Whereas, the land specifications whereof are given in “Annexure–A”to this notification is required for public purpose viz. for widening of Jammu-Rajouri-Poonch road double lane specification in Village and Tehsil Siot,District Rajouri by GREF ;

Whereas, on the basis of an indent placed by Office Commanding 57RCC (GREF), a notification under section 4 (1) was issued by Collector,Land Acquisition (Def), Rajouri/Poonch, HQ Rajouri vide No. Coll/Def/71-75 dated 23–04–2011 read with corrigendum No. Coll/Def/837-41 dated18-09-2012 for land measuring 113 Kanals and 19 Marlas, situated in Villageand Tehsil Siot, District Rajouri ;

Whereas, the District Collector (DC), Rajouri, vide No. Coll/Def/1324 dated 01-02-2018 has reported that the notification issued under section4 (1) of the J&K State Land Acquisition Act by him was served upon theinterested persons for filing objections, if any, to the proposed acquisition,

Whereas, the report furnished by Distirct Collector (DC), Rajouri,vide No. referred above duly endorsed by Divisional Commissioner, Jammuvide No. 502/1533/Acq/GREF/Siot/Raj/18/4523-25 dated 05-03-2018 andby Financial Commissioner, Revenue vide No. FC-LS/LA-4282/2012 dated15–03–2018 has been examined and it has been found that the land ownersdid not filed any objection to the proposed acquisition ;

Whereas, the Government is satisfied that the land particularswhereof are given in “Annexure–A” to this notification, is required forpublic purpose viz. for widening of Jammu-Rajouri-Poonch road doublelane specification in Village and Tehsil Siot, District Rajouri by GREF.

Now, therefore, in pursuance of section 6 of the J&K StateLand Acquisit ion Act, Samvat 1990, it is declared that landmeasuring 113 Kanals and 19 Marlas situated in Village and Tehsil Siot,District Rajouri, particulars whereof are given in “Annexure–A” to thisnotification is required for public purposes viz. for widening of Jammu-Rajouri-Poonch road double lane specification in Village and Tehsil Siot,District Rajouri by GREF. Further, the Collector, Land Acquisition (Def),Rajouri/Poonch, HQ Rajouri is directed under section 7 of the said Act totake orders for acquisition of the said land after giving prescribed noticeto the interested person(s) as required under the Land Acquisition Act/rules.

However, the Collector concerned shall be personally responsiblefor identification and proper title verification of all types of land involvedin the case and apportionment of compensation amongst all theinterested persons/rightful claimants in accordance with the relevantlaws/rules in force, while making the award.

Whereas, the land specifications whereof are given in “Annexure–A”to this notification is required for public purpose viz. for widening of ChobiaLink Road in Village Gatha, Tehsil Bhaderwah, District Doda by PW (R&B)Department ;

Whereas, on the basis of an indent placed by Executive Engineer,PWD Division, Bhaderwah vide No. 540-41 dated 20–05–2008 andNo. 2222-23 dated 20–10–2011 a notification under section 4(1) was issuedby Collector, Land Acquisition (SDM), Bhaderwah vide No. 180-86/LAS/15 dated 25–05–2015 for land measuring 25,086 Sqft, situated in VillageGatha, Tehsil Bhaderwah, District Doda ;

Whereas, the Collector, Land Acquisition (ADC), Bhaderwah, videNo. ADC/LAC/16-17/828-29 dated 06-02-2018 has reported that thenotification issued under section 4 (1) of the J&K State Land AcquisitionAct was served upon the interested persons for filing objections, if any, tothe proposed acquisition, but no objection was received from the landowners/interested persons in the prescribed time period as required undersections 5 & 5-A of the Land Acquisition Act ;

Whereas, the report furnished by Collector, Land Acquisition(ADC), Bhaderwah vide No. referred above duly endorsed by DeputyCommissioner, Doda vide No. 682/LAC/D/17 dated 15-02-2018 has beenexamined and it has been found that the land owners did not filed anyobjection to the proposed acquisition ;

Whereas, the Government is satisfied that the land particularswhereof are given in “Annexure–A” to this notification, is required forpublic purpose viz. for widening of Chobia Link Road in Village Gatha,Tehsil Bhaderwah, District Doda by PW (R&B) Department.

Now, therefore, in pursuance of section 6 of the J&K StateLand Acquisition Act, Samvat 1990, it is declared that the landmeasuring 25,086 Sqft, situated in Village Gatha, Tehsil Bhaderwah, DistrictDoda particulars whereof given in “Annexure–A” to this notification, isrequired for public purposes viz. for widening of Chobia Link Road in VillageGatha, Tehsil Bhaderwah, District Doda by PW (R&B) Department. Further,the Collector, Land Acquisition (ADC), Bhaderwah is directed undersection 7 of the said Act to take orders for acquisition of the said landafter giving prescribed notice to the interested person(s) as required underthe Land Acquisition Act/rules.

