AN ABUSE

There is something barbarous in a

law that allows the stopping of a man

from taking passage out of the King

dom without tlie intervention of

judge or jury upon a claim that is

squarely disputed and can only be set

tled by mutual arrangement or refer-

ence

to the courts When as in the

case reported to hae happened yestcr

day the victim of the law is called

away on such an errand of humanity

as the illness of a wife the proceedingis calculated to work great hardship

Writs of capias in other countries are

sometimes abused in like manner but

there is the safccuaid in their case ofgreater formality in the producing of

the suspected intending absconder im

mediately before a magistrate for ex ¬

amination into the claim against him

In any case however the passport law

of this country should have a pro-

vision

¬

requiring reasonable notice of

intention to stop a debtor leaving tne

country if his purpose be known within

a day of his projected departure Tobe complete moreover such a law

should go a little further and compelstreets

at lcasl thirty six hours in advance of

the sailing of the vessel that is take

them and allow no process to inter-

fere

with their departure twelve

hours prior to the time of the shipsleaving port Of course per-

AN ABUSE

There is something barbarous in a

law that allows the stopping of a man

from taking passage out of the King

dom without tlie intervention of

judge or jury upon a claim that is

squarely disputed and can only be set

tled by mutual arrangement or refer-

ence

to the courts When as in the

case reported to hae happened yestcr

day the victim of the law is called

away on such an errand of humanity

as the illness of a wife the proceedingis calculated to work great hardship

Writs of capias in other countries are

sometimes abused in like manner but

there is the safccuaid in their case ofgreater formality in the producing of

the suspected intending absconder im

mediately before a magistrate for ex ¬

amination into the claim against him

In any case however the passport law

of this country should have a pro-

vision

requiring reasonable notice of

intention to stop a debtor leaving tne

country if his purpose be known within

a day of his projected departure Tobe complete moreover such a law

should go a little further and compelstreets

at lcasl thirty six hours in advance of

the sailing of the vessel that is take

them and allow no process to inter-

fere

with their departure twelve

hours prior to the time of the shipsleaving port Of course per-
