Conditions of saleBidding on items indicates acceptance of the following

1. A Buyer’s Premium will be added to the hammer price of each lot; the buyer’s premium is 18% of the final bid up to and including $200,000, then 10% for the remaining balance above $200,000.

2. All goods are sold “AS-IS” and all sales are final. Condition reports are not included in this catalog. It is the responsibility of prospective bidders to examine lots and decide their level of interest. Neither the auctioneer, nor the consignor, is responsible for the accuracy of any printed or verbal descriptions. All weights and measurements are approximate.

3. The auctioneer has the sole right to re-offer a lot and/or settle disputed bids.

4. The record of sale kept by the auction house will be taken as final in the event of dispute.

5. The purchaser assumes complete responsibility for items at the fall of the hammer.

6. Some lots carry reserves or minimum selling prices. This is a figure set by the consignor and the auction house below which a lot will not be sold. The auction house will execute the reserve bids. The reserve will not exceed the low estimate. Estimates are subject to change at any time prior to the offering of each lot.

7. Absentee and telephone bids will be executed when possible as a convenience to customers; the auction house will not be held responsible for any errors or failures to accurately execute bids. Bidders are encouraged to submit absentee bids prior to the auction. Purchases will not be available to absentee buyers for pick-up during the auction unless arrangements are made prior to the sale.

8. Items may be withdrawn at any time prior to the offering of each lot.

9. The auctioneer reserves the right to reject an opening bid that, in his opinion, is not commensurate with the value of the lot.

10. Payment by cash or good check only. The auction house reserves the right to hold property until checks clear. Potential buyers of expensive lots should discuss payment before the sale. A service charge of 1.5% will be added each month to unpaid balances beginning 30 days after the sale date. A $30.00 fee will be added for returned checks. If a check fails to clear after the second deposit, the purchaser will be held responsible for any and all bank and/or collection fees until we have collected good funds.

11. Payment is due at the end of each sale, or upon receipt of an invoice, unless other arrangements have been authorized by the auction house. Shipping is arranged as a courtesy and at the buyer’s expense. Buyers of small items may choose to use Frank’s Parcel Place, a local packing and shipping facility, and payment for shipping with Frank’s can be made with Mastercard or Visa. Northeast Auctions must have received cleared funds to release property regardless of shipping method. Shipping may take up to four weeks after payment is received.

12. In all instances the auctioneer’s interpretation of these conditions is final and binding on all bidders.

Marcus Austin Fine’s passion for collecting American Folk Art played an integral role in our family life. There are

so many memories. Vacations and drop-offs at summer camps and colleges always included stops off the beaten

path to visit antiques dealers, auctions or shows. At an early age, my sister and I boycotted these visits, remaining in the

stifling car reading teen magazines. Many years later, I received a phone call from dad who had successfully chased a

cupboard somewhere in New England. In the middle of a blizzard, he requested that I drive out to the house to accept its

delivery. I drove through blinding conditions and trudged through snow drifts down the long and winding driveway to

greet a none-too-happy deliveryman. To top it off, the cupboard had to be jockeyed up a ladder and through an upstairs

window. Once while in Boston visiting friends, father purchased two return plane tickets to Baltimore, one for me and

another for the strawberry tea set he had bought at auction. I well remember a conversation with Harold Sack. He asked

me what I collected and I replied by saying my father’s rejects. His response was that was better than what he collected;

his mistakes!

Over the years since his passing, we continue to hear “Austin stories” from close friends and acquaintances. Father’s

pursuits were legendary. Many a friend was invited to take a quick drive only to find themselves in another state, or two,

or three. No object was safe once Austin set his sights on it. He so enjoyed the chase. His passion for collecting American

folk art provided the energy that allowed him to build a renowned collection as well as make wonderful friends. Mary

Allis, Joe Kindig and Peter Tillou were high on the list of dealers who Austin turned to for the treasures that were part

of this collection. Our mother, Jill, was always by his side, sharing his passion in her own quiet way most of the time. In

fact, it was Jill who started it all by asking Austin to buy a bowl for the dining room table. Each piece tells a story that

our parents loved to recount.

Father also enjoyed his many projects and approached them with the same passion. One of his main projects also became

mine. As a member of the board, he founded the Baltimore Antiques Show to benefit the Baltimore Museum of Art.

