hour course sessions scheduled and explore online education and webinars for Florida pool pros. Mary’s father was in the pool industry in Sarasota for years and just happens to be the very first name on our Person of the Year Plaque, Richard LaGasse.

Ava Jones joined us in August as Member Information Specialist. She will be handling all aspects of membership renewals, database management as well as member programs. Ava was a competitive swimmer in high school and college and is excited to be part of the pool industry in a different setting.

Erika Dunayer also began in August in the newly created position of Public Relations and Digital Engagement Specialist. Erika’s experience includes

customer service at Disney, writing for news organizations, video production and editing and, most recently, marketing for The Florida Mall.

We are also happy to have Pennie Quinn as our new receptionist. Her happy voice will greet you when you call the office; her energy and enthusiasm has all of us smiling. Please take a few moments to welcome our new team members and make them feel like they are part of our family.

IN REMEMBRANCE - MARY ELIZABETH MANION, 72 AUBURNDALE - Mrs. Mary Elizabeth Manion, age 72, of Auburndale, passed away on July 28, 2015, at Winter Haven Hospital. She was a ‘trooper’, having battled and conquered many serious health conditions and has gone home for eternal rest with Our Heavenly Father. Mary was the Executive Director of the FSPA Central Florida and Polk Chapters from November, 1994 to November, 2009. Mary was well liked and loved by her members and forged some wonderful friendships with her members and FSPA staff.She is survived by her loving husband Charles ‘Chick’ Manion, daughters Kelly Manion and Kathleen ‘Katie’ Petro, and granddaughter Elizabeth

‘Lizz’ Petro-Levay. Mary was born in Acton, Massachusetts, to Edmond J. McNiff and Helen C. Schnair McNiff. She is also survived by her brother John ‘Doc’ McNiff and sister Patricia ‘Tish’ Haras. Mary and Chick met in the 7th grade and attended Acton Boxborough High School together. Mary graduated from Westbrook College in Portland, Maine, as a dental hygienist. They were united in marriage in 1964 and celebrated their 50th Wedding Anniversary last summer. Following the Blizzard of 1978, they decided to move south and chose Auburndale, Florida, where they would raise their family living the LAKE LIFE on the shores of Lake Ariana. Mary considered ‘her lake’ to be a blessed gift from God and she cherished the sunrise and sunset each and every day. She embraced life surrounded by family and friends and celebrated right until the end... Her celebration was a visitation service at Oak Ridge Funeral Care in Winter Haven on Friday, July 31. A Funeral Mass was held on Saturday, August 1 in Winter Haven at St. Joseph’s Catholic Church followed by a reception (in true ‘Mary Style’). Condolences may be sent at www.oakridgefuneralcare.com.

Florida Building Commission provides clarity on public pool resurfacingBy Jennifer Hatfield, FSPA Government Relations Consultant, [email protected]

On August 7 both the Code Administration and Swimming Pool Technical Advisory Committees (TACs) of the Florida Building Commission unanimously answered FSPA member Shamrock Pool Services, Inc.’s petition for declaratory statement. The TACs agreed with the petitioner that a public pool re-plaster job does require a permit. The TACs recommendation was then provided to the full Commission on August 18. The Commission unanimously supported the TAC decision that the answer to the question of whether a permit is required for a public pool re-plaster is YES.

This petition was brought up due to the fact that based on the 2012 legislation removing construction from the Department of Health’s purview, resurfacing requirements found in 64E-9, F.A.C. will be removed. FSPA members wanted to ensure there would be oversight by the building departments to ensure items are addressed when a re-plastering job is completed on a public pool.

At the Commission meeting on August 18 research projects were also approved, this included a project looking into swimming pool lighting. More details on what all this will entail is forthcoming.

Are you offering the complete pool package?By Ken Parker, Retiree - Ken Parker Pools

When you make a sales call or visit, several important measures will ensure that you are offering the customer a complete pool package. One of my first customers, a retired, very successful auto dealership owner, gave me this advice, “Present the top of the line, a complete package. It may be more than the customer is asking for, but many customers are pleasantly surprised that the cost of extras is not as much as they had imagined, and items can always be removed. It’s much easier to remove costs than add them.” And, as you know, profit margins on extras are larger.

Are you offering your customers the best materials and accessories available in the market today, or are you staying in your “comfort zone”? It’s comfortable to stay with a solid 6 x 6 tile that’s quick and easy to install, but why not offer more decorative options? “My builder did not show me that tile,” may not get

you that referral you need in this economy. Establish a relationship with a local tile company that carries a large variety of tiles, and encourage the customer to visit the store with or without you. This is much easier than lugging samples of tile to the customer’s residence. Does your bid include over-flow piping, dedicated cleaner piping, auto level control and, with spas and other features, automated or remote controls? Remember, sell the convenience and ease of owning a pool.

