1.6 RATES : - The rates are to be quoted legibly on flat percentage basis i.e. AT PAR/ABOVE the Schedule ofRates for Roads and Bridges works for National Highway Circle, P.W.D.(Roads), Meghalaya,Shillong for the year 2007 - 2008 (5thRevision).

1.7 TIME OF COMPLETION: 12 (Twelve) months from the date of issue of F.W.O.

or other work nor should any of their contract for N.E.C. or other works have been rescinded inthe last 5 (five) years.

(c) The minimum annual financial turnover of the prospective applicant over the last 5 (five) yearsshall not be less than 40 % of the project cost.

(d) The prospective applicant or any of their constituent partners shall have their own plantsmachineries for execution of the work or to furnish documentary proof for acquisition hire/purchase)of plants and machineries to be utilised in the execution of work.

(e) The prospective applicant should have minimum key personnel for the project which includeProject Manager (B.E.,Civil), Site Engineer (B.E.,Civil), Quality Control Engineers (B.E.,Civil)and Plant Manager (B.E., Mechanical or Diploma in Mechanical).

(f) The working capital of the prospective applicant or any of their constituent partners shallnot be less than 10% of the project cost.

(g) The available bid capacity of the prospective applicant or any of the constituent partners shall bemore than the cost of the project, which will be calculated as per provision of the bidding documentfor pre qualification.

(h) Registered contractor / Firm who fulfills all the above conditions are only eligible to cast theTender.

(i) In case of Joint Venture both the partners should submit Trading License and Labour Certificate.Also, Earnest Money is to be enclosed along with the Tender.

(j) The Chief Engineer, PWD (Roads) Meghalaya, Shillong reserves all rights to accept or rejectany or all tender without assigning any reason thereof.

Note : In case of a Joint Venture, both the partners should meet the qualifying criteria of Para - 2(a) & 2 (c) above as follows :-

*(i) The lead partner shall meet not less than 40% of all the qualifying criteria given in aboverelevant paras.

(ii) Each of the partners shall meet not less than 30% of all the qualifying criteria given in theabove relevant paras.

(iii) The Joint Venture must satisfy collectively the criteria of personnel capabilities, holding ofequipment and financial strength for which purpose the relevant figures for each of thepartners shall be added together to arrive at the Joint Venture’s total capacity. Individualmembers must each satisfy the requirements of soundness of Applicant’s financial positionand the clear record for execution of works.

(iv) Any bid shall be signed so as to legally bind all partners jointly and severally and the bidshall be submitted with a copy of Joint Venture Agreement providing to joint and severalliability with reference to the contract.

10. The contractor shall not sub-contract the work to sub-contractors or to any single sub-contractor. Anundertaking by the contractor shall have to be submitted to this effect.

11. The successful contractor shall provide a performance security for his proper performance of thecontract within 7 (seven) days from the date of receipt of letter of award. The performance Securityshall be in the form of FD/Call Deposit to be pledged in favour of Commandant 3rd MLP Bn KhliehtyrshiJowai. In case the Performance Security is in the form of Bank Guarantee the same is to be sent tothe Commandant 3rd MLP Bn, Khliehtyrshi, Jowai in sealed envelope directly by the issuing Bankalong with the forwarding letter indicating BG No. purposed of the BG, etc. The amount of the securityshall be 5 % (five percent) of the contract price. The performance security shall be valid until thecontractor has executed and completed the works and remedied any defects therein in accordancewith the contract. The Performance security shall be returned to the contractor within 14 days fromthe expiry of the Defect Liability period. If the contractor fails to perform the work as per terms andconditions of the contract, the performance security shall be forfeited.

12. During the execution of the works, the contractor shall keep the site reasonably free from allunnecessary obstructions and shall store or depose of any contractors equipment and surplusmaterials and clear from the site any wreckage, rubbish or temporary works in consultation with theSanitary Supt. of the Institute.

13. Before issue of any completion certificate, the contractor shall clear away and remove from that partof the site to which the completion certificate relates all contractors’ equipment, surplus material,rubbish and temporary works of every kind.

14. When whole of the works have been substantially completed, the contractor shall give a notice to theCommandant 3rd MLP Bn, Khliehtyrshi, Jowai, accompanied by a written undertaking to finish with

due expedition any outstanding work during the defect liability period. Such notice and undertakingshall be deemed to be a request by the contractor to issue a taking over certificate.

15. Defect liability period shall be 6 (six) months calculated from the date of completion of the workscertified by the Asstt. Engineer P.H.Q. in the completion certificate.

16. If the contractor fails to fulfill any of the obligations under this contract, the Commandant 3rdMLP Bn, Khliehtyrshi, Jowai, shall be at liberty to terminate the contract there by voiding the contractand will be at liberty to allot the whole work or balance works to any other party at the risk and costof the first party.

17. All works are to be carried out as per current specification prevailing in the state of Meghalaya(MPWD & CPWD) and when directed by the Commandant 3rd MLP Bn, Khliehtyrshi, Jowai.

18. In submitting tender the registered contractor should mention registration number and class with fullpresent address and should submit attested copy of the registration certificate.

19. All the relevant documents required to be submitted along with the tender including the EMD shouldbe submitted in the first envelope marked as Envelope I and only the price quoted should be submittedin another envelope marked as Envelope II (form annexed to these conditions).

20. The Envelopes should clearly indicate the name of work, name, address and contact number of thecontractor. Tenders not submitted in the said format will be rejected.

21. Every page of the tender paper to be signed by the contractor as a token of acceptance of the termsand conditions before submission of tender, failing which the tender will be rejected.

32. The specifications and mode of measurement for civil works shall be in accordance with PWD/CPWD specifications unless otherwise specified.

33. If there is any excess payment on any item etc. made to the contractor, the contractor shall nothesitate to cooperate in adjusting/deducting the same from either the running bills or final bills.

34. The rates written in words shall prevail in case of any variation between the rates mentioned in figureand in words.

35. The Commandant 3rd MLP Bn, Khliehtyrshi, Jowai, reserves the right to accept or reject any or alltenders without assigning any reason thereof.

40. The rate quoted for the additional/non-scheduled item should be quoted as per the price bid formatannexed to this tender failing which tenders will be rejected.

41. The Party shall be responsible for the safety of all its workmen/employees during the period ofexecution of the work. The party shall provide all safety materials, gadgets, equipments etc to all itsworkmen/employees to ensure their safety during execution of the work. The Institute shall not beheld responsible in case of any accidents, mishaps etc. to the party and its employees.

42. Any delay in completion of the works beyond the stipulated date due to reasons attributable to thecontractor may eventually lead to cancellation of letter of award for which the contractor is not entitledto any compensation. The cancellation of letter of award would lead to forfeiture of performancesecurity.