Whereas, the Collector, Land Acquisition (ADC), Kishtwar, videNo. ADCK/LA/2017/671-77 dated 17-10-2017 has reported that thenotification issued under section 4 (1) of the J&K State Land AcquisitionAct was served upon the interested persons for filing objections, if any, tothe proposed acquisition, but no objection was received from the land owners/interested persons in the prescribed time period as required under sections5 & 5-A of the Land Acquisition Act ;

Whereas, the report furnished by Collector, Land Acquisition (ADC),Kishtwar vide No. referred to above duly endorsed by District Collector(DC), Kisthwar vide No. DCK/LA/2017/1021-27 dated 19-03-2018 hasbeen examined and it has been found that the land owners did not filed anyobjection to the proposed acquisition ;

Whereas, the Government is satisfied that the land particularswhereof are given in “Annexure–A” to this notification, is required forpublic purpose viz. for construction of Galhar Sansari Road in Village Sohal(3rd Phase), Tehsil Atholi Padder, District Kisthwar by GREF.

Now, in pursuance of section 17 of the Land Acquisition Act, Samvat1990, it is ordered that on expiry of fifteen days from the publication of thenotification under section 9(2) of the said Act, the Collector will takepossession of the aforementioned land in Village Sohal, Tehsil Atholi Padder,District Kisthwar required for public purpose, subject to fulfillment of theconditions prescribed under section 9(2) and section 17-A of the LandAcquisition Act and Rules 63 of the Land Acquisition Rules ;

(ACR), Kishtwar vide No. ACR/LA/435-40 dated 19-06-2010 for landmeasuring 22 Kanals and 19 Marlas situated in Village Badhat, TehsilDrabshala, District Kishtwar ;

Whereas, the Collector Land Acquisition (ACR), Kishtwar vide

No. ACR/LA/2017/2527-30 dated 03-03-2018 has reported that thenotification issued under section 4 (1) of the J&K State Land AcquisitionAct was served upon the interested persons for filing objections, if any, to

the proposed acquisition, but no objection was received from the landowners/interested persons in the prescribed time period as required under

sections 5 & 5-A of the Land Acquisition Act ;

Whereas, the report furnished by Collector, Land Acquisition (ACR),Kishtwar, vide No. referred to above duly endorsed by Deputy Commissioner,Kisthwar vide No. DCK/LA/2017/1006-10 dated 19-03-2018 has been

examined and it has been found that the land owners did not filed anyobjection to the proposed acquisition ;

Whereas, the Government is satisfied that the land particulars

whereof are given in “Annexure–A” to this notification, is required forpublic purpose viz. for construction of Link Road from Drabshala to Bugranain Village Badhat, Tehsil Drabshala, District Kishtwar.

Now, therefore, in pursuance of section 6 of the J&K State

Land Acquisition Act, Samvat 1990, it is declared that the land

for acquisition of the said land after giving prescribed notice to the

interested person(s) as required under the Land Acquisition Act/rules.

Now, in pursuance of section 17 of the Land Acquisition Act, Samvat

Whereas, on the basis of an indent placed by Executive Engineer,Civil Construction Div-Ist, Kirthai, HEP vide No. HEP/K-II/LandAcq./47-49 dated 26–12–2012, a notification under section 4 (1) wasissued by Collector, Land Acquisition (ADC), Kishtwar videNo. ADCK/LA/2017/708-15 dated 17-10-2017 for land measuring 11Kanals and 04 Marlas situated in Village Affani, Tehsil Padder,District Kishtwar ;

Whereas, the Collector, Land Acquisition (ADC), Kishtwar videNo. ADCK/LA/2017/600-05 dated 17-11-2017 has reported that thenotification issued under section 4 (1) of the J&K State Land AcquisitionAct was served upon the interested persons for filing objections, if any, tothe proposed acquisition, but no objection was received from the landowners/interested persons in the prescribed time period as required undersection 5 & 5-A of the Land Acquisition Act ;

Whereas, the report furnished by Collector, Land Acquisition (ADC),Kishtwar vide No. referred to above duly endorsed by Deputy Commissioner,Kishtwar vide No. DCK/LA/2017/1134-44 dated 19-03-2018 has beenexamined and it has been found that the land owners did not file any objectionto the proposed acquisition ;

Whereas, the Government is satisfied that the land particularswhereof are given above is required for public purpose viz. for constructionof HEP (Phase–II) in Village Affani, Tehsil Padder, District Kishtwar byJ&K State PDC.

Now, therefore, in pursuance of section 6 of the J&K StateLand Acquisition Act, Samvat 1990, it is declared that the landmeasuring 11 Kanals and 04 Marlas situated in Village Affani, Tehsil AtholiPadder, District Kishtwar, particulars whereof are given above is requiredfor public purposes viz. for construction of HEP (Phase–II) in VillageAffani, Tehsil Padder, District Kishtwar by J&K State PDC. Further, theCollector, Land Acquisition (ADC), Kishtwar is directed under section 7

Now, in pursuance of section 17 of the Land Acquisition Act, Samvat1990, it is ordered that on expiry of fifteen days from the publication of thenotification under section 9(2) of the said Act, the Collector will takepossession of the aforementioned land in Village Affani, Tehsil Padder,District Kisthwar required for public purpose, subject to fulfillment of theconditions prescribed under section 9(2) and section 17-A of the LandAcquisition Act and Rules 63 of the Land Acquisition Rules ;

However, the Collector concerned shall be personally responsiblefor identification and proper title verification of all types of land involvedin the case and apportionment of compensation amongst all theinterested persons/rightful claimants in accordance with the relevantlaws/rules in force, while making the award.

