Whereas, seniority tentative list of Assistant Grading and MarketingOfficers was notified under No. Horti/HPM/150/2018 dated 25-10-2018for information of all concerned with the advise that they may submit theirobjections, if any, with documentary evidence in support of their claim,within 21 days from the date of its issue ;

Whereas, no objection has been received by this Department or inthe Directorate of Horticulture (Planning and Marketing) J&K.

Now, therefore, in view of the above the final seniority list of AssistantGrading and Marketing Officers of J&K Horticulture (Planning andMarketing) as it stood from 08-05-1987 to 31-05-1998 is hereby issuedforming Annexure to this Government Order.

The seniority list shall be without prejudice to the outcome of writpetitions, if any, pending before any competent court (s) of law.

Whereas, on the basis of an indent placed by Chief Engineer,PMGSY (JKRRDA) Jammu vide No. CEJ/PMGSY/17710-12 dated31-10-2017, a notification under section 4 (1) was issued by Collector,Land Acquisition (ACR), Doda vide No. 1532-28/Acq dated16-01-2018 for land measuring 37 Kanals and 08 Marlas situated inVillage Sarsi, Tehsil and District Doda ;

Whereas, the Collector, Land Acquisition (ACR), Doda videNo. 465-70/Acq dated 07-07-2017 has reported that the notificationissued under section 4 (1) of the J&K State Land Acquisition Act wasserved upon the interested persons for filing objections, if any, to theproposed acquisition, some interested land owners filed objections withinstipulated period of 15 days. The objections so filed were got verifiedthrough Tehsildar, Doda and found to be without any merit ;

(ii) These Rules shall be deemed to have come into forcefrom 29-08-2008, i. e., the date of the resolution adopted by the Full Courtin this behalf.

2. Definitions.––In these Rules, unless there is something repugnantto the subject or the context :––

(a) ‘Governor’ means the Governor of Jammu and Kashmir ;

(b) ‘Chief Justice’ means the Chief Justice of the High Court ofJammu and Kashmir ;

(c) ‘High Court’ means the High Court of Jammu and Kashmir ;

(d) ‘State’ means the State of Jammu and Kashmir ;

(e) ‘Government’ means the Government of Jammu andKashmir ;

(f) ‘Staff’ means the Chauffeurs, Divers-I and Drivers-II borneon the establishment of the High Court.

3. Interpretation.––Any doubt regarding the interpretation of theseRules shall be decided by the Chief Justice whose decision shall be final.

4. Pay.––The Chauffeurs, Drivers-I and Drivers-II, borne on theestablishment of the High Court Staff shall be entitled to the payment oftwo and half days' salary which shall be over and above their usual pay.

5. Removal of difficulties.––The pay band and grade pay of theother categories of Officers and officials on the establishment of the HighCourt shall remain unchanged.

(ii) in rule 89, for sub-rule (5), the following shall besubstituted, namely :—

“(5) In the case of refund on account of inverted dutystructure refund of input tax credit shall be granted asper the following formula :—

Maximum Refund Amount=[(Turnover of inverted ratedsupply of goods and services) x Net ITC ÷Adjusted TotalTurnover]-tax payable on such inverted rated supply ofgoods and services.

Explanation :––For the purposes of this sub-rule, theexpressions––

(a) “Net ITC” shall mean input tax credit availed oninputs during the relevant period other than theinput tax credit availed for which refund is claimedunder sub-rules (4A) or (4B) or both ; and

(b) “Adjusted Total Turnover” shall have the samemeaning as assigned to it in sub-rule (4).” ;

(iii) for rule 97, the following rule shall be substituted,namely :––

“97. Consumer Welfare Fund.––(l) All amounts ofduty/central tax/integrated tax/union territory tax/cess andincome from investment along with other moniesspecified in sub-section (2) of section 12C of the CentralExcise Act,1944 (1 of 1944), section 57 of the Jammuand Kashmir Goods and Services Tax Act, 2017(Act No. V of 2017) read with section 20 of the IntegratedGoods and Services Tax Act, 2017 (13 of 2017), andsection 12 of the Goods and Services Tax (Compensationto States) Act, 2017 (15 of 2017) shall be credited to theFund :

Provided that an amount equivalent to fifty per cent,of the amount of integrated tax determined undersub-section (5) of section 54 of the Jammu and KashmirGoods and Services Tax Act, 2017, read with section 20of the Integrated Goods and Services Tax Act, 2017, shallbe deposited in the Fund.

(2) Where any amount, having been credited to theFund, is ordered or directed to be paid to any claimant

by the proper officer, appellate authority or court, thesame shall be paid from the Fund.

(3) Accounts of the Fund maintained by the StateGovernment shall be subject to audit by theComptroller and Auditor General of India.

(4) The Government shall, by an order constitute aStanding Committee (hereinafter referred to as the“Committee”) with a Chairman, a Vice-Chairman, aMember-Secretary and such other members as it maydeem it and the Committee shall make recommendationsfor proper utilization of the money credited to the Fundfor welfare of the consumers.

(5) (a) The Committee shall meet as and whennecessary, generally four times in a year ;

(b) the Committee shall meet at such time andplace as the Chairman, or in his absence,the Vice-Chairman of the Committee maydeem fit ;

(c) the meeting of the Committee shall bepresided over by the Chairman or in hisabsence, by the Vice Chairman ;

(d) the meeting of the Committee shall becalled, after giving at least ten days noticein writing to every member;

(e) the notice of the meeting of the Committeeshall specify the place, date and hour ofthe meeting and shall contain statementof business to be transacted thereat ;

(f) no proceeding of the Committee shall be valid,unless it is presided over by the Chairman orVice-Chairman and attended by a minimum ofthree other members.

(6) The Committee shall have powers––

(a) to require any applicant to get registered withany authority as the Central Government mayspecify ;


(b) to require any applicant to produce before it, orbefore a duly authorized officer of the CentralGovernment or the State Government, as thecase may be, such books, accounts, documents,instruments, or commodities in custody andcontrol of the applicant, as may be necessaryfor proper revaluation of the application ;

(c) to require any applicant to allow entry andinspection of any premises, from whichactivities claimed to be for the welfare ofconsumers are stated to be carried on, to a dulyauthorized officer of the Central Governmentor the State Government, as the case may be ;

(d) to get the accounts of the applicants audited,for ensuring proper utilization of the grant ;

(e) to require any applicant, in case of any default,or suppression of material information on hispart, to refund in lump sum along with accruedinterest, the sanctioned grant to the Committee,and to be subject to prosecution under the Act ;

(f) to recover any sum due from any applicant inaccordance with the provisions of the Act ;

(g) to require any applicant, or class of applicantsto submit a periodical report, indicating properutilization of the grant ;

(h) to reject an application placed before it onaccount off actual in consistency, or in accuracyin material particulars ;

(i) to recommend minimum financial assistance,by way of grant to an applicant, having regardto his financial status, and importance and utilityof the nature of activity under pursuit, afterensuring that the financial assistance providedshall not be misutilised ;

(j) to identify beneficial and safe sectors, whereinvestments out of Fund may be made, and makerecommendations, accordingly ;


(k) to relax the conditions required for the periodof engagement in consumer welfare activitiesof an applicant ;

(l) to make guidelines for the management, andadministration of the Fund.

(7) The Committee shall not consider an application,unless it has been inquired into, in material detailsand recommended for consideration accordingly, bythe Member Secretary.

(8) The Committee shall make recommendations-–

(a) for making available grants to any applicant ;

(b) for investment of the money available in theFund ;

(c) for making available grants (on selective basis)for reimbursing legal expenses incurred by acomplainant, or class of complainants in aconsumer dispute, after its final adjudication ;

(d) for making available grants for any otherpurpose recommended by the State ConsumerProtection Council (as may be consideredappropriate by the Committee) ;

(e) for making available up to 50% of the fundscredited to the fund each year, for publicity/consumer awareness on GST provided theavailability of funds for consumer welfareactivities of the Department of ConsumerAffairs is not less than twenty-five crore rupeesper annum.