His goal was to make it the best in the country. He hand-picked many of the top dealers from whom he made purchases

over the years. After his death, at too young an age, it became my legacy and I co-chaired, chaired and managed the show

for nearly ten years, striving to assure that it lived up to his expectations.

Our parents were respected collectors of Americana and also founding members of the American Folk Art Society.

Additionally, they established a gallery at the Baltimore Museum of Art to preserve a portion of their collection. After

our father’s death, mother had a vision that Barbara’s husband helped her fulfill by designing a contemporary home to

house the collection. With its large glass windows providing breath-taking views of the Maryland countryside, its white

walls and wonderful light, the home showcased the collection of painted furniture, ceramics, paintings, frakturs and

decorated tins in a museum-like setting.

It is now our turn to present the Austin and Jill Fine Collection and to invite you to share in their passion. It is indeed

bittersweet to part with this collection that our parents lovingly assembled over more than a quarter of a century. We

hope that these treasures in new hands will bring the same pleasure, foster more collectors and generate additional

wonderful stories. But always remember, yes, it was about the chase, but as important, the friendships forged along the

way.

Jill and Austin Fine were a unique couple who enjoyed life together outside of the box. Austin’s passion, intellectual

curiosity and love of American art, especially the decorative arts was truly a treat to encounter. Jill was very devoted

to Austin and loved the hunt as well as the friendships they developed over the years of collecting.

The cup was always half full as Austin pursued a piece he lusted after. One day Jill and Austin arrived at my house to

see what new treasures I had collected. They asked to see the third floor where my private collection of furniture and

American folk art was displayed. I was quite specific in saying that nothing was for sale however they were welcome

to enjoy themselves. Undaunted, Austin proceeded to pressure me into selling them a wonderful pair of New England

country Queen Anne chairs (lot 630 in this sale). I teased him that he most likely could not financially manage the cost

of these chairs. At that moment Jill spoke up and said “Come on Austin; let’s leave. Peter doesn’t wish to sell anything

from his collection to beginners like us.” I laughed and conceded to Jill, who was Austin’s “straight man” so to speak,

that this was her most brilliant line yet as she attempted to heap the guilt on me. Of course, during their next visit I

acquiesced and Austin and Jill won the chairs. What fun we all had.

This marvelous sale of Americana which Jill has been the keeper of since Austin’s death is certainly a fine tribute to

their love of the American decorative arts. Jill and Austin were loved and respected by an endless array of friends and

characters. I feel blessed to have shared some of the American dream with them during their early years of collecting.

The Fine collection provides an excellent opportunity to study the decoration of late eighteenth and early nineteenth century pearlware, in particular the variety of birds commonly identified as “Leeds Peafowl” or “Peacock” pattern wares. In their book Feathers and Foliage: The Life and Times of the Pearlware Peafowl, George and Mickey Deike categorized the numerous peafowl patterns they had carefully researched into families exhibiting identifiable traits. The groups in their “Aviary” were then given names derived mostly from friends, family or obvious characteristics. Taken together these fifty known types illustrate a wide array of design with regard to each bird’s shape, color, position, the foliage and the bird’s relation to the foliage. The Deike’s noted that while the pattern and colors were very consistent within each group, various artist’s hands were revealed in the bird’s subtle individual characteristics. They used sherds from archeological digs to help determine origin and compiled lists of the forms particular to each bird type. Although they were working with the goal of linking each bird to a specific pottery, in the end they weren’t sure their findings could be definitively proven. Obvious differences regarding color aside, the Deike’s system will be used to point out the individual characteristics that distinguish a particular pattern, which makes the study of these birds so fascinating.

The birds depicted on the four dated wares, lots 544, 545, 548 and 585, and the bowl depicting the songbird, lot 691, are precursors to these later birds.

M. Austin Fine - A Pioneer Collector with a Vision

Austin Fine started collecting in the early 1960’s when there was very little published information to define the good, better, best of American Folk Art and Decorative Arts. Yes, he had great advisors such as Mary Allis, Jeff Miller and Peter Tillou but somehow Austin had the innate ability to seek out and collect the best of what past generations of country folk had acquired to dress up their rather drab homes. When Austin passed away in 1986, Jill divided the collection and kept her favorite pieces. Her son-in-law, Michael Justin Dowling, an architect from Annapolis, designed a modern home for Jill to showcase these special pieces

In the eighteenth century most country dwellers devoted their time and money to providing their family with the necessities of life; food, clothing and shelter. There were a few families that could afford to dress up their homes and surviving pieces are extremely rare. Austin was able to acquire several painted and decorated pieces from the eighteenth century including the Massachusetts William and Mary chest with the bird and sunburst decoration (lot 549) and the two Connecticut painted and decorated chests (lots 574 and 616).