Now, before taking over the poossession of land and paymentof compensation, all the interested persons are called upon to appearbefore the undersigned on 11-09-2018 at 11.00 A. M. at DC Complex,Ramban and state the nature of their respective interests in the land,the amount and particulares of their claims to compensation for suchinterests, and their objections (if any) to the quantum and measurementof land. It is required that all such claims and objections are madein writing.

Executive Engineer, PMGSY Division, Ramban (IndentingDepartment) is also hereby called upon to appear before theundersigned either in person or through his authorized representativeon above said date, time and venue to putforth his objection, if any,to the measurement made and to the amount of the tentativecompensation that may be assessed.

[No. 23-z–––––––––––––––––––––––––––––––––––––––––––––—–––––—————and Kashmir hereby makes the following Scheme for providing effect tothe transfer of certain Assets, Liabilities, Personnel, Proceedings, Propertiesand undertakings of Power Development Department to the ‘Transferee’as defined in this scheme and for matters incidental and ancillary thereto.

Power Development DepartmentTransfer Scheme (Phase-l) Rules, 2018

1. Short title, extent and commencement.––(1) This Scheme shallbe called the “Power Development Department Transfer Scheme(Phase-I) Rules, 2018” (hereinafter referred to as ‘Scheme’).

(2) The Scheme shall come into force with effect from 11-09-2018.

2. Application of Scheme to the assets and liabilities.––The Scheme shall apply to such assets, properties, undertakings, interests,rights, obligations, liabilities, personnel and proceedings of the PowerDevelopment Department within and outside the State as mentioned in theScheme.

3. Definitions.––In this Scheme, unless the context otherwiserequires,––

(a) “Act” means the Jammu and Kashmir Electricity Act, 2010(Act No. XIII of 2010) ;

(b) “Appointed Date” means the date of 11-09-2018 for effectingtransfer of functions, properties, interests, undertakings, rightsand liabilities, proceedings and personnel of the Departmentto the Transferee in accordance with the Act and this Schemefor all objects and purposes under this Scheme ;

(c) “Assets” means all assets and properties including powersystems, plant, machinery, land, building, offices, stores,furniture, fixtures, vehicles, computer, laptop, telephone, f ax,residential quarters and guest houses and amenities andinstallations pertaining and attached thereto and other movable

and immovable assets, cash in hand, cash at bank, investments,book debts-corporeal and incorporeal, tangible and intangibleassets, benefits, licenses, consents, authorities, registration,patents, trademarks and powers of every kind, nature anddescription whatsoever, privileges, liberties, easements,advantages, benefits and approvals, contracts, deeds, schemes,bonds, agreements and other instruments and interest ofwhatever nature and wherever situated and including thecontingent assets, which may arise in regard to dealings beforethe Appointed Date of transfer in respect of the specifiedTrading Undertaking ;

(d) “C&S Wing” shall mean the existing Commercial and SurveyWing of Department responsible for (i) power purchases, (ii)setting up, maintenance and operations of communicationnetwork between different grids and power houses, (iii)enforcement of power curtailments as per schedule formaintaining of strict grid discipline, (iv) managing operationsof SLDC and Sub-LDC, and (v) testing of electric protectionfor all electric installations, etc. ;

(e) “Cash Flow Arrangement” shall mean the arrangement to beput in place by the Transferee in accordance with Rule 14 ofthis Scheme ;

(f) “Company” means a company formed and registered underthe Companies Act, 1956/Companies Act, 2013 ;

(g) “Department” means the Power Development Department,Government of Jammu and Kashmir and responsible for allfunctions related to transmission, distribution and load despatchof electricity in the State ;

(h) “DCP” shall mean the Development Commissioner, Powerand responsible for Heading of the Department ;

(i) “EM&RE Wing” shall mean Electrical Maintenance and RuralElectrification Wing, an existing wing of the departmentresponsible for (i) setting up, maintenance and operation ofdistribution system at 66 KV level and below (ii) billing ofenergy to consumers and collection ;

(j) “liabilities” means all liabilities, debts, duties, obligations andother outgoings including statutory liabilities and Governmentlevies of whatever nature and contingent liabilities which mayarise in regard to the dealings before the Appointed Date inrespect of the Trading Undertaking transferred under thisScheme ;

(k) “P&D Wing” shall mean the Planning and Design Wing, anexisting wing of the Department, and responsible for (i)technical study and approval of projects, (ii) setting up standardsof quality control for projects, and (iii) procurement processof equipment for grid stations and transmission lines above66 kV ;

(l) “P&MM Wing” shall mean the Procurement and MaterialManagement Wing, an existing wing of the Department, andresponsible for procurement of line material and equipmentfor sub-transmission level at 66 KV and below ;

(m) “Personnel” means workmen, employees, staff and officersof the department by whatever name called and includestrainees, if any, for the recruitment in the department andthose on deputation from the department to other organizationsor institutions but shall exclude the employees on deputationto the department from other Government Departments ororganizations or institutions ;

(n) “Proceedings” means the proceedings of whatevernature including suits, appeals, complaints, petitions,

applications, conciliatory, arbitration whether civil or criminalor otherwise ;