Explanation :––For the purposes of this rule,

(a) ‘Act means the Jammu and Kashmir Goods andServices Tax Act, 2017 (Act No. V of 2017),or the Central Excise Act, 1944 (1 of 1944) asthe case may be ;


(b) ‘applicant’ means,

(i) the Central Government or StateGovernment ;

(ii) regulatory authorities or autonomous bodiesconstituted under an Act of Parliament orthe Legislature of a State or UnionTerritory ;

(iii) any agency or organization engaged inconsumer welfare activities for a minimumperiod of three years, registered under theCompanies Act, 2013 (18 of 2013) or underany other law for the time being in force ;

(iv) village or mandal or samiti or samiti levelco-operatives of consumers especiallyWomen, Scheduled Castes and ScheduledTribes ;

(v) an educational or research institutionincorporated by an Act of Parliament or theLegislature of a State or Union Territory inIndia or other educational institutionsestablished by an Act of Parliament ordeclared to be deemed as a University undersection 3 of the University GrantsCommission Act, 1956 (3 of 1956) andwhich has consumers studies as part of itscurriculum for a minimum period of threeyears ; and

(vi) a complainant as defined under clause (b)of sub-section (l) of section 2 of theConsumer Protection Act, 1986 (68 of1986), who applies for reimbursement oflegal expenses incurred by him in a caseinstituted by him in a consumer disputeredressal agency.

(c) ‘application’ means an application in the formas specified by the Standing Committee fromtime to time ;


(d) ‘Central Consumer Protection Council’ meansthe Central Consumer Protection Council,established under sub-section (1) of section 4of the Consumer Protection Act, 1986 (68 of1986), for promotion and protection of rightsof consumers ;

(e) ‘Committee’ means the Committee constitutedunder sub-rule (4) ;

(f) ‘Consume’ has the same meaning as assignedto it in clause (d) of sub-section (l) of section 2of the Consumer Protection Act, 1986 (68 of1986), and includes consumer of goods onwhich central tax has been paid ;

(g) ‘duty’ means the duty paid under the CentralExcise Act, 1944 (1 of 1944) or the CustomsAct, 1962 (52 of 1962) ;

(h) “Fund” means the Consumer Welfare Fundestablished by the Central Government undersub-section (l) of section 12C of the CentralExcise Act,1944 (1 of 1944) and section 57 ofthe Jammu and Kashmir Goods and ServicesTax Act, 2017 (Act No. V of 2017) ;

(i) ‘proper officer’ means the officer having thepower under the Act to make an order that thewhole or any part of the central tax is refundable.

(iii) in FORM GST ITC-03, after entry 5(e), for theinstruction against “**”, the following shall besubstituted, namely :-–

(iv) after FORM GSTR-8, the following FORMshall be inserted, namely :-–

2. Whereas, in this connection, Case FIR No. 21/2017 undersection 13 of the Unlawful Activities (Prevention) Act, 1967 came tobe registered in Police Station, Yaripora, Kulgam ; and

3. Whereas, on the basis of investigation carried and statementof witnesses recorded under sections 161, 164-A Cr. P. C. it has beenestablished that two accused persons namely 1. Mudasir Ahmad MallaS/o Ghulam Mohi-ud-Din R/o Nowpora, Kharpora and 2. Zahid AhmadRather S/o Ghulam Mohd Rather R/o Nowpora, Kharpora wereapprehended who disclosed that they pasted these incriminating postersof HM outfit on electric poles and have kept some of these posters inthe house of accused No. 1 and accordingly lead to the recovery of moreposters from the house of the accused and recovery memo was preparedand placed on record ; and

4. Whereas, investigation conducted has prima facie establishedthe commission of offence punishable under section 13 ULAP Act,against the above and mentioned accused persons and investigationclosed as challan ; and

5. 2. Whereas, in this connection, a Case FIR No. 62/2018 under sections18, 18-B, 19, 38, 39 ULA(P) Act, 1967 and 7/25 Arms Act came to beregistered in Police Station, Kulgam ; and

Whereas, the authority appointed by the State Government undersub-section (2) of section 45 of the Unlawful Activities (Prevention) Act,1967 has independently scrutinized the case diary file and all the otherrelevant documents relating to the case and has come to a definite conclusionthat this is a fit case for accord of prosecution sanction against the saidaccused person for commission of offences punishable under sections 18,18-B, 19, 38 and 39 of the Unlawful Activities (Prevention) Act, 1967 ; and

NotificationsJammu, the 12th of December, 2018.

SRO-550.––In exercise of the powers conferred by section 164of the Jammu and Kashmir Goods and Services Tax Act, 2017(Act No.V of 2017), the State Government on the recommendationsof the Council hereby makes the amendments in the Jammu andKashmir Goods and Services Tax Rules, 2017, namely :–

1. after rule 83, the following rule shall be inserted as 83A, namely :–

“83A. Examination of Goods and Services TaxPractitioners.–(1) Every person referred to in clause (b)of sub-rule (1) of rule 83 and who is enrolled as a goodsand services tax practitioner under sub-rule (2) of the saidrule, shall pass an examination as per sub-rule (3) of thesaid rule.

(2) The National Academy of Customs, Indirect Taxes andNarcotics (hereinafter referred to as “NACIN”) shall conductthe examination.

(3) Frequency of examination.–The examination shall beconducted twice in a year as per the schedule of theexamination published by NACIN every year on the officialwebsites of the Board, NACIN, common portal, GST CouncilSecretariat and in the leading english and regional newspapers.

(4) Registration for the examination and payment of fee.–(i) A person who is required to pass the examination shallregister online on a website specified by NACIN.

(ii) A person who registers for the examination shall payexamination fee as specified by NACIN, and the amount forthe same and the manner of its payment shall be specifiedby NACIN on the official websites of the Board, NACINand common portal.

(5) Examination centers.–The examination shall be heldacross India at the designated centers. The candidate shallbe given an option to choose from the list of centers asprovided by NACIN at the time of registration.

(6) Period for passing the examination and number ofattempts allowed.– (i) A person enrolled as a goods andservices tax practitioner in terms of sub-rule (2) of rule 83is required to pass the examination within two years ofenrolment :

Provided that if a person is enrolled as a goods and servicestax practitioner before 8th of July, 2018, he shall get onemore year to pass the examination :

Provided further that for a goods and services tax practitionerto whom the provisions of clause (b) of sub-rule (1) of rule83 apply, the period to pass the examination will be asspecified in the second proviso of sub-rule (3) of said rule.

(ii) A person required to pass the examination may avail ofany number of attempts but these attempts shall be withinthe period as specified in clause (i).

(iii) A person shall register and pay the requisite fee everytime he intends to appear at the examination.

(iv) In case the goods and services tax practitioner havingapplied for appearing in the examination is prevented fromavailing one or more attempts due to unforeseen circumstancessuch as critical illness, accident or natural calamity, he maymake a request in writing to the Jurisdictional Commissionerfor granting him one additional attempt to pass the examination,within thirty days of conduct of the said examination. NACINmay consider such requests on merits based on recommendationsof the Jurisdictional Commissioner.

(7) Nature of examination.–The examination shall be aComputer Based Test. It shall have one question paperconsisting of Multiple Choice Questions. The pattern andsyllabus are specified in Annexure-A.

(8) Qualifying marks.– A person shall be required to securefifty per cent, of the total marks.

(9) Guidelines for the candidates.–(i) NACIN shall issueexamination guidelines covering issues such as procedure ofregistration, payment of fee, nature of identity documents,provision of admit card, manner of reporting at the examinationcenter, prohibition on possession of certain items in theexamination center, procedure of making representation andthe manner of its disposal.

(ii) Any person who is or has been found to be indulgingin unfair means or practices shall be dealt in accordance withthe provisions of sub-rule (10). An illustrative list of use ofunfair means or practices by a person is as under :–

(a) obtaining support for his candidature by any means ;

(b) impersonating ;

(c) submitting fabricated documents ;

(d) resorting to any unfair means or practices inconnection with the examination or in connectionwith the result of the examination ;


(e) found in possession of any paper, book, note or anyother material, the use of which is not permitted inthe examination center ;

(f) communicating with others or exchanging calculators,chits, papers etc. (on which something is written) ;

(g) misbehaving in the examination center in any manner ;

(h) tampering with the hardware and/or software deployed ;and

(i) attempting to commit or, as the case may be, to abetin the commission of all or any of the acts specifiedin the foregoing clauses.

(10) Disqualification of person using unfair means orpractice.–If any person is or has been found to be indulgingin use of unfair means or practices, NACIN may, afterconsidering his representation, if any, declare him disqualifiedfor the examination.

(11) Declaration of result.–NACIN shall declare the resultswithin one month of the conduct of examination on the officialwebsites of the Board, NACIN, GST Council Secretariat,common portal and State Tax Department of the respectiveStates or Union Territories, if any. The results shall also becommunicated to the applicants by e-mail and/or by post.

(12) Handling representations.–A person not satisfied withhis result may represent in writing, clearly specifying thereasons therein to NACIN or the Jurisdictional Commissioneras per the procedure established by NACIN on the officialwebsites of the Board, NACIN and common portal.