Always communicate honestly about schedules and problems that arise. Unfulfilled promises are a big source of bad feelings between contractors and clients. On the gunite, deck placement and plaster days I always say, “Treat it as a rumor.” These phases are usually completed by subcontractors, and schedule delays and weather play a big part in these phases staying on schedule.

Do you have a relationship with a landscape architect or a landscaper you work with on a regular basis? As I often tell my customers, “Landscape architects make my pools look even better.” Of course, if you have a knack for landscape design, the L.A. isn’t a requirement, but landscaping should be mentioned as part of the total project. With the current economy, the “backyard vacation” is the goal for many families, and good landscaping completes the backyard ambience.

Offering a complete backyard package at the beginning of a project will show the customer you have the experience and knowledge to successfully complete the contract.

As we go to work each day we sometimes forget that we, as licensed and qualified individuals, are professionals. Webster’s dictionary defines the term professional as “a job that requires special education, training, or skill.”

Most of us have apprenticed in our craft, studied volumes of literature, and been tested and certified by governing bodies or recognized authorities. We continue our education through classes and seminars, meet locally with manufacturers representatives, attend hands-on demonstrations, and perform physical work. Most members in the FSPA support and involve themselves in the legislation of our chosen field at the state and national levels. All of this is done to help us conduct ourselves in a professional, competent and skillful manner.

Yet, we often sell ourselves short! We don’t realize the value of our skills. We possess knowledge and expertise that very few others can offer on a

wide range of varied situations. We are a combination of pseudo plumbers, chemists, masons, electricians, meteorologists and engineers. We have knowledge of drainage, ground water, landscaping, tides and hydraulics. Most of us deal daily with contracts, insurance, laws, rules and regulations. All of these things require a particular type of personality and skill set. Most people are not knowledgeable or well-rounded enough to possess these all-encompassing skills.

And the members of the FSPA hold themselves to an even higher standard! We possess all of the skills and qualities mentioned above and more.

We are involved in an organization which not only promotes all of the benefits that our license and industry have to offer but also encourages its members to better themselves as industry professionals and business professionals.

Yet we often judge the value of our services and products based on the lowest common denominator. We propose jobs or services to prospective clients and find that we are “too high” or “too much” or that “the other guy said I didn’t need that.”

And that may very well be true. We may very well be priced higher or offering things that the other guy didn’t. But at the end of the day, we must realize the value of our license and expertise and the ability to perform or provide the proposed services or products. The value of our service is a reflection of our knowledge and skill set and understanding of codes and circumstances required to do the job right! Our skill set allows us to not propose projects based on proposals from other less qualified people, but to propose projects based on what is necessary and required! Based on the value of our abilities! Based on our knowledge of job specifics and competence!

Let us not allow ourselves to lead our companies based on the lowest common denominator. Let us not stand complacent while other, less qualified or non-licensed, individuals intrude on our chosen profession and bring down the standards. Let us recognize that we are proven, competent professionals in our chosen field and that those less qualified should be held to our standards - the standards of a true pool professional!

overlooked insurance coverages

Here are some insurance coverages and policies which either have been or are quickly becoming more prevalent, more competitively priced and most necessary to properly protect your business.

Pollution Liability: Most every liability policy these days has a Total Pollution Exclusion form attached. To determine if you have coverage for the storage, use/handling and transportation of pool chemicals, check your policy. If your insurance is with our Amerisure Insurance Program you have the option to add coverage for these exposures.

Pool Pop Liability: This one is not overlooked much anymore but it is unique to the pool industry and worthy of mention here. Just know how easy it is to pop a pool, that taking precautions is important but not a guarantee it won’t pop, and that there are multiple ways to drain a pool either on purpose or by accident.

Mold or Fungi Liability: Over the years we have had some claims where a pool service or pool contractor has caused a release of water inside a home. In fact, it happened multiple times in 2013. The good news is that the property damage is covered by a comprehensive general liability policy. The bad news is that if the damage goes undetected long enough for mold to form, the cost to remediate the mold is not covered. Other damage, generally yes, but mold – no.

Employment Practices Liability: This is a coverage excluded by general liability and workers’ compensation policies and has to do with employer/employee relationships. Coverage responds to allegations of wrongful termination, discrimination, harassment, wage and hour violations, etc.

Cyber/ E Commerce Liability: Here is another coverage excluded by general insurance policies. This responds to claims of a security breach of your confidential employee or customer private information. The retailer Target was

a great example of a claim where thousands of customers’ private information was skimmed off Target hard drives. The claim was in the millions of dollars. You don’t need to be the size and scope of Target to be targeted though.

Employee Dishonesty: While these claims primarily involve money, they don’t have to. Your employees can steal money, inventory, tools, etc. from you. Proving the claim can be difficult though and without proof there is no claim. Coverage may also be added for forgery or alteration, funds transfer fraud, and 3rd party computer fraud.