(o) “Properties” means all assets including power systems, dieselgenerating sets, transmission and distribution systems, plant,machinery, land, building, offices, stores, furniture, fixtures,vehicles, residential quarters and guest houses and amenitiesand installations pertaining and attached thereto and othermovable and immovable assets, cash in hand, cash at bank,investments, book debts-corporeal and incorporeal, tangibleand intangible assets, benefits, licenses, consents, authorities,registrations patents, trademarks and powers of every kind,nature and description whatsoever, privileges, liberties,easements, advantages, benefits and approvals, contracts,deeds, schemes, bonds, agreements and other instruments andinterest of whatever nature and wherever situated ;

(p) “Revenue Mechanism” shall mean the mechanism to be putin place by the Transferee in accordance with Rule 13 of thisScheme ;

(q) “Schedule” means the Schedules appended to this Scheme ;

(r) “Scheme” means this Power Development DepartmentTransfer Scheme (Phase-l) Rules, 2018 ;

(s) “Shared Services” means the existing services provided bythe office of DCP, EM&RE Wing, S&O Wing, P&MM, P&D,C&S and TTIC Wings of the Department ;

(t) “State” means the State of Jammu and Kashmir ;

(u) “State Government” means the Government of Jammu andKashmir ;

(v) “TTIC Wing” shall mean the Training, Testing, Inspection andCommissioning Wing, an existing wing of the Department, and

responsible for (i) technical inspection of all new electricinstallations before their commissioning, (ii) arranging trainingfor the department’s staff, (iii) setting standards for electriccontractors and issuing licenses after gauging their abilities,(iv) technical investigation of all electrical accidents, and (v)electrical testing and commissioning of a ll electricinstallations ;

(w) “Terminal Benefits” mean the gratuity, pension, dearnessallowances and other applicable relief, medical benefit, andother applicable benefits including the right to have theappropriate revisions in the above benefits consistent with thepractice that were prevalent in the department ;

(x) “Trading-cum-Holding Company” or “JKSP Trade co(JKSPTC)” means the Jammu and Kashmir State PowerTrading Company Limited, a company incorporated under theCompanies Act, 1956 ;

(y) “Transferee” means Jammu and Kashmir State Power TradingCompany Limited (JKSPTC) ;

(z) “Transition period” means the period starting from theAppointed Date till the date to be notified by the StateGovernment ;

(aa) “Transmlssion Company” means the Jammu and Kashmir StatePower Transmission Company Limited, a companyincorporated under the Companies Act, 1956 with the mainobject of undertaking the transmission of electricity in the Stateof Jammu and Kashmir and to function as State TransmissionUtility and perform load despatch functions as per theprovisions of the Act ;

(bb) “Trading undertaking” means the undertaking as specified inthe Schedule I of this scheme and such other undertakings as

may be specified by the Government from time to time byamending Schedule-I of this scheme.

4. Words and expressions used in this Scheme but not specificallydefined in this Scheme shall have the same meaning as assigned to them inthe Act.

5. Transfer of Trading Undertaking by the State.––

a. The Trading Undertaking as set out in Schedule-I shall standtransferred to and vested in the Transferee on and from theAppointed Date subject to the terms and conditions specifiedin the Act and the Scheme ;

b. On such transfer and vesting of the Trading Undertaking interms of Sub-Rule (a) above and except as otherwise provided,the Transferee, shall be responsible for all functions, contracts,rights, deeds, schemes, bonds, agreements and otherinstruments of whatever nature relating to the respectiveTrading Undertaking transferred to it to which the Departmentwas a party, subsisting or having effect on the Appointed Date,in the same manner as the Department was liable immediatelybefore the Appointed Date, and the same shall remain in forceand effect against or in favour of the Transferee and may beenforced effectively as if the Transferee had been a partythereto instead of the Department ;

c. As consideration for the transfer and vesting of Assets andLiabilities to the Transferee as specified in this Scheme, theState Government and/or any Company will be issued sharesand/or instruments as may be decided by State Government ;

d. The transfer to and vesting of the Trading Undertaking to theTransferee in terms of this Scheme shall take effectimmediately on the Appointed Date notwithstanding that thevalue of the Trading Undertakings have not been determinedand shall be determined at a later date ;

e. The State Government may transfer appropriate assets suchas chairs, tables, cupboards, computers, laptops etc. as maybe necessary for smooth functioning of the Transferee. If theassets cannot be transferred from the Department, necessaryarrangements shall be done by the State Government or theDepartment to procure the same for the Transferee.

The value of the Assets to be transferred to the Transfereeshall be the fair value determined in anyone or more of thefollowing basis :––

i. Revenue earning potential ; or

ii. Depreciated replacement value ; or

iii. Depreciated Book value.

f. The opening balance sheet of the Transferee shall be finalizedand notified by the State Government on the date as may bedecided by the State Government.

6. Transfer of sanctioned positions.––The sanctioned positions ofC&S Wings as mentioned at Schedule-II shall stand transferred to theTransferee on the Appointed Date.