(13) Power to relax.–Where the Board or State TaxCommissioner is of the opinion that it is necessary orexpedient to do so, it may, on the recommendations of theCouncil, relax any of the provisions of this rule with respectto any class or category of persons.


Explanation :–For the purposes of this sub-rule, the expressions,–

(a) “Jurisdictional Commissioner” means the Commissionerhaving jurisdiction over the place declared as address in theapplication for enrolment as the GST Practitioner in FORMGST PCT-1. It shall refer to the Commissioner of CentralTax if the enrolling authority in FORM GST PCT-1 has beenselected as Centre, or the Commissioner of State Tax if theenrolling authority in FORM GST PCT-1 has been selectedas State ;

(b) NACIN means as notified by Commissioner vide hisNotification No. 45 dated 01.06.2018.

2. In the said rules, after rule 142, the following ruleshall be inserted, namely :–

“142A. Procedure for recovery of dues under existinglaws.–(1) A summary of order issued under any of theexisting laws creating demand of tax, interest, penalty, feeor anyother dues which becomes recoverable consequentto proceedings launched under the existing law before, onor after the appointed day shall, unless recovered underthat law, be recovered under the Act and may be uploadedin FORM GST DRC-07A electronically on the commonportal for recovery under the Act and the demand of theorder shall be posted in Part II of Electronic LiabilityRegister in FORM GST PMT-01.

(2) Where the demand of an order unloaded under sub-rule (1) is rectified or modified or quashed in anyproceedings, including in appeal, review or revision, or therecovery is made under the existing laws, a summarythere of shall be uploaded on the common portal inFORM GST DRC-08A and Part II of Electronic LiabilityRegister in FORM GST PMT-01 sha ll be updatedaccordingly.”.

3. In the said rules, in FORM GST REG-16,–

(a) against serial number 7, for the heading, the followingheading shall be substituted, namely :–

“In case of transfer, merger of business and change inconstitution leading to change in PAN, particulars ofregistration of entity in which merged, amalgamated,transferred, etc.”;

(b) in the instruction, after the Table, for the paragraphsbeginning with the words “In case of death of solepropr ietor” and ending with the words “surrender ofregistration falls” , the following paragraphs shall besubstituted, namely:–

“In case of death of sole proprietor, application shallbe made by the legal heir/successor before the concernedtax authorities. The new entity in which the applicantproposes to amalgamate itself shall register with the taxauthority before submission of the application forcancellation. This application shall be made only afterthe new entity is registered.


Before applying for cancellation, please file your tax returndue for the tax period in which the effective date ofsurrender of registration falls or furnish an application to theeffect that no taxable supplies have been made during theintervening period (i.e. from the date of registrationto the date of application for cancellation of registration).”.

4. In the said rules, in FORM GSTR-4, in the Instructions,for SI. No. 10, the following shall be substituted, namely :—

“10. Information against the Serial 4A of Table 4 shallnot be furnished”.

5. In the said rules, for FORM GST PMT-01 relating to“Part II : Other than return related liabilities”, the followingform shall be substituted, namely :—

6. In the said rules, in FORM GST APL-04, after serial number 9,and the Table relating thereto, the following shall be inserted, namely:–

SRO-553.—Whereas, P/S, Sogam received an information throughreliable sources that one Javid Ahmad Mir S/o Gh. Mohi-u-Din MirR/o Maidanpora, Lalpora in connivance with Bashir Ahmad Pir S/oAbdul Jabbar Pir R/o Gangbugh have planned to make call of SogamChallo Successful, in order to carry out the programme of the outfitswho are bent upon to secede the State of J&K from Union of India.

[No. 36-o–––––––––––––––––––––––––––––––––––––––––––––—–––—————–In this connection, the above said persons have pasted some postersin the locality for wide publicity and some posters were kept in thehouse of one Bashir Ahmad Pir S/o Abdul Jabbar Pir R/o Gangbugh,thus had waged a war against the sovereignty of India and are instigatingthe youth of the area for committing illegal and unlawful activitiesetc. ; and

2. Whereas, in this connection, case FIR No. 88/2016 under section13 UAPA Act, 1967 came to be registered in Police Station, Sogamand investigation initiated ; and

3. Whereas, during the course of investigation, the InvestigationOfficer visited the spot, apprehended the accused and recovered theincriminating posters from the possession of the accused and preparedseizure memo, draft site plan, lifted the finger print of the caused,recorded the statement of witnesses under the relevant provisions oflaw and the accused were arrested in the instant case ; and

4. Whereas, the Authority appointed by the State Governmentunder sub-section (2) of section 45 of the Unlawful Activities(Prevention) Act, 1967, has independently scrutinized the Case Diaryfile and all the other relevant documents relating to the case and hascome to a definite conclusion that this is a fit case for accord ofprosecution sanction against the said accused persons for commissionof offences punishable under Section 13 of the Unlawful Activities(Prevention) Act, 1967 ; and

5. Whereas, after perusing the Case Diary, the relevant documentsand also taking into consideration the observations/views of theAuthority appointed under sub-section (2) of section 45 of the UnlawfulActivities (Prevention) Act, 1967, the State Government is of the viewthat there is sufficient material and evidence available against theaccused persons for their prosecution under the aforesaid provisionsof law.

6. Now, therefore, in exercise of powers conferred bysub-section (2) of section 45 of the Unlawful Activities (Prevention)Act, 1967, the State Government hereby accords sanction forlaunching prosecution against the below mentioned accused personsnamely Javid Ahmad Mir S/o Gh Mohi-u-Din Mir R/o Maidanpora,

Whereas, the officers were given opportunity to represent to theAdministrative Department through Director, Animal Husbandry Jammu/Kashmir within 30 days from the date of issuance of the said notification, ifthey have objection, failing which it shall be presumed that there is nothingobjectionable against the seniority position assigned to them and final senioritylist shall be notified accordingly ; and

Whereas, the depar tment received following types ofrepresentations :–

i. Regarding incorporation of categories, correction in names, recordingdate of birth etc. of clerical nature.

ii. From the officers left out from the seniority list.

iii. Re-fixing of seniority of the officers in whose case the dies-nonwas imparted.

Whereas, comments of concerned Directors on their representationshave received ; and

Whereas, during the examination of the objections, it was furtherobserved as under :–

(i) Some officers have unauthorisedly remained absent from duty fora long period and dies-non have been imparted against them andtheir seniority has now been refixed at appropriate place as theyhave represented before the department through concernedDirectors ;

(ii) Some officers have been appointed in the year 2017 on therecommendations of the Public Service Commission and are stillon probation. Their inter-se merit based seniority on therecommendations of PSC is required to be notified separately.

Whereas, all the issues have been examined in detail in accordancewith the rules and it has been felt as under :–

1. The seniority position of Dr. Ghulam Mohi-ud-Din Kashoo, Dr. JavedAhmad Rather, Dr. Javaid Peerzada, Dr. Shabir Ahmad Mir, Dr.Syed Mohammad Shah and Dr. Rakesh Kumar due to impart ofDies-Non has been refixed in accordance with the rules atappropriate place ;

2. Necessary corrections which are of clerical nature and based onthe recommendations of the concerned Directors have been madein service particulars of the officers in the seniority list ;

Now, after considering the above, therefore the final seniority listof Veterinary Assistant Surgeons of Animal Husbandry Jammu/Kashmiras it stood on 01-01-2018 as per Annexure (A) to this Government orderis notified.

However, any officer, whose seniority has been altered and isaggrieved with the position assigned to him the seniority can, if he so desires,make an appeal before the Competent Authority under the relevantprovisions of J&K Civil Services (Classification, Control and Appeal) Rules1956 within a period of 15 days.

The date of birth recorded against the name in the seniority list sofinalized shall not be taken as authentic and shall be subject to furtherverification of service records.

This issues without prejudice to the outcome of writ petition, if anypending before any competent Court of Law.

The reserved category position reflected mentioned against the officeris subject to authentication from the Deputy Commissioner concerned.

J&K TRADE AND EXPORT POLICY 2018-28

1. Introduction :

1.1 The State of Jammu & Kashmir with the hope inspired by thegoals of Development Vision of the Country and determinationto consolidate gains on the macroeconomic front and to facethe economic challenges that lie ahead, looks forward forforging a strong, diversified, resilient and competitive Stateeconomy. Towards this end, all sectors have specific rolesand contributions to make in raising pace of development to adynamic self-sustaining level. In this regard, trade andcommerce function is seen as a central and pivotal pillar inattainment of the mission of moving to Trade and Export ledeconomy with higher proficiency, productivity andcompetitiveness from agrarian economy.