By the beginning of the nineteenth century many rural families had a little extra money and time to devote to making their homes more comfortable and colorful. What Austin collected from that century was captured by Sumpter Priddy in his landmark book “American Fancy.” One of Sumpter’s theories was that the invention of the kaleidoscope opened eyes to the joy of fancy and colorful

objects. The star quilt (lot 531) clearly shows the influence of the kaleidoscope on interior decoration in rural America. As you leaf through the pages of this catalog pull down your copy of “American Fancy” and see the similarities time and time again.

The collection of colorful English pearlware, much which was made for the American market, was part of “American Fancy” of the nineteenth century. The peafowl, beehive and strawberry decorated pieces were a favorite of rural Pennsylvanians and certainly of Austin and Jill.

American painted tinware was very popular with homemakers in New England, Pennsylvania and the other middle-Atlantic states. The “tin peddlers” traveled the countryside with a good selection of these wares which they traded or bartered for cow horns, hoofs and other by-products of farming. Most of the tin was utilitarian and did not survive in good condition. There are always exceptions and the early collectors Blanch and Abraham Harpending of Rochester, New York assembled an important collection of American painted tinware in spectacular condition. Austin rarely missed an opportunity and acquired over twenty pieces from this important collection.

Starting in 1996 Gina Martin and Lois Tucker have published four hard-bound, full color volumes identifying the tin shops from Maine to Pennsylvania where many of the pieces in the Fine collection were made. A lot of the shops have been identified, but many decorators were employed to do the fancy painting. Very little is known about the decorators, but the Connecticut dome top trunk with painted bird decoration and stenciled name “Hannah Barber” on the back (lot 512) may open a window to discovering more about the decorators. Barber is certainly a common surname in Connecticut.

Without the four books by Gina Martin and Lois Tucker the attribution to specific tin shops of many of the pieces in the Fine collection would not have been possible. In addition we have tried to use the terms for the forms that are listed in the books from original tinsmith’s sales invoices. I certainly recommend to anyone interested in the subject to acquire this set of books published by the Historical Society of Early American Decoration Inc., Farmers Museum, Cooperstown, New York.

The bird depicted on this hot water pot is one of 156 examples forming a large group of birds which the Deike’s named the “Aye” bird. This bird is in the “Cambridge” pattern and falls into Group I, and with the blue and ochre banding is also part of hollow ware Group VII. This boldly and fancifully decorated chest of drawers belongs to a small group of case pieces made by a yet-identified craftsman, probably working in the Andover-Georgetown area of Essex County, Massachusetts. Furniture from this shop commonly exhibits a faux-japanned surface, including distinct rounded mounds issuing stylized flowers and leaves. Most examples, feature some combination of Chinese-style fenced stairways, red brick buildings, and perched birds. Height 47 inches, width 39 inches, depth 20 inches.

Height 10 inches.

The two birds on this punch pot are oddities. They match traits particular to the bird named “Pamela,” with her three wings and feet actually attached to the branch, arrangement of the branches, and apparent addition of the sponged foliage before the branches were painted. Unlike “Pamela,” this bird is not outlined in brown and colored in blue, yellow and ochre with dotted wings and tail. The painted decoration on the spout and handle differ from the feather-type example shown on p. 181. At the time of printing the Dieke’s knew of eight teawares in both creamware and pearlware, and noted that the glaze was green-tinged on creamware and blue-tinged on pearlware. If the birds were produced by the same factory and at the same time, they wondered why the glazes were so different. The appearance of this bird adds another dimension to the question. See pp. 181-184.

Sheldon Peck (1797-1868) had been painting portraits for less than a decade when he moved his young family from Cornwall, Vermont, to Jordan, New York, in 1828. No evidence has been found that Peck had another occupation in Vermont, so assuming that he worked full time as an artist, it was probably out

of necessity that he developed his art fairly rapidly. The patronage that Peck enjoyed in Vermont’s Addison and Chittenden Counties enabled him to purchase a home in the rough, booming Erie Canal town of Jordan soon after arriving there. Jordan owed its rapid growth to its location on canal, its prosperity fueled by the steady stream of goods and travelers passing through the village. By 1836, when Peck moved west, Jordan boasted grist and saw mills, factories producing window sash and pails, a tannery, general stores, a newspaper, one-hundred fifty houses, a distillery, taverns, and more bordellos than any other town on the canal.