7. Transfer of Personnel.––

a. The transfer of Personnel shall be subject to the terms andconditions contained in section 93 and section 94 of the Act ;

b. On the Appointed Date, the Personnel working against thesanctioned posts mentioned in Schedule-II shall be deemed tohave been deputed to the Transferee on as is-where-is basis,on standard terms and conditions of deputation as defined inSchedule-XVIII, Jammu and Kashmir Civil Services(Regulations), Vol-II as amended from time to time ;

c. The posts that are proposed to be transferred from the FinanceDepartment as mentioned in Schedule-II shall be identified bythe Department and deemed to have been deputed to theTransferee on as is-where-is basis, on standard terms andconditions of deputation as defined in Schedule-XVIII, Jammuand Kashmir Civil Services (Regulations), Vol-II as amendedfrom time to time ;

d. The personnel for sanctioned but vacant posts identified fortransfer from the C&S Wing of the Department and postsapproved for creation in the Transferee vide Cabinet DecisionNo. 188/29/2012 dated 10-10-2012 shall be taken on deputationor appointed by the Transferee as per the rules and regulationsdecided by the Board of Directors of the Transferee ;

e. The Board of Directors of the Transferee shall be constitutedin accordance with its Memorandum of Associationand Articles of Association as approved by the StateGovernment ;

f. Notwithstanding, the provisional nature of transfer of Personnelto the Transferee, as per Sub-Rule (b) above, the Personnelshall discharge the duties and functions as may be assigned tothem from time to time by Transferee, as the case may be andthe Transferee shall have the power to exercise alladministrative and disciplinary control over such Personneltransferred to them as per this Scheme ;

g. All proceedings including disciplinary proceedings pendingagainst the Personnel prior to the Appointed Date which mayrelate to misconduct, lapses or acts of commission or omissioncommitted before the Appointed Date, shall not abate and shallbe continued by the Transferee ;

h. The Personnel transferred to the Transferee, shall be deemedto have entered into an agreement with the Transferee to repay

loans, advances and other sums due or otherwise performobligations undertaken by them to the Department whichremain outstanding as on the Appointed Date, on the sameterms and conditions as contained in the arrangement with theDepartment ;

i. Nothing contained in this Scheme shall apply to Personnel ofthe Central Government or any other organization on deputationto Department as on the Appointed Date but such Personnelshall continue to be on deputation to the Transferee to whoseservices they are assigned on “as is-where-is” basis ;

j. In case the Department is unable to transfer persons of suchqualification/s as may be required by law or by any regulationfor enabling the Transferee to carry out its activities as normalcourse of business, the Transferee shall have the independenceto hire the services of such personnel from outside theDepartment ;

k. Absorption of Personnel in Transferee will be decided by theState Government in future. However, at the time of absorptionas may be decided by the State Government, the rank, scaleof pay, salary, allowances and other pecuniary benefitsincluding pension, Terminal Benefits etc., of the Personnel afterthe Appointed Date shall not in any way be inferior to thoseapplicable to them immediately before the said transfer.

8. Treatment of Terminal Benefits.––

a. The Terminal Benefits for the personnel on deputation fromthe Department shall be as per the applicable policies of theDepartment ;

b. The Terminal Benefits for personnel who have been hired bythe Transferee directly shall be as per the relevant policiesdeveloped/to be developed by the Transferee in this regard.

9. Shared services/common services.––

a. However, the Department shall continue to extend expertsupport and knowledge with respect to shared services/common services including but not limited to Human ResourceManagement, IT support, Secretarial services support, audit,anministrative support to the Transferee ;

b. The Personnel transferred to the Transferee Company ondeputation shall be eligible to use facilities of the rest housesor the guest houses or the transit houses of the Departmentfor a nominal charge as decided by the State Government orthe Department.

10. Rights and obligations of third parties restricted.––

a. All the outstanding liabilities against power purchase cost ofthe Department as on the Appointed Date shall notbe transferred to the Transferee and shall vest with theDepartment ;

b. Upon the transfer being effected in accordance with theprovisions of the Act and this Scheme, the rights and obligationsof all persons (including body corporate, financial institutions,lenders, etc.) shall be restricted to the Transferee to whomthey are transferred to and notwithstanding anything to thecontrary contained in any deed, documents, instruments,agreements or arrangements which such person has with theDepartment, he shall not claim any right or interest against theState Government or the Department except the liabilityprovided under Rule10a ;

c. In such case, the Transferee shall discharge its undertakingsas the same would have been done by the Department beforethe Appointed Date.

11. Pending suits, proceedings, etc.––

a. All proceedings of whatever nature by or against thedepartment pending on the Appointed Date shall not abate ordiscontinue or otherwise in any way prejudicially be affectedby reason of the transfer under this Scheme and theproceedings shall be continued, prosecuted and enforced byor against the Department ;

b. The proceedings may be transferred to the Transferee at alater date by issuance of an order or a scheme by the StateGovernment.