1.2 While the National Development Vision inspires and raiseshope, the argument for trade as the engine of growth anddevelopment in the face of globalization needs no emphasis.Unfolding developments in the political, economic and socialspheres are bringing about tremendous changes and challengesin the business environment. These changes entail perceptibleshifts in economic relations, evident in the trade liberalizationand globalization phenomenon.

1.3 Thus, the State requires a Trade and Export Policy that willensure effective participation in the designed framework andcodified trading system that has emerged at the national andinternational level and in seizing the opportunities inherent inthe free flow of resources inherent in globalization. The StateTrade & Export Policy intends to ensure that liberalizationoffers meaningful, identifiable and measurable benefits toentrepreneurs.

1.4 The efficacy of Trade and Export Policy depends on theestablishment of a specific macroeconomic, social and politicalenvironment. When fundamental changes occur in theunderlying environment, the configuration of policy strategieshave to change. This Policy reflects the dynamics of Jammuand Kashmir State as an agrarian economy in transition towardsa market driven one.

1.5 The Trade and Export Policy expects to assist the State striveto carve a place for itself in the national economy and a nichefor its products in the national and international market. Theprivate sector would be the lead stakeholder, the economicagents responsible for the production of goods and serviceswould enable the State to occupy its rightful place in the globalmarket. The public sector’s primary role is that of enablingand facilitating this process. This essence of the strategy willenable J&K to use her resources, especially her manpowerbase, to address economic challenges with the objective ofattaining goals of the Development Vision and enhancingpercapita income of the State.

1.6 This Policy document has therefore been formulated withconsciousness and belief of the State Government that tradeand investment regime encourages integration into globaltrading environment and import of diverse and moderntechnologies that are important for productivity improvements.

2. Policy Vision :

2.1 Role of trade sector towards the realization of the goal ofeconomic development will be attained through the structuraltransformation of the economy and enhanced value addedproductivity that would in turn contribute to the process ofcompetitiveness and lead to rapid economic growth. The PolicyVision, in the aforesaid context, has to be :

“....to transform the state economy from a supplyconstrained one into a competitive export-led entity


responsive to enhanced domestic integration andwider participation at national and global economythrough trade liberalization in tune with the nationalpolicies.”

3. Mission :

3.1 Trade is not an end in itself but a means for achieving higherlevel of welfare of the society. The function of the trade sector,therefore, is to integrate the State economy into the nationaland global economy through trade. This entails structuraltransformation of the State economy in tandem with initiativesin this regard at the national level, and product/marketdiversification.

3.2 Indeed, to have a sustained economic growth rate which iscapable of addressing the challenge of unemployment issue inthe State depends on developing a modern export-led economy.High volumes of exports are necessary to achieve the goalsof sustained economic development. Sustaining a high growthrate is a necessity but not sufficient condition. Growth has tobe complemented by broad-based equal opportunity of accessto the primary assets of production - land, skills and finance-for such growth to be translated in to economic and socialwell being. The mission of the trade sector is therefore to :

“....stimulate the development and growth of tradethrough enhancing competitiveness by creatingfavourable ecosystem aiming at rapid socioeconomicdevelopment.”

4. Objectives :

4.1 The State Government, by adopting this Trade Policy aims toachieve the following objectives :—

• To enhance the domestic trade volume by five times fromthe existing level at present in next 10 years.


• To move more speedily towards transformation of its rolefrom ‘regulator’ to ‘facilitator’ and from performer toenabler for the Trade and Commerce sector.

• To encourage, promote and facilitate more investment inenterprises and build a strong, responsive and vibrantbusiness environment in the State.

• To recognize the significant role of distribution of goodsand services in generation of employment, the Governmentshall endeavor to increase the share of Trade andCommerce in GDP by at least 3% in next five years andto add to per capita income of the State. Further, toraise, the share of State in the gross national export from0.05 % at present to 2 % in next 10 years.

• To raise efficiency and widening linkages in domesticproduction and building a diversified competitive exportsector as the means of stimulating higher rates of growthand development.

• To provide employment opportunities to the educatedunemployed and skilled youth in the field of Trade andCommerce by concerted human resource and skilldevelopment interventions.

• To provide guidelines for State Development Plans forreserving suitable patches of land for facilities such aswarehousing and logistics support helpful in promotingretail, wholesale and exports trading in and from the State.

• To create new markets and ancillary facilities throughregional development plans.

5. Strategy :

5.1 One consequence of liberalization is the de-facto merger ofdomestic and international markets into a single market and


the necessity for domestic business and trading entities tobecome internationally competitive even in internal markets.One of the impacts of globalization is the accessibility todomestic firms, of resources that can facilitate enhancedproductivity and efficiency necessary for competitiveness. Inthis setting, export-led growth is both an opportunity and achallenge for the State. Entrepreneurs of the State have tostrive towards production of higher quality goods and first classservices at lower prices. The overall strategy includes reformof institutional structures and change of cultural norms andpractices in economic activities so as to put in motion theprocess of re-orienting the economy towards an open marketsystem targeting export-orientation.

5.2 Jammu and Kashmir State’s export remains too heavilyfocused on primary commodities and its share of total trade inIndia remains low, despite numerous economic measures anddomestic market liberalization. Inter-state trade is particularlylimited. Therefore, there is a need to identify cumbersomeand non-transparent state border administration, particularlyimport-export procedure.

5.3 Export enhancement strategy including identification of focusproducts, focus markets and market linked focus products shallbe adopted. Focus products can be Basmati rice from JammuDivision, Saffron, Handicrafts and Handloom products andHorticulture produce from Kashmir Division. In consultationwith the Regional Authority of DGFT, CEPC, EPCH, ITPOetc. such products and sectors shall be recommended forvarious export incentives given by the Government of Indiafrom time to time.

5.4 The strategy measures will also include the support forstandardized international certifications, packaging,development of common facility centres e. g. Pack Housesand Vapour Heat Treatment facilities and development ofmarket linkages with the outlets of international chain stores


across the country. Besides, the stakeholders in export sectorwill be informed, through a series of seminars and informationevents about the focus markets in terms of the emergingopportunities for exports.

5.5 District/Regional Export Promotion Committees shall benotified involving the Regional Authority of DGFT in Jammuand Srinagar and other stakeholders in every District/Regionof the state to focus on promotion of District/Region specificproducts and cater to the demands of the exporter communityfrom those Districts/Regions. This shall also help in resolvingthe issues and concerns of MSMEs and small businesses thatface problems in exporting their goods or services. Thesecommittees shall identify the existing gaps with reference toexport infrastructure and policy initiatives that would berequired to attain the export growth potential of the State.

5.6 It would be collective endeavour to assess specific sectorsfor demand-supply gaps, their potential for export in the next5-10 years and identify policy initiatives to promote valueaddition in the export of goods from the State.

5.7 Steps shall also be taken to promote organic cultivation andcertification and required skill training in this area shall bepromoted involving the APEDA and the State AgricultureDepartment.

5.8 The strategy would be to provide an assessment of “as is”situation of the State in terms of its economic profile, availabilityof physical and social infrastructure as well as highlight thekey factors of production which can serve to create a conduciveecosystem for export growth. In identification of championexport sectors, the sectors with high global demand, thosecontributing significantly to the State’s export share, sectorswhere State is showing high competitiveness in the domesticmarket and significant contribution in the domestic productionand trade value, sectors which can generate more employmentand services would be focused.


5.9 For each of the identified champion export sectors, a highlevel assessment of demand-supply gap shall be undertakento develop a broad prospective of export potential in the nextten years. Further, a value chain analysis of the sectors shallbe conducted in order to identify opportunities for moving upthe value curve in the future. Gaps in infrastructure and policyinitiatives would be regularly identified and plugged to ensureattainment of the export growth potential of the State. Besides,in order to layout a clear roadmap to address various identifiedgaps, Government shall prioritize various initiatives in terms ofimpact and ease of implementation, layout specific timelinesand key nodal agencies for each initiative and shall also developa responsibility matrix that clearly identifies the roles of theCentre and the State Government in helping the State attainits export potential. The export strategy to be followed shallbe as depicted through the following flow-chart :—

1. Vision Development :

Defining aspiration of the State with reference to itsrole in global value chain and trade growth.

2. SWOT Analysis of :

(a) States Economic Profile.

(b) Physical Infrastructure/Social Infrastructure

(c) Factors of Production.

3. Identifying Champion Export Sectors onfollowing parameters :

(a) Sectors with high global demand

(b) Sectors currently contributing to a significantshare of State’s export.

(c) Sectors where State’s show highcompetitiveness in domestic market.


(d) Sectors with significant contribution in domesticproduction andtrade value.

(e) Sectors which can generate more employment.

(f) Service sectors that can promote services export.