Peck decided to make a strong impression to help establish himself as an artist in Jordan. It is sometimes difficult to distinguish between his late Vermont and early New York portraits when a sitter’s identity and a painting’s provenance is lost. Child in a Chair was probably painted in New York State based on its relationship to portraits of two young boys that Peck probably painted in close succession shortly after he moved to Jordan. The three pictures show Peck’s confidence in his ability to adapt to new circumstances by offering images that were unlike what he had done before or what was available from other artists. These three paintings represent Peck’s earliest full-length likenesses found to date, and he is not known to have repeated this pose until nearly twenty years later in Illinois.

Parents, naturally, could be critical of portraits of their children, and what a parent would find acceptable in their own likeness would not always do for their children—especially very young children. Convention often required that young children be depicted full length and sometimes accompanied by evidence of their youth such as toys. Peck’s recollection of the double portrait he had painted of Mary Hoxie Drake and her daughter Emily in Milton, Chittenden, Vermont, may have provided inspiration for this painting. Both girls hold roses, wear similar white gowns, and Emily Drake is shown nearly full length seated in a Windsor high chair. As in the Drake portrait, Peck placed this girl in a neutral space with no background elements to distract from the likeness. Her white gown is enlivened by red bowknots at the shoulders, and Peck added his signature trefoil motif to the gown’s cuffs, waistband, and hem to simulate embroidery. Multiple stands of beads are draped around the girl’s neck, and her bright red slippers give the costume added stylishness; but it is her large, dark eyes, close-cropped blonde hair, and the small, decorated armchair that betray her youth and contribute to the painting’s strong appeal.

This girl was probably a resident of Onondaga or Cayuga County where all of Peck’s identified New York sitters lived. Farmers, merchants, judges, physicians, lawyers, and politicians, their wives and children were Peck’s clients, and several of them had migrated to New York from New England. Many of these people probably had some familiarity with portraits, so Peck balanced their expectations with his own desire to produce likenesses that satisfied him. This helps explain his avoidance of repetitive compositions for children’s portraits in favor of original ones, of which Child in a Chair is a distinguished example.

For Peck, a rose was a female emblem. A traditional symbol of love, the rose acknowledges the child’s gender and the bond of affection shared by the child and her parents. Peck satisfied the primary function of a portrait to document the girl’s appearance. However, by adding this tender note, Peck helped ensure the portrait’s survival and account for its continued appeal after nearly two centuries.

Although the artist has not been firmly identified, itinerant painter Rufus Porter (1792-1884) remains a prime candidate. The leafy trees and finely delineated buildings are commonly found on Porter’s frescoed walls. Of particular note are the upper tiles depicting a man and his faithful dog chasing squirrels up a tree. A similar scene is played out in a wall mural painted by Porter for the Prescott Tavern in East Jaffrey, New Hampshire around 1824. The cream painted and molded fireplace “surround” enclosing a brick and stone hearth with blue double-handled urn holding an arrangement of roses surrounded by “tiles” painted with scenic landscapes of trees and houses. 29 x 38 inches.

The portrait of “J. B.” is stylistically related to a group of likenesses, all depicting children and all dated 1784, identified by descendants as residents of Gloucester, Massachusetts. This group includes the portraits of brother and sister John and Priscilla Wharff (or Wharf ) illustrated here, and a portrait of Dorcas Lufkin in the collection

of a descendant of the sitter.

At least three of these portraits show the young sitters in oblong ovals with drop-shadow lettering giving their initials in the upper corners and their ages in the lower corners. They all depict children between one and six years of age holding gender-appropriate props. The unidentified artist’s rendering of facial features is strikingly similar in each; the sitters all have almond-shaped eyes that are slightly misaligned, small mouths with cupid’s-bow lips, noses that appear flat against their faces, and ears that extend outward parallel to the picture plane. Their hands are rendered simply with dark outlines and gently bending fingers. Of the known portraits, “J.B.” is distinctive for its inclusion of a genre element in the charming vignette of the boy feeding his dog, and for the inclusion of articulated trees in the background.