12. Classification and transfer of property, rights, liabilities andproceedings to be provisional in the first instance.––

a. The classification and transfer of Trading Undertaking includingPersonnel under this Scheme, unless otherwise specified inany order issued by the State Government, shall be provisionaland shall be finalized during the Transition Period or any otherdate notified by the State Government ;

b. Finalization of the Scheme––

i. At any time within the Transition Period or any otherdate notified by the State Government, the StateGovernment may, by order to be notified, amend, vary,modify, add, reduce, delete or otherwise change termsand conditions of the transfer including items includedin the transfer, and transfer such properties, interests,rights, Liabilities, Personnel and Proceedings formingpart of Trading Undertaking of the Transferee to thatof the Department in such manner and on such termsand conditions as the Department may considerappropriate ;

ii. During the Transition Period, the PPAs, MoUs andother similar arrangements with respect to purchaseof power or power trading, if any, shall be allocated tothe Transferee ;

iii. On the expiry of the Transition Period or any otherdate notified by the State Government and subject toany directions given by the State Government, thetransfer of Trading Undertaking, properties, interests,rights, Liabilities, Personnel and Proceeding made inaccordance with this Scheme shall become final.

13. Revenue Mechanism.––

i. The Transferee will procure power from power suppliers(generators, other traders, power exchange) and will bulksupply the same to the Distribution Licensees of JKPDDwith margin at rates regulated by the State Government. TheState Government may take guidance from the margin ratesas permitted by the Central Electricity Regulatory Commissionof India for Inter-State power trading business ;

ii. The filing of ARR to the State Electricity RegulatoryCommission will be done by the Department or as may bedecided by the State Government ;

iii. If permitted by the State Government, a trading margin canbe charged by the Transferee subject to applicable rules andregulations issued by the J&K State Electricity RegulatoryCommission or Central Electricity Regulatory Commission, asthe case may be ;

iv. The Transferee will meet its expenditure through the followingsources :––

a. Rebate on early payment of power purchase cost.

b. Sale of power to the procurers other than theDepartment.

c. Trading margin if allowed by the State Government.

d. Recovery of expenditure through annual revenuerequirement of the Department.

v. The Transferee will also be entitled to recover the interestand finance charges on the working capital loan and letter ofcredit from the department on actual basis.

14. Cash Flow Arrangement and Accounting Procedures.––

i. The Transferee shall create/open new bank account to manageits cash flow ;

ii. The Transferee will generate revenues by procuring powerfrom various generating stations or traders through long-term,medium-term or short-term PPAs as well as from powerexchanges and selling the same to the Department for furtherdistribution to the consumers in the State. Expenses to be madeby the Transferee viz. power procurement cost, interest onloans, statutory payments, if any, operations expenses such assalary, capital expenditure, if any, etc. shall be handled by theTransferee itself. However, the same shall be recovered asmentioned in sub-rules (iv) & (v) of Rule 13 ;

iii. The power procured by the Transferee from within the Statewill be at ex-bus bar of the generating stations and at theperiphery of the State of Jammu and Kashmir in case ofprocurement of power from generating stations and otherpower trading companies outside the State unless otherwiseprovided in the power purchase agreement ;

iv. All the bills raised by the Transferee on the Department forthe power supplied will be verified by the Department andrecommendation for payment will be made to StateGovernment Treasury. The payment from the State

Government Treasury will be directly made to the bank accountof the Transferee ;

v. The Transferee shall be entitled to avail short-term loans/letterof credit/line of credit to meet its working capital requirementsas per prudent financial management practices.

15. Delegation of power.––

a. All personnel of the department who are on deputation to theTransferee shall continue to fulfill their responsibilities as pertheir existing delegation of power till the finalization of thedelegation of power by the Transferee ;

b. All approvals beyond the delegation of power of ChiefEngineers shall be vested with Board of Directors of theTransferee till finalization of new delegation of power byTransferee.

16. Transfer by operation of law.––

a. The transfer under this Scheme shall be operative and effectivepursuant to action of the State Government by publishing thisScheme and orders issued in terms of this Scheme and withoutany further act, deed or thing to be done by the StateGovernment, Department, Transferee or any other person,subject to the terms and conditions of this Scheme.

17. Rights and powers of the transferee.––The transferee shall bea deemed licensee under section 2 of Jammu and Kashmir Electricity(Amendment) Act, 2018 (Act No. XI of 2018).

18. Decision of State Government to be final.––

a. If any doubt, dispute, difference or issue shall arise in regardto the transfers under this Scheme subject to the provisions ofthe Act, the decision of State Government thereon shall befinal and binding on all parties ;

b. The State Government may, by order published in theGovernment Gazette, amend this Scheme and make suchprovisions, not inconsistent with the provisions of the Act, asmay appear to be necessary for removing the difficulties arisingin implementing the transfers under this Scheme.

TRADING UNDERTAKING

PART I

ASSETS AND LIABILITIES

The Trading Undertaking shall comprise generally of all the assetsand proceedings including the following but not limited to them, belonging tothe C&S Wing of the Department, concerning the trading of electricity :–

I. MISCELLANEOUS :

(a) Contracts, agreements, interest and arrangements tothe extent they are associated with or related to tradingactivities or to the undertaking or assets including allagreements and contracts with Central Power SectorUndertakings (for which no allocation of power is madeby the Central Government for the State), contracts,agreements, interest and arrangements withIndependent Power Producers and Captive PowerPlants in the State ;

(b) Proceedings to the extent they are associated with orrelated to power trading activities or to the undertakingsreferred above.

