A Less Active Government…

Gov. should protect the rights of the citizens.

Decreased size of Gov. Departments.

Cut Federal Budget. Reduced size of Army/Navy. Repealed the Whiskey Tax. Sedition Act: expired

Pardoned those in Jail. Re-establish 5 yr. rule to

become a citizen.

Federalist Policies Remain…

Bank of the United States.

Fed Gov. continued to pay off State Debts.

Many Federalist kept their government jobs.

The Judiciary Acts 1789: Created a National courts

system with three circuit courts and thirteen district courts, all headed by the Supreme Court.

1801: Decreased the number of Supreme Court justices and increased the number of federal judges.

Midnight Judges:

Adams trying to limit Jefferson’s opportunity to appoint judges to the Supreme Court.

John Marshall Chief Justice.

Marbury v. Madison William Marbury was

appointed justice of the peace for the District of Columbia by Adams before left office.

Sectary of State Madison under orders of Jefferson never delivered the official papers giving Marbury his authority.

Marbury sued Madison.

Under Judicial Review: Marshal ruled against Marbury.

An Important Precedent. Supreme Court ruled

against Marbury. Judiciary Act was

unconstitutional. Judicial Review:

gave the Supreme Court the power to decide whether laws passed by Congress were constitutional and to reject laws that it considered to be unconstitutional,