Umbrella/Excess Liability: There is a difference between the two and the difference is big. The Excess Liability policy extends over a General Liability Policy only (on rare occasion auto). The Umbrella can extend over the general liability as well as auto and workers’ compensation. Either form is definitely recommended. Note that in order to be eligible for either of these the underlying policies must have minimum liability limits of $1,000,000.

Business Income and Extra Expense: This one is more common but still often overlooked. When added to your property insurance, essentially what this coverage does is to assist with the financial loss resulting from a covered peril (fire, wind, etc.). Basically it pays ongoing expenses during a down time and extra expenses incurred to keep operating.

Directors and Officers Liability: Does your company have a Board of Directors? If so, does anyone outside of your company sit on that Board? If so, you need this coverage.

Employee Benefits Liability: This is an errors and omissions type coverage which responds to claims arising out of the unintended errors in the management of your employee benefit programs (group health, dental and life programs as well as profit sharing plans and employee stock plans).

So, how much insurance should you buy you ask? When is enough, well, enough? We have all heard the phrase “insurance poor” from spending too much on insurance. But not carrying enough insurance can make you real poor real fast. There has to be balance and the balance comes in two forms.

One is the broadening of coverage. This is where you purchase additional coverages such as pool popping or pollution liability to broaden the existing

forms and coverages and/or eliminate restrictions or exclusions. The other form is in the property and liability limits you carry. Do your

property limits provide for total 100% replacement of your building and/or business personal property? How about your liability limits (general liability and auto liability)? This is the scary part. While a $1,000,000 per occurrence limit may be enough for most accidents and incidents the value of a claim can always (and easily) exceed even the $1,000,000. We have experienced claims involving fatalities and severe injuries (which sometimes can carry an even higher insurance cost) resulting from both general liability as well as auto liability claims. We have clients with Umbrella Liability policies in excess of $10,000,000.

Getting back to the questions above, there is no single answer. Carry as much insurance:

• As you can afford.• As much as you personally feel a need to carry.• Enough to protect your business assets from the worst case scenario• Enough to ensure you a good night sleep… every night with no worries.

Risk is defined as “exposure to the chance of loss.” How much risk are you willing to assume relating to your company? How much risk are you inclined to pass along to an insurance company to protect the valuable asset of your company; a company which you have worked so hard and so long to grow and develop?

This year’s FSPA High School Invitational Swimming & Diving Meet marks the 38th year of this great event. More than 1,000 athletes will make their way to Stuart to compete against teams from all over the state and against swimmers of all different levels. This is an event where they will probably be challenged more than they are at their local meets and can bond with their team as many teams must stay overnight.

Each year FSPA member companies sponsor the event and provide their time to volunteer. Without the generosity of these members, this event would not be the same. While it is too late to have your company on the event T-shirt, you can still be a sponsor.

We are also in need of many more volunteers to ensure the success of the swim meet. Volunteers time the races with stopwatches as a backup to the underwater touchpads that are precisely timing the swimmers. It is exciting to watch the energy, drive and determination of the athletes and the intensity of the close races.

NCCI proposes decrease to Florida workers’ compensation rates

Tallahassee, Florida –The National Council on Compensation Insurance (NCCI), delivered its annual workers compensation insurance rate filing to the Florida Office of Insurance Regulation (OIR). Based upon its review of the most recent data available, NCCI has proposed an overall average rate level decrease of 1.9%. With a reduction in the expense constant from $200 to $160 and changes to minimum premiums, the overall average premium decrease is 2.2%, effective January 1, 2016.

• Interest rates have remained near historic lows for several years, which has prompted NCCI to request a higher profit and contingency provision of 4%.

Today, Florida’s workers compensation insurance rates, overall, remain stable and commensurate with other southeastern states.

However, rates could increase, perhaps dramatically, depending on decisions issued in a couple of pending court cases:

• Westphal v. City of St. Petersburg• Castellanos v. Next Door Company• Florida Workers Advocates v. State of Florida (if accepted by the Florida

Supreme Court)NCCI is monitoring these cases, and once final, will be prepared to issue

estimated cost impact analyses, and if necessary, submit amendments to the pending rate filing or submit future rate filings.

The OIR is expected to schedule a public rate hearing in October.

The Chapter held a CE class on July 23 with Connie Sue Centrella, Team Horner, teaching us that customer loyalty is priceless. More than 23 members and guests attended this informative class. Thank you to HornerXpress Jacksonville for letting us take over your showroom for this class! The attendees were very engaged and we strongly encourage other Chapters to offer it to your members. The objectives Connie Sue spoke about were: Convert customer from satisfied to loyal; develop loyalty through strong customer service; and turn buyers into customers for life.

Please pay attention to your renewal dates of your membership. Some of you were on the June 30 renewal cycle while others are on an anniversary date renewal based on when you joined. If you are not a member, you cannot serve on the Board and you cannot take advantage of the many benefits you are afforded by being a member. Your Board of Directors is engaging in a membership campaign – for the first 10 new members who are recruited and pay their dues in full for one year, the Chapter will give them a $150 gift card.