II. GENERAL :

(a) In consideration of the transfer mentioned above, theState Government may direct the Transferee to issueinstruments such as equity shares, preference shares,debentures and other securities in favour of the StateGovernment as the State Government may direct takinginto account the assets and liabilities, if any, transferredfrom Department to the Transferee ;

PART II

FUNCTIONS AND DUTIES OF TRADING-CUM-HOLDINGCOMPANY

The functions and duties of the Trading-cum-Holding Company willbe detailed as per the clauses of the Memorandum of Association andArticles of Association of the Company constituted thereunder as originallyframed or as altered from time to time.

Main functions and duties of Trading-cum-Holding Company are––

(a) To act as a bulk purchaser and supplier of electricity :

i. As a bulk purchaser and supplier, the trading-cum-holding company shall be responsible for purchase ofthe entire power requirement from State ownedgenerating station, Central Generating Stations, Traders,Merchant Power Producers, Independent PowerProducers and any other source to meet the demandof State Distribution Companies and perform theactivity of bulk supplier of power to all the distributioncompanies at bulk supply tariff ;

ii. Under this role, the trading-cum-holding company shallbe responsible for sale of power contracted under MoU(free/subsidized/SERC determined tariff) on behalf ofState Government.

(b) To act as a Residual Company and perform followingfunctions :––

i. To provide a clean and financially strong openingbalance sheet to the other successor companies toensure their financial viability, by transferring the

unreconciled balances, accumulated losses andunfunded liabilities to the trading-cum-holdingcompany ;

ii. Entrusted with contract, agreements, rights, interest andarrangements, loans, cash and bank balance, currentassets and liabilities and obligations and proceedings tothe extent they are associated with or related to commonactivities or not associated directly with generation,transmission and distribution activities

(c) To act as an investment company and carry out the followingkey functions/responsibilities :––

i. Hold equity in successor entities and subscribe toadditional equity on behalf of State Government ;

ii. Invest on behalf of the State Government in variousschemes/projects for the development of power sectorin the State ;

iii. Invest equity in all existing and future Joint Venture(JV) projects on behalf of State Government for thedevelopment of new power projects ;

iv. Execute Memorandum of Understanding (MoUs) andImplementation Agreements (IAs) with theIndependent Power Producers (IPPs)/Captive PowerProducers (CPP), establishing power plant in theState ;

(d) To act as a Coordinator while performing the following keyfunctions/responsibilities are being carried out :––

i. Deal with shared services till final allocation tosuccessor companies ;

ii. Responsible for the cash management function(centralized cash flow arrangement) for all thesuccessor companies during transition phase ;

iv. Supervision, coordination and facilitation of the activitiesof other successor companies and act as coordinatorbetween Government and successor entities for smoothfunctioning of the latter ;

v. Coordination functions related to finance, accounts,human resources and legal issues ;

vi. Implementation, coordination and monitoring of theprojects and schemes supported by any financialinstitution, Accelerated Power Development ReformProgramme and any other scheme concerning theelectricity sector in the State ;

(e) Till the time, the next phase of restructuring takes place, theTransferee shall be responsible to carry out the duties andfunctions mentioned as a bulk purchaser and supplier or as aninvestment vehicle to invest equity in all existing and futureJoint Venture (JV) projects on behalf of State Governmentfor the development of new power projects.

In sub-rule (4), the following words shall be inserted at theend.

“The electoral rolls for Panchayat Halqa for election ofSarpanch shall consist of the electoral rolls of all theconstituencies of Panchayat Halqa”.

Sub-rule (5) for the word “panch”, the word “Sarpanches andPanch” shall substituted.

2. In Rule 5, 7 and 8. The word “Panch”, the word‘Sarpanches and Panch’ shall be substituted.

3. After Rule 13, the following Rule shall be inserted :––

“13-A : Holding of Public Meeting.––No person shallhold or attain any public meeting within the area ofPanchayat Halqa where poll is to be taken during the periodof 48 hours before the hour of close of poll.”

4. Sub-rule 4, of Rule 17 shall be substituted by thefollowing :––

The votes shall ordinarily be cast in person :

Provided that Election Authority may generally or in respectof any specific class of persons, may issue instructions forcasting of votes.

5. The following proviso shall be added to Rule 23 :––

Provided that the Election Authority shall be competent toprescribe the document (s) that would be used to establishthe identity of the voters.

6. After Rule 23, the following shall be added asRule 23-A :––

“23-A. Making of Attendance.––(1) Every voter aboutwhose identity the Presiding Officer or the Polling Officer,

(2) If any Elector refuses to allow his/her forefinger to beinspected or marked in accordance with sub-rule (1) orhas already such a mark on his left forefinger or does anyact with a view to removing the ink mark, he/she shall notbe supplied with any ballot paper to vote.

(3) Any reference to this rule to the left forefinger or anyElector shall in case where the forefinger of a votes ismissing, the constructed as a reference to any other fingerof his/her hand and shall be the case where all the fingersof his/her fingers are missing be constructed as a referenceto the forefinger or any finger of his/her right hand, andshall in case where all his/her fingers of both hands aremissing be constructed as a reference to such extremity ofhis/her left or his/her right arms as he/she possesses.