4. Gap Assessment across :

(a) Export linked Logistics Infra (Rail, Road, Air, PortCoastal transport, warehouses etc).

(b) Other Trunk Infra (Land, Industrial zones, Power,Water etc.).

(c) Ease of doing business (Technology andoperational interventions).

(d) Sector specific policy and regulatory challenges.

(e) Ancillary Infra (Testing facilities, Standards andCertifications Labs etc.)

(f) Fiscal/Non fiscal incentives especially to promotefocus sectors which may include––

(i) Service sector ;

(ii) Organic cultivation ;

(iii) Sectors where significant value additionopportunities exists.

5. Roadmap for export strategy enablers :

1. Prioritization of initiatives based on :

(i) ease of implementation and

(ii) impact on export.

2. Development of action plan across Infrastructureand Policy enablers specified timelines and nodalagency.

3. Development of responsibility matrix forCentre-State Cooperation on exports.


5.10 The value of services exports has increased in India over theyears and there is demand for Indian services world-wide. The share of service sector in total exports of India in2016-17 was 36.80%. India’s services exports are dominatedby the software sector followed by business, trade,transportation, finance, insurance and communication services.The J &K State has its own share of services exports in thesesectors including fair amount of share in health and engineeringsectors as well.

5.11 Some of the issues concerning services exports are connectedto work permits and visa, rationalization of taxes, simplificationof rules of temporary stay and social security contributionissues for short term workers. However, all these issues fallunder the domain of Union Government and are being dealt atthat level.

5.12 To be specific on policy concerning J&K, “Tourism”, be thatleisure, adventure, eco or MICE tourism, has in the pastremained a significant foreign exchange earner for the peopleof the State. A chain of Golf courses in lush green surroundingshas added one more tourism activity for high end tourists.Domestic pilgrimage tourism has increased considerablyhowever, the overall tourism of the state faced tough timeover the years especially the foreign tourism due to negativeadvisories issued by European and Western Countries.

5.13 With a view to develop J&K as a dynamic, sustainableand favoured destination offering high quality experience toincrease the footfall of domestic as well as the internationaltourists, the Government is working for :

• developing potentia l new and emerging marketsthrough the targeted marketing strategies based on touristprofile ;


• harnessing of the opportunities available in the sectors likeAdventure, Caravan Tourism, Heliport Tourism,Handicrafts, Pilgrimage, MICE, Heritage, Eco-Tourismand Golf etc. ;

• development of human resources for tourism sector andcapacity building of the tourism stakeholders ;

• diversification of Jammu and Kashmir Tourism products ;

• showcasing Brand Jammu and Kashmir in tourism ;

• standardization of the establishment of tourism productsand services by eco-friendly infrastructure ;

• promotion of sustainable tourism and encourage theconservation and preservation of unique natural andcultural heritage of Jammu, Kashmir and Ladakh ;

• ensuring ‘total quality’ services to tourists by introductionof modern technologies and information dissemination fortourist products and services ;

• encouragement of a strong and sustainable participationby private Sector in creation of tourism infrastructureespecially through public private partnership (PPP) ;

• promotion of effective inter-departmental coordination tostreamline processes and increase sector performance inareas like Horticulture, Agriculture, Sericulture, Health,Bio- Tech and IT.

5.14 Human Resource and Skill Development :

5.14.1 Special emphasis will be given to the development of humanresource and skill development for increasing employability inthe sector of Trade and Commerce. Government Institutionsand established Private Institutions will be encouraged toconduct certification based training and placement programs.


5.14.2 Skill Institutes such as the Craft Development Institute (CDI)and the Indian Institute of Carpet Technology (IICT), Srinagarintend to start skill programs, namely, Craft Design Programmeand Handloom Technology respectively.

5.14.3 The Indian Institute of Carpet Technology (IICT) and CraftDevelopment Institute (CDI) have been working tirelessly indigitizing the traditional, contemporary designs of Carpets andall other crafts of the State. Both the institutions have createdtheir design banks.

5.14.4 Design Studio equipped with latest digital equipments includingfew world famous Design Softwares has been established inIICT. The introduction of Design Softwares has eased designwork enormously as it used to take months together for a groupof persons comprising of Naqash (Designer), Taleem Writerand a Taleem Copyist to make the carpet design of standardsize and then to transfer the design drafted on graph paper(outline only) into the coded pattern known as Taleem in thelocal language. As many as 905 carpet and 190 Kani Shawldesigns have been developed in the digital form in the DesignStudio with the application of different Design Softwares.These designs have been provided to the industry in the formof computerized design papers (Talim) on nominal charges.

5.14.5 Design Innovation and Product Development is continuingactivity of CDI wherein about 800 new design samples havebeen created and digitized nearly 600 artisans have been trainedon these new designs.

5.14.6 The Jammu Kashmir Entrepreneur Development Institute(JKEDI) is establishing a Centre for Incubation & BusinessDevelopment to guide young entrepreneurs in gaining accessto capital, material and market support for their projects.

5.14.7 To promote women entrepreneurship, two WomenEntrepreneurship Development Institutions (EDIs) are beingdeveloped, one each in Srinagar & Jammu.


5.14.8 The Government will collaborate with the Department ofCommerce, Government of India in organizing various outreachprograms related to Export procedures under Niryat BandhuScheme of Government of India, training on manufacturingpractices and other requirements related to SPS-TBT issues,Anti-Dumping and Safeguard duties etc.

5 .15 Communication and Logistics Infrastructure :

5.15.1 The State is largely dependent on road transport for carriageof goods and there are road bottlenecks, particularly duringthe months of winters and rains. Apart from the loss of time indetention, the goods and the crew of the vehicles are subjectedto vagaries of the weather in the absence of adequate protectionand roadside facilities, and the cost of goods to the consumerincreases. The Government also recognizes that the transportindustry operates through several layers of intermediaries whichaffect its cost efficiency and transparency.

5.15.2 The Government would support establishment of world classwarehouses/distribution centers/Logistics Parks/Dry Ports bymeans of allocation of land and incentives for such activities.

5.15.3 The Government shall pursue the case with the respectiveGol authorities to functionalize the Inland Container Depot/Air Cargo Complexes at Jammu, Srinagar and Leh.

5.15.4 The Government also envisages to have multi-model LogisticsParks and Dry Ports in collaboration with Local, National andInternational Companies in the field.

5.15.5 The Government looks forward to the completion of railwayconnection between Kashmir valley and rest of the country(target year 2022) and ongoing four lanning & upgradation ofNH IA is expected to change the entire transport scenario forthe State.

5.15.6 The Government shall endeavour to appropriately take up thematter with Civil Aviation Ministry for allowing International


flights to operate from Srinagar Airport so as to enhance exportvolume from the State especially in handicraft and handloomsectors. Efforts shall also be made to set up an Air CargoComplex with warehouse facility at Srinagar airport. Besides,efforts shall also be made to make Inland Container Depot(lCD) Jammu fully functional by filling the infrastructure gapsbesides setting up of additional lCD hubs in the State to improvethe export logistics.

5.15.7 The Government shall have a critical look at its powers vestedunder section 72 of the Motor Vehicles Act for revising therestrictions imposed on vehicles including the maximum ladenweight permissible for the goods carriers, keeping in view theimprovements made on various roads and highways.

5.15.8 The Government shall look into problems faced by exporterswho use containers in respect of their maximum laden weightand levy of Toll on the empty containers in the interest ofpromotion of exports.

5.15.9 The Government shall improve basic infrastructure and civicamenities at the major loading and unloading points/warehousesand overnight parking lots for the goods carriers.

5.16 Development of new Markets and amenities :

5.16.1 Based on pure objective criteria, the Government/the concernedMunicipal Corporations/Urban Local Bodies shall examine forliberalized conversion of the identified residential pockets intocommercial zones so as to arrest haphazard and clandestineconversion of individual residential houses into businesspremises.

5.16.2 Adequate provisions for commercial activities including kiosksand central markets shall be kept in the new housing coloniesto be developed by the organizations like JDA, SDA and theJ &K Housing Board depending upon the size and the locationof the colony. Similar practice shall be adopted by the privatedevelopers of housing colonies.


5.16.3 Demand surveys shall be undertaken by the Governmentthrough professional consultants for development of futuremarkets. A cluster approach would be adopted for developmentof specialized markets wherever feasible/advantageous. Theretail trade organizations would be encouraged to formulateSPVs for development of new markets.

5.16.4 The H&UDD shall expedite development of warehousingfacilities as per their announced programmes and if needed,the Industries & Commerce Department shall provide inputfor the same. ‘Smart City’ project shall also strengthen theabove endeavors of the Government in Srinagar and Jammu.