Some scholars have suggested a stylistic relationship between this group of portraits and the work of Rufus Hathaway (1770-1822), but a number of factors weigh against an attribution. Hathaway was presumably born in Freetown, Rhode Island, and lived most of his life in Duxbury, in southeastern Massachusetts both far from Gloucester on the North Shore. His earliest known portraits, dated to about 1790, are considerably more highly developed than the ones depicted here (see “Lady with Her Pets,” 1790, The Metropolitan Museum of Art). It seems unlikely that a fourteen-year-old boy would be plying a portrait painter’s trade far from home in 1784.

The Deike’s placed the two different birds depicted on this mug into their family of “Fancy” birds. At the time of publication they only knew of five pieces: some teawares (but no cups and saucers), a large punch bowl, and a quart mug or tankard. Along with the attention to detail evident in the skillful painting of these birds there are several characteristics particular to this family. Each bird is placed directly on the branch as it lacks legs and feet. The style of deformed tree is singular with the sponged foliage more naturalistically rendered than the simple circular patches commonly found on these wares. See pp. 57-61.

The coloration and articulation of the wing is very different from other examples. The curious palm-type foliage appears to be painted over the thinly disguised branches.

Birds in the “Spike” pattern are outlined differently than the other birds, in that the line of their curved necks continues to form the head and beak. According to the Deike’s the foliage on most “Spike” pattern blue shell-edge plates is sponged onto the surface, whereas the foliage on green shell-edged plates, as on this one, is washed. A nearly identical side chair thought to have been owned by David Ellsworth (1709-1782) of East Windsor, Connecticut was made by the shop, possibly that of Windsor cabinetmaker Timothy Loomis. Loomis was among the most prominent furniture craftsmen working in this area in the mid-to-late eighteenth century. He is known to have made clock cases with pagoda-form hoods that relate closely to the crests on chairs from this group.

The octagonal plate is in the Group V “Beach Ball’ pattern, the molded scalloped rim heightened with a brown border. See pp. 108-113, with identical examples p. 111, fig. 5.81.

The bird on the circular plate is in the Group II “Song Bird” pattern, and with its teardrop-shaped body is similar to the “Beach Ball” bird. However it looks forward, has the characteristic almond-shaped eye and a long neck. See pp. 142-147, with a similar pattern including ribbon border illustrated on p. 144, fig. 5.124.

The fourth plate is in the “Oliver” pattern. This bird is distinguished by its unusual pose, and the brown flourishes under the crossed tree trunks. See pp. 208-209, with a nearly identical image on a jug discussed and illustrated on p. 209, fig. 5.196.

The toy plate is in the “Duffy” pattern. This bird is depicted stepping onto a nearby stem, and is blinking. It varies from the norm in that it has six plumes instead of five and is on a blue irregular shell-edge plate. See pp. 126-129.

The first bird is called “Parrot” and a nearly identical plate is discussed and illustrated on p. 203, fig. 5.193. The second bird is similar in execution to birds in the “Dr. Seuss” pattern in that it lacks a wing (or even an indication of a wing), the legs are widely spaced, and the leaves are comb-shaped. However, this bird exhibits five bands of color as opposed to four, and differs in the typical color sequence of these bands. The crest is ochre and not ochre and blue, and the plate has a blue shell-edge rim as opposed to the blue dotted border. See pp. 148-155.

Each painted in underglaze-blue, green, ochre, yellow and brown with a peafowl perched amidst branches with sponged foliage, the teabowl and saucer each within a vine border, the saucer with painter’s numeral “8” in brown enamel. Diameters of teabowl and saucer 3 7/8 and 5 5/8 inches.

The bird painted on either side of the teapot is in the “Joyce” pattern. This bird is predominately blue in color, with a broad differently delineated wing and upswept tail feathers. The branches on the tree tend to have the same configuration across all wares. This pattern incorporates elements found on the “House” pattern evident in the ground patches, fence and distant birds in flight. It is interesting to compare this teapot to the cider jug dated 1829 (lot 46) with its more sophisticated rendering of these compositional elements. See pp. 206-207.

The teabowl and saucer are in the “Spike” pattern, pp. 122-125.

An identical saucer is discussed and illustrated in fig. 5.100, where the authors state a sherd with this rim decoration was found in Alexandria, Virginia. The toy saucer is in the Group VIII brown-banded “Aye” pattern and is an example of what the Deike’s describe as a “simplified” bird, typically found on toy teawares. Examples are discussed and illustrated on pp. 93-94, figs. 5.55-5.57.