7. In Rule 24, the words “and indelible ink mark to be puton his left forefinger” shall be omitted.

8. In Rule 41, for the word “Panches” , the words“Sarpanch and Panches” shall be substitued.

9. After Rule 41, the following shall be inserted asRule 42 :––

“42. Election of Sarpanches.––Sarpanches shall beelected by the electorate of Panchayat Halqas and theprocedure for election of Panches shall apply mutatismutandis to election of Panches.”

10. In Rule 43, for the word “Panch”, the words “Sarpanch orPanch” shall be substituted.

12. In Rule 45 :––

“(4) The Sarpanch shall thereafter cause to behanded over to each Panch a blank paper withrequest to write the name of Panch in favour ofwhom he desires to vote and Panch shall then writethe names secretly without giving any chance toothers to see it and shall fold the papers and hand itover to the Secretary. The Panch shall not sign hisname on the voting paper.”

13. In sub-rule of Rule 45-A, the words “Sarpanch or” shallbe omitted.

14. In Rule 47 :––

(i) Sub-rule (1) shall be substituted by the followingsub-rule :––

“(1) The Sarpanch shall cause the votes to becounted there and shall declare the Panch havingsecured the largest number of votes to be dulyelected”.

(ii) In sub-rule (3), for the words “Sarpanch andNaib-Sarpanch”, the words “Naib-Sarpanch” shall besubstituted.

15. After Rule 47, the following rule shall be added :––

“47-A. Notification and constitution of HalqaPanchayat.––For constitution of Halqa Panchayat undersection 4 of the Act, the Election Authority shall forwardnames of Sarpanch and Panches to the Government fornotification. The Government may notify the names itselfor authorize any other officer for the same.”

16. Clause (a) & (b) of Rule 48 shall be substituted by thefollowing :––

“(a) The delegation of authority for sanctioning of projectsshall be done by Halqa Panchayat in consultation with HalqaMajlis.

(b) The list of works to be taken up in the Panchayat Halqashall be approved by the Panchayat Halqa in consultationwith Halqa Majlis.”

17. After sub-rule (1) of Rule 57, the following proviso shall beadded :––

“Provided that, in the absence of elected Halqa Panchayat,the Block Development Officer concerned shall be authorizedto collect the revenue under any already signed contractagreement.”

Provided that the Government in the General AdministrationDepartment may, in exceptional circumstances, exclude any GovernmentDepartment from the purview of this notification :

Provided further that the procedure for selection for the posts forwhich selection process has already been initiated by the EmpoweredCommittee(s) shall continue to be governed by the rules/orders in force onthe date of issuance of this notification.

The qualification for recruitment of Class-IV posts shall continue tobe governed by Notification SRO-99 dated 7th April, 2008.

Whereas, in terms of the Notification dated 06-11-2018, inter alia,various dates were appointed for the conduct of elections to elect Sarpanchesand Panches for all the Halqa Panchayats of Block Lar, District Ganderbalexcept Halqa Panchayat, Chuntwaliwar-A in view of the interim orderdated 24-10-2018, passed by Hon’ble High Court in OWP No. 2013/2018titled Inhabitants of Halqa, Chountwar-A versus State and others ; and

Whereas, pursuant to the said direction of the Hon’ble Court, thematter was duly considered by the Election Authority (Chief ElectoralOfficer, J&K) and a consideration order dated 02-11-2018 waspassed ; and

Whereas, Hon’ble Court vide its order dated 19-11-2018, whiledeciding the application moved by Election Department for vacation of thestatus quo order dated 24-10-2018, has observed that there was no need tofile such application as the mandate of the said interim order has alreadybeen carried out by considering the matter and passing of an appropriateorder by the respondent authority (Election Authority) ; and

Whereas, perusal of the order mentioned supra reveals that the ElectionAuthority can proceed ahead with the election process in the HalqaPanchayat, Chuntwaliwar-A, since there being no restraint or stay order inthis regard.

Now, therefore, in exercise of powers under section 36 of J&KPanchayati Raj Act, 1989, read with Rule 8 of the J&K Panchayati RajRules, 1996, the Election Authority (Chief Electoral Officer, J&K) herebynotifies and, accordingly, appoints the following dates for the conduct ofelections to elect Sarpanches and Panches in respect of the PanchayatHalqa, Chuntwaliwar-A of Block Lar of District Ganderbal, as under :––

(a) the 22nd November, 2018 (Thursday) as the date of issuance ofthe Gazette Notification.

(b) the 29th November, 2018 (Thursday) as the last date for makingnominations.

(c) the 30th November, 2018 (Friday) as the date for the scrutiny ofnominations.

Whereas, such improper rejection has resulted in vitiation of the electionprocess from the date of scrutiny onwards for the Panch Constituency ofWard No. 4-Chargali (L) of the Panchayat Halqa Sohagani, Block Marh.

Now, therefore, considering the above in exercise of powers undersection 36 of J&K Panchayati Raj Act, 1989, read with Rule 8 of the J&KPanchayati Raj Rules, 1996, the Election Authority (Chief Electoral Officer,J&K) hereby notifies and, accordingly, appoints the following dates for theconduct of electios to elect Panches in respect of the Ward No. 4-Chargali (L)of the Panchayat Halqa, Sohagani, Block Marh, Jammu as under :––