5.16.5 The Government shall facilitate creation of adequate facilitiesand civic amenities like paving of parking areas, provision ofraised platforms for loading/ unloading and conducting auctions,drainage for rain water, toilets, clean paths for the movementof the buyers and sellers, street lighting etc. in the areas wheremarkets have come up or have been created/developed bythe Government agencies.

5.16.6 Various Government Corporations dealing with Handicraftsand Handloom, Agro Industries, Horticulture (Produce andMarketing) etc. shall use National or State E-commerceplatforms for trading products from respective sectors toincrease outreach of local products worldwide at lower costs.E-marketing shall also eliminate mediators and improvelinkages between farmers, food processors, small time artisans/manufacturers and retailers.

5.17 Use of Technology :

5.17.1 The Government shall encourage use of InformationTechnology (IT) by all concerned agencies to enable the tradingcommunity to gradually move towards modernization, providingvirtual showrooms at household levels, IT application and digitaltransactions. If required, it will collaborate with the J&K Bankfor promotion of its Point of Sale (PoS) service to the retailers.


5.17.2 The Government shall facilitate e-filing of returns under variouslabour laws and financial codes as also for depositing varioustypes of fees including monthly payments of employer’s shareof the Provident Fund into the account of the PF Commissioner.

5.17.3 The Government shall take steps to attend to the work ofcompiling Provident Fund accounts of workers covered bythe Employees Provident Fund Act under the aegis of theLabour Department.

5.17.4 The Government, for enhancing traceability of transactionsand need to save paper by retailers, shall allow to have optionsto issue e-bills (tax invoices) to consumers in electronic mode.The GST regime has already started this process.

5.17.5 The Government intends to bring more transparency in theprocurement of goods by making procurements through GeMPortal/Other GoI e-Commerce platforms at the approved ratesthat would also bring cost efficiency in the system.

6. Trade Scenerio :

6.1 Domestic Trade comprises mainly of wholesale and retail tradeactivities and the external trade which is mainly based onexports of goods is largely dependent on external factorsincluding the policies of the importing Countries.

6.2 The Services sector covers a wide variety of activities suchas trade, hotel and restaurants, transport, storage andcommunication, financing, insurance, real estate, businessservices, community, social and personal services and servicesassociated with construction.

6.3 About 23% to 24% share in the Service Sector is claimed bythe Internal Trade based on wholesale and retail activity, ofwhich 10% is Wholesale and 90% the Retail Trade.

6.4 Despite constraints the vitality of the Internal Trade is alwaysvery paramount as it not only provides selfemployment but


also boosts the creation of employment. It serves the public atlarge by supply of goods and services. One of the notableaspects of both wholesale and retail trade in India is that theyoperate at the lowest margins than in any other Country. Thusthis is the biggest laudable service, this sector is rendering tocommon man.

6.5 In Jammu and Kashmir State, which traditionally has been anagrarian economy, over the years, the Internal Trade as partof the service sector of State economy has emerged as largestcontributors towards the State GSDP.

6.6 Since the organized retailing business is projected to grow at25% per annum, it will also benefit the State by attractingmassive investments and professional expertise in the sectorwhich shall create large number of white collar jobs. It shallalso boost the rural economy by establishing direct businesscontacts with the farmers through efficient supply chains, cuttingdown huge intermediary expenses and heavy storage andtransportation wastages.

6.7 The Government intends to enhance the percentage share ofthe exports in the GSDP of the State from presently 0.7%during 2016-17 to at least 3.5% of the GSDP during the policyperiod. The last 10 years export trends from J&K are asunder :—

6.10 Loc Trade :

Though the figures of LoC trade are not captured by theDepartment of Commerce, Ministry of Commerce and Industry,Government of India while finalizing national level state-wiseexport figures but it has taken a different importance in thetrade and export scenario of the State. Opening of CrossLoC trade along Uri-Muzaffarabad and Poonch-Rawalakoteroutes on 21st October, 2008 as part of Confidence BuildingMeasures (CBMs) between Pakistan and India marked aparadigm shift since the sub-continent was partitioned in 1947.It has many unique features. The two governments declaredCross-LoC trade as zero-tariff trade as it is not treated asinternational trade. The Exports are called ‘traded-out’ goods


and Imports are called ‘traded-in’ goods. 21 items have beenagreed for this trade between the two parts of the State.

6.11 Trade volumes have substantially shown an increase despitethe trade being on barter terms with lakhs of propercommunication channels, absence of banking system, dearthof legal enforcement of contracts and limited number of tradedays and tradable goods. 7. Key Enablers :7.1 The fundamental role of Government is to provide enabling

policy environment that will facilitate private sector in becomingengine of economic activity and growth through efficiencyand better performance. The major fundamental premisesand challenges include establishing and sustaining an enablingbusiness environment, development of hard and softinfrastructure, technological interventions, building capacity formarket supporting institutions, creating the internal ability toparticipate in international trading system and promotion ofTrade and Commerce in the context of supply-side capacity.

7.2 Business Reforms :

In order to usher into an environment of ‘Ease of DoingBusiness’ in the State, following reforms have been initiated :—

• The Government has objectively examined the current utilityof all State laws applicable to Trade and Commerce with aview to integrate them into fewer enactments ;

• The Government is moving towards self-regulatory mechanismfor providing flexibility to trade in areas where a rigid controlis no more necessary or feasible ;

• The Government Departments has made a number servicedelivery smoother while implementing the Central and Statelaws. Appropriate suggestions for amending the existingprovisions in the existing enactments have been done in lineswith ‘Business Reforms Action Plan (BRAP) ;

• Issuance of all online Approvals/NOCs/permissions/licenses/registrations and renewals regarding establishment andoperation of Trading units by various departments and Agenciesof the State Government has been initiated through appropriateGovernment order(s) and are in place that allow only onlineapplication submission, payment, tracking and monitoringwithout the need for a physical touch point for documentsubmission and verification ;


• Clear timelines have been notified through the PublicService Delivery Guarantee Act for approval of completeapplication regarding obtaining anyApproval/NOC/PermissionRegistration/License or renewal thereof ;

• The Labour Department is in the process of making servicesonline. A number of notifications/SROs have been issued inthis regard ;

• The State PCB, Weights & Measure Department, AgricultureDepartment, Finance Department, Fire and EmergencyServices etc. are converting their services into ‘On-line only’mode ;

• Several authorities that have overlapping spheres of controlare under process for phasing out in due course of time toenhance the efficiency and effectiveness of the laws in place ;

• E-Tax Collection Centres have been strengthened ;

• E-payments of all kinds related to trade are facilitated and agradual thrust is towards making it mandatory in a definitetime-frame ;

• Feasibility of merger of collection points of taxes like road tax,entry tax, permit fee, passenger tax, basic toll (road tax) areunder examination for implementation.

7.3 Taxation Enablers :

7.3.1 The State Government has adopted uniform Goods andServices Tax (GST) Act which is now applicable at pan Indialevel. The GST Act has subsumed most of the taxes onproduction and sales of goods and services, which were leviableby the Union and the State Governments, commencing fromthe Excise Duties and Central Sales Tax (CST) and ending atVAT or Service Tax which would practically be the only taxcollectable from the consumers at the level of retail trade.

7.3.2 The State Government in terms of SRO-299 dated 18th July,2017 has notified www.gst.gov.in as the Common Goods and


Services Tax Electronic Portal for facilitating registration,payment of tax, furnishing of returns, computation andsettlement of integrated tax and electronic way bill.

7.3.3 The persons engaged in making supplies of taxable goods andservices or both, the total tax on which is liable to be paid onreversed charge basis by the recipient of such goods andservices or both, have been exempted from obtainingregistration under the Jammu & Kashmir Goods and ServicesTax Act, 2017. SRO-298 dated 18th July, 2017 has been issuedin this regard by the State Finance Department.

7.3.4 In order to boost Internal Trade, the Government has exemptedintra-State supply of around 149 goods and 81 servicesfrom the GST. In this regard the Union Ministry of Financehas issued Notifications vide No. G.S.R. (E)-2/2017 dated28-06-2017 and No. G.S.R. (E)-12/2017 dated 28-06-2017respectively for exemption of CGST on intra-State supplyof identified goods and services. The State FinanceDepartment has also issued SRO No. GST-2 dated08-07-2017 and SRO No. GST-12 dated 08.07.2017respectively for exemption of SGST on the intra-State supplyof identified goods and services.

7.3.5 The State Finance pepartment’s SRO GST-18 dated15th September, 2017 read with SRO-431 dated 13th October,2017 have been issued, wherein for ‘Casual Taxable Persons’specified, in terms of sub-section (2) of section 23 of the Jammu& Kashmir Goods and Services Tax Act, 2017, as thosepersons making taxable supplies of a number of Handicraftproducts have been exempted as the category of personsexempted from obtaining registration under the aforesaid Act,provided that the aggregate value of such supplies, to becomputed on all India basis, does not exceed an amount ofRs. 20 lakh in a financial year which is a special dispensationextended to Jammu & Kashmir State as this benefit is availableto other Special Category States to the aggregate value of


such supplies amounting up to Rs. 10 lakh only. This exemptionshall be available to such persons who are making inter-Statetaxable supplies of Handicraft goods and are availing benefitof Union Finance Ministry’s Notification No. 8/2017-IntegratedTax, dated 14th September, 2017 published in the Gazette ofIndia vide No. G.S.R.(E) dated 14th September, 2017. Beyondthe aforementioned limit of Rs. Twenty Lakh per annum, supplyof Handicraft products have been kept in the lower tax bracketof 12.5% whereas paper machie and willow wicker productshave been kept in the tax bracket of 5%. Carpet is .alsoexpected to be into this bracket soon.

7.3.6 In order to provide budgetary support to the manufacturingunits in the shape of Reimbursement of State Taxes paid underJ&K GST Act, 2017, the State Government has issued aScheme in terms of SRO-519 dated 21st December, 2017called ‘Jammu & Kashmir Reimbursement of State Taxes forpromotion of Industries in the State of Jammu & Kashmir’,which has come into operation w. e. f. 08-07-2017 for eligibleunits and shall remain in force till the Scheme dated05-10-2017 announced by Government of India, namely‘Budgetary Support under Goods and Services Tax regime tothe Industrial Units located in Jammu & Kashmir, Uttrakhand,Himachal Pradesh and North East including Sikkim’, is inoperation.

7.3.7 Likewise, in order to provide budgetary support to the existingeligible manufacturing units operating in the State of J&K inthe shape of 42% of the Central Tax paid under Central GSTAct, 2017 after adjustment of input credit tax, another Schemecalled ‘Jammu & Kashmir Reimbursement of Central Taxesfor promotion of Industries in the State of Jammu & Kashmir’,has been issued vide SRO-521 dated 21-10-2017. This Schemeshall also remain in force till the Government of India’s Schemedated 05-10-2017 announced by Government of India, namely‘Budgetary Support under Goods and Services Tax regime tothe Industrial Units located in Jammu & Kashmir, Uttrakhand,Himachal Pradesh and North East including Sikkim’, is inoperation.


7.3.8 The State Government shall be regularly taking up the issuesin the GST Council and other appropriate forums regardingfurther relaxations and lowering of tax rates as per requirementof the furtherance of growth of Trade and Commerce activityof the State.

7.4 e-Commerce platform for artisans and weavers : TheGovernment is very soon introducing an e-Commerce platformto link artisans and weavers of the State. The households shallserve as the virtual showrooms through this portal.

Key features would be :

• to reach a wider audience especially in Tier 2 and Tier 3 citiesand other countries where retail stores of our State do notexist.

• increased variety of the products for the buyers to choosefrom.

• assurance of reasonable price offerings to the buyer. Lowermarkups will result in access of product to the buyers atreasonable prices resulting in increased sales and improvedprofits.

• provide an alternate marketing platform to the existingtraditional platform of retail stores.

• create a centralized selling platform and bring down losses asa result of various malpractices as part of retail buying.

• encouraging competition between the suppliers through an openmarketplace, which will put an end to cartelization and fraudin the supplier community and make sure that only genuinequality of products comes onboard.

7.5 Building Global Image and Promotion of J&K/KashmirBrand.

7.5.1 In order to make the Handicrafts and Handmade products ofthe State visible on the international map, an important initiativehas been undertaken by the State Government to get Srinagarcity included in the UNESCO Creative Cities Network underthe category of Crafts and Folk Art.

7.5.2 The UNESCO Creative Cities Network covers seven creativefields : Crafts and Folk Arts, Design, Film, Gastronomy,Literature, Media Arts and Music, providing a platform forreflection on the role of creativity as a lever for sustainabledevelopment as well as a breeding ground of action andinnovation. The 180 cities which currently make up thisnetwork work together towards a common objective; plakhingcreativity and cultural industries at the heart of theirdevelopment plans at the local level and cooperating activelyat the international level. With an endeavor to build a GlobalImage for the J&K/Kashmir brand of Handicrafts andHandmade products, the Government has imitated processfor getting the Srinagar city incorporated as the next city.

7.5.3 The Government appreciates that ‘Brand Kashmir’ is one ofthe strong points for the trade in locally produced goods


including Silk, Tweed, Pashmina and Jamawar Shawls, SilkCarpets, Ladakh Carpets (Khalidan and TSUKDAN),Papermachie, Embroidery, Namdas, Gabbas, LadakhHandicrafts items (Wood and Metal work), Ladakhi Thankapaintings, Ladakhi Blankets (Chali and Reba) as also otherlocally produced items like Saffron, Silk Fabric, Guchchi,Anardana, Blakhk Cumin, Jammu Basmati Rice, Red Chilli,Honey, Olive Oil etc. for which the buyers look for an authenticreference or an endorsement or a certificate and/or guaranteeof its purity as also reasonability in its pricing.

7.5.4 Measures have been initiated to create product awarenessabout ‘Brand Kashmir’ in new markets beyond the traditionalregions. Export Marketing and Management workshops andseminars would be arranged, so that the exporters getacquainted/informed about latest marketing trends/marketintelligence in Export Business and to create awareness amongthe exporters through various Export Promotion Councils andStar Export Houses.

7.5.5 Regional Authority of Director General of Foreign Trade(DG FT) has been established in Srinagar in the year 1982 tofacilitate and assist in promotion of the exports. It was closedin 1992 and the offices of DGFT have been reopened in 2012with two Regional Authorities one each at Srinagar and Jammu.The Government intends to provide office space forestablishment of local offices of other two national level exportagencies viz. Export Promotion Council for Handicrafts(EPCH) and Carpet Export Promotion Council (CEPC) soon.

7.5.6 On the other hand, complaints are regularly made about fakeHandicraft items being passed on to the tourists as genuineKashmir craft. The trade has been wary of such practices asit brings bad name to the entire trade. However, unscrupulouselements in the trade find their own ways and keep indulgingin such unfair practices to make a fast buck by living fromseason to season under different names. To address thisnuisance labels for original Kashmir product is underway.


7.5.7 In order to promote the handmade and authentic produce, theState has successfully registered seven regional crafts namely,Kashmir Carpet, Kashmir Pashmina, Kashmir Paper-Machie, Kashmir Sozni, Kashmir Walnut Wood Carving,Kani Shawl and Khatamband under the GeographicalIndications Act of India. Further, the State Government is alsoin the process of registering agro products like Saffron underthe same Act.

7.5.8 The department has undertaken initiative through CraftDevelopment Institute, Srinagar to provide legal protection tothe traditional Handicrafts products under the GeographicalIndication Act. Six main traditional Handicrafts of Kashmirnamely, Pashmina, Kani, Sozni, Khatamband, Papermachie and Walnut- Wood-Carving for GI certification todiscourage imitation and counterfeiting of the regionalHandicrafts. Besides, a Pashmina Testing and CertificationCentre for Hallmarking (labeling) and certification of KashmirPashmina has also been set up in Craft Development Institute,Srinagar. The Government intends to create more testing andcertification centers.

7.5.9 Another project for global imaging, branding, marketing andnetworking has been initiated for J&K textile, handicraft andhandloom is underway to not only showcase our products butto have long lasting relationship with global buyers and to supplycustomized products as per their taste and preference.

7.5.10 The Government supports brand promotion and quality controlby providing incentives to registered SSI units for brandpromotion, R&D, acquiring of quality control equipment,registration with the Bureau of Indian Standards and registrationwith International Standards Organization (ISO) etc. underthe State Industrial Policy and the Package of Incentives andnational schemes like ‘Agmark’ exist for food products.

7.5.11 The Government sees the need of a major initiative In qualitycontrol, maintenance of standards in manufacturing/processingand quality marking which can be created around the aura of


Kashmir. For this, the Government has initiated State levelQuality Control Council for products especially agro andhandicrafts comprising of all stakeholders and manage qualitymarking programme under which very high and exactingstandards of quality control mechanism promotingCertifications, Labeling and Traceability (Trace back) can becreated and enforced with use of information technology, barcoding, holograms etc. in the furtherance of value addition inexports from the State.

7.6 Establishment of JKTPO : Government has establishedJammu Kashmir Trade Promotion Organization (JKTPO) asa Joint Venture Company (JVC) with India Trade PromotionOrganization (ITPO) and Export Promotion Council forHandicrafts (EPCH) as equity partners with followingobjectives.—

i. to promote, organize, manage and participate in handicrafts/handlooms/industrial trade, other fairs and exhibitions inIndia and abroad and to take, all measures incidental theretofor promoting Industry, especially in the State of Jammuand Kashmir and enhance its global competitiveness ;

ii. to build, support, maintain, increase and promote traderelated activities and infrastructure in the State of Jammuand Kashmir by such methods as may be necessary orexpedient, and without prejudice to the generality of thepremised ;

iii. to build, support, maintain such activities like e-commercetrade in the State of Jammu and Kashmir by such methodsas may be necessary ;

iv. to organize trade fairs and exhibitions and invite widerparticipation in export promotion activities like :—

a. Buyers Sellers Meet ;

b. Contact Promotion Programs ;


c. India promotions with Departmental Stores ;

d. Product Specific Promotions ;

e. Product Development Adaptation ;

f. Undertake Market Studies, Research work todetermine Market, potential ;

g. Export Promotion Measures to tap exportopportunities ;

h. One to one interaction between the companies,distributors, dealers for business opportunities,networking, Joint Ventures, strategic alliances,informal meetings, technology transfer, vendordevelopments and sales promotion.

v. to publicize in India and overseas, the InternationalTrade Fairs and Exhibitions to be held in the State ofJammu and Kashmir and other parts of India andoverseas and invite the foreign as well as Indianparticipants to participate in them ;

vi. to organize and undertake trade in commoditiesconnected with or relating to the fairs and exhibitionin India and abroad and to undertake the purchase,storing and transport of such commodities in India oranywhere else in the world ;

vii. to undertake promotion of exports and to explore newmarket for traditional items of export and developexports of new items with a view to maintaining,diversifying and expanding the export trade ;

viii. to develop, manage and run infrastructureprojects of Government of India, Government of J&Kand like institutions related to trade, exporte-commerce etc ; and

ix. to serve as a reference point in the State of Jammuand Kashmir for Indian Industry and the InternationalBusiness Community.

8 Incentives, Subsidies and Marketing Support :

8.1 Prior to the implementation of GST in the State, the IndustrialUnits of State were entitled to the remission of VAT on localpurchase of raw material. The VAT was first paid by the units


on the procurement of raw material, which was subsequentlyreimbursed to them by the State Government throughJ&K SICOP.

8.2 To continue the incentive, the State Government has decidedto reimburse 100% of SGST paid by the eligible Industrial Unitsafter utilization of input tax credit. The Scheme in this regardhas been issued by the Finance Department vide SROs-519and 521 dated 21st December, 2017.

8.3 As per Budget Announcements for 2018, the StateGovernment will consider providing suitable incentive in lieuof 2% CST exemption available to the Industrial units in J &Kduring pre-GST regime.

8.4 The State Government in the Budget announcement of 2018has extended the benefit of Freight Subsidy in favour of theindustrial units located in the State for transporting theirmanufactured goods beyond 1000 kilometres for whichnotification is expected soon.

8.5 Marketing support to the Artisans, Weavers, CooperativeSocieties and manufacturers of Handicrafts and Handloomproducts is provided by the Government in different forms.Sale-cum-Exhibitions, Expos, craft bazaars are organized atthe National/Regional/State and District level. The majorsupport in organizing these events comes from variousprogrammes of the Ministry of Textiles, Government of Indiathrough the Development Commissioners of Handicrafts andHandlooms. The stalls are provided to the participants onsubsidised rates. Annual calendars are framed for organizing/participating in all such events.

8.6 Market Intervention Scheme under National HandloomDevelopment Programme (NHDP) of Ministry of Textilesprovides incentive in the shape of rebate of 10% from thesales of Handloom products to the Handloom DevelopmentCorporation, apex organizations and primary weaverscooperative societies. This rebate which is shared in


reimbursement by Government of India and the StateGovernment on 50 : 50 basis provides a significant boost in thesales of these products.

8.7 Schemes for Trade and Export related units :

The Industries and Commerce Department is administeringand implementing a number of schemes where incentives arealso available for export trade related and service sector units.These schemes are :—

i. Seed Capital Fund Scheme (SCFS)-Incentive in the formof non-refundable seed money to the prospectiveentrepreneurs @ 35% of the Project Cost up to amaximum of 3.00 lakhs in respect of 10+2 & Graduates,Rs. 5.00 lakhs in respect of Postgraduates and Rs. 7.50lakhs in respect of Doctors, Engineers, MBAs, etc. sothat they are able to start their ventures and make theirprojects bankable.

ii. Youth Start-up Loan Scheme (YSLS)-Soft loan is providedto the prospective entrepreneurs in an off-bank mode forthe projects involving an investment of Rs. 8.00 lakhs atan interest rate of 6% (simple).

iii. Term Loan & Education Loan Scheme of NationalMinorities Development and Finance Corporation(NMDFC)-The maximum quantum of credit is Rs. 20.00lakhs @ 6% interest (simple) per annum.

iv. “J&K Rural Employment Generation Programme(JKREGP)”— The term loan equivalent to 60% of theproject cost is provided by the financial institutions withthe Government subsidy in the shape of Margin Moneyof 35% in rural areas/villages across all categories. Thebeneficiary is required to put his share equivalent to 5%of the project cost up to Rs. 25.00 lakh.

v. Scheme for setting-up of Start-up Hub, Incubators andAssistance to Start-ups in J&K has been introducedStart-up hub, Incubation Centres and Innovation Centresset-up in the State. The eligible Incubators shall beprovided capital grant of max 50% for Fixed Cost


Investment (excluding Land cost) for setting up Incubator,subject to maximum of Rs. 50 lakh.

vi. Prime Minister’s Employment Generation Programme(PMEGP)-The Government of India, Ministry of MSMEis administering this Credit Linked Subsidy Scheme, thesubsidy in the shape of Margin Money ranging from 25%(urban) to 35% (rural) is provided by the CentralGovernment to the entrepreneurs for setting up their units.

vii. Industrial Development Scheme for J&K—The Govt.of India notified the scheme in April, 2018 which shallremain effective till 31st March, 2022. The schemeprovides 30% of the investment in Plant & Machinerywith upper limit of Rs. 5 Crore as Capital InvestmentIncentive. Interest Incentive at the rate of 3% in workingCapital credit for 5 years and reimbursement of 100%insurance premium on insurance of building and Plant &Machinery for a maximum period of 5 Years. All unitholders whether in manufacturing or service sectorintending to export their goods & services shall also beeligible for availing the benefit under the scheme.

viii. Pradhan Mantri Mudra Yojana (PMMY) supports Microenterprises by bringing them to the formal financial systemand extending affordable credit. It enables a smallborrower to borrow loan upto Rs. 10 lakhs (Shishu:covering loans upto 50,000/-, Kishor covering loans above50,000/- and upto 5 lakh and Tarun: covering loans above5 lakh upto 10 lakh) from all Public Sector Banks such asPSU Banks, Regional Rural Banks and CooperativeBanks, Private Sector Banks, Foreign Banks, MicroFinance Institutions and Non Banking Finance Companies(NBFC) for non-farm income generating activities.PMMY can also be used to leverage and scale upinitiatives and projects undertaken by entrepreneur throughabove mentioned schemes.

9. Periodical Review Mechanism :

9.1 The State Government shall create Commerce AdvisoryCommittee (CAC)/Export Promotion Committee at the State


level to organize meaningful periodical interactions among allthe stakeholders.

9.2 The CAC shall deliberate on the mechanism to :

• Turn the policy into action programmes,

• Seek cooperation from all concerned GovernmentDepartments,

• Arrive at a consensus by resolving sectoral/ departmentalconflict of interests,

• Motivate the concerned Departments to agree to a‘Common Minimum Programme’,

• Consider all the sector specific suggestions relating to tradepromotion,

• Monitor the progress of implementation,

• Review the ‘trading policy’ and tackle new issues, etc.

9.3 The composition of the CAC shall be as broad based as possibleand it shall, as far as possible, meet once at Srinagar and onceat Jammu every year. Besides, it shall include all concernedAdministrative Secretaries to the Government, the RegionalAuthority of DGFT and a few experts from the trade andmarketing management as well.

The Trade Policy shall be reviewed by the State Government inevery two years to accommodate new issues and matters recommendedby the CAC and accordingly published.

10.0 Validity of Policy

The Trade and Export Policy shall come into effect from the date ofissuance of Government Order and will be valid for a period of ten years ortill a new Trade and Export Policy is announced.
